    LONDON — Whisper it softly, but the Brexit endgame has arrived.

    Eighteen months after Brussels and London reopened talks on the contentious Northern Ireland protocol — and more than three years after Britain actually left the EU — panicked officials on both sides of the English Channel are frantically trying to manage expectations as reports of a technical-level deal between the two sides emerge.

    “They’re still in calls with the EU, but it’s literally just lawyers tidying up bits of text,” one senior British government official said Wednesday, in reference to the U.K. negotiating team. “We’re done.”

    Multiple reports suggest U.K. Prime Minister Rishi Sunak now has a draft technical deal on his desk to consider, despite a wave of both official and unofficial denials from politicians and diplomats on all sides.

    “I suspect it is more the technical shape of a deal than a deal per se,” said a second person close to the talks on the U.K. side, “which might be giving them wriggle room to deny it.”

    Denials of an outright agreement were still coming thick and fast Wednesday night after the Times reported that London and Brussels had indeed reached a deal on the key customs and governance disputes that have dogged talks over the protocol. Crucially — and most contentiously — its front page story suggested the EU has given ground on the role its top court will play in resolving future disputes. 

    That followed earlier reporting late last week by Bloomberg News that technical-level solutions on customs, state aid and checks were indeed within touching distance.

    Talks on smoothing the operation of the Northern Ireland protocol have been ongoing since the summer of 2021, with negotiators long targeting a deal this month, ahead of an expected visit to Ireland by U.S. President Joe Biden in April.

    The protocol arrangement, agreed as part of the Brexit divorce deal, sees Northern Ireland continue to follow the EU’s customs union and single market rules, in an effort to avoid a politically-sensitive hard border with the neighboring Republic of Ireland, which remains an EU member state. 

    Yet Northern Ireland’s unionist politicians have long objected to the protocol, with the Democratic Unionist Party boycotting power-sharing and arguing that checks on goods moving from Great Britain to Northern Ireland effectively separate the region from the rest of the U.K. They’re backed by critics in Sunak’s governing Conservative Party who resent the Court of Justice of the European Union’s place in protocol governance.

    Selling a deal to those domestic audiences represents an almighty political challenge for a prime minister already battling to keep his fractured party together.

    The official line

    Officially, both sides are sticking to the script and insisting that talks continue.

    European Commission President Ursula von der Leyen told reporters Wednesday: “I’m very sorry, but I cannot give partial elements — because you never know in the very end how the package looks like.”

    In Downing Street, Sunak’s official spokesperson tried to steer journalists away from what he called “speculative” reporting.

    “No deal has been agreed, there is still lots of work to do on all areas, with significant gaps remaining between the U.K. and EU positions,” the spokesperson said. “Talks are ongoing on potential solutions including on goods.”

    But the senior U.K. official quoted before said the message from No. 10 that negotiations are ongoing only applied at a political level.

    They added: “It’s now up to politicians to decide ‘yay’ or ‘nay.’ Rishi could have further technical talks with Ursula von der Leyen and [EU Brexit point-man] Maroš Šefčovič and stuff like that, but officials are done. It’s plain as day.”

    According to the second person close to the talks, Sunak has been receiving regular updates on the evolving technical shape of the deal. 

    “As far as I know, he hasn’t given it the green light yet,” they said. “But it is all being quite ‘secret squirrel’ in the [U.K.] Cabinet Office. So I don’t think many people will be fully in the loop.”

    In Brussels and in London, EU diplomats were busy rubbishing reports of an imminent resolution, while acknowledging that information on the state of play is being kept tight. European ambassadors were briefed on Wednesday morning that a breakthrough is yet to be reached, and that the CJEU issue remains particularly tricky.

    Even inside the U.K., claim and counter-claim were flying. Another British official close to the talks said it was “just wrong [that a deal] is close,” with “fundamental” issues outstanding “including making sure there isn’t a border.” They would not, the person added, “expect anything in the short term.”

    One EU diplomat summed up the mood: “If somebody tells you they know what’s happening, they’re lying.”

    In truth, a final agreement on Brexit has never looked so close.

    With war raging in Europe, the race to find NATO’s next chief is on. 

    Jens Stoltenberg was a steady hand as Western capitals rushed to help Ukraine push back invading Russian troops. But as his term expires in September, speculation is growing over who might succeed him. 

    Could it be a woman? Someone from Eastern Europe?

    Moscow’s war greatly complicates the decision, which requires consensus among the leaders of NATO’s 30 member countries.

