    I have the highest respect for former Prime Minister Imran Khan‘s wife Bushra bibi

    But first I must make a confession. I had in the past ridiculed her on twitter etc by calling her ‘pinky peerni’, who does ‘jaadu tona’, and by saying that she has two djinns in a bottle which she takes out at midnight to feed meat to them, that she roasts live chicken at midnight to feed these djinns, that one cannot see her face in a mirror ( implying she is a vampire ), and similar poppycock.

    Though all this was said as a joke, yet I am ashamed of saying such nonsense. I am guilty of throwing mud and casting aspersions on the character of a noble lady, which I should never have done, and I can never forgive myself for saying all this rubbish and baloney..

    The media, which only seeks ‘mirch masaala‘, made all sorts of false and fantastic allegations to malign her, alleging that she was controlling her husband, and that he only does what she orders ( as her diary allegedly revealed ).

    It was alleged that she practices ‘kaala jaadu’.

    It was alleged that she married Imran Khan before completing the perid of iddat following her divorce with her previous husband ( an allegation she denied in her interview by Nadeem Malik, to whom she said she married him 7 months after her divorce ).

    Even allegations of corruption have been made against her

    There were even allegations that she had deserted her husband and has left her home

    I have carefully considered all these allegations, and I agree with senior advocate Sardar Latif Khosa that Bushra bibi is a very good woman, and all these allegations against her are false and figments of the imagination of some people, particularly mediapersons who only want to melodramatize and publish  ‘mirch masaala’.

    I am convinced that she is a simple housewife, loyal to her husband. Of course it may be that on some occasions she may have given advice to Imran Khan, but which wife does not ? This not mean that she controls him. Her interview to the eminent journalist Nadeem Malik reveals her devotion to her husband, and her desire to serve the poor

    I believe she is a pious lady and would not do wrong things, and that is why Imran Khan married her after meeting her in Baba Farid dargah. Imran Khan is a mature person who has seen the world, and would not have married her unless he found her a lady of high character. Imran Khan has said that

    “the character of a person and the mind is much more important than the physical aspect, because in my experience that has the smallest shelf life ”, and he has referenced his respect for his wife based on her intellect and character.

     Bushra has been described as an introvert who maintains a low profile, and prefers to stay at home rather than attending social functions and gatherings ( though she often visits hospitals, orphanages etc ), to which Imran Khan admittedly has no objections, as he said he is himself “past the age of socialising”. According to Khan, his two sons have met Bushra, while he has also had time to get to know Bushra’s children following their marriage. Bushra has also clarified that she is not present on social media and any accounts attributed to her are fake.

    Even her previous husband said after their divorce in 2018 “I want to clearly state about my former wife, Bushra Bibi, that I have not seen a woman as pious as her in the world”

     Bushra bibi has been loyally standing by her husband in his hour of trial, and has protected his honour. This is proved by the fact that when some guards at Attock jail asked her ( when she came to meet her husband ) to give them money and they would supply good food to Imran Khan, she refused, knowing that this would later be played up as an attempt of bribery.

    I salute this noble woman. Shame on those seeking to assassinate her character

    Arghya Sengupta’s superficiality and inanity

    I saw the recent interview by the eminent journalist Karan Thapar of Arghya Sengupta, Research Director of Vidhi Centre for Legal Policy on his book ‘The Colonial Constitution‘, and I regret to say that I found Dr Sengupta’s views totally superficial and inane

    The thrust of Dr Sengupta’s argument is that the basic defect in the Indian Constitution of 1950 is that it does not devolve power to the people. In other words it gives too much power to the Central Government, which towers over the people, and therefore it is broadly a repetition of the colonial Government of India Act, 1935 made by the British rulers.

    But the vast majority of the Indian people are casteist and communal, with backward mindsets. Devolving power to them really means devolving power on people with feudal mindsets ( as Karan rightly pointed out in the interview when talking of village panchayats and local bodies ). Should power be given to such people ?

    The Constitution has set up a system of parliamentary democracy, but everyone knows that in India this largely runs on the basis of caste and communal vote banks. Casteism and communalism are feudal forces, which must be destroyed if India is to progress, but parliamentary democracy further entrenches them. How can India progress under this system ? Dr Sengupta simply ignores this question.

    India is perpetually in an election mode. Apart from the Central Government, there are 28 states and 8 Union territories in India, and the moment one election ends preparations begin for the next one somewhere or the other. Presently focus is on the coming parliamentary elections due in 2024.

