    FTC won’t challenge Amazon’s One Medical deal

    “The FTC’s investigation of Amazon’s acquisition of One Medical continues,” said FTC spokesperson Douglas Farrar. “The commission will continue to look at possible harms to competition created by this merger as well as possible harms to consumers that may result from Amazon’s control and use of sensitive consumer health information held by One Medical.”

    Bloomberg earlier reported on the FTC’s decision to not challenge the One Medical deal.

    One Medical is the second Amazon acquisition to go unchallenged at the FTC since Lina Khan, a fierce critic of the company, took over the agency in 2021. Amazon’s purchase of MGM Studios also closed without opposition, though the commission at the time was deadlocked 2-2 along partisan lines, preventing a lawsuit.

    Federal law provides strict timelines for merger review. Once a deal is filed with the FTC and Justice Department, the agencies have 30 days to decide whether to open an in-depth probe. If they do, the agency reviewing the deal has another 30 days to decide whether to challenge the deal in court after the companies fully comply with all demands for information.

    The FTC can agree with merging companies to extend that latter deadline. It couldn’t be learned what agreements Amazon had with the FTC, but Tuesday marked the deadline for the agency to decide on whether to sue.

    One Medical is a membership-based primary care provider, with locations around the U.S. Amazon shut down a similar service shortly after it bought One Medical, and a key focus of the investigation was whether Amazon chose to buy a competitor rather than compete with it.

    The person with knowledge of the investigation said that while the FTC had serious concerns about the deal, it would have been a challenging case.

    An FTC probe of Amazon’s takeover of iRobot, maker of the Roomba robot vacuum, is still underway, as is a more wide-ranging antitrust investigation of the company that is expected to result in a lawsuit later this year, according to two people with knowledge of that investigation.

    An Amazon spokesperson declined to comment.

    Lucknow: Samajwadi Party chief Akhilesh Yadav on Tuesday said foreign investors will not come to India as the BJP government’s ‘bulldozer policy’ and the recent I-T “raids” at the BBC offices have dented the country’s image abroad.

    Talking to reporters after attending an assembly session here, Yadav, referring to the recently concluded Investors Summit in Uttar Pradesh, said the ruling BJP was selling dreams to people.

    The pictures of the authorities bulldozing the houses of poor people have been seen by the world. If the BJP raids an institution like the BBC and intimidates the media, do you expect people from around the world to invest in the country, Yadav said.

    The BJP is just selling dreams to the people that investments worth Rs 40 lakh crore will come to Uttar Pradesh, he said while referring to the Investors Summit.

    “Investors came and went after taking a round of the Investors Summit. The government will not tell you that no one stayed at the tent city built by spending thousands of crores of rupees for the investors to stay. You (media) find out how many investors stayed in them. All were empty,” Yadav claimed.

    Bulldozers used for demolishing illegal buildings have been in hot discussion in the state, inviting the sobriquet of “bulldozer Baba” for Chief Minister Yogi Adityanath.

    A 45-year-old woman and her 20-year-old daughter died after they immolated themselves during an anti-encroachment drive in a village in Kanpur Dehat district of Uttar Pradesh.

    Referring to the death of Apna Dal-Sonelal’s MLA Rahul Prakash Kol due to cancer, the former chief minister said, “Today, so many people are dying due to cancer, but you (BJP) will not build a cancer institute, you will not build a hospital.”

    “You (BJP) are the people of the government who want to build your own temple,” he said without elaborating which temple he was talking about.

    On the presentation of the budget for 2023-24 in the state assembly on Wednesday, the SP president said, “Six budgets of this government have come so far. What did anyone get? No one got anything… the income of the farmers did not get doubled.”

    “Unemployment and inflation are at their peak. The increase in the price of diesel and petrol has resulted in an increase in prices of vegetables and food items,” he claimed.

    Describing the manhandling of mediapersons by security personnel during a protest by SP members in the Vidhan Bhavan premises on Monday as “unfortunate”, Yadav said action should be taken against the guilty.

    New Delhi: The Supreme Court on Monday observed that everything which is said could not be equated with hate speech, stressing: “We have a common enemy, that is hate. That is the only thing. Remove hate from your minds and just see the difference.”

