  • DOJ cites threats to democracy on Jan. 6 in push for steep Oath Keepers sentences

DOJ cites threats to democracy on Jan. 6 in push for steep Oath Keepers sentences

    [ad_1]

    capitol riot investigation 29499

“As this Court is well aware, the justice system’s reaction to January 6 bears the weighty responsibility of impacting whether January 6 becomes an outlier or a watershed moment,” Assistant U.S. Attorney Jeffrey Nestler wrote in the 183-page sentencing memo. “Left unchecked, this impulse threatens our democracy.”

Prosecutors cited polling from earlier this year showing that one in five Americans believe political violence is sometimes justified and that one in 10 “believes it would be justified if it meant the return of President Trump.”

Rhodes was charged with seditious conspiracy last year alongside nearly a dozen Oath Keepers for their roles in the Jan. 6 attack. Prosecutors alleged that Rhodes embraced Donald Trump’s false claims that the 2020 presidential election was stolen and used it to mobilize Oath Keepers across the country to resist the results of the election.

“These defendants were prepared to fight. Not for their country, but against it,” prosecutors wrote in their sentencing memo. “In their own words, they were ‘willing to die’ in a ‘guerilla war’ to achieve their goal of halting the transfer of power after the 2020 Presidential Election. … These defendants played a central and damning role in opposing by force the government of the United States, breaking the solemn oath many of them swore as members of the United States Armed Forces.”

In an eight-week trial last year, prosecutors presented evidence that the group planned to descend on Washington, D.C., on Jan. 6 in response to Trump’s call about two weeks earlier for supporters to “be there, will be wild.” They stockpiled weapons, which prosecutors contend were meant to be available if the mob’s clash with police turned even more violent than it did, at a Comfort Inn in Arlington, Va.

Rhodes, an Army veteran, Yale Law School graduate and disbarred attorney, was one of a pair of Oath Keepers convicted by a jury last November on rare seditious conspiracy charges for planning an assault on the Capitol as Congress was tallying the electoral votes as part of the process transitioning power from Trump to President Joe Biden.

The other person convicted on the marquee charge was Kelly Meggs, a leader of the Florida Oath Keepers. Three Oath Keepers members tried with Rhodes and Meggs were acquitted of seditious conspiracy, but convicted on other felony charges.

Four other Oath Keepers were convicted of seditious conspiracy at a second trial in January. And three more pleaded guilty to seditious conspiracy over the past year.

In addition to the nine Oath Keepers who have been convicted of seditious conspiracy, five members of the far-right Proud Boys have also been convicted of or pleaded guilty to the charge. Four of them, including the group’s national leader Enrique Tarrio, were found guilty by a jury on Thursday. The sentencing recommendation for Rhodes is a window into the likely sentence that prosecutors will seek for Tarrio and his allies.

The recommendation for the stiff prison term for Rhodes was sent Friday night to U.S. District Court Judge Amit Mehta, who has presided over three jury trials for Oath Keepers members. A fourth is slated to take place later this year.

Mehta, an appointee of former President Barack Obama, has scheduled sentencing for Rhodes, Meggs and several other convicted Oath Keepers over a series of dates in late May and early June.

Prosecutors also announced in their Friday night submission that they are seeking similarly lengthy sentences for others convicted in the Oath Keepers trials to date, including: 21 years for Meggs, 18 years for Jessica Watkins, 17 years for Roberto Minuta, 17 years for Ed Vallejo, 15 years for Kenneth Harrelson and 14 years for Thomas Caldwell. Each of them would equal or exceed the lengthiest sentences given to Jan. 6 defendants so far.

Prosecutors arrived at those steep sentencing recommendations in part by labeling the actions of Rhodes and his co-conspirators “terrorism,” defined in the criminal code as “acts that were intended to influence the government through intimidation or coercion.” The Justice Department has sought this enhancement in relatively few Jan. 6 cases and with limited success.

Judges declined to adopt it in several cases against high-profile Jan. 6 defendants — but none had been convicted of seditious conspiracy and none were alleged to have played as large a role in the Jan. 6 attack as Rhodes and his allies.

Prosecutors also dinged Rhodes and several allies for participating in post-trial interviews in which they defended their actions on Jan. 6. Rhodes, in particular, they said “continues to invoke the words and deeds of the Founding Fathers in not-so-veiled calls for violent opposition to the government.”

