  • Woman hit-drag case: Accused’s identity proved through CCTV footage

Woman hit-drag case: Accused’s identity proved through CCTV footage

    [ad_1]

New Delhi: The identity of four accused in the hit-and-run case where a 20-year-old woman was dragged to death while trapped under a car here on new year’s day was established based on CCTV footage, statements of witnesses and other scientific evidence, the Delhi Police said in its charge sheet.

According to the final report, the evidence proved the presence of the four accused — Amit Khanna, Krishan, Manoj Mittal and Mithun — in the car.

The charge sheet cited the statements of six eyewitnesses, including the victim’s friend, the person who informed police about the body, an autorickshaw driver, and a person who was in the car with the four accused but was dropped at Sultanpuri before the incident.

    MS Education Academy

It said the CCTV footage revealed crucial evidence, such as the presence of all the accused at a dhaba before the incident and in Rohini Sector 1 after.

“It has also been revealed by the footage that the accused knew that the victim was entangled… The accused didn’t try to save the life of the woman. After getting back in the car, they intentionally dragged her for a long distance to kill her,” the charge sheet claimed.

It stated that the DNA profile generated from the strands of hairs recovered from the car matched with the profile generated from the blood samples of Khanna, Mittal and Krishan.

Also, the DNA profile generated from the blood spots present on the clothes of the accused matched with that generated from the blood sample of the victim, the charge sheet stated.

DNA profiles generated from the exhibits recovered from the spot along with those lifted from the car, the cloth of the victim and from the clothes of Manoj Mittal, Mithun and Krishan were found similar to the DNA profile generated from the blood on gauze, the charge sheet said.

“A forensic science laboratory team lifted the blood in gauze from the offending car and the spot where the body of the deceased was found. DNA profile thus prepared matched with the DNA profile prepared from the blood in gauze preserved during the post-mortem of the deceased,” the charge sheet said.

The report said that the owner of the vehicle, Ashutosh Bhardwaj, voluntarily permitted his car to be driven by Amit Khanna, who did not have a valid driving licence. Also, Khanna’s blood test revealed the presence of alcohol above the permissible limit, it said.

“During the interrogation, Ashutosh disclosed that when he came to know about the incident and that the person driving the car did not possess a valid driving licence, he, Ankush and other accused planned to plant another person possessing a valid driving licence as the driver of the offending car at the time of the incident,” the charge sheet said.

“Ashutosh helped in the disappearance of the evidence of offence and gave false information to shield the accused,” it said.

Police arrested Deepak Khanna (26), Amit Khanna (25), Krishan (27), Mithun (26), and Manoj Mittal in the case on January 2.

Co-accused Ashutosh Bhardwaj and Ankush, were earlier given bail by the court, while the bail plea of Deepak Khanna was rejected by a sessions court.

Amit Khanna, Krishan, Mithun and Manoj Mittal have been accused of murder, while Amit Khanna and Ashutosh were booked under the Motor Vehicles Act.

It said all the accused were booked for the offences of criminal conspiracy, destruction of evidence, harbouring offender, common intention and false information with an intent to cause a public servant to use his lawful power to the injury of another person.

Delhi Police has levelled additional charges against Amit Khanna for the offences of rash driving and causing hurt by an act endangering the life or personal safety of others.

2 pets rescued after video showing woman thrashing dog goes viral

According to the police, a father-son duo in Sector 109 had kept two dogs of foreign breeds which were looked after by their domestic help. • Newsom faces push to name Black woman to Senate if Feinstein retires

Newsom faces push to name Black woman to Senate if Feinstein retires

    [ad_1]

“There is no Black woman in the Senate, so that commitment was heard across the nation,” said Assemblymember Lori Wilson, chair of the California Legislative Black Caucus. “There are Black women in Texas, in Georgia, who are holding onto: If there’s a vacancy, we’re going to get a Black woman, because Governor Newsom said so.”

A Senate vacancy in California would create outsize implications for the 2024 Senate race and a series of fraught political choices for Newsom. The governor would face enormous pressure to move quickly on his decision, given Democrats’ razor-thin margin in the Senate. He’d also have to decide whether to appoint a caretaker or wade into the contest by naming a contender like Lee.

