    New Delhi: A plea has been moved in the Supreme Court seeking direction to various state governments — West Bengal, Bihar, Gujarat, Maharashtra, Karnataka, Jharkhand, and Telangana — to assess the loss of properties and injuries suffered by people during the violence which erupted during ‘Ram Navami’ processions and provide adequate compensation.

    Advocates Vishnu Shankar Jain and Hari Shankar Jain filed the plea on behalf of “Hindu front for Justice”. The plea submitted that in Tehseen Poonawalla case (2018), the apex court had laid down guidelines for the state government to take necessary measures to prevent hate crimes but the respective state governments have not taken any steps in accordance with the guidelines issued by the top court. In case the guidelines would have been followed, the “shameful act” on Ram Navami day might not have occurred, it added.

    The plea said: “It is unfortunate that in independent India, Hindus are not being allowed to take our religious processions peacefully and to observe their customary rites and rituals and the same is being disturbed by a group of Muslims and the respective state governments have failed to take appropriate steps to prevent such mis-happenings”.

    The plea cited large scale violence, and arson committed in an alleged pre-planned manner in various parts of the country: Hyderabad (Telangana), Aurangabad (Maharashtra), Howrah, Uttar Dinajpur (West Bengal), Sasaram and Nalanda (Bihar), Vadodara (Gujarat), Jamshedpur (Jharkhand) etc.

    The plea contended that it is unfortunate that West Bengal Chief Minister Mamata Banerjee talked about ‘Muslim dominated areas’ and asked the Hindus not to take out processions through such areas. “This concept is against the very theme of the Constitution. There is no area that can be considered as a ‘Muslim dominated area’. Every citizen of the country has the right to take out religious procession through public roads in a peaceful mannera..”, it contended.

    The plea sought a direction to state governments to recover the loss caused to the persons committed in connection with Ram Navami festival from miscreants after due verification. “Direct the concerned state governments to determine the loss incurred by the persons who sustained injuries and lost their valuables in the attacks committed by miscreants in observing Ram Navami festival on 29/30/31.03.2023 and thereafter and pay suitable compensation to the victims,” it added.

    The plea also sought a direction to state governments to take preventive measures so that in future the incident of attacks or disturbing the Shobha Yatra on Ram Navami festival and other festivals may not take place.

    The application has been moved in a pending petition of Qurban Ali in connection with hate speech.

    Hyderabad: A recent report on communal violence in 13 states during Ram Navami and Hanuman Jayanthi in 2022 said that Telangana proved that it is possible to take out religious processions while also maintaining peace and harmony.

    The report Routes of Wrath is written by the Citizens and Lawyers Initiative. Former Supreme Court judge Rohinton Nariman, in the foreword, praised the Telangana police force as well as Telangana High Court for ensuring peace and harmony existed between Hindu and Muslim communities during the Ram Navami and Hanuman Jayanti festivities.

    The report examined how “…in state after state, including some under non-Bharatiya Janata Party (BJP), outwardly secular chief ministers, the routes permitted for Ram Navami and Hanuman Jayanti processions, and of course their timings and the freedom to halt in front of major mosques, led invariably to rioting”.

    Stating that the appalling loss caused by marauding mobs was followed by the brutal destruction of homes and shops by tyrannical administrations, the report said that the violence was neither inevitable nor unavoidable.

    The report said that “elementary precautions taken by the state administration and the police authorities in Telangana, which were strongly endorsed and backed up by Justice Lalitha Kanneganti, resulted in absolute peace and harmony even though huge Ram Navami processions were taken through Hyderabad and Bhainsa”.

    Analysing the strict limits imposed by different police commissioners on Ram Navami Shobha Yatras held on April 10, 2022 in different parts of the state, the report speculated that the orders must have come from either the chief minister or the home minister.

    “The takeaway from Telangana’s handling of these religious processions is that where the administration and the courts wish to prevent communal clashes and riots even while allowing religious processions, they can,” said the report.

    Justice Lalitha Kanneganti balanced the constitutional right of Hindus to take out a religious procession, with the need to maintain peace and harmony in a secular nation, and allowed the procession while making it subject to stringent conditions, added the report.

    New Delhi: In the wake of communal violence in West Bengal and Bihar, Rajya Sabha MP Kapil Sibal on Sunday questioned the “silence” of Prime Minister Narendra Modi over the matter, and said “let not 2024 general elections be the reason” for the violence.

    Sibal appealed to the people of the country to put a stop to the “burning of Bengal and Bihar, and to the seeds of hatred” which, he said, can only benefit politicians and political ideologies.

    The ordinary man becomes a victim of this hatred, he said in a statement.

    “I want the prime minister (Modi) to speak up, I want the home minister (Shah) to speak up and condemn the violence. It is unfortunate that in the midst of this violence neither of them have spoken, why are they quiet,” he asked.

