    Guwahati: Assam Chief Minister Himanta Biswa Sarma said on Friday that the state government has withdrawn at least 27,000 cases related to minor crimes with an aim to reduce the burden on the judiciary.

    Attending the platinum jubilee celebrations of Gauhati High Court, Sarma said, “For facilitating ease of justice, the Assam government took a decision of withdrawing petty offence cases to bring down the pendency of cases.

    “Cases punishable for up to three years with or without fine were taken into consideration for withdrawal, barring the cases of heinous nature,” Sarma said, adding that till February this year, around 27,000 such cases have been withdrawn and it is estimated that through this action around one lakh criminal cases will be disposed of.

    Sarma also asserted that this will reduce the load on lower courts.

    The Chief Minister hailed the role played by the Gauhati High Court as the true guardian of human rights, protector of the Constitution and promoter of the age-old democratic ethos.

    He mentioned that the Gauhati High Court has a unique identity for being the common high court for all the seven states of the northeast for a longer span of its existence.

    “This court has been dealing with the fascinating task of interpreting enacted laws as well as tribal laws and customs and has judicial authority on subjects falling under the 6th Schedule of the Constitution of India, which is unique to this region only,” Sarma said.

    The Chief Minister also expressed his commitment to create as many posts as required in the lower judiciary with adequate infrastructure.

    He said, “The state government has decided to create a new campus of Gauhati High Court, work for which will start this year.”

    New Delhi: A Delhi court has “dismissed as withdrawn” a plea seeking an injunction against the upcoming movie “Adipurush”.

    Additional Senior Civil Judge Abhishek Kumar heard the arguments on behalf of the plaintiff, advocate Raj Gaurav, on the maintainability of the civil suit seeking an injunction at the pre-summons stage.

    “The matter is listed for remaining arguments on behalf of the plaintiff…. However, at this stage, the plaintiff has submitted that he may be allowed to withdraw the case as the release of the movie has been postponed and it has come to his knowledge that the filmmakers are planning to make certain alterations and changes in the movie,” the judge said in an order passed on Saturday.

    “In view of the statement, the present suit is dismissed as withdrawn,” the judge added.

    The petitioner claimed that the film, starring Kriti Sanon, Prabhas and Saif Ali Khan, hurts the sentiments of Hindus by unwarranted and inaccurate depiction of Lord Ram and Lord Hanuman in its promotional video, and sought an ad interim stay on the movie in its present form along with a permanent injunction.

    SRINAGAR: The Supreme Court on Monday refused to entertain a plea against a Jammu and Kashmir government circular directing all Deputy Commissioners to remove encroachments on Union Territory land, including Roshni land and Kachharie land, by January 31, reported BarAndBench.

    A bench of Justices MR Shah and BV Nagarathna was unconvinced with the argument of the petitioners that despite the Jammu & Kashmir State Land (Vesting of Ownership to Occupants) Act, 2001 (popularly known as the Roshni Act) being repealed, their ownership rights persisted.

    “You tell us what right you have.. not under Roshni Act – it has been struck down! …. The Act has been repealed. Once the Act has been repealed, where is the question of savings clause?,” the Court remarked.

    The bench also orally observed that if the Court were to grant relief to those continuing to occupy the land, it could have larger repercussions.

    “If we protect your possession, it will affect the entire J&K encroachment! At the most we can grant you reasonable time to relocate,” the Court said.

    The petitioner eventually sought to withdraw the petition and was allowed to do so by the Court.

    During the previous hearing, the bench had advised the petitioners to restrict their prayers to status quo rather than a blanket stay on the circular.

    “If stay (of order) granted then it will benefit land grabbers also,” Justice Shah had remarked.

    In 2001, the Jammu & Kashmir government had enacted a law called the the Roshni Act for granting ownership of state land to unauthorised occupants in order to raise funds for power projects in the erstwhile State.

    In October 2020, a Division Bench of Justices Gita Mittal and Rajesh Bindal of the High Court had declared the Act unconstitutional. All acts done under it as well as amendments under the Act were subsequently declared void ab initio.

    The Court had also ordered a Central Bureau of Investigation (CBI) probe into the Roshni land scam case, stated to be the biggest ever in the history of the ertswhile State.

    The Jammu & Kashmir government had then moved the High Court to review the said ruling. At the same time, appeals were also filed against the High Court judgment before the Supreme Court.

    Even as several review petitions challenging the High Court judgment were pending, the Union Territory, on January 9 this year, had directed all deputy commissioners to remove encroachment on such land by January 31, 2023.

    Residents were told to either demolish the structures on their own or bear the expenses for the demolition.

    The Supreme Court had, earlier this week, agreed to list the urgent application seeking a stay on the circular. Justice Sanjiv Khanna had earlier recused from hearing the matter.

    Delhi: Hours after a plea was moved in the Delhi High Court on Monday against the sexual assault allegations on Wrestling Federation of India (WFI) chief Brij Bhushan Sharan Singh by multiple wrestlers, it was withdrawn.

    Talking to IANS, Lawyer Shrikant Prasad said that Vicky, who was the petitioner, has asked us to withdraw the plea as the matter has been highlighted a lot.

    The lawyer further said that the motive to file the plea was about the misuse of law by women on sexual harassment and resorting to protests and there should be some guidelines set up in this context.

    In the plea, it is said that Phogat, who is also the first respondent in the plea, started blackmailing Bhushan for resigning from the post of WFI president on the pretext of protest against the sexual harassment of the wrestlers.

    It is said that the media thinks of itself as Janata Adalat and has started intervening in the proceedings of the court, the plea said.

    It is contended that wrestlers, instead of moving to court, have approached the media to show their concern, said the petition.

    In the petition, it has been argued that respondents (wrestlers) have crossed all their limits to approach the issue and that his reputation and dignity were being tarnished.

    It further claimed that sexual harassment laws were being misused and an extortion was being done on him.

    This writ petition is filed against the complete misuse of sexual harassment laws by the wrestler women, the petition read.

    It is in the petition that wrestlers are trying to get their own benefits out of this issue.

    A huge protest by the wrestlers at Delhi’s Jantar Mantar was called off following assurances from the Centre that grievances would be addressed and Brij Bhushan Sharan Singh was asked to step aside for four weeks.