Feinstein, who plans to retire after next year, said Wednesday she will return to the Senate as soon as her medical team allows — though she didn’t specify a date. In the meantime, she called for Senate Majority Leader Chuck Schumer to pick a Democrat to replace her on the important Judiciary Committee.

Newsom has made no public statements on the politically thorny issue in recent days, as some lawmakers openly called for Feinstein’s resignation. When asked if he intends to honor his promise, a spokesperson for his office directed POLITICO to his previous comments.

The governor in 2021 said he had “multiple names” in mind for Feinstein’s replacement, though didn’t specify any. Los Angeles Mayor Karen Bass, Secretary of State Shirley Weber, Los Angeles County Supervisor Holly Mitchell and San Francisco Mayor London Breed have all been floated as potential contenders — though representatives for at least two said they would not accept the nomination.

But Lee, one of the most prominent Black women in California politics, seems to be garnering the most support for the appointment. She is running against fellow congressmembers and formidable fundraisers Katie Porter and Adam Schiff in the fierce competition to replace Feinstein in 2024 — a race that is already creating tension within the California Democratic establishment.

In 2020, San Francisco-based She The People helped organize a pressure campaign to fill Harris’ seat with a Black woman. Last time around, the goal was to uplift both Lee in Northern California and then-Congresswoman Bass in Southern California.

But with Bass now installed as Los Angeles mayor, Lee is the most senior among the contenders to replace Feinstein, said the group’s founder, Aimee Allison. It’s widely expected that the statewide political establishment “will break in favor of Barbara Lee,” she said.

Wilson noted that the California Legislative Black Caucus has already endorsed Lee’s bid for Senate, and said she would like to see the congresswoman appointed in the event Feinstein stepped down.

A representative for Lee’s campaign declined to comment on the prospect of a direct appointment. “The congresswoman’s primary concern is for Sen. Feinstein’s health,” said Lee campaign spokesperson Katie Merrill in a statement. “She is wishing the Senator a full and speedy recovery.”

Appointing someone outside the 2024 Senate contest, such as Weber, could give Newsom an out — allowing him to avoid any show of favoritism between Lee, Porter and Schiff. But there’s no guarantee that such an appointee wouldn’t change their mind and run in 2024.

And it might not be Newsom’s preference, anyway.

“Appointing a caretaker may be the way out of a difficult political situation,” said Rose Kapolczynski, a longtime Democratic consultant known for running former Sen. Barbara Boxer’s campaigns. “But [Newsom’s] history shows that he’s happy to take a risk and appoint someone who’s going to serve and run.”

Adding to the pressure is the fact that Newsom did not not endorse Bass for mayor last year even as nearly every high-powered Democrat, including President Joe Biden, rallied behind her — a political decision that earned him some harsh criticism. In a letter sent ahead of the November election, a coalition of Black women’s groups accused the governor of turning his back on them.

“He selectively supports Black women candidates even when they have overwhelming support from the party leaders and our community,” the letter read.

Newsom has so far not moved off his position to appoint a Black woman to the Senate should it become a possibility.

When asked if Weber would consider the job, Matt Herdman, a spokesperson for her campaign, said, “no comment.”

Bass’ spokesperson Zach Seidl, when asked the same question, responded, “absolutely not.”

Lenée Richards, a spokesperson for Mitchell, said “she would not accept an appointment to the Senate.”

Breed’s office didn’t respond to a request for comment.

Roger Salazar, a veteran California Democratic consultant who has advised statewide and national campaigns, said Newsom could certainly risk alienating Schiff and Porter supporters if he appointed Lee to a vacancy.

But regardless of who he has in mind, Newsom would be expected to make a decision quickly — if it came to that. After Harris vacated her seat, it took Newsom several months to name a successor. Now, given the tight margin for Democrats in the Senate and the ongoing debates around gun control, abortion and the economy, he would not have the same luxury of time.

“There’s no question that there’s going to be an urgency because of the national situation,” Salazar said.