    Our politicians, who are experts in manipulating elections, constantly go around polarising society, and whipping up casteism and communalism to win elections, paying little attention to the people’s welfare.

    So the fundamental flaw in the Indian Constitution is that it has set up parliamentary democracy, which ensures that India remains semi feudal and backward. Dr Sengupta does not deal with this, and yet advocates modernity, which is a contradiction because parliamentary democracy ensures that India does not modernise.

    To set up a modern Constitution is only possible after a mighty historical united people’s struggle, led by patriotic, modern minded leaders, which will be protracted, and in which tremendous sacrifices will have to be made.

    As to who will be those patriotic leaders determined to raise the standard of living of our people and give them decent lives, how will that struggle be conducted, how much time will it take to achieve success, what will be the alternative to parliamentary democracy under which India will rapidly industrialise and modernise, etc no one can predict. One cannot be rigid about historical forms. The enlightened sections of the people will have to use their creativity in solving these problems.

    The Constitution of 1950 no doubt gave to the people certain fundamental rights, which were not there in the Govt of India Act, 1935. But these were only political rights, not economic ones. In India there is massive poverty, record and rising unemployment, appalling level of child malnutrition ( Global Hunger Index has said that every second child in India is malnourished ), skyrocketing prices of food and other essential commodities, almost total lack of proper healthcare and good education for the masses, etc.

    Moreover, even the political rights often exist only on paper, as they are rarely enforced. After all, the Constitution is only a piece of paper, but the ground realities are very different. Many people who criticise the government are arrested and jailed for long periods on concocted charges. Atrocities are often committed on minorities.

    Dr Sengupta is totally wrong when he advocates decentralisation. In fact we need a strong central government if we wish to solve our basic socio-economic problems, but this must consist of modern minded patriotic persons. 

    Karan gave the example of the Meiji Restoration in Japan in 1868 which led to modernisation and emergence of Japan as a modern industrial country. The real rulers during the Meiji Restoration was not the Emperor but his handful of advisers who were modern minded people determined to transform Japan from a feudal country under the Shoguns to a modern country. This was not done democratically by taking the consent of the people by elections.

    Similarly, Mustafa Kemal, who was an army general who staged a coup in 1922 and deposed the Sultan and Khalifa, and then destroyed feudalism in Turkey forcibly, not by elections. In fact if elections had been held, most Turks, who were then feudal minded, would have opposed abolition of sharia, suppression of the clergy, and emancipation of women.

    Since most of our people are backward with feudal mindsets we must have a central government which ‘towers over the people’ ( to use Dr Sengupta’s words ), but such a government must consist of patriotic modern minded persons. Devolution of power to the people means keeping India backward, semi feudal and poor..

Notably, suggesting honey for infants is not considered an essential religious practice. Kapoor also expressed her openness to considering apple puree, which is not recommended for infants under six months.

    While the details of the interaction with the “panditji” remain uncertain, Kapoor’s juxtaposition of ‘panditji’ and ‘our traditions’ raises questions about potential pressures to follow unscientific practices.

    Conclusion:

    In a recent legal development, Dr. Cyriac Abby Philips, a prominent hepatologist and clinician-scientist, has had his Twitter account suspended after a court order was secured by Himalaya Wellness Company. The company sought to restrain Dr. Abby from making defamatory remarks against their products and to direct the social media platform, formerly known as Twitter, to suspend his account.

    This shows that despite all attempts by certain people to create enmity between India and Pakistan, the Indian public does not harbour any hostility towards Pakistanis, and have displayed maturity. After all, cricket is just a game, and is not war.

    My own opinion is that India and Pakistan are one country, so we should cheer the Pakistani team if it wins any match as if India has won, and if they lose we should feel India has lost.

    A Pakistani friend spoke to me a short while back on WhatsApp and asked my opinion of the Chief Justice of Pakistan Qazi Faez Isa.

    I said he is a fraud, and a mere dramabaz.

    He asked me why I thought so.

    I replied that as a Judge he has taken an oath to uphold the Pakistan Constitution, and protect the rights of citizens, which includes the right to life and liberty ( Article 9 ). About 10,000 people have been arrested, beaten, brutally tortured, and jailed on concocted and frivolous charges,  after the events of 9th May, and held in terrible conditions, and 180 false charges have been levied against former Prime Minister Imran Khan for which he has been incarcerated, but he will never order their release.

     Also, he will never order holding elections within 90 days, as is the requirement of Article 224(2).

     Instead, he has been doing the dramabazi of refusing protocol facilities, guard of honor, bullet proof car, etc to show off how good a man he is.

