Caste census right solution to reservation problem: Akhilesh Yadav

Lucknow: Days after the Allahabad High Court observed that several illegalities were committed in fixing quota for appointment of 69,000 assistant teachers, Samajwadi Party chief Akhliesh Yadav on Wednesday attacked the BJP government over the issue of reservation and asserted that a caste census is the right solution to this problem.
“The decision on recruitment of 69,000 assistant teachers has come. It is the result of weak arguments in the case by the BJP government, which is against the basic spirit of reservation.
“To take away the rights of Dalits-backwards, BJP complicates the reservation issue through ‘vidhai mayajaal’ (legislative illusion). Caste census is the right solution to this problem so that reservation can be provided in proportion to the population,” Yadav said in a series of tweets in Hindi.
The Lucknow bench of Allahabad High Court on Monday held that the authorities committed several illegalities in fixing quota for appointment of 69,000 teachers in Uttar Pradesh through the Assistant Teachers Recruitment Examination (ATRE)-2019.
The court had directed the state government to review the final list issued in the matter on June 1, 2020, within the next three months after fixing the reservation in a proper manner.
The bench had also quashed the select list of 6,800 teachers issued on January 5, 2022.
“This is the sad story of ill-treatment meted out to the Dalits and OBCs in the BJP government. Is this the ‘Amritkal of freedom’ where assistant teachers are wailing on the streets to protect their livelihood? Will India become Vishwaguru just like this?
This time, 69,000 will bring change!,” Yadav said in another tweet with a video of protesting teachers.

In a separate tweet with another video of protesters, Yadav said, “Where there is no right to protest for one’s rights, everyone has to come forward to revive democracy. Now the Dalit-backward youth have understood the conspiracy of the BJP regarding reservation. BJP should remember that the youth have the power to change the ‘yug’ (era).”
The HC in its order had said that the reservation limit must not exceed 50 per cent of the total seats in any circumstances.
“Apparently, there was no clarity of the score and details of the reserved category candidates, who appeared in the ATRE 2019. There had been no endeavour from the state authorities, who are custodian of the records of the ATRE 2019 and would have assisted this court in providing the said records,” a bench of Justice Om Prakash Shukla said in his verdict disposing of as many as 117 writ petitions.
The court also showed sympathy to the teachers, already posted, facing ouster as result of the review, but went on to rule that the order will work to restore the balance of equity.
“It is the state authorities, who were under a constitutional duty to implement the provisions of the Reservation Act in its letter and spirit. However, the same has not been done, this court in order to balance the equity and keeping in mind these young men and women, who as teachers are going to shape the future of this country,” the court said.
It had granted liberty to the state government to frame a policy for adjustment of teachers who may be ousted by a revision in the select list of June 1, 2020.
Hearing a bunch of petitions, the bench had to look into the correctness of the quota provided by the state authorities in appointing 69,000 assistant teachers.

Vote to save Constitution in 2024: Akhilesh Yadav

Bijnor: Samajwadi Party President Akhilesh Yadav on Monday exhorted people to vote in the 2024 general election to “save the Constitution” as he accused the BJP of rigging last assembly elections and ensuring loss of his party candidates.
“This time, you all have to vote to save the constitution. In the last assembly polls, BJP and the state administration ensured the defeat of opposition candidates, who were winning,” Yadav told reporters here.
Naemul Hasan, who contested from Dhampur seat, was winning by a margin of 203 votes but was declared defeated by the administration, he said.
On the bulldozer policy against encroachment championed by the BJP-run state administration, Yadav said in Varanasi alone there are over 20 thousand illegal constructions belonging to BJP men, but no action has been taken against them.
“In Bareilly, a petrol pump of party leader Shahzil Islam was demolished, but in the same city there are illegal nursing homes and petrol pumps belonging to BJP men and that were spared,” Yadav said, and wondered when will the government move to raze such structures owned by people from BJP.
In an apparent reference to the alleged financial irregularities committed by Adani group, Yadav said the LIC and SBI suffered losses because of it, but the Central government is still using ED and CBI to attack the opposition.