    A bench of Justices K.M. Joseph and B.V. Nagarathna, hearing a batch of petitions seeking directions against hate speech, also considered a plea by Shaheen Abdullah in connection with an event organised by a body known as the Sakal Hindu Samaj in Mumbai earlier this month.

    The top court had directed the Maharashtra government to record the event scheduled on February 5, and stressed that the government has to ensure that hate speeches are not made, while seeking a report on it.

    During the hearing on Monday, the bench queried Solicitor General Tushar Mehta, did they make any hate speech, and he replied, according to his instruction: “No”.

    Justice Joseph then told advocate Nizam Pasha, representing one of the petitioners in the matter, said: “Two days back we stayed the proceedings against (Delhi Chief Minister) Arvind Kejriwal… involved Section 125 of The Representation of the People Act… he brought a list of decisions of this court, as what is (Section) 123A. It is not everything is said amounts to hate speech. So, we have to be careful only in terms of (what) this section means, as interpreted by this court, will involve the offence. Correct. Bear that in mind also…”

    Pasha submitted that reading of transcripts in these cases will help convince “my lords, that in these particular cases what is said amounts to hate speech”.

    At this, the bench observed: “The problem is what is hate speech as such… we have to fall back on (IPC’s Sections) 153A and 295A… these are the provisions to deal with this kind of propensity… there has to be some vilification.”

    Mehta said the counsel wants many things and “we were served yesterday, let us ascertain what he says is right or wrong”.

    The bench told Mehta that it had asked him to give the report and video of the religious event and he said that it will be filed.

    The bench asked Pasha if the meeting took place and he said that it did but was not on a large scale.

    Justice Joseph orally observed: “We have a common enemy that is hate. That is the only thing. Remove hate from your minds and just see the difference. Everything will be clear.”

    Concluding the hearing, he added: “We have got such a great, great civilisation… unparalleled in the whole world. Our civilisation, our knowledge is eternal.”

    The top court scheduled the matter for further hearing on March 21.

    The plea filed by Abdullah said: “The mass participation at these rallies being organised not just with the consent and knowledge of government authorities but with their active participation, pose a serious threat to the very foundation of our nation as a secular nation. The hatred being taught and the radicalisation of youth being carried out with such impunity will inevitably lead to communal disharmony and violence of an unfathomable scale across the country.”

    The plea said rallies have been organized by the Sakal Hindu Samaj, an umbrella body of Hindu right-wing organisations under the banner of “Hindu Jan Aakrosh Sabha”. The last such rally took place on January 29 in Mumbai and more than 10,000 people attended a rally organised by Hindu far-right groups seeking boycott of goods from shops owned by Muslims and a law against “love jihad” and “religious conversions”.

    “That the aforementioned Sakal Hindu Samaj will be organising yet another rally, of a similar nature, on February 5 in Mumbai. At least 15,000 people are expected to participate in the said rally. The very nature of all the previous rallies clearly indicate the kind of hate speeches that will in all likelihood be delivered at the same,” added the plea.

    In October last year, the apex court had directed the Delhi, Uttar Pradesh, and Uttarakhand governments to come down hard on hate speeches, promptly registering criminal cases against the culprits without waiting for a complaint to be filed.

    Delhi: The Union Housing and Urban Affairs Ministry has decided to take over 123 properties of the Delhi Waqf Board, including mosques, dargahs and graveyards, evoking a sharp reaction from board chairman and AAP MLA Amanatullah Khan.

    Khan asserted that he will not allow the central government to take over the Waqf properties.

    The deputy land and development officer, in a letter to the board on February 8, informed it of the decision to “absolve” it from all matters pertaining to the 123 Waqf properties.

    The Land and Development Office (L&DO) of the central ministry said the two-member committee headed by Justice (retired) S P Garg on the issue of denotified Waqf properties in its report submitted that no representation or objection was received by it from the Delhi Waqf Board.

    The committee was formed by the government of India on the order of the Delhi High Court, according to the L&DO letter.

    The L&DO said the Delhi Waqf Board was the main stakeholder/affected party to whom the opportunity was given by the committee. However, it did not appear before the committee or filed any representation or objection regarding 123 properties.

    “It is evident from the above facts that Delhi Waqf Board does not have any stake in the listed properties, neither have they shown any interest in the properties nor filed any objections or claims. It is, therefore, decided to absolve Delhi Waqf Board from all matters pertaining to ‘123 Waqf Properties’,” said the L&DO letter.

