Bill to reform H-1B and L-1 visa programme introduced in US Senate

    [ad_1]

Washington: A group of influential lawmakers have introduced a bipartisan legislation in the US Senate to comprehensively overhaul the H-1B and L-1 visa programmes and usher in more transparency in the recruitment of foreign workers.

The H-1B visa is a non-immigrant visa that allows US companies to employ foreign workers in speciality occupations that require theoretical or technical expertise.

Technology companies depend on it to hire tens of thousands of employees each year from countries like India and China.

The L-1 is the other type of work visa the US issues to professionals looking to work in the country.

Unlike the H-1B, where an individual is looking to join an American company, the L-1 visa is issued to those who are already employed by the company in another country, and who are merely relocating to an American office.

Two influential Senators — Dick Durbin and Chuck Grassley — have introduced this legislation in the US Senate.

The co-sponsors include Senators Tommy Tuberville, Bernie Sanders, Sherrod Brown, and Richard Blumenthal.

The H-1B and L-1 Visa Reform Act will reduce fraud and abuse in the immigration system, provide protections for American workers and visa holders, and require more transparency in the recruitment of foreign workers, a media release said on Tuesday.
The legislation proposes to place new wage, recruitment and attestation requirements on employers looking to hire L-1 and H-1B workers, and employers seeking to hire H-1B employees to post those jobs on the Department of Labour (DOL) website, it said.

It also proposes to give DOL the authority to place a fee on labour condition applications and use it to hire an additional 200 DOL employees and make reforms to the H-1B programme by prioritising the H-1B visa issuance for workers with higher levels of education in STEM and amending the definition of a “specialty occupation” to require a bachelor’s degree or higher, according to the release.

The legislation seeks reforms to the L-1 nonimmigrant programme, including new time limits and evidentiary requirements for petitions from a “new office” and mandating cooperation from the Department of State in verifying foreign affiliates.

“For years, outsourcing companies have used legal loopholes to displace qualified American workers and replace them with foreign workers who are paid sub-par wages and put under exploitative working conditions,” Democratic Party Senator Durbin said.
“These actions hurt all workers and make our country less attractive to the world’s top talent. Our legislation would fix these broken programs, protect workers, and put an end to these abuses,” he explained.

The H-1B and L-1 visa programmes were established to fill in gaps in America’s high-skilled workforce, not supplant it, Grassley, a Republican, said.

“Unfortunately, some companies have exploited these programmes to replace American workers with cheaper labour, which ultimately harms American workers and foreign labour alike. Our bill puts American workers first and ensures that the programmes promote fairness for all workers,” he said.

Durbin and Grassley, long-time advocates for H-1B and L-1 visa reform, first introduced the legislation in 2007.

Authors of this legislation said the H-1B and L-1 Visa Reform Act would stop these abuses by closing loopholes in these programmes.

The legislation will also crackdown on companies that hire large numbers of H-1B and L-1 workers to displace American workers and facilitate the outsourcing of American jobs, the media release added.

Thousands of highly skilled foreign-born workers, including Indians, in the US, have lost their jobs due to the series of recent layoffs at companies like Google, Microsoft and Amazon.

According to The Washington Post, nearly 200,000 IT workers have been laid off since November last year.

Industry insiders say that between 30 to 40 per cent of them are Indian IT professionals, a significant number of whom are on H-1B and L1 visas.

  • H1B visa cap for FY 2024 reached

H1B visa cap for FY 2024 reached

    [ad_1]

New York: The US has received a sufficient number of applications needed to reach the Congressionally mandated 65,000 H1B visa cap for the fiscal year 2024.

The US Citizenship and Immigration Services (USCIS) said on Monday that it has received enough electronic registrations during the initial registration period to reach FY 2024 H1B numerical allocations, including the advanced degree exemption (master’s cap).

“We have randomly selected from the registrations properly submitted to reach the cap, and have notified all prospective petitioners with selected registrations that they are eligible to file an H1B cap-subject petition for the beneficiary named in the applicable selected registration,” the USCIS said.

H1B cap-subject petitions for FY 2024, including those petitions eligible for the advanced degree exemption, may be filed with USCIS beginning April 1, 2023, if based on a valid, selected registration.

Only petitioners with selected registrations may file H1B cap-subject petitions for FY 2024, and only for the beneficiary named in the applicable selected registration notice.

The H1B is a non-immigrant visa that permits US companies to hire foreign workers in speciality occupations, which require theoretical or technical expertise.

