    Hathras conspiracy: UP STF nabs PFI functionary from Kerala wanted in UAPA case

    Noida: The Uttar Pradesh police on Friday said it has arrested a “functionary” of the banned Popular Front of India (PFI) from Kerala on charges of conspiracy to trigger riots in the wake of the alleged gangrape and death of a Dalit girl in Hathras in 2020.

    This is the same case in which journalist Siddique Kappan and three others were arrested under the Unlawful Activities Prevention Act (UAPA) in Mathura by the UP police in October 2020 while they were on their way to Hathras. Kappan walked out of jail in February this year.

    Suspect Kamal KP (aged around 50) was arrested from his residence in Kizhattur, under Melattur police station limits in Malappuram district of Kerala at around 12 pm on Friday, the Special Task Force (STF) of the UP Police said in a statement.

    Kamal, who is believed to be handling the “hit-squad” of the movement, was arrested by a joint team of the Noida and the Agra units of the STF.

    He is among the top officer bearers of the PFI and has worked as office secretary at its Delhi headquarters too, according to the statement.

    “Kamal KP was wanted in connection with a case lodged at the Maat police station in Mathura regarding a well-planned attempt to provoke riots in the wake of the unfortunate incident in Hathras. He is an active member of the banned PFI and carried a reward of Rs 25,000,” the UP STF said.

    According to an STF officer, Kamal’s is the ninth arrest in connection with the case lodged under Indian Penal Code sections 153A (promoting enmity between groups), 295A (deliberate act to outrage religious feelings), 120B (criminal conspiracy), the IT Act and under provisions of the stringent anti-terror UAPA.

    Of these nine, two suspects, including Kappan, have been released from jail so far, even as investigation continues into the case over the alleged role of the PFI in planning communal disharmony after the Hathras incident, the officer said.

    Srinagar, February 20: Special Investigation Unit of Kashmir Police is carrying searches at two places in Tral area of South Kashmir’s Pulwama district, officials said on Monday.

    A police officer told GNS that the searches are carried out in connection with a case under Unlawful Activities Prevention Act.

  • J&K Ghaznavi force banned under UAPA

    Srinagar, Feb 17: The central government on Friday banned the Jammu and Kashmir Ghaznavi Force and declared it as terrorist organization under the UAPA.

    In a notification, a copy of which lies with Kashmir News Service (KNS), the government stated that JKGF has been found involved in infiltration bids, narcotics and weapon smuggling and carrying out terror attacks in Jammu and Kashmir.

    “It draws its cadres from various terrorist organisations, such as Lashker-E-Taiba, Jaish-E-Mohammed, Tehreek-ul-Mujahideen, Harkat-ul-Jehad-E-Islami etc,” it reads.

    It added that with declaration of this organisations as terrorist organization, there are now total 44 designated terrorist organizations under the UAPA.(KNS)

    New Delhi: The Delhi High Court on Tuesday posted the bail plea of Jawaharlal Nehru University (JNU) student Sharjeel Imam in a UAPA case related to an alleged conspiracy behind the 2020 riots here to March 15.

    A bench headed by Justice Siddharth Mridul deferred the hearing on the plea, which assails an April 2022 trial court order that rejected Imam’s prayer for bail after a request for accommodation was made by his counsel.

    “List on March 15 at the specific request of the counsel for the appellant,” the court recorded.

    The bench, also comprising Justice Rajnish Bhatnagar, in the meantime, began hearing submissions on the bail plea of the Rashtriya Janata Dal’s (RJD) youth wing leader and Jamia Millia Islamia student Meeran Haider in the same case.

    Imam, Haider and several others, including Umar Khalid, have been booked under anti-terror law Unlawful Activities (Prevention) Act (UAPA) and provisions of the Indian Penal Code (IPC) for allegedly being the “masterminds” of the February 2020 riots in northeast Delhi that left 53 people dead and more than 700 injured.

    The violence had erupted during protests against the Citizenship (Amendment) Act (CAA) and the National Register of Citizens (NRC).