    The next secretary-general must play a tough balancing act in encouraging capitals to continue supplying weapons to Ukraine and building up NATO’s own defenses — all while formally staying out of the conflict. Few pass muster for this highly sensitive role. 

    The “overall feeling,” said one senior NATO diplomat, is that it is “time for fresh air.”

    But the allies may end up playing it safe after all, and sticking with Stoltenberg.

    The Stoltenberg card 

    A senior European diplomat summed up the buzz around names in three tiers, ranked by intensity of chatter.

    An extension of Stoltenberg’s term is the most-mentioned option. 

    A second tier includes Dutch Prime Minister Mark Rutte, Estonian Prime Minister Kaja Kallas and British Defense Secretary Ben Wallace. 

    A third group of less frequently mentioned names, the diplomat said, consists of Lithuanian Prime Minister Ingrida Šimonytė, Slovakia’s President Zuzana Čaputová and European Commission President Ursula von der Leyen of Germany.

    Since all of NATO’s secretaries-general have thus far been male, there is pressure within the ranks to appoint a woman. 

    “Time for a female Sec Gen,” said the senior NATO diplomat. “If men try to hold their positions forever, fair representation of women will never have a chance.” 

    And some allies have pushed for more regional diversity. Stoltenberg, who has held the job since 2014, is a former Norwegian prime minister. His most recent predecessors were Danish, Dutch and British. 

    The current secretary-general’s term was quickly extended last March after Russia’s invasion of Ukraine. Many officials now believe that another extension for Stoltenberg, even if short, is a serious possibility. 

    The longtime leader is seen as a safe pair of hands. Despite some delegations preferring to see a fresh face soon, Stoltenberg is still perceived as a rare senior official who can keep his cool — and stick to the script — in even the gravest of crises. 

    “Stoltenberg wants to stay,” said the senior NATO diplomat.

    But giving Stoltenberg a short extension could make a future replacement decision collide with the EU’s own top jobs competition in 2024, not to mention the upcoming U.S. presidential election — an outcome some allies would prefer to avoid.

    A NATO spokesperson declined to elaborate on Stoltenberg’s future aspirations. Asked in December about the issue, the current secretary-general told the BBC: “My focus now is on my responsibilities.”

    “I don’t speculate,” he added, “about what will happen after my tenure.” 

    The eastern front 

    Some see candidates from Eastern Europe as particularly suitable.

    Already before Russia’s invasion of Ukraine, there was momentum for the alliance to select a secretary-general from the east. Some officials in the region argue that the war has since strengthened the case for someone from a country like Estonia or Lithuania.

    “For years, the countries of the eastern flank have been warning about Russia’s threat,” said an official from the Baltics. 

    The region’s countries, the Baltic official said, were front-runners in boosting military spending and pushing the alliance to improve its defenses. 

    “It would be very logical and sobering,” the official continued, “to have someone who is experienced in dealing with Russia and who understands Russia’s logic and mentality, to lead the North Atlantic Alliance.”

    Slovakia’s Čaputová ticks both boxes as a female eastern candidate, though her name is mentioned less often in alliance circles. 

    A spokesperson for Čaputová said she was focused on her current job, but said the possibility of a Slovak being floated for the NATO post was “a strong reflection of our foreign and security decisions.” 

    Another figure possibly in the running is Klaus Iohannis, Romania’s president. But he could face obstacles from neighboring Hungary, and opposition from those who would prefer a female candidate. 

    Some western capitals, however, would not support such candidates at the moment, seeing the alliance’s east — and the Baltic states in particular — as too hawkish when war is raging next door. 

    Estonia’s Kallas herself has played down expectations, telling local media in November that “the likelihood of an offer like this being made” is “extremely low.” 

    The Western option 

    Western NATO countries are for some allies a reliable fallback source for possible leadership. 

    Wallace, Britain’s defense secretary, is well respected and has previously said that NATO would be a “nice job.” However, numerous European capitals — in particular Paris — are expected to object to a London name and insist on an EU candidate. 

    One possible compromise being floated in Brussels is yet another secretary-general from the Netherlands. Dutch politicians have traditionally been a popular choice for the role, previously holding the post for three terms covering 21 years in the past six decades.

    The Dutch are seen as serious on defense but not as hawkish as the Baltics — and the names of current Prime Minister Rutte, Deputy Prime Minister and Finance Minister Sigrid Kaag and Defense Minister Kajsa Ollongren are all circulating as possible candidates. 

    Asked about the speculation, Rutte said he wanted to “leave politics altogether and do something completely different.” The two Dutch ministers did not express interest in the job. 