It is the most sought-after work visa among foreign professionals, including Indians.

  • Visa applications from Delhi reach 80% of pre-pandemic levels

Visa applications from Delhi reach 80% of pre-pandemic levels

    [ad_1]

New Delhi: Visa applications from the national capital nearly touched the pre-pandemic levels last year, driven by pent-up demand, the opening of international borders and eased Covid-related protocols, a report showed on Thursday.

According to VFS Global, the visa application volume from New Delhi reached close to 80 per cent of the 2019 pre-pandemic levels in 2022 and registered a 93 per cent growth when compared to 2021.

This trend of rise in visa application volume from New Delhi is in line with the overall growth registered in India, which was also close to 80 per cent of the pre-pandemic levels in 2022.

“We witnessed unprecedented demand from India in 2022 which led to an extended peak outbound travel season with steady volumes witnessed until December. We are confident that the momentum will further grow and hence it is advisable for applicants to apply for their visas in advance to avoid last-minute surprises,” said Prabuddha Sen, Chief Operating Officer-South Asia, VFS Global.

Premium optional services such as Visa At Your Doorstep (VAYD) which enables travellers to book the entire visa experience at a location of their choice, witnessed around 90 per cent year-on-year rise in 2022.

“Health considerations continue to be a key determining factor in the new normal. As a result, we see an increasing number of travellers opt for such services that provide a seamless visa experience and prioritise safe travel,” Sen added.

According to the revised Schengen Visa Code, one can apply for a Schengen visa up to six months before the date of travel.

“Particularly this year with higher demand and limited appointment slots available, we urge applicants to apply for their visa as early as possible,” said the company.

Visa applicants are advised to beware of fraudulent entities who charge fees from customers for scheduling appointments or providing any other services using VFS Global’s name or independently.

VFS Global operates a global network with more than 3,400 application centres in 145 countries. The company has processed over 256 million applications since its inception in 2001. VFS Global is majority-owned by funds managed by Blackstone, the world’s largest alternative asset manager.

The tourist visa was launched in 2019 to keep pace with the development and growth of the tourism sector. On March 9, Saudi Arabia announced a major change to the visa application process for residents of the GCC countries.

Residents of the GCC can now apply for tourist visas regardless of their profession. The visa will be valid for tourism and Umrah visits and is available in the form of single entry or multiple entries.

  • International students can apply for US visa a year in advance: State Department

International students can apply for US visa a year in advance: State Department

    [ad_1]

Washington: In a much-needed relief for foreign students looking to study in the US, the Biden administration has announced they can now apply for a visa up to a year before their academic term begins.

The State Department, however, said that international students will not be allowed to enter the country on a student visa more than 30 days before the start of their programme.

International students are normally issued two categories of US visas – F and M. “Student (F and M) visas for new students can be issued up to 365 days in advance of the start date for a course of study,” the State Department said.

“However, you will not be allowed to enter the United States on your student visa more than 30 days before the start date,” it said on Tuesday.

A student can enter the US before 30 days of the start of their programme on a valid visitor (B) visa.

A student visa is issued by US embassies and consulates based on the I-20 form issued by their academic institutions.

The State Department mandates that all students must be registered in the Student and Exchange Visitor System (SEVIS).

The spouse and minor children, if they intend to live in the United States with the student, each need to receive an individual Form I-20 from the academic institution of the student, it said.

According to the State Department, foreign students in the United States with F visas must depart the US within 60 days after the programme end date listed on Form I-20, including any authorised practical training.

The new announcement means that universities can accept and issue I-20 forms 12-14 months before term time.

Earlier, visa interviews could be scheduled only up to 120 days, and I-20 forms 4-6 months before the term started.

The update comes after Deputy Assistant Secretary for Visa Services, Julie Stufft told PTI the US is “putting every ounce of its energy” to eliminate the long visa wait time in India.

India broke the record for most student visas last year and it may do so this year again, she said, adding that India is now number two in the world in terms of international students coming to the United States.

“We are really, we’re putting all of our efforts now focusing on this visa for visitors and those, in particular, if you don’t need an interview, you don’t need to wait very long at all for a visa renewal. And that’s also one part of our strategy as well,” she said.

There have been growing concerns in India over the long waiting period for first-time visa applicants, especially for those applying under B1 (business) and B2 (tourist) categories.

The waiting period of first-time B1/B2 visa applicants in India was close to three years in October last year.

India was one of the very few countries where applications for US visas saw a major upswing after coronavirus-related travel restrictions were lifted.
