    Washington: In a move that could benefit tens of thousands of foreign tech workers on H1B and L1 visas, the US is planning to resume “domestic visa revalidation” in certain categories on a pilot basis with the goal of scaling it up in the next few years.

    The pilot project, to be launched later this year, when fully implemented, would be a big relief to thousands of Indian tech professionals in the United States.

    Until 2004, certain categories of non-immigrant visas, particularly the H1B, could be renewed or stamped inside the US. After that, for renewal of these visas, in particular, those on H1B, the foreign tech workers have to go out of the country, mostly to their own country to get the H1B extension stamped on their passport.

    For all the H1B visa holders, when their visa is renewed, they need to get their passports stamped with renewal dates. This is required if they wish to travel outside of the US and re-enter the US. As of now, H1B visa restamping is not allowed within the US.

    Restamping can only be done at any US consulate.

    This was a big inconvenience for foreign guest workers and also for their employees, particularly at a time when the visa wait time is more than 800 days or more than two years.

    The much-sought-after H1B visas are issued for three years at a time. The H1B visa is a non-immigrant visa that allows US companies to employ foreign workers in speciality occupations that require theoretical or technical expertise.

    Technology companies depend on it to hire tens of thousands of employees each year from countries like India and China.

    “We are working in earnest on plans to restart this service for certain petition-based NIV categories, and we hope to have a pilot up and running later this year. This would eliminate the need for these applicants to travel abroad to renew visas,” a State Department spokesperson told PTI.

    The State Department facilitated domestic visa revalidation until 2004 for applicants who were physically present in the US and renewing a visa in certain petition-based nonimmigrant visa (NIV) categories, the official said.

    “We cannot comment on how many visa holders would be initially eligible, but the pilot would begin with a small number of cases before scaling over the following 1-2 years,” said the State Department spokesperson in response to a question.

    Over the past few months, the Biden administration has taken several steps to streamline the visa processing system and reduce inconveniences.

    Notably, this was one of the recommendations of the President’s Advisory Commission on Asian Americans, Native Hawaiians, and Pacific Islanders, which now seems to have been implemented by the State Department.

    Under the existing rule, that came into force in 2004, the procedure for restamping H1-B and L visas is to visit the home country and submit their H1, and L1 visas, passports, and documents by way of a dropbox or interview.

    People have to wait months or years for H1-B visa stamping or sometimes they get no response after submitting all documents and get stuck for over 2 years in their home country. While their families are waiting in the US for him/her to come back, the presidential commission had argued in one of its meetings last year.

    Moved by a commission member, Ajay Jain Bhutoria from Silicon Valley, the presidential commission recommended that H1-B and L visas be allowed for restamping in the US by US Citizenship and Immigration Services (USCIS).

    It urged the USCIS to establish a separate department or unit to handle restamping of renewed H1-B and L visas within the US.

    The commission felt that the whole process has proven to be very painful for legal immigrants who are invited to work here in the US to support the US companies and the economy.

    New Delhi: The US Embassy in India has said that Indians who are travelling abroad can get a visa appointment at the US Embassy or consulate of their destination. It cited the example of Thailand, saying that the country has opened appointment capacity for B1 and B2 visas (business and travel) for Indians.

    The US Embassy in India took to its Twitter handle to make the announcement. In a tweet on February 3, the US Embassy in India stated, “Do you have upcoming international travel? If so, you may be able to get a visa appointment at the U.S. Embassy or Consulate in your destination. For example, @USEmbassyBKK has opened B1/B2 appointment capacity for Indians who will be in Thailand in the coming months.”

    Meanwhile, the US Embassy in India in another tweet informed that they have processed more than 1 Lakh visa applications. It further said that their team will grow this spring.

    The US Embassy in a tweet on February 4 stated, “This January, the U.S. Mission to India processed over 1 Lakh visa applications. That’s more than in any month since July 2019 and one of our highest monthly totals ever! And we aren’t done yet. Our capacity will continue to increase as our team grows this spring.”

    Earlier on January 21, the US Mission in India launched the first in a series of special Saturday interview days to reduce wait times for first-time visa applicants. The US Embassy in New Delhi and Consulates in Mumbai, Chennai, Kolkata and Hyderabad all opened consular operations on Saturday to accommodate applicants who require in-person visa interviews.