    Physical inspection of all 123 properties will now be carried out by the L&DO.

    According to Khan, the L&DO has pasted notices at 123 properties, which has caused “widespread anxiety, fear and resentment” among the Muslim community.

    “We have already raised our voice in the court on 123 Waqf properties, our Writ Petition No.1961/2022 is pending in the High Court.

    “Some people are spreading lies about it, the proof of this is in front of all of you. We will not allow anyone to occupy the properties of the Waqf Board,” he said in a tweet in Hindi.

    The DWB chairman in a reply to the Deputy Land and Development Officer of the central ministry on Friday said that the Delhi Waqf Board had already filed a petition in the high court in January 2022 against the formation of a two-member committee on the basis of whose report the action has been initiated by the ministry.

    Khan said that the committee was informed on April 12 last year about Waqf Board’s petition in the high court, challenging its formation and asking it to defer its proceedings until a final order was passed by the court. The matter is pending in the high court.

    He also said that before the two-member committee, a one-member panel was formed whose report was rejected without giving any reason. Also, the government of India had allotted one of the 123 properties to the Indo-Tibetan Border Police (ITBP) on permanent basis, after which the Waqf Board had approached the high court.

    “Two-member committee has already submitted its report. However, no such report is shared with the Delhi Waqf Board. Hence, you are requested to share a complete set of the report with the Delhi Waqf Board urgently,” Khan said.

    He claimed that there was no direction to constitute a two-member committee by the high court in its order dated August 20, 2014.

    These 123 properties are used by the Muslim community. The day-to-day management of these 123 properties was done by Mutawallis or the management committees appointed by the Delhi Waqf Board, he said.

    The Delhi Waqf Board has a statutory right under Section 32 of the Waqf Act, 1995, to exercise the powers of general supervision, administration and control over these properties, he asserted.

    According to the Waqf Act, all the Waqf properties vest in the concerned Waqf Board, which in the present case, is Delhi Waqf Board, Khan said.

    The Waqf nature of the 123 properties was “innate” as all were religious structures like mosques, dargahs and graveyards. Some of them were given to the Delhi Waqf Board’s predecessor – ‘Sunni Majlis Auqaf – by the British ruler, he added.

    New Delhi: Pakistan’s former flamboyant all-rounder Shahid Afridi feels “even the ICC won’t be able to do anything in front of the BCCI” as far as hosting the 2023 Asia Cup in his country is concerned.

    The BCCI’s refusal to play in Pakistan owing to the political tension between the neighbours has cast doubts over the tournament taking place across the border later this year.

    The continental tourney is significant as it is scheduled just before the ODI World Cup, which India is hosting and Pakistan has threatened to boycott in a tit-for-tat riposte.

    “I have no idea, will India visit Pakistan for the Asia Cup? Will we boycott the ODI World Cup in India? But we need to take a stand at some point or the other,” Afridi told ‘Samaa TV’.

    “In this case ICC’s role becomes crucial, they should come forward, but let me say it even ICC won’t be able to do anything in front of BCCI,” he added.

    Afridi, one of cricket’s biggest entertainers of his time with his power-hitting abilities and quick leg-spinners, said the BCCI is flexing its muscles because it has made itself “that strong”.

    “If anyone is unable to stand on his own feet and then the decision to make such strong calls is not easy. They have to look at plenty of things. India agar aankhe dikha raha hain (If India is flexing its muscles) or taking such strong stance, then they have made themselves that strong.

    “So they are able to talk like this, otherwise they wouldn’t have the courage. At the end it’s about making yourself strong and then take decisions.”

    Afridi’s remarks came following seasoned India off-spinner Ravichandran Ashwin’s take on the contentious issue.

    “Asia Cup was supposed to take place in Pakistan. But India has announced that if it takes place in Pakistan, then we won’t be participating. If you want us to participate do change the venue. But we would have seen this happen many times.

    “When we say that we won’t go to their place, they will say that they will also not come to our place. Similarly, Pakistan has said that they will also not come to the World Cup. But however, I think it is not possible,” Ashwin had said in a video shared on his YouTube channel.

    “The final call might be that the Asia Cup is moved to Sri Lanka. This is an important lead-up to the 50-over World Cup. Many tournaments have taken place in Dubai guys. I will also be pleased if it is moved to Sri Lanka.” Ashwin added.

