    Delhi HC orders Google to remove YouTube videos claiming Indian spices contain cow dung, urine

    New Delhi: In view of some videos posted on YouTube channels claiming that all Indian spices contain cow dung and cow urine, the Delhi High Court has ordered Google to take them down.

    These videos targeted several Indian brands, including ‘Catch Foods’.

    Justice Sanjeev Narula of the Delhi High Court prohibited the Two YouTube channels from defaming and violating the copyright of the conglomerate Dharampal Satyapal Sons Pvt Ltd, which is the owner of goods sold under the ‘Catch’ brand.

    The court observed that the videos contained defamatory words without any justification.

    Stating that the defendants made such fraudulent statements and spread false information under the guise of disclosing truth or facts concerning Indian spices, the court noted that there was no authoritative material or underlying cause for this.

    The court said: “The impugned videos contain defamatory remarks against the plaintiff’s products without any basis. The plaintiff has placed on record a list of ingredients contained in its products/spices advertised in the impugned videos. It has obtained certification from all the concerned regulatory bodies and has even presented reports of an independent food analysis by a certified laboratory, which do not indicate presence of cow dung, cow urine or any other contaminants, as alleged in the impugned videos.”

    Google had already been directed to disable access to the videos and provide the basic subscriber data, which it did and later summons were issued to TVR and Views News. As they did not show up, the court decided to continue ex-parte.

    Rule 4(4) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, which mandates additional due diligence to be observed by social media intermediaries in case such content is uploaded or streamed online, was also brought to the court’s attention by the plaintiff who urged for a summary judgement.

    The court observed that the defendants’ failure to take action to remove the infringing content notwithstanding the plaintiff’s complaint, which was also confirmed by one of the defendants, demonstrated mala fide intentions.

    As a result, the court decreed the suit against the defendants. It directed that in the event the videos appear again, the plaintiff might give Google the URLs, and Google will be required to take the appropriate steps to ensure that they are removed.

    The court made it clear that if the content is different, Google could let the plaintiff know within a week and the plaintiff could then take appropriate legal action.

    “The filing of a notice of intent to use CCTV video should have caused Attorney Watkins to request that sentencing be postponed in order to obtain from the government all video evidence of Mr. Chansley from inside the Capitol,” Shipley wrote. “By not securing the video and determining whether it supported Mr. Chansley’s description of events, Attorney Watkins allowed the Government to take liberties in describing Mr. Chansley’s conduct while inside the Capitol, without fear of the unproduced videos contradicting the Government’s claims.”

    Chansley pleaded guilty in September 2021 to obstruction of an official proceeding.

    The new motion was prompted by video footage that House Speaker Kevin McCarthy shared exclusively with Tucker Carlson, then of Fox News, earlier this year. Some of the video Carlson aired showed police appearing to open a door for Chansley and to direct him through various hallways in the Capitol.

    Prosecutors claimed in correspondence with Shipley that almost all the videos aired during Carlson’s program last month were made available to his then-attorney and others on a data-sharing platform in October 2021. However, Shipley asserts that prosecutors in another case said the videos were uploaded the prior month “and it is quite likely that both [claims] are false.”

    In addition to claiming Chansley’s lawyer didn’t explore the video issue sufficiently, the motion argues that prosecutors violated Chansley’s rights by failing to isolate and highlight the videos Shipley contends are exculpatory. Prosecutors have argued that they fulfilled their obligations by turning over a massive trove of video evidence to all defendants and by alerting defendants to relevant videos that prosecutors were aware of.

    The motion is likely to have little direct effect on the most significant element of Chansley’s sentence — his time spent behind bars — because he was released last month from a federal prison in Arizona and sent to a halfway house. A federal prisoner database shows he’s scheduled for release from custody in May. He served only about 27 months of his 41-month sentence due to various policies crediting prisoners with so-called “good time” and allowing for transition programs like halfway houses.

    Shipley did not immediately respond to a request for comment Thursday night on what concrete benefit the motion can achieve for Chansley at this juncture, but the motion suggests that the video footage undermines prosecutors’ claims that Chansley intended violence when he entered the Capitol. U.S. District Court Judge Royce Lamberth, who sentenced Chansley and will handle the new motion, applied an enhancement for use of violence that more or less doubled the recommended sentence for Chansley.

    Lamberth, an appointee of President Ronald Reagan, also ruled early in Chansley’s case that a finial on an American flag he carried in the Capitol could have been used as a spear so it qualified as a weapon. The finding supported Lamberth’s decision to deny Chansley release on bond.

    Whatever the actions of the police, prosecutors have contended that Chansley acted in a manner that was unambiguously threatening. After going onto the Senate floor, he went up on the dais, writing and leaving a note saying: “It’s only a matter of time. Justice is coming.” Chansley has contended he was “peaceful” on Jan. 6, never engaging in the violence some other protesters did.