    Commission President von der Leyen, a former German defense minister, is a female candidate who could gain support from western capitals nervous about the prospect of a leader from the eastern flank, but it’s unclear whether she is interested in the role. “We never comment on such speculations,” said a Commission spokesperson. 

    Although her reputation in security circles is mixed, von der Leyen is seen as a strong possible candidate regardless — if the timing aligns and she does not get a second term as European Commission president. 

    Other female politicians floated include Canada’s widely respected Deputy Prime Minister Chrystia Freeland and Foreign Minister Mélanie Joly. Nevertheless, officials say, as the alliance focuses on boosting its defenses, Ottawa’s low defense spending and non-European status mean that a Canadian is unlikely to get the job. 

    Amid all the speculation, some within the alliance dismiss the breathless names game. 

    “This is more a basket of names that came to anybody’s mind,” said a second senior European diplomat, adding: “My guess: Stoltenberg.”

    Ukrainian Prime Minister Denys Shmyhal has a tight two-year timetable for securing EU membership that is bound to dominate discussions at this week’s historic EU-Ukraine summit, the first to take place on Ukrainian soil.

    The problem? No one within the EU thinks this is realistic.

    When EU commissioners travel to Kyiv later this week ahead of Friday’s summit with Ukrainian President Volodymyr Zelenskyy and the heads of the European Commission and Council, their main task is likely to involve managing expectations.

    Shmyhal himself is imposing a tough deadline. “We have a very ambitious plan to join the European Union within the next two years,” he told POLITICO. “So we expect that this year, in 2023, we can already have this pre-entry stage of negotiations,” he said.

    This throws down a gauntlet to the EU establishment, which is trying to keep Ukrainian membership as a far more remote concept.

    French President Emmanuel Macron said last year it could be “decades” before Ukraine joins. Even EU leaders, who backed granting Ukraine candidate status at their summit last June, privately admit that the prospect of the country actually joining is quite some years away (and may be one reason they backed the idea in the first place.) After all, candidate countries like Serbia, Turkey and Montenegro have been waiting for many years, since 1999 in Ankara’s case.

    Ukraine is a conundrum for the EU. Many argue that Brussels has a particular responsibility to Kyiv. It was, after all, Ukrainians’ fury at the decision of President Viktor Yanukovych to pull out of a political and economic association agreement with the EU at Russia’s behest that triggered the Maidan uprising of 2014 and set the stage for war. As European Commission President Ursula von der Leyen put it: Ukraine is “the only country where people got shot because they wrapped themselves in a European flag.”

    Ukraine’s close allies in the EU such as Poland and the Baltic countries strongly support Kyiv’s membership push, seeing it as a democracy resisting an aggressor. Many of the EU old guard are far more wary, however, as Ukraine — a global agricultural superpower — could dilute their own powers and perks. Ukraine and Poland — with a combined population of 80 million — could team up to rival Germany as a political force in the European Council and some argue Kyiv would be an excessive drain on the EU budget.  

    Short-term deliverables

    Friday’s summit in Kyiv — the first EU meeting of its kind to take place in an active war zone — will be about striking the right balance.

    Though EU national leaders will not be in attendance, European Council officials have been busy liaising with EU member states about the final communiqué.

    Some countries are insisting the statement should not stray far from the language used at the June European Council — emphasizing that while the future of Ukraine lies within the European Union, aspirant countries need to meet specific criteria. “Expectation is quite high in Kyiv, but there is a need to fulfill all the conditions that the Commission has set out. It’s a merit-based process,” said one senior EU official.

    Still, progress is expected when Zelenskyy meets with von der Leyen and European Council President Charles Michel.

    Shmyhal told POLITICO he hopes Ukraine can achieve a “substantial leap forward” on Friday, particularly in specific areas — an agreement on a visa-free regime for industrial goods; the suspension of customs duties on Ukrainian exports for another year; and “active progress” on joining the SEPA (Single Euro Payments Area) payments scheme and the inclusion of Ukraine into the EU’s mobile roaming area.  

    “We expect progress and acceleration on our path towards signing these agreements,” he said.

    Anti-corruption campaign

    The hot topic — and one of the central question marks over Ukraine’s EU accession — will be Ukraine’s struggle against corruption. The deputy infrastructure minister was fired and deputy foreign minister stepped down this month over scandals related to war profiteering in public contracts.

    “We need a reformed Ukraine,” said one senior EU official centrally involved in preparations for the summit. “We cannot have the same Ukraine as before the war.”