About 1,000 people have been charged criminally in connection with the Jan. 6, 2021 riot at the Capitol, but prosecutors said Rhodes and other members of the fiercely anti-government Oath Keepers deserve lengthy prison sentences because they were instigators of the unrest and violence that broke out that day.

While the vast majority of those charged entered the Capitol building, Rhodes and Tarrio were convicted on the serious seditious conspiracy charge despite never setting foot in the building that day. Rhodes was in Washington and marched with Oath Keepers members, but remained in a parking lot as rioters entered the building and clashed with police. Tarrio had been arrested by police a couple of days before and was in Baltimore when the violence unfolded on Jan. 6 after being ordered to leave Washington.

While the 25-year recommendation for Rhodes is the lengthiest yet in Jan. 6 cases, it is only slightly longer than the 24-year, six-month sentence prosecutors sought for a man sentenced Friday for repeatedly assaulting police officers during the riot.

A jury convicted Peter Schwartz, 49, last December on assault and civil disorder charges for throwing a chair at police and spraying them with pepper spray, all while armed with a wooden tire knocker. According to prosecutors, unlike many Jan. 6 defendants, Schwartz had “a substantial violent criminal history.”

Mehta, the same judge handling the Oath Keeper’s cases, sentenced Schwartz to 14 years in prison. While that was more than a decade short of what prosecutors asked for, it was the longest sentence yet for a Jan. 6 offender. The next longest was also handed out by Mehta: 10 years for Thomas Webster, a retired New York City police officer who assaulted a D.C. cop on the front lines of the Capitol riot. Prosecutors had sought a 17-and-a-half year term in that case.

Watch Video: India’s Hard-Hitting Attack on Pakistani Counterpart Bilawal Bhutto After SCO Summit

In a hard-hitting attack on his Pakistani counterpart Bilawal Bhutto Zardari, External Affairs Minister S Jaishankar called him the “promoter, justifier and spokesperson of a terrorism industry” after the Shanghai Cooperation Organisation meeting on Friday.

On Bhutto Zardari’s comments on tackling terrorism, Jaishankar said Pakistan’s credibility in dealing with is depleting even faster than their forex reserves. Asked whether there could be talks between India and Pakistan on combating the menace, the external affairs minister said, “Victims of terrorism do not sit together with perpetrators of terrorism to discuss terrorism.”

    WATCH VIDEO:

The external affairs minister said Bhutto Zardari came to India as foreign minister of an SCO member state and it is part of multilateral diplomacy. “Do not see it as anything more than that,” he added. On the so-called China-Pakistan Economic Corridor, Jaishankar said it was made very clear that connectivity is good for progress, but it cannot violate the territorial integrity and sovereignty of states. He said as a foreign minister of an SCO member state, Bhutto Zardari was treated accordingly.

  • Biden calls McCarthy ‘honest’ and himself wise as debt ceiling talks heat up

Biden calls McCarthy ‘honest’ and himself wise as debt ceiling talks heat up

    [ad_1]

    biden 29934

Biden declined the chance to take a personal jab at House Speaker Kevin McCarthy, choosing instead to call him an “honest man.” The two have negotiated formally just once, though McCarthy has been pushing for a followup, and Biden will meet with him and the three other main congressional leaders next week. Instead of teeing off on the speaker, Biden criticized the deal McCarthy cut with his fellow House Republicans to get a debt ceiling hike through their chamber.

“I think he’s in the position, well, he had to make a deal and that was pretty — you know, 15 votes. Fifteen votes that where he had — just about sold away everything that he — at the far, far right,” he said. “There’s the Republican Party and there’s the MAGA Republicans, and the MAGA Republicans really have put him in a position where in order to stay speaker he has to agree — he’s agreed to things that, maybe he believes, but are just extreme.”

    No workarounds… yet

The president said he wasn’t ready to try a workaround for raising the debt ceiling, at least not yet. Pressed by Ruhle as to whether he would argue that the debt limit was unconstitutional (as his aides are reportedly considering), he said he had not “gotten there yet.”

“Here’s the deal, I think that — first of all, this is not your father’s Republican Party. This is a different group. And I think that we have to make it clear to the American people that I am prepared to negotiate in detail with their budget,” he said. “How much are you going to spend? How much are you going to tax? Where can we cut?”

    Age is but a number

It wasn’t all budget and debt talk. Ruhle also pressed Biden about running for a second term when he would be nearly 82 at his reelection. She noted that no one at a Fortune 500 company would consider hiring a CEO at that age. So why, she asked, would voters give him a job?