    Watkins and a spokesperson for the U.S. Attorney’s Office in Washington also did not respond to messages Thursday night seeking comment on the filing.

    Srinagar, April 01: Body of minor girl who slipped into an irrigational canal in Perniya area of North Kashmir Baramulla district on Saturday has been recovered.

    An official told Kashmir Scroll that morning a girl while waiting for the school bus along LJHP canal slipped and fell into the canal.

    The girl has been identified as Rukaya Bashir (14) daughter of Bashir Ahmad Ganaie resident of Nowpora Kreeri who is student of 9th class, Syed Sakhi Nowshera high school.

    Soon after the incident, rescue operation was started and after hectic efforts, body was retrieved almost a kilometre away from whe she had drowned, official said.

    He said that body is being handed over to legal heirs after legal-medico formalities.

    SRINAGAR: The District Legal Services Authority Budgam on Saturday directed Senior Superintendent of Police Budgam to lodge FIR against the persons who have uploaded the videos and pictures of the lady killed brutally in the district.

    The District Legal Service Authority (DLSA), District Court Complex Budgam in an order has directed Senior Superintendent of Police (SSP) Budgam to lodge FIR against the persons, who have uploaded and circulated the pictures and videos of victim.

    “It has been observed that the media and general public have been circulating the videos of the recent victim of Soibugh Budgam, who was murdered brutally. Moreover, the pictures of the victim and the videos of her autopsy have also been uploaded and circulated by a number of persons, thereby violating the right to privacy of the victim and her family. Such actions of the above persons and agencies are against law wherein the identity of the victim is revealed and even her private videos have been uploaded and circulated including the video of the autopsy of the deceased victim, which is punishable under law,” the order reads.

    It added that as such, the media and general public is informed  to stop revealing the identity of the victim and also circulating her pictures immediately, failing which, the violators shall be booked under law.

    “Hence, the SSP Budgam is directed to lodge FIR against the persons who have uploaded and circulated the pictures and videos of the victim,” it added.

    Further, Ld. Special Mobile magistrate Budgam is requested to direct the concerned social media agencies to remove the pictures and videos of the victim from all social media platforms and also block the accounts of such violators, it added. (KNO)

    Patna: Manish Kashyap, a YouTuber wanted by the Bihar Police for allegedly sharing fake videos of “attacks on migrant workers in Tamil Nadu”, surrendered before the law enforcers in West Champaran district on Saturday, a statement said.

    The Economic Offences Unit (EOU) of Bihar Police has registered three cases against Kashyap and others on the charges of “indulging in spreading fake videos of migrants being killed and beaten up in Tamil Nadu on social media”.

    The EOU has also frozen four bank accounts belonging to Kashyap.

    “Kashyap, wanted by Bihar Police and Tamil Nadu Police in fake news matter of labourers issue in the southern state, surrendered before the police on Saturday fearing arrest and attachment of his belongings,” a statement issued by the EOU said.

    “Six teams constituted by the EOU along with Patna and Champaran Police were continuously conducting raids on his locations at various places and hideouts since yesterday (Friday). He surrendered at Jagdishpur police station of Bettiah on Saturday fearing arrest and other legal action,” it added.

    The EOU had on March 6 registered its first FIR in connection with the case and booked four persons, including Kashyap.

    EOU sleuths have already also arrested Aman Kumar from Jamui in connection with its investigation into the first FIR. Those named in that FIR included Aman Kumar, Rakesh Tiwary, Yuvraj Singh Rajput and Manish Kashyap.

    J S Gangwar, Additional Director General of Bihar Police (Headquarters), had told reporters last week that the EOU probe has found that 30 fake videos of migrants getting beaten up and killed in Tamil Nadu were widely shared on social media, spreading panic among the labourers and forcing them to flee the southern state.

    The Tamil Nadu Police has also registered 13 cases to probe the matter.

    Earlier, the Bihar government had also sent a four-member team of top officials to Tamil Nadu to coordinate with officers who were investigating the matter in the southern state.

    San Francisco: Microsoft plans to release GPT-4 as early as next week, with the ability to create AI-generated videos from simple text prompts.

    Andreas Braun, Chief Technology Officer at Microsoft Germany, recently confirmed that GPT-4 will be unveiled next week at an event called — AI in Focus — Digital Kickoff, reports Windows Central.

    “We will introduce GPT-4 next week, where we have multimodal models that will offer completely different possibilities – for example, videos,” Braun was quoted as saying.