Land-for-jobs ‘scam’: Tejashwi Yadav skips CBI questioning Saturday, seeks fresh date

New Delhi: Bihar Deputy Chief Minister Tejashwi Yadav did not appear before the CBI for questioning on Saturday in the alleged land-for-jobs scam citing personal reasons, officials said.
The federal agency summoned RJD leader Yadav for questioning on Saturday after he had skipped the previous date on March 4, they said.
He has cited personal reasons for not attending the questioning session, following which the agency is likely to give him another date, they said.
The Central Bureau of Investigation (CBI) had recently questioned RJD supremo Lalu Prasad and his wife Rabri Devi — former chief ministers of Bihar — in Delhi and Patna respectively.
The case pertains to people allegedly given employment in the railways in return for land parcels gifted or sold at cheap rates to the Yadav family and its associates, the officials said.
After the recent questioning of his parents, Tejashwi Yadav had alleged that investigation agencies were acting against political opponents of the ruling BJP at the Centre.
“It is an open secret that probe agencies are acting against political opponents of the BJP and helping those who agree to align with that party,” the Rashtriya Janata Dal (RJD) leader had told reporters outside the Bihar assembly on Monday.
Yadav then said that Prasad, as the railway minister, had “no powers” to give employment in exchange for favours. He got support from the Congress and the AAP, which targeted the central government, alleging that the ruling BJP wanted to “suppress” the voice of the Opposition.

Bihar Chief Minister and JD(U) leader Nitish Kumar on Saturday hinted that he agreed with the contention of ally RJD that the recent crackdown on its president Lalu Prasad and his family members by the CBI and ED was “politically motivated”.
The CBI has filed a charge sheet in the land-for-jobs case against Prasad, Rabri Devi and 14 others under charges of criminal conspiracy and provisions of the Prevention of Corruption Act, and all the accused have been summoned on March 15 by a special court, officials said.
The allegations have been denied by members of the Yadav family.
The officials said the fresh round of questioning is taking place as part of “further investigation” on the basis of fresh inputs gathered by it during its ongoing probe.
The CBI has alleged that during Lalu Prasad’s tenure as the railway minister in the UPA government from 2004 to 2009, favourite candidates were appointed in the railways in violation of norms and procedures.
No advertisement or public notice was issued for appointment but some residents of Patna were appointed as substitutes in different zonal railways located in Mumbai, Jabalpur, Kolkata, Jaipur and Hazipur, the CBI has alleged.
As a quid pro quo, the candidates, directly or through their immediate family members, allegedly sold land to the family members of Prasad at highly discounted rates, up to one-fourth to one-fifth of the prevailing market rates.

Nikki Yadav murder case: Delhi court extends Sahil Gehlot’s judicial custody

New Delhi: A Delhi court on Monday extended the judicial custody of Sahil Gehlot, the main accused in the Nikki Yadav murder case, and five others by 14 days.

Additional Chief Metropolitan Magistrate, Dwarka courts, Samiksha Gupta extended their judicial custody till March 20.

The magistrate also allowed family of co-accused Ashish and Lokesh to meet them in the courtroom.

Appearing for Lokesh, advocate Anirudh Yadav moved an application seeking the marking of the case diary and showed displeasure over manipulation in it.

The judge listed his application for hearing on March 13.

On February 20, Gupta had sent five co-accused to 14 days of judicial custody and two days later, Chief Metropolitan Magistrate Archana Beniwal sent Gehlot to 12-day judicial custody.

Four fresh charges were invoked by police under different Sections of the Indian Penal Code (IPC).

Gehlot’s counsel D.S. Kumar had said that while the FIR was initially registered under Sections 302 (murder) and 201 (causing disappearance of evidence of offence, or giving false information to screen offender) of the IPC, police have now invoked Sections 120 B (criminal conspiracy), 34 (common intention), 202 (intentional omission to give information of offence by person bound to inform), and 212 (harbouring offender).

Gehlot had allegedly strangled 23-year-old Yadav near Kashmiri Gate on February 10 and married another woman on the same day.

Yadav’s body was found in a fridge at a dhaba, owned by Gehlot, in Mitraon village on the outskirts of Delhi on February 14.

Gehlot’s father Virender Singh; cousins Naveen (a constable in Delhi Police) and Ashish; and friends Lokesh and Amar are accused of hatching a conspiracy to get rid of Yadav, so he could go ahead with his wedding with another woman.

According to a senior police official, Gehlot was interrogated at length during police custody and disclosed that Yadav was trying to stop him from marrying someone else as they had already solemnised their marriage in 2020.

“She was pleading with him not to go ahead with the marriage fixed by his family with another girl on February 10. However, Gehlot along with his father, two cousins, and two friends hatched the conspiracy and planned to remove the deceased from their way,” the official had said.

“He executed the plan and murdered her and informed other co-accused persons about it on the same day and then all of them went ahead with the marriage ceremony.”