    Shmyhal insisted that the Zelenskyy government is taking corruption seriously. “We have a zero-tolerance approach to corruption,” he said, pointing to the “lightning speed” with which officials were removed this month. “Unfortunately, corruption was not born yesterday, but we are certain that we will uproot corruption,” he said, openly saying that it’s key to the country’s EU accession path.

    He also said the government was poised to revise its recent legislation on the country’s Constitutional Court to meet the demands of both the European Commission and the Venice Commission, an advisory body of the Council of Europe. Changes could come as early as this week, ahead of the summit, Shmyhal said.

    Though Ukraine has announced a reform of the Constitutional Court, particularly on how judges are appointed, the Venice Commission still has concerns about the powers and composition of the advisory group of experts, the body which selects candidates for the court. The goal is to avoid political interference.

    Shmyhal said these questions will be addressed. “We are holding consultations with the European Commission to see that all issued conclusions may be incorporated into the text,” he told POLITICO.

    Nonetheless, the symbolic power of this week’s summit is expected to send a strong message to Moscow about Ukraine’s European aspirations.

    European Council President Michel used his surprise visit to Kyiv this month to reassure Ukraine that EU membership will be a reality for Ukraine, telling the Ukrainian Rada (parliament) that he dreams that one day a Ukrainian will hold his job as president of the European Council.

    “Ukraine is the EU and the EU is Ukraine,” he said. “We must spare no effort to turn this promise into reality as fast as we can.”

    The key question for Ukrainians after Friday’s meeting will be how fast the rhetoric and promises can become a reality.

    Beijing wants to be friends again.

    Chinese diplomats are fanning out with a new softer message for international partners and adversaries alike. Gone is the aggressive “wolf warrior” rhetoric. In its place, a warmer tone and a promise of economic cooperation.

    Vice Premier Liu He took Beijing’s diplomatic olive branch to the exclusive annual huddle of the global political and business elite in Davos, Switzerland this week. With a heated transatlantic trade spat exploding in panel after panel and melting the Swiss Alpine snow, Liu offered a kinder, gentler Beijing.

    “China’s national reality dictates that opening up to the world is a must, not an expediency. We must open up wider and make it work better,” Liu said on Tuesday.

    The Chinese charm offensive drove a lot of private conversations in Davos amid the World Economic Forum gathering. Executives are eager to learn more — and as always to explore opportunities in a market as big as China’s. The shift, if real, would signal a return to something the Davos crowd considers more normal: a somewhat predictable, business-friendly Chinese communist leadership, more interested in making money than waging fights against internal critics or outside enemies. The improved economic relationship between China and Australia has fueled such optimism.

    Western officials have heard the message as well, but are suspicious that the outreach is more diplomatic sparkle than an indication of substantive changes. They are leery that the growing economic and military threat posed by China remains despite the velvet gloves.

    The shift has been gathering steam for weeks after China’s President Xi Jinping offered a warmer tone in his meeting with U.S. President Joe Biden in Bali in November. Xi urged a return to “healthy and stable growth” in bilateral relations.

    That has set in motion a cascade of Chinese initiatives seemingly aimed at repairing the harm done by years of “wolf warrior”-style diplomacy; saber-rattling across the Taiwan Strait; a more bellicose military posture in the Indo-Pacific; economic coercion; and high-tech espionage.

    China’s Foreign Ministry is rolling out a rhetorical red carpet for U.S. Secretary of State Antony Blinken’s visit in early February. Europe is bracing for a multi-country diplomacy spree by former Foreign Minister Wang Yi. On Wednesday in Zurich, U.S. Treasury Secretary Janet Yellen’s meeting with Liu reaped an invitation to visit China “in the near future.” And the Chinese Foreign Ministry signaled gentler public messaging by banishing pugnacious spokesperson Zhao Lijian to the bureaucratic backwater of the ministry’s Department of Boundary and Ocean Affairs last week.

    Western officials still have their guard up, though — particularly since Chinese diplomats were until recently issuing outright threats to their host countries. 

    “We are seeing a warmer Beijing that’s keen to talk about a business-as-usual approach, and there are fewer wolf warrior narratives,” an EU official told POLITICO on condition of anonymity because he isn’t authorized to speak on the record. “However, a softer face doesn’t necessarily mean a softer heart.”

    Russia’s friend

    That skepticism springs from the fact that Beijing isn’t matching its rhetorical expressions of bilateral goodwill with any substantive policy shifts. China’s “no limits” alignment with Russia continues even after Moscow’s war on Ukraine and record numbers of Chinese military aircraft regularly menace Taiwan. Beijing denies its well-documented abuses against Uyghur Muslims in Xinjiang and continues what the U.S. calls “unfair trade practices” that sustain billions of dollars of U.S. tariffs on Chinese imports.