    The report said that GPT-4 is the next iteration of OpenAI’s Large Language Model (LLM), and it should be significantly more powerful than GPT-3.5, which powers the current version of ChatGPT.

    ChatGPT and other GPT-3.5-powered technologies are currently limited to text-based responses.

    However, Braun’s comments imply that this may change with the release of GPT-4.

    The multimodal models of the LLM could pave the way for video production and other types of content, according to the report.

    Meanwhile, the AI-powered Bing search engine has surpassed 100 million daily active users, as ChatGPT’s integration into Bing has helped the company grow its usage within a month like never before.

    Its rival Google Search engine has more than 1 billion daily active users.

    Roughly one-third of daily Bing preview users are using AI chat daily.

    Patna: Days after the arrest of a man for allegedly sharing “fake” videos of attacks on migrants in Tamil Nadu on social media, the Bihar Police on Friday registered a fresh FIR against four persons as part of its probe into the case.

    The Economic Offences Unit (EOU) of the state police filed the FIR against Youtuber Manish Kashyap, Yuvraj Singh and two others “on the charges of indulging in spreading fake videos of migrants being killed and beaten up in Tamil Nadu on social media”, a senior officer said.

    “Despite repeated summons by investigators, both Manish Kashyap and Yuvraj Singh did not turn up before the EOU sleuths. They are absconding. Now the EOU has initiated a process to arrest them,” Bihar Police (Headquarters) Additional Director General JS Gangwar told reporters here on Friday.

    The EOU had on March 6 registered its first FIR in connection with the case and booked four persons.

    Those named in the case are Aman Kumar, Rakesh Tiwary, Yuvraj Singh Rajput and Manish Kashyap.

    It had already arrested Kumar from Jamui in connection with its probe into the case.

    “Investigations by the EOU have revealed that the accused were indulging in spreading fake videos of migrants being killed and beaten up in Tamil Nadu on social media. Thirty such videos were shared on social media, forcing migrant workers from Bihar to flee Tamil Nadu in panic”.

    Notices have already been sent to social media service providers for “preserving 42 such videos for further investigation”, the ADG said.

    “A 10-member team of the EOU is analysing these videos…and those posting and sharing such videos for spreading rumours will be dealt with strictly. The Tamil Nadu police have also registered 13 cases to probe the matter,” Gangwar said.

    The Tamil Nadu administration has opened help desks for the people to lodge complaints against those who are indulging in such activities and also for those who need any assistance, he said.

    The Bihar government had, last week, sent a four-member team to the southern state to coordinate with officers who were investigating the matter there.

    Chennai: As various social media content of alleged attacks on migrant workers from Tamil Nadu have turned out to be fake, Chief Minister M K Stalin has alleged the “lies spread” regarding such assaults in the State was a fallout of his recent call for opposition unity to dislodge the ruling BJP at the Centre next year.

    He blamed the saffron party functionaries for doing so.

    A Facebook user shared a video of an overcrowded passenger train claiming that migrants from Bihar were returning to their home state in large numbers from Tamil Nadu. In its investigation, the PTI Fact Check found that the train in the video posted on social media travels between Bihar’s capital city Patna and Barka Kana in Jharkhand.

    It doesn’t travel from Tamil Nadu to Bihar, as the social media post claims. The unrelated video was shared on social media with a misleading claim.

    A Facebook user shared a video which purportedly showed a train teeming with people. The text in the video reads Tamil Nadu to Bihar’, which implied that they were migrant workers from Bihar leaving the southern state.

    Earlier too, a social media post showing purported clipping of a Hindi newspaper, claiming it reported the alleged killing of the Hindi-speaking migrant labourers in Tamil Nadu turned out to be fake following an investigation by the PTI Fact Check Desk.

    Stalin, in his “Ungalil Oruvan” question and answer series, asserted no migrant worker in the State has been assaulted as alleged.

    Many such workers were employed in Tamil Nadu for a long time and never have they faced any issues, the chief of the ruling DMK said.

    “Some have been preparing fake videos and spreading lies. The BJP functionaries in north India have done this with an agenda. You will understand the conspiracy behind doing so, if you notice that such lies were spread the very next day I highlighted the need for political organisations opposed to the BJP joining hands at the national level,” he said.

    At his birthday rally here on March 1, attended by leaders including Congress president Mallikarjun Kharge, Stalin had stressed for opposition unity to defeat the BJP in the 2024 Lok Sabha polls.

    The Chief Minister said that soon after he received information about the alleged attacks, he enquired if the migrant workers were targeted anywhere in the State and it emerged that it was not the case.

    “I have informed Bihar chief minister Nitish Kumar that not even a small irritation has been caused (to the workers),” he said, adding the official delegation from that state which had visited TN over the issue has returned with ‘satisfaction.’