    My friend said that there is a danda above him, so he cannot do that.

    I said that the bigger danda is of Allah who on roz-e-mehshar ( the Day of Judgment ) will assuredly send Qazi Faez Isa to jahannum for not doing his solemn duty

    One day in Delhi the renowned Sufi saint, Nizamuddin Aulia ( 1238-1325 ), was standing with his disciple Amir Khusro ( 1253-1325 ), on the bank of the river Jumna.

    The saint saw Hindu worshippers bathing in the Jumna, and remarked (in Persian) :

    “Har Qaum raast raahe
    Din-e-wa qibla gaahe”
    Which means:
    “Every people has a pole (qibla) to which it turns”
    i.e.: Every sect has its own right path of worship.
    Amir Khusro immediately completed the couplet with a verse of his own:
    “Man qibla raast kardam
    bar samt kaj kulahe”
    Which means:
    “I, however turn my face
    towards the tilted cap”

    In other words, Amir Khusro said that his path was that of Nizamuddin Aulia, i.e. Sufiism

    Trudeau’s Hobson’s choice – Canada India relations

    The ongoing diplomatic tensions between India and Canada has taken the center stage both in Canada and India. The war of nerves continues without resolution, with a series of tit for tat responses. Leaders on both sides appear to have firmed up their stances as the relations between two key democratic countries in the world flounders.


    At the center of this rift is the murder of Hardeep Singh Nijjar in Surrey in Canada’s British Columbia earlier in June this year. He was a plumber by day and a Khalistani terrorist by night who had active links to Pakistani and Canadian Intelligence agencies. The man was wanted by Indian security agencies for several years now, on multiple charges that included terrorism, narcotics, murder, and fake passport rackets.


    Can two major liberal democracies snap their relations over the death of an otherwise small time plumber cum terrorist who was unknown to Canadian public? Had Canada not gone public with its accusations, the matter would have had a greater chance of resolution by prudent heads via bilateral negotiations behind closed doors in Ottawa or New Delhi.


    There was further escalation when Prime Minister Trudeau, while addressing Parliament had the chutzpah to ask India to cooperate with them in the on-going investigations, thereby preemptively declaring his presumptions of guilt on part of India. This is no diplomatese or for that matter able statesmanship.


    In a further embarrassment to the Canadians, media reports have pointed out the plain incompetence of Canadian security agencies who have made no headway in the murder investigations even after three months, despite the availability of CCTV footages and eye witness accounts.


    Its appeal for support from its Five Eyes partners had at best, a cautious response from the US, while others mouthed carefully measured statements but offered no direct condemnation of India. Canada’s diplomatic intransigence pushed itself into a corner thus magnifying a problem that it created in the first place.


    The Canadian government as well as media – electronic media in particular – have been actively shepherding the narrative on the row to one of freedom of expression and Canada’s sense of justice and propriety in international conduct.


    The reality of course is at variance with Mr. Trudeau’s public posturing. The real problem, between the two countries is the shelter, support and sustenance provided to anti-India terrorists who are seeking to break away territory from India.


    The Canadian government has been supporting anti-India groups and individuals for many decades now. In recent years however, Canada under Mr. Trudeau, has crossed the diplomatic red line on several occasions – by repeatedly commenting on India’s domestic politics and turning a blind eye to terrorists putting up posters to kill Hindus and Indian diplomats in Canada.


    Slicing through the crafted diplomatic veneer of Prime Minister Trudeau’s “… rule of law, country and the protection of our citizens and defense of our sovereignty are fundamental…”, speech in Parliament, we continue to see Canada’s serial duplicity in mouthing something and doing the exact opposite. How come Canada’s sovereignty is more sacrosanct than India’s territorial integrity?


    So that explains the anxiety of the Trudeau administration and major sections of its media to spin doctor a narrative far removed from the real reasons for the current state of Indo-Canadian affairs. The Indian media, on the other hand, has been level headed and reported the unfolding episodes by bringing in opinion makers from both countries to the table.


    The fragility of Trudeau’s ruling coalition and hence his compulsions to pander to extremist Sikh groups that spearhead the National Democratic Party of Canada are well understood. But to jeopardize Canada’s key international relationship, particularly during a less favorable economic cycle, for the sake of political expediency only smacks of myopia and political immaturity.


    Prime Minister Modi on the other hand, runs a very strong and stable government and enjoys the loyal support of almost 80% of its vast populace. India under Modi today is of a different mettle. Lot of quiet transformations are already in place – be it bilateral dealings or securing India’s vital interests. As a powerful economy that is leading the resurgence of global economies, it has over the years invested and upgraded itself to deal with existential threats from far and near.