    There are also suspicions that China is seeking to prevent the imposition of additional crippling U.S. export restrictions on high-technology items such as semi-conductors — and slow down or derail U.S. efforts to persuade its allies to do likewise.

    “Xi wants the American boot off his neck — he can’t stomach any more tech containment or more sanctions and recognizes that a lot of [Beijing’s] foreign diplomacy has backfired and he wants to lower the temperature,” said Craig Singleton, senior China fellow at the Foundation for Defense of Democracies. Beijing’s uptick in diplomatic outreach aims to “seek a reprieve from Washington’s regulatory assault on China’s tech sector, and then lay the groundwork to stimulate China’s economy after this current COVID wave subsides,” Singleton said.

    China is in desperate need of an international image overhaul. The results of a Pew Research survey published in June indicated “negative views of China remain at or near historic highs” in 19 European and Asian countries due to concerns about human rights and perceptions of a growing Chinese military threat. Pew Research Center survey results released in September revealed that 82 percent of Americans in 2022 had “an unfavorable opinion of China,” an increase from 76 percent the previous year.

    Beijing’s change in tone reflects its alarm at the Biden administration’s success in rallying international support for his China-countering Indo-Pacific Strategy. That has included arch-rival Japan’s embrace of closer defense ties with the U.S. underwritten by a multibillion-dollar investment in Tokyo’s military.

    The ruling Chinese Communist Party’s sense of vulnerability is heightened by China’s raging COVID outbreak and an economy pummeled by three years of lockdown linked to the country’s now-defunct zero-COVID policy. “There’s recognition [in Beijing] that — wait a minute, the U.S. is not going anywhere, it is still a major geopolitical power — and so China has to reengage with the United States,” said Victor Shih, an expert in Chinese elite politics at the University of California, San Diego’s School of Global Policy and Strategy.

    Uphill struggle

    But old habits die hard. Vice Foreign Minister Xie Feng, the incoming Chinese ambassador to the U.S., accused the Biden administration of “besieging China through geopolitics such as the Indo-Pacific Strategy,” in a speech on Monday. And besides Zhao’s removal from the Foreign Ministry press briefing platform, Xi hasn’t fired or demoted any senior “wolf warrior” diplomats, points out Joshua Kurlantzick, a senior fellow at the Council on Foreign Relations.

    EU officials in Brussels are preparing for a visit by Wang, the former Chinese foreign minister who has been promoted into the 24-person Politburo, the Communist Party’s ruling body, to oversee foreign affairs. 

    But Wang faces an uphill struggle in convincing Europe of a shift in China’s diplomatic settings. The EU is angered by Xi’s close relationship with Moscow despite Russia’s aggression against Ukraine. In response, European leaders have started exploring the diversification of sources of key imports, including those from China.

    In conversations with their European counterparts, Beijing officials and diplomats have adopted the tactic of highlighting recent transatlantic disputes to try to persuade the Europeans that the U.S. — even after the Donald Trump era — remains an untrustworthy ally.

    “They like to repeat the U.S. ‘gains’ in the Russian war against Ukraine, as well as the IRA,” another European official said, referring to the Biden administration’s Inflation Reduction Act, which is seen by many Europeans as a protectionist policy unfavorable to EU businesses. China claims that the U.S. military-industrial complex stands to gain from the war, while Europe suffers more from the energy crisis than the U.S. 

    Beijing is also reaching out to traditional allies in the U.S. business community to amplify its more benign messaging. Wang sat down in Beijing last month with John Thornton, former Goldman Sachs president and the current executive chair of Barrick Gold Corporation. That meeting signaled that “China is open to dialogue with the United States at all levels,” current Chinese Foreign Minister Qin Gang tweeted.

    Similar outreach to the European business community may fall flat.

    “China heavily subsidizes its industry and restricts access to its market for EU companies,” European Commission President Ursula von der Leyen said during the World Economic Forum in Davos on Tuesday. “We need to focus on de-risking rather than decoupling. This means using all our tools to deal with unfair practices.”

    But Beijing will hope that persisting with the warmer rhetoric will pay off even if the fundamentals don’t change.

    “There are elements of Wall Street and certain constituencies in the U.S. government that are extremely receptive to talk about stability and predictability in the U.S.-China relationship after a very volatile two years,” said Singleton from the Foundation for Defense of Democracies. “But it’s an illusion.”