Lucknow: Uttar Pradesh Deputy Chief Minister Brajesh Pathak on Thursday said the protest by Samajwadi Party MLAs during the governor’s address in the Assembly was condemnable, asserting that party chief Akhilesh Yadav’s remarks in the House were nothing but a “bundle of lies”.

Pathak said he had hoped that Yadav would apologise for the “hooliganism” of his party legislators during his speech in the House.

We heard the Leader of Opposition for long and we were thinking that he would apologise after seeing the hooliganism of the Samajwadis at the time of the governor’s address, he said.

Pathak said he condemns the way the SP members created a ruckus during the address in the House.

He said whatever the SP chief said on the governor’s address is a “bundle of lies” and there is no truth in it.

Yadav on Thursday termed Governor Anandiben Patel’s address in the House as “cut and paste speech” and alleged that the schemes mentioned have not been implemented on the ground.

The budget session of the Uttar Pradesh Legislature began on a stormy note on Monday with the governor reading out the address amid sloganeering by the opposition.

Pathak, participating on a discussion on the governor’s address, praised senior SP member Shivpal Singh Yadav and Akhilesh Yadav, though.

He said the leader of the opposition was a gentleman but some people around him mislead him.

The deputy chief minister listed the achievements of the BJP government, while pointing out the shortcomings of the previous SP dispensation.

He also talked about the recent Global Investors Summit and its success to attract investors.

Patna: While his RJD’s leaders are claiming that he will soon become Bihar Chief Minister, Deputy Chief Minister Tejashwi Yadav on Wednesday sought to shoot down all such speculation, saying that Nitish Kumar will not only become the Chief Minister in 2025 but also in 2030.

Talking to media persons in Jahanabad, Tejashwi Yadav said that as long as Nitish Kumar will stay on the post of Chief Minister, his political experience will be enhanced.

“Nitish Ji will stay on the Chief Minister’s post not only in 2025 but also in 2030. His political experience will enhance. Where is the problem?” he said.

“Now, you people (media) would find the meaning of it. He has the capacity to stay on the post of Chief Minister.”

The statement of Tejashwi Yadav came after JD-U national President Lalan Singh said that the CM face of Mahagathbandhan for 2025 assembly poll is not decided yet, while JD-U national General Secretary K.C. Tyagi went a step ahead to say that Nitish Kumar will not only stay as a Chief Minister in 2025 but also in 2030.

“We have only one motive – to remove BJP from the Centre in the 2024 Lok Sabha election. We are working on it. The Mahagathbandhan government is running under the leadership of Nitish Kumar. There is no confusion in it,” Tejashwi Yadav said.

Nikki Yadav murder case: Victim’s family planning to write to PM for justice

Jhajjar: The family members and supporters of Nikki Yadav, who was allegedly murdered by her purported husband Sahil Gehlot, so he could marry again, are planning to write to Prime Minister Narendra Modi demanding that the accused be tried in a fast track court and receive stern punishment.

“We, along with 36 other communities, will jointly write to Prime Minister Narendra Modi and demand the case be moved to fast track court,” Yadav Samaj district chief Virendra Yadav, commonly known as ‘Daroga’ in the area, said.

Daroga said that in coming days they will hold a meeting with the members of Yadav community and decide their further course of action. “We are also planning a candle march to pay our respects to the deceased Nikki,” he said.

“We want the case to be fast track and Daroga from our community is planning to write a letter to the PM. My fight will continue till the accused is hanged till death,” said Nikki’s father Sunil Yadav, in his house at village Kheri Khummar, two km away from Haryana’s Jhajjar city and 144 km from Delhi.

Daroga said that there is extreme anger among the villagers and community members over the brutal murder of Nikki Yadav. “She should be given justice and the only way to give justice is if the case is heard in a fast track court and the culprit gets capital punishment,” he said.

Days after it was believed that Nikki and Gehlot were both live-in partners, the accused interrogation had revealed that the couple had actually tied a knot at an Arya Samaj temple in nearby Greater Noida in October 2020.

Nikki Yadav’s body was found in a fridge at dhaba, owned by Gehlot, in Mitraon village, outskirts of Delhi on Valentine’s Day (February 14). He had allegedly killed her on February 10 and gone on to marry another woman on the same day.

Police have also arrested Gehlot’s father, his two cousins Ashish and Naveen (a constable in Delhi Police) and two friends, Amar and Lokesh, for hatching a conspiracy to get rid of Nikki and go ahead with the wedding with another girl.

The interrogation of Gehlot revealed that he had earlier planned to push her out of a moving car and show her death as an accident.