    Unlike the past, the Indian security establishment is now more than willing and capable of delivering a “global solution to global threats” to the safety, security, and territorial integrity of India. Furthermore, India has demonstrated the political will to execute it.


    The problem is that Canada, like many other countries, has discovered much to its chagrin, that it is no longer business as usual with India. India is no more the worlds’ whipping boy who will take state duplicity lying down when it comes to its security and safety of its citizens.


    It must be noted here that in official communiques, the government of India while rejecting Trudeau’s statements, has sought evidence of Indian hand in the murder of the plumber-terrorist. India knows fully well that no intelligence apparatus of a nation worth its salt will share its intelligence on matters of such high visibility that would compromise its assets.


    It is worth mentioning that India has not publicly denied its hands in getting rid of threats to its territorial integrity. As the Indian foreign minister Dr S Jayshankar said, ”political convenience cannot give way to terrorism”. But if Canada or any other country would choose to do business with India in its old-fashioned ways, there will certainly be a “global response to global terror”. Canadian Prime Minister Trudeau has a Hobson’s choice on his hand.

    I now wish to state that 95% Pakistanis are fools. 

    One may ask why I have given additional 5% marks to Pakistanis, since I have often said that India and Pakistan are one nation.

    My answer is that a Hindu who does not associate with Muslims becomes a fool, and a Muslim who does not associate with Hindus becomes a fool.

    In India about 15% of the population is Muslim. So most Hindus would have associated and interacted with Muslims, and have Muslim friends.

    On the other hand, almost 97% Pakistanis are Muslims, and only about 2% are Hindus.

    So the chances of a Muslim in Pakistan associating with a Hindu or having Hindu friends are remote.

    It logically follows that there are more fools in Pakistan, than in India, and that is why I have added those 5% marks for Pakistanis.

    There are two Eids which are celebrated with joy by all Muslims viz Eid ul Fitr, which is celebrated at the end of the Holy Month of Ramzan, and Eid al Adha ( also called Bakrid in India ) in which an animal is sacrificed, in memory of the sacrifice of a lamb by Prophet Abraham.

    Eid Milad un Nabi

    However, there is a third Eid called Eid Milad un Nabi, which is the birthday of Prophet Mohammad, and which is falling tomorrow, 28th September 2023.

    About this third Eid there is a controversy among Muslims. The orthodox Muslims known as Salafi or Wahabi are against celebrating it, as they say that this is ‘shirk’ i.e. giving a companion to God, or deification or worship of someone other than God. 

    According to such Muslims, celebrating the birthday of the Prophet implies treating the Prophet as a God, and thus there will be two Gods viz Allah and the Prophet, whereas Islam recognises only one God.

    On the other hand, the more liberal and tolerant Muslims say that celebrating the birthday of the Prophet is only giving him respect, and not elevating him as a God.

    In this connection I may relate a case which came before my court when I was a Judge in the Allahabad High Court.

    A petition was filed before me by some Salafi Muslims, and their prayer was that I should prohibit the taking out of a procession in Saharanpur district in UP on the occasion of Eid Milad un Nabi, which was on the next day.

    I asked the learned counsel for the ;petitioners why I should pass such an order ? He replied that celebrating Ed Milad un Nabi was unislamic and offends the religious feelings of the petitioners.

    I said that if the petitioners did not wish to celebrate Eid Milad un Nabi they need not participate in the procession or look at it. But this was a free country, and there was no law prohibiting such processions. I would only enforce the law, not religious feelings. 

    Saying this I dismissed the petition.

    I may relate another incident.

    When I was a Judge in the Supreme Court a petition was filed before a bench presided over by me by some orthodox Muslims who prayed that an order should be passed prohibiting any Muslim from saying ” Ya Ali ” or ” Ya Gharib Nawaz ” ( Ali was the son-in-law of the Prophet, and Gharib Nawaz is the appellation often attributed to the saint of Ajmer dargah, Moinuddin Chishti ).

    I asked why we should pass such an order ? The counsel replied that saying ” Ya Ali ” or ” Ya Gharib Nawaz ” was shirk, as it treated Ali or Moinuddin Chishti as Gods.

    I said that saying it does not violate any law, and the petition was frivolous and without any merit. If the petitioners did not want to say ” Ya Ali ” or ” Ya Gharib Nawaz ” they need not say it, but how can they stop others from saying it in a free country ?  

    Saying this, we dismissed the petition