  • Iranian-born US woman jailed for 4 years in plot to kidnap Iranian activist Masih Alinejad

Iranian-born US woman jailed for 4 years in plot to kidnap Iranian activist Masih Alinejad

    [ad_1]

Tehran: An American citizen of Iranian origin residing in California was sentenced to four years in prison for her role in the attempted kidnapping of Masih Alinejad, an Iranian activist, the US Department of Justice announced.

In December 2022, 48-year-old Niloufar Bahadorifar, was charged with many offences, including conspiracy to break US sanctions by providing Iran with material support.

On Friday, the US Attorney General for the Southern District of New York, Damian Williams, announced that Niloufar Bahadorifar had been sentenced to 4 years in prison for conspiring to violate the International Emergency Economic Powers Act (IEEPA) by providing financial services to Iran and its government in violation of US sanctions.

    MS Education Academy

“Niloufar Bahadorifar willfully violated the sanctions and provided financial support to Iranian intelligence assets, who in turn participated in a plot to kidnap an Iranian human rights activist living in the United States whom the Iranian government sought to silence,” prosecutor Damien Williams said.

According to New York Times, US court confirmed that Bahadorifar paid a private investigator who was recruited in 2020 to monitor Masih Alinejad, an activist campaigning against the veil and residing in New York.

    Provided funds, access

Bahadorifar was convicted of laundering money to the United States from Iran that was used to pay private investigators to conduct surveillance on Alinejad on behalf of an alleged Iranian intelligence agent, Mahmoud Khazein.

Bahadorifar has been accused of making cash deposits of more than 476,100 dollars into accounts in the US since 2019, structuring most deposits in increments of less than 10,000 dollars to avoid detection by US financial authorities.

Bahadorifar was not accused of taking part in the kidnapping plot itself, and her lawyers argued that she was unintentionally deceptive.

On Friday, Alinejad said in a video statement on Twitter that she came face to face with Bahadurifar shortly after appearing in federal court.

“In my statement I said in the federal court, that this is beyond belief that anyone could even claim that they are unaware of the evil nature of the Islamic Republic,” said Alinejad. “The sentence today is a reminder for the US government, for Europeans, who is still trying to get a deal with the Islamic Republic because the Islamic Republic is a terrorist regime.”

Alinejad, an activist-journalist, became a US citizen in 2019. She has been an advocate for women’s rights in Iran for years and has played a prominent role in amplifying the voices of demonstrators during the most recent wave of protests, which began in September 2022.

  • Compensate woman for illegal detention for a day, SC to Maha Police officers

Compensate woman for illegal detention for a day, SC to Maha Police officers

    [ad_1]

New Delhi: The Supreme Court has asked police officers in Maharashtra to compensate a woman for keeping her in illegal detention despite she being granted interim protection and two weeks to surrender it.

A bench of Justices S.K. Kaul and A. Amanullah observed that the woman, an accused in a criminal case, got the interim protection on November 17, 2021 and the apex court had granted her two weeks’ to surrender and apply for regular bail.

Expressing discontent with the illegal detention of the woman, the bench noted that the court had given interim protection to the petitioner and despite the same, she was taken into custody.

    MS Education Academy

The petitioner had submitted before the court that she had also shown the court’s order to the police, though she was bailed out next but she was in custody for a day.

The top court ordered that the petitioner should be compensated with Rs 15,000 for the illegal detention for one day which will be shared by the two police officers and the payment to be made within a period of two weeks.

The bench noted that two police officers filed their affidavit seeking to express unconditional apology. However, the bench said that behaviour of the officers was in the teeth of the court’s order and cautioned the police officers to be careful in future.

The top court passed the order on a contempt plea filed by the woman against two police officers. In a previous order passed in January this year, the bench had noted petitioner’s counsel arguments that despite the November 2021 order, within two days the woman was arrested from a hospital where she was working as a nurse.

The bench noted that the police officers were ready to compensate the woman from their own pocket in the matter.

In 2021, the woman had moved the apex court challenging the Bombay High Court order, passed in August 2021, refusing to entertain her plea for anticipatory bail in the case.