As his plan could not work out, he then strangled her with a charging data cable in the car at Nigambodh Ghat parking and then stuffed her body inside the fridge in his dhaba.

Meanwhile, Nikki’s family members said that the murder of their daughter was not done in fit of rage but was a pre-planned conspiracy and so far they are completely satisfied with the ongoing Delhi Police’s Crime Branch investigation.

“As we see the circumstances of the murder, from no possible way it was the result of sudden outrage. They had planned it and Gehlot went to Bindapur flat with the intention to kill her. Everybody who is involved in the murder should be given a death sentence,” Parveen Yadav, Nikki’s uncle, said.

Nikki’s uncle is a Kargil war veteran and had even lost a part of his right arm during the war.

Nikki’s father, who runs an automobile business in Gurugram had shifted back to their house in the village from Dwarka in 2020 after Nikki’s grandfather Ramkishan asked them to, however, Nikki continued her studies in Delhi, said a relative.

Nikki Yadav case: Sahil Gehlot taken to temple where they solemnised marriage in 2020

Delhi: The Delhi Police took Sahil Gehlot, accused of killing his first wife Nikki Yadav and keeping her body in a refrigerator, to the Arya Samaj Mandir in Greater Noida where they had solemnised the marriage, sources said on Sunday.

According to the sources, police have recorded the statements of the temple’s priest and the witnesses who were present at the time of the marriage.

Gehlot allegedly killed Yadav, stuffed her body inside a refrigerator of his dhaba in southwest Delhi, and went off to marry another woman. The incident had come to light on February 14, Valentine’s Day, four days after the crime.

The police have so far arrested Gehlot, his father and four others — two cousins and two friends — in connection with the case. The police claimed that they had planned to get rid of Yadav so that Sahil Gehlot could marry a second time to a woman of the family’s choosing.

The police on Saturday recorded the statement of Nikki Yadav’s younger sister.

In her statement, she denied that she was aware about the marriage of her sister with Sahil Gehlot. She told police that she knew that they were good friends, they said.

Gehlot married Yadav at an Arya Samaj temple in 2020. The couple had not informed their respective families about their marriage.

“However, when Gehlot’s parents started looking for a girl for his marriage and started pressuring him to take interest in marriage…, he finally revealed to his family that he was already married,” a police officer said earlier.

When Gehlot’s family got to know about his marriage to Yadav, they expressed their displeasure over him marrying a girl of his choice without informing them.

Nikki Yadav’s parents told police that they were not aware of her relationship or her wedding with Gehlot.

Nikki Yadav murder: Delhi court sends 5 accused to 2-day custody

New Delhi: A Delhi court has sent Sahil Gehlot and four co-accused in the Nikki Yadav murder case, to two-day police custody.

Gehlot had strangled the 23-year-old woman at Kashmiri Gate on February 10.

The police had produced the five arrested people before the court on Friday night.

On Wednesday, the court had sent Gehlot to five-day police custody for interrogation.

In a recent development, Gehlot has told the investigators that the two had married in 2020.

Police have also arrested Gehlot’s father, his two cousins Ashish and Naveen (Constable in Delhi Police) and two friends Amar and Lokesh for hatching a conspiracy to get rid of Yadav and go ahead with the wedding with another girl.

According to a senior police official, the prime accused Gehlot was interrogated at length during police custody and disclosed that Yadav was dissuading him from marrying someone else as they had already solemnised their marriage in 2020.

“She was pleading with him not to go ahead with the marriage fixed by his family with another girl on February 10. However, Sahil along with his father, two cousins and two friends hatched the conspiracy and planned to remove the deceased from their way,” said the official.

“Sahil executed the plan and murdered her and informed the other co-accused persons about it on the same day and then all of them went ahead with the marriage ceremony,” said the official.

“All the five co-accused were thoroughly interrogated and arrested after verifying and ascertaining their role,” the official added.

According to the official, on the night of February 9, Gehlot, a resident of Mitraon village, went to meet the woman at her Uttam Nagar residence where she lived with her younger sister.

“Sahil stayed there for two-three hours and later both of them went to Nizammudin railway station. But as they could not get tickets to Goa, they decided to go to Himachal Pradesh instead and reached ISBT, Kashmere Gate,” said the official.

When the duo reached ISBT, an argument broke out between them. He then strangled Nikki with his mobile phone data cable inside the car, probably around 8 a.m on February 10, drove to his dhaba to hide her body, and then proceeded with his wedding on February 10.