    The BCCI and the Pakistan Cricket Board (PCB) have been at loggerheads regarding the Asia Cup venue.

    Gaetz’s congressional office on Wednesday also said that the DOJ confirmed to his attorneys that authorities have completed their probe and won’t charge Gaetz with any crime.

    The news was first reported by CNN. POLITICO reported in September that the DOJ’s investigation was winding down and that prosecutors weren’t likely to file charges against Gaetz.

    Officials at the DOJ declined to comment.

    Speaking Wednesday night on “System Update,” a program hosted on video platform Rumble by Glenn Greenwald, Gaetz said the DOJ’s decision isn’t a surprise but is certainly welcome.

    “While the two years haven’t been the most comfortable of my life, I have been very focused on my work here in Congress representing my constituents and never really looking past the task at hand,” Gaetz said.

    Federal prosecutors and the FBI began investigating Gaetz in late 2020 during the Trump administration over potential sex trafficking crimes related to allegations he’d paid women for sex and traveled overseas on at least one occasion to parties attended by teenagers who were not yet 18.

    Federal authorities also looked into whether Gaetz had obstructed justice due to a call Gaetz and the lawmaker’s girlfriend had with a witness. Exact details of that phone call are unknown.

    Gaetz repeatedly denied having sex with anyone who was underage.

    Gaetz has been a staunch ally of former President Donald Trump and frequented appeared on conservative media to defend the president. His national profile grew even more this year when he was part of a group of conservative Republicans who refused to back GOP Rep. Kevin McCarthy as speaker. In one notable moment, another Republican confronted Gaetz on the House floor and had to be held back by fellow members.

    The investigation into Gaetz came in the aftermath of federal authorities charging Joel Greenberg, a Florida county tax collector who once was close friends with Gaetz. Greenberg was sentenced in December to 11 years in prison.

    He had been charged initially with more than two dozen criminal counts, but in May 2021 he pled guilty to six — including sex trafficking and fraud — in exchange for his cooperation in multiple cases, including the probe in into Gaetz.

    Greenberg’s sentencing was delayed multiple times as he cooperated with authorities.

    Jalota then went on to cite Kashmir, claiming that terrorist attacks have decreased under India’s supervision, involvement and since the Aborgation of Article 370, despite opposition.

    “Changes that have taken place in Kashmir have not made any difference to anyone, but the attacks of terrorists have reduced there,” he claimed, adding that people are living in peace now.

    Jalota said at the end of the video, “You see everything is happening for the good. So this work should be done soon. I can give my opinion. I have given my vote. I have given my view.”

    Most of Congress’ intraparty feuds are fleeting, especially when margins of control are as close as they are in the House and Senate these days. Any standoff that lasts longer than a few days risks ceding power to the other party.

    But Scott and McConnell’s split is going the distance.

    Over the past year, Scott has managed to dislodge Cruz as the biggest thorn in McConnell’s side, no small feat. The Florida senator’s performance as chair of the Senate GOP campaign arm and Scott’s own competing legislative agenda, which McConnell felt compelled to disavow — has sparked a nearly yearlong row between the two GOP senators.

    And it’s more than a mere personality conflict for Republicans. Scott’s challenge of McConnell for leader has factionalized the GOP in a manner not seen since Cruz set the table to run for president a decade ago by taking on McConnell every chance he had. McConnell may have easily dispatched Scott — the final tally was 37-10 — but the fact that McConnell now knows 10 Republican senators were ready to oust him has made his job more complicated.

    “Petty retribution can be a dangerous pattern in this place, particularly with a small body,” Cruz said in an interview, referring to the removal of Scott from the Commerce panel. “There’s an old proverb: when you look for revenge, you better dig two graves.”

    McConnell denies removing Scott and Sen. Mike Lee (R-Utah) from the Commerce Committee over their opposition to him as leader, but he is still slamming the Floridian’s personal policy portfolio nearly a year after its release. In public remarks last week, McConnell lashed Scott for a proposal that he sees as fuel for Democratic campaigns next year: “Unfortunately, that was the Scott plan. That’s not a Republican plan.”

    It’s fair to say the animosity goes both ways.

    “Who does really well with what we’ve been doing, just spending money like it’s going out of style? The elites do, people who make money off of the government do. Wall Street makes money,” Scott said this week. “Who doesn’t like my plan? Those people.”