    “On January 21, the U.S. Mission in India launched the first in a series of special Saturday interview days, as part of a larger effort to reduce wait times for first-time visa applicants,” the US Embassy in India announced in a statement.

    The US Mission will continue to open additional slots for appointments to take place on select Saturdays, according to the statement released by US Embassy in India. These additional interview days is among the measures that have been taken to address the backlog in visa processing caused by COVID-19.

    The US Department of State has implemented remote processing of interview waiver cases for applicants with previous US visas. According to the statement, dozens of temporary consular officers from Washington and other embassies will arrive in India to increase processing capacity between January-March.

    The US Department of State is also increasing the number of consular officers permanently assigned to the Embassy and Consulates. The US Mission in India released more than 250,000 additional B1/B2 appointments, according to the statement released by US Embassy in India.

    Consulate General Mumbai has also extended its weekday operating hours to make space for additional appointments. According to the statement, the US Mission in India will be at full staffing by this summer and they expect to be processing visas at levels from prior to the COVID-19 pandemic.

    Abu Dhabi: The tourists in the United Arab Emirates (UAE) who have overstayed their visit visas are being prosecuted in absconding cases, local media reported.

    If a tourist does not leave the country within five days after their visas have expired, they are also at risk of being blacklisted and banned from entering the UAE or any other Gulf Cooperation Council country.

    As per a report by Khaleej Times, some of the travel agencies also issued a circular in this regard warning tourists who overstay even one day will be absconded without notice.

    Although the warnings are stern, they are from travel agencies and not from the competent immigration authorities.

    If the visitor is accused of absconding, he/she should clarify the case with the agent who issued his/her visa or the sponsor. Then, fines must be paid so the case can be withdrawn.

    It is reported that the minimum absconding penalty that must be paid is 2,000 Dirhams (Rs 44,916) and this increases every day.

    In fact, many visitors only become aware of an absconding case when they arrive at the airport, so travel agents insist on checking the length of your visa.

    New York: The low annual limit for US H-1B work visa petitions is currently the main problem facing employers trying to secure foreign-born talent, according to a new research.

    The H-1B visa denial rates have returned to low levels following the administration’s losses in federal court during former President Donald Trump’s last year in office, the National Foundation for American Policy (NFAP) said in a new study released on Thursday.

    In April 2022, the US Citizenship and Immigration Services (USCIS) reported employers submitted over 483,000 H-1B registrations, almost 400,000 above the 85,000-annual limit for H-1B petitions.

    The denial rate for (new) H-1B petitions for initial employment in FY 2022 was 2 per cent.

    The rate declined during the final year of the Trump administration after judges declared many of its H-1B-related actions unlawful.

    This led to a legal settlement and changes to restrictive immigration policies that resulted in the denial rate for new H-1B petitions for initial employment in FY 2021 dropping to 4 per cent — far lower than the denial rate of 24 per cent in FY 2018, 21 per cent in FY 2019 and 13 per cent in FY 2020.

    The research, based on data from the USCIS H-1B Employer Data Hub, also found that Amazon had the most approved H-1B petitions for initial employment in FY 2022, with 6,396, followed by Infosys (3,151) and TCS (2,725).

    The 85,000 new H-1B petitions allowed each year for companies represent only 0.05 per cent of the approximately 165 million people in the US labor force.

    An H-1B petition is often the only practical way to hire a high-skilled foreign national, including an international student.

    At US universities, more than 70 per cent of full-time graduate students in electrical engineering and computer and information sciences are international students.

    A 2022 NFAP study found 55 per cent of America’s startup companies valued at $1 billion or more have at least one immigrant founder, illustrating the importance and contributions of immigrants to the US economy.

    “Despite the end of the Trump administration’s restrictive immigration policies that made US companies less competitive in the global battle for talent, companies in America still must deal with the low annual limit on H-1B petitions and employment-based green cards,” said Stuart Anderson, NFAP’s executive director.

    “These and other policies encourage employers to send work and people outside the US and make it difficult for many talented people to pursue their dreams in America,” he added.

    Riyadh: The Kingdom of Saudi Arabia (KSA) launched a free stopover visa for visitors to stay in the Kingdom for up to four days, the Saudi Press Agency (SPA) reported.

    The Saudi Ministry of Foreign Affairs on Monday, January 2, launched the stop-over transit visa, effective immediately.