    “It is my earnest appeal to all those, and it may not be about one particular party, who are responsible for this madness. The country needs to move forward away from the environment that is being created. Let not 2024 be the reason for this,” the former Union minister said.

    Sibal said let the rule of law prevail.

    Sources said Home Minister Amit Shah on Sunday expressed concern over incidents of communal violence in Bihar, and spoke to Governor Rajendra Vishwanath Arlekar to take stock of the situation.

    Sibal said it was not enough to express concern.

    His statement comes after communal violence rocked Sasaram and Bihar Sharif towns during Ram Navami festivities.

    The police till Saturday arrested 45 people in connection with the communal violence at Sasaram and Bihar Sharif.

    Vehicles, houses and shops were torched and several people injured in the communal flare-ups reported in both towns.

    Howrah’s Shibpur and Kazipara area in West Bengal had also witnessed clashes during a Ram Navami procession.

    Sibal, who was a Union minister during the UPA 1 and 2 regimes, quit the Congress in May last year and was elected to the Rajya Sabha as an independent member with the Samajwadi Party’s support.He recently floated a non-electoral platform ‘Insaaf’ aimed at fighting injustice.

    Tensions remained high in Bihar even a day after Ram Navami, as new violence in Rohtas and Nalanda districts yesterday, the police said.

    One person was murdered and many others were injured in Nalanda’s Biharsharif during skirmishes between two groups last evening, while six others were hurt in a bomb blast in Rohtas district’s Sasaram town.

    The blast occurred at a residence in Sasaram, the police said and a two-wheeler was retrieved from the scene.

    To ensure law and order in the region, police have issued prohibitory orders in Nalanda. On Friday, clashes were reported in both districts.

    Since Thursday, tensions have been mounting over the removal of Ram Navami processions. By Friday afternoon, the tension had escalated into full-fledged fights, with both sides throwing stones at one other.

    District Magistrate of Nalanda Shashank Shubhankar stated that at least 80 persons have been detained, and community leaders are organising meetings to urge people to keep the peace.

    Senior officials are present in the affected districts, and security has been enhanced in Nalanda and Rohtas, they said, adding that social media is also being monitored to avoid the transmission of false or inflammatory news.

    Home Minister Amit Shah, who was due to visit Sasaram today, spoke to Bihar Governor Rajendra Arlekar on Sunday about the state’s violent situation.

    After communal tensions in the area, Shah cancelled his trip to the state.

    Patna: A day after violence erupted during Ram Navami Shobha Yatra, some people were involved in looting shops in Bihar’s Nalanda, an official said.

    The accused were caught on CCTV cameras looting in the shops located at Nala road area under Laheri police station. They looted the shops in the garb of violence in the affected area.

    The traders shut their shops in fear of violence and anti-social elements looted the valuables in the garb of violence.

    Shashank Subhankar, the Nalanda District Magistrate, said: “We have detained 27 persons for questioning. Besides, CCTV cameras are being scanned to identify the offenders. The process of analysing the loss is currently underway and the victims will be compensated.”

    “We are analysing the loss of properties in the district. The victims will be compensated after the analysis. The number of private and government properties were damaged in the violence,” he added.

    “We have initiated flag marches in the affected area and deployed adequate forces there to prevent any untoward incidents,” said Ashok Mishra, Nalanda Superintendent of Police.

    Sasaram Superintendent of Police, Vineet Kumar, said: “The district police have deployed adequate security forces in the affected area. We also did the flag march. Some rumours were also spread that people are migrating from the district which is absolutely false. We are keeping an eye on those people who are spreading lies on social media.”

    Kolkata: Trinamool Congress on Saturday questioned the decision of West Bengal Governor C. V. Ananda Bose to set up special cell for real time monitoring the situation at Howrah’s Shibpur- Kazipara area in wake of the clashes over a Ram Navami procession that started on Thursday and continued till Friday afternoon.

    On late Friday afternoon after the Governor took a detailed report from the state chief secretary H. K. Dwivedi and the state home secretary B. P. Gopalika about the situation in the tension-prone area, a strong-worded statement was issued by the Raj Bhavan from where the decision to set up this special monitoring cell was announced.

    “Governor ordered real time monitoring of the situation and constituted a special cell for the same,” the statement of Raj Bhavan read.

    The statement also mentioned about “a confidential discussion to review the situation” between the Governor and Chief Minister Mamata Banerjee.

    On Saturday, Trinamool Congress’ state general secretary and the party’s spokesman in West Bengal Kunal Ghosh said that it is not clear whether the decision to set up the special monitoring cell was just a verbal announcement or there had been formal notification in the matter.