    While standing behind his plan, Scott also raised eyebrows last week when he introduced a new bill preventing cuts to Medicare and Social Security.

    And that’s not the end of the diss track.

    McConnell warned last week that Scott’s own agenda would become a “challenge” when the former Florida governor stands for reelection. Scott won narrowly in 2018, ousting former Sen. Bill Nelson (D-Fla.), though the state has moved to the right in the last four years.

    “He’s gonna win. He’s won three statewide races already,” said fellow Florida Republican Sen. Marco Rubio. “I don’t think he’s going to have a problem winning reelection.“

    Then Rubio acknowledged what’s abundantly clear: “Obviously, there’s some friction there“ between McConnell and Scott.

    Indeed, the GOP senators’ ongoing back-and-forth is creating plenty of intrigue — particularly given how taciturn McConnell usually is. As Sen. Kevin Cramer (R-N.D.) put it: “He’s a pretty patient guy, but occasionally even Mitch McConnell has a right to stand up for himself. That’s what I think he’s doing.”

    Others see things differently.

    “The leader’s role is to support incumbent senators. He certainly did it up in Alaska,” said Sen. Ron Johnson (R-Wis.), who supported Scott in the leadership fight. “Certainly don’t denigrate them, don’t say anything negative about them. Financial support is one thing, but just verbal support is his responsibility. So, beyond disappointing.”

    Scott’s seat is a key cog in the Senate GOP’s plans to win back the majority, and McConnell’s political network is behind him there. Sen. Steve Daines (R-Mont.), Scott’s successor at the National Republican Senatorial Committee, is behind Scott. So is the chief McConnell-aligned super PAC — even after it publicly sparred with Scott just a few months ago over campaign strategy.

    “Senator Scott has never lost an election in the state of Florida, and 2024 will be no different,” said Torunn Sinclair, a spokesperson for the Senate Leadership Fund.

    The imbroglio goes back to McConnell’s decision not to release an agenda ahead of November’s midterms, and Scott’s subsequent move to put out his own while running the NRSC. McConnell smarted over the plan, as well as Biden’s concerted attacks linking it to the rest of the party, though on Tuesday he declined to utter Scott’s name.

    “This continues to come up. The president was talking about it in the State of the Union. He’s taken it out to various states. So let me say one more time. There is no agenda on the part of Senate Republicans to revisit Medicare or Social Security. Period,” McConnell said.

    In addition to policy disputes, the clash stems in part from the two Republicans’ divergent views of modern politics. Scott views the attention he gets from Democrats as valuable increased name recognition, and he’s raised money off of the loss of his committee assignment. He said in an interview that it’s “great” to see Biden distribute his proposal: “I put out a plan, Biden puts it out. What else could you ask for?”

    But McConnell sees things very differently, according to allies. He’s studiously avoided releasing any agenda that can be easily pilloried, instead trying to run as a check on Democrats — a strategy that’s had mixed results in his 16 years as Senate GOP leader.

    With the party gearing up for another bid to take back the White House and Senate, that means some Republicans are cringing every time Biden brings up Scott.

    “It’s a problem when you have the president of the United States in his State of the Union saying that Republicans want to get rid of Social Security,” said Sen. Shelley Moore Capito (R-W.Va.). Because of Scott, she added, Biden “has a kernel to hold onto. And I think that frustrates McConnell.”

    “The government has taken action by arresting some people. Such an insult to Ambedkar is unacceptable. Remove the ‘deemed university’ status and withdraw all the facilities given to the educational institution,” Annadani said and trooped to the well of the House.

    Replying to him, the state Law and Parliamentary Affairs Minister J C Madhuswamy said, “the government is not in a position to tolerate it. If the management’s role is found then certainly action will be taken,” Madhuswamy said.

    On repeated insistence seeking removal of deemed-to-be-university status, Madhuswamy said the government will not yield to whatever was asked for in the House.

    Annadani alleged the professor and the dean of the university must be held accountable as they knew about the play when the rehearsal was happening.

    The skit that was performed by the students of the Jain (Deemed-to-be) university at a college festival recently, purportedly contained offensive references mocking Dr Ambedkar and Dalits, the portion of which was widely shared on social media. Nine persons including seven students have been arrested in this connection.