“Because I have acquired a hell of a lot of wisdom and know more than the vast majority of people,” said Biden. “And I’m more experienced than anybody that’s ever run for the office. And I think I’ve proven myself to be honorable as well as also effective.”

    All the president’s troops

Biden has faced criticism — from both the right and left — for his administration’s decision to send 1,500 active-duty troops to the southern border ahead of next week’s lifting of the Trump-era health policy known as Title 42. Biden defended the move in the interview, saying more resources are needed to address the influx of migrants and that he has sought help from Congress.

“We’re in a situation now where those 1,500 [troops] at the border, they’re not there to enforce the law, they’re there to free up the border agents that need to be on the border,” Biden said. “And we’re having another thousand people coming in. There are asylum judges to make judgments, to move things along.”

    To Hunter’s defense

The president’s son, Hunter Biden, has been embroiled in legal problems. Prosecutors are reportedly close to determining whether the younger Biden will be charged with gun and tax violations, and his defense team has reportedly met with prosecutors.

Biden argued to Ruhle that any federal charges filed against Hunter would not affect his presidency.

“It will not because he has done nothing wrong. And I’m proud of him,” he said.

    Beat the Press

When Ruhle pointed out that “sentiment in this country … is not very good,” Biden complained of the negative coverage in the press.

“All they’ve heard is negative news for years,” he said. “Everything is negative. And I’m not being critical of the press. If you turn on the television, the only way you’re going to get a hit is if there’s something negative.”

    2020 rematch?

When asked about his past remarks about the “soul of America,” Biden took the opportunity to take a jab at former President Donald Trump, whom he defeated in 2020 — and who currently leads in Republican primary polls. But Biden did not identify Trump by name.

“We can’t let — we cannot let this election be one where the same man who was president four years ago becomes president again,” he said.

Pakistan Skipper Babar Azam Broke Another Record

Pakistan skipper Babar Azam broke another record Friday after he became the batter to score 18 centuries in the least innings.

Babar — the number one batter in the world in the one-day international format — achieved the feat during the fourth ODI against New Zealand in Karachi.

The Pakistan skipper has smashed 18 tons in 97 innings, which South Africa’s Hashim Amla achieved in 102, Australia’s David Warner 115, and India’s Virat Kohli 119.

Babar also holds the record for scoring his 13th, 14th, 15th, 16th, and 17th centuries in the fewest innings.

In the same match, the Pakistan skipper added another feather to his cap by becoming the fastest batsman to score 5,000 runs in one-day internationals (ODI).

The star batter became the first batter to achieve this feat in less than 100 innings.

Babar crossed this milestone in just 97 innings, becoming the 14th to score 5,000 runs.

South Africa’s Amla scored 5,000 runs in 101 innings, while West Indian legend Vivian Richards and India’s Kohli scored these runs in 114 innings.

Babar Azam Breaks ODI Record As Pakistan Climb To Top Of Rankings – Kashmir News

    [ad_1]

Pakistan went to the top of the MRF Tyres ICC Men’s ODI Team Rankings with a win in Karachi in the fourth ODI against New Zealand.

Pakistan are the new No.1 team in men’s ODIs after a massive win over New Zealand in the fourth ODI of the bilateral series in Karachi. The hosts, who now lead 4-0 in the series that has one game to go, have 113 rating points, and edge Australia and India by decimal points.

Pakistan, who were fifth with 106 rating points in the ODI rankings before the start of the series, were in top form as they chased down tall targets in the first two ODIs.

They went on to win the third ODI in Karachi by 26 runs to move to third in the points table behind Australia and India, going ahead of England and New Zealand in the process.

In the fourth ODI on Friday, a century from Babar Azam, his 18th in the format, and contributions from others helped Pakistan post a tall total of 334.

Babar became the fastest to 5000 ODI runs in the process, reaching the milestone in his 96th ODI innings. The record was previously held by Hashim Amla, who achieved the feat in 101 innings.

    Babar Azam96
    Hashim Amla101
    Viv Richards114
    Virat Kohli114
    David Warner115

However, to remain at the top of the rankings at the conclusion of the series, Pakistan will have to make this a clean sweep by winning the fifth and final ODI on Sunday.

A loss in the final ODI will see them slipping back to No.3 and Australia reclaiming their No.1 ranking. New Zealand will remain at the fifth spot irrespective of the result of the final game.

Pakistan will also remain on top if the fifth match is abandoned or yields a no-result. (Icc.cricket.com)