    The new Saudi visa is free and entitles its holder to a four-day stay in the Kingdom and will be valid for three months.

    The Ministry of Foreign Affairs, in coordination with the relevant authorities and cooperation with national airlines, launched the digital transit visa for stopover to facilitate the arrival in the Kingdom for all purposes, and the procedures for obtaining and automating an entry visa.

    The transit visa for stopover allows those in transit who wish to enter the Kingdom to perform Umrah and visit the Prophet’s Mosque, in addition to roaming and attending tourism events.

    When purchasing tickets to visit the Kingdom via Saudi Airlines, Flynas passengers will be automatically passed to the unified national visa platform at the Ministry of Foreign Affairs.

    When the request is processed, it will be automatically approved and emailed to the passenger.

    The Saudi Ministry of Foreign Affairs introduced the visa in order to boost tourism, as part of the Vision 2030 strategy.

    The new service comes within several steps taken by Saudi Arabia to support tourism and make it one of the main tributaries of the national economy and to enhance the Kingdom’s position as a global tourist.

    The Kingdom aims to attract investments worth 220 billion Saudi Riyals in the tourism sector by 2023, and 500 billion Saudi Riyals by 2030, according to previous statements by the Minister of Tourism.

    The annual revenues of the Saudi tourism sector exceed 211 billion Saudi Riyals, according to 2019 statistics.

    During 2022, Saudi Arabia topped the G20 countries in the rate of international tourist arrivals, according to the World Tourism Organization.

    Abu Dhabi: Indian expatriates in the United Arab Emirates (UAE) can now submit their applications for passport and visa services on all days including Sundays, local media reported.

    Indian outsourcing services provider for government and diplomatic missions, BLS International Service Ltd, will be open seven days a week, effective from January 22, 2023.

    Three centers located in Dubai and Sharjah will be open for submitting applications for passport and visa services on all days.

    Except for local government holidays, the center will be open for consular services throughout the year.

    “I reiterate our commitment to work for your well-being and well-being. To this end, since last week, the overseas service provider for passport and visa services has been operating on all days of the week.”

    Dr Aman Puri, Consul General of India, was quoted as saying by Khaleej Times.

    On Sundays, applicants may submit their filled application online with the required supporting documents on an appointment only basis from 9 am to 3 pm except for cases of Tatkal, Emergencies (medical treatment, death); senior citizens; who can apply on a walk in basis.

    Applicants are requested to book an appointment with BLS on the given link.

    Islamabad: India has issued visas to 249 Pakistani pilgrims to visit the tomb of Sufi saint Moinuddin Chishti in Ajmer, Rajasthan, an official said on Sunday.

    Citing a spokesperson of the Ministry of Religious Affairs and Interfaith Harmony, the state-run Radio Pakistan reported that 488 applicants had applied for visas, but only 249 pilgrims were granted visas.

    The spokesperson said that all the pilgrims have been informed to reach Lahore from where they will embark on a journey to India on Tuesday.

    He said six officials were deputed to take care of the pilgrims during their stay in India. However, only one of them was granted permission to go with the pilgrims, he added.

    The two counties allow pilgrims to travel under the Protocol on Visits to Religious Shrines, signed by India and Pakistan in September of 1974.

    However, it has been witnessed that the two sides routinely reject visas of pilgrims on various grounds.

    The additional interview days are one component of a multi-pronged initiative to address the backlog in visa processing caused by COVID-19.

    The Department of State has implemented remote processing of interview waiver cases for applicants with previous U.S. visas.

    In order to increase processing capacity, dozens of temporary consular officers from Washington and other embassies will arrive in India between January and March 2023.

    Apart from it, the Department of State is also increasing the number of consular officers permanently assigned to the Embassy and Consulates in Hyderabad and other cities in India.

    Consulate General Mumbai also extended its weekday operating hours to make space for additional appointments.

    By this summer, the U.S. Mission in India will be at full staffing, and it is expected that the processing of visas will reach levels that existed prior to the outbreak of the COVID-19 pandemic.

    The pandemic resulted in profound reductions in the department’s visa processing capacity, and many of US embassies and consulates were at times only able to offer emergency services.

    As travel restrictions have been lifted, the U.S. Mission to India has made it a priority to facilitate legitimate travel and adjudicated over 800,000 nonimmigrant visas in 2022, including record numbers of both student and employment visas.