    Raising doubts over whether there are legal provisions on whether such a cell can be set up by the Raj Bhavan, Ghosh also expressed apprehension that in case the said cell procures information from independent or private sources, doubts will remain whether the information received was authentic or not.

    However, BJP’s state spokesman Samik Bhattacharya has justified the setting up of the special monitoring cell by the Raj Bhavan.

    “As the constitutional head of the state it is the duty of the Governor to protect the democratic rights of the citizens of the state. So, he is well within his limits to order the opening up of the cell just as he sought reports of the situation from the state chief secretary and state home secretary,” Bhattacharya said.

    Patna: Following the imposition of section 144 in Sasaram, BJP on Saturday cancelled the rally of Union Home Minister Amit Shah.

    Bihar BJP President Samrat Chaudhary confirmed the development. He said that the district administration has imposed section 144 at the venue and in the entire Sasaram city, how could it be possible to organise an event there?

    Chaudhary, however, said that Shah’s rally in Nawada will take place at the scheduled time on Sunday.

    “It is extremely unfortunate that the Bihar government has failed to provide security to our men. Our supporters are being attacked by a section of people. The district administration has imposed section 144 in the city. Hence, how could it be possible to organise an event there?” Chaudhary said.

    The BJP had a pre-scheduled programme at Sasaram to celebrate the birth anniversary of Samrat Ashok. The district has a significant number of people from Kushwaha community and BJP wants to get their support. Kushwaha community is in the target list of BJP to hurt the Lav-Kush equation of Nitish Kumar-led JD-U. Hence, an event was organised for Union Home Minister Amit Shah in Sasaram city.

    The district administration imposed section 144 in Sasaram after a massive clash broke out between two groups over Ram Navami Shobha Yatra on Friday afternoon. Two houses, some shops and several vehicles were set on fire after a section of people pelted stones and bricks on the Shobha Yatra.

    “Nitish Kumar has not done anything for Samrat Ashok. Due to the BJP, he did some work after 2015. If he has done anything for Samrat Ashok before 2015, he needs to mention it in public domain,” he said.

    When asked about the Nawada rally, Chaudhary said that section 144 is not imposed in Nawada, hence the pre-scheduled programme of Nawada will take place at the scheduled time. Amit Shah is coming to Patna today and he will go to Nawada to attend the programme,” Chaudhary said.

    Besides Sasaram, violence also erupted in Nalanda district over Ram Navami Shobha Yatra on Friday.

    Kolkata: West Bengal Chief Minister Mamata Banerjee on Friday asserted that neither Hindus nor Muslims, but the BJP and other right-wing organisations were behind the violence in Howrah’s Kazipara area during a procession on Ram Navami.

    She also appealed to the people of both communities to maintain peace and law and order in the area.

    Banerjee admitted that it was a failure on part of the police and said strict action will be taken in this regard.

    “I am lucky that no one was killed in yesterday’s clash,” Banerjee told news channel ABP Ananda.

    The Trinamool Congress supremo announced that those affected in the clash and had their houses and shops vandalised would be compensated by the state government.

    “I have been appealing to the people to carry out Ram Navami processions peacefully. No government incites people to carry out vandalism. It was the BJP, Bajrang Dal and some of their allies who directly carried out the vandalism,” Banerjee said.

    She alleged that the BJP incited similar clashes at around 100 places in the country.

    “Howrah’s incident is very unfortunate. I had repeatedly given instructions that the processions should not pass through that area. I am telling you, it’s neither the Hindus nor the Muslims who carried out yesterday’s attacks.

    “Criminals used guns, petrol bombs and several other materials including bulldozers to enter the area and attacked those who were fasting during Ramadan month and carried out devastations at shops and residences,” she added.

    Banerjee said that the police officers who failed in carrying out their duty properly on Thursday will face strict action.

    “I will appeal to all and both the communities to have faith in me and maintain peace. I know how to handle this situation,” she said.

    Talking more on the incident, Banerjee expressed her apprehensions that the BJP-led central government would be sending probe agencies to the state in connection with the clashes in Howrah.

    “Bengal is a peaceful team… But in this context they (the BJP-led central government) will send agencies,” she said.

    Later, police said that 45 people have been arrested in connection with their alleged involvement in Thursday’s vandalism in Howrah.

    Mumbai: Maharashtra Governor Ramesh Bais on Friday asked Chief Minister Eknath Shinde to ensure that stern action was taken against those involved in an attack on a police station in Aurangabad city.

    Bais had a telephonic conversation with Shinde, Raj Bhavan sources said.

    At least 12 persons including ten policemen were injured on Thursday after a mob of around 500 people hurled stones and petrol-filled bottles when cops tried to control the situation following a clash between two groups near a Ram temple in Kiradpura locality of Aurangabad.

    One person succumbed to injuries during the day while police have arrested seven persons in connection with the violence.