    Haider’s lawyer argued that although his client was managing eight protest sites and had “spoken” at several such sites, it was incorrect to presume that he was part of any conspiracy or strategy to incite violence.

    He asserted that the accused’s specific role has to be ascertained to sustain a case under the UAPA and in the present case, his “pattern of involvement does not match” the prosecution’s version.

    “What part of the chargesheet is attributable to Meeran Haider for the offence under section 15, UAPA? It is not sufficient to say you cannot differentiate between different accused,” the counsel argued.

    It was also claimed that the speeches given by Haider were “political”, where he expressed his “discontent with the government” and “chose to express his anguish” but did not incite violence or rioting.

    He was not calling for violence but was talking about the right to protest, the lawyer told the court, which listed the matter for further hearing on February 8.

    Haider was arrested in April 2020 and the trial court had dismissed his bail plea in April last year.

    New Delhi: The Delhi High Court on Monday adjourned, to Tuesday, the hearing of former Jawaharlal Nehru University student and activist Sharjeel Imam’s bail plea seeking bail in a Unlawful Activities (Prevention) Act (UAPA) case related to alleged conspiracy behind the 2020 northeast Delhi Riots.

    The violence had erupted while protesting against the Citizenship Amendment Act (CAA).

    Due to Justice Rajnish Bhatnagar’s unavailability, the matter was adjourned.

    A Delhi court, on January 4, discharged Imam with 10 other accused persons in a case related to the incidents of violence at Jamia Millia Islamia in December 2019.

    The violence had erupted after a clash between the police and people protesting against the CAA in December 2019.

    Additional Sessions Judge of Saket Court Complex, Arul Verma, had passed the order.

    He had held that the police were unable to apprehend the actual perpetrators behind the commission of the offence, but surely managed to rope in the 11 accused as “scapegoats”.

    SRINAGAR: Peoples Democratic Party (PDP) president Mehbooba Mufti on Wednesday alleged that the encroachment drive launched by the government is another UAPA for the people in Jammu & Kashmir, terming the step a part of corruption practice as under the influence of this drive, the government wants money from rich and vote from the poor.

    Addressing a news conference here, the former chief minister said that the drive to retrieve the land is being used as a weapon against the people of J&K to uproot them, suppress and harass them and also make them homeless. “It is another UAPA for the people, otherwise China has encroached our 20000 sq km land, if the government is serious then let the encroached land be retrieved from China first,” she said.

    Quoting Mehbooba news agency KNO reported that there are some people who possess the land since Maharajas rule and their land properties are also being demolished, adding that first the government created rift between the religious communities and now it is making attempts to create a rift between poor and rich class through this drive.

    However, she said that such measures cannot be stopped until and unless the people from J&K and Ladakh are not united. “The people here in Kashmir are not being allowed to hit the streets.

    The people were even trying to participate in Bharat Jodo Yatra in large number, but they were not allowed. The government has created a situation where the people are not being allowed to come out. The people of Ladakh have united, but until and unless Jammu’s Dogra and Kashmiri people don’t get united, these measures cannot be stopped,” she said.

    “Jammu people reacted yesterday, but people in Kashmir can’t do so as there is NIA, ED and other agencies behind Kashmir. How would it be possible that the people will come out to react over the issue,” she said, adding that these drives are part of a massive corruption here as they want to get money from the rich and vote from the poor. “The poor are being asked to vote against their land and the rich are being asked to meet some officials in this regard,” she said.

    Mehbooba also said that if the government is serious in retrieving the land; let it start from Governor House, B B Cant here.

    Asked about the budget presented today in parliament, Mehbooba said that there was nothing new in today’s budget as the financial plan by the incumbent government is being made for the benefits of some capitals and businessmen. “The taxes being collected should have been used for the welfare of people, but the budget is being made for some businessmen only. The situation is such that the poor are getting poorer, the free ration quantity has been reduced to four kilograms,” she added.
