    Srinagar School Violates FFRC Orders, Charges Excessive Transportation Fee

    SRINAGAR: The Committee for Fixation and Regulation of Fee of Private schools (FFRC) Friday said that Presentation Convent Higher Secondary School Rajbagh was violating its orders by charging excessive transportation fee from the students.

    In this regard, the Chairperson of the committee, Justice (Retd) Sunil Hali has given one last opportunity to the school to appear before FFRC to explain their position by or before May-02 and has warned  the reputed private school of the consequences if it fails to appear before the Committee to explain its position why it arbitrarily hiked the transportation fee for the students.

    Hali in a communique to the school has said that in pursuance to the complaint filed by the parent, notices were issued to the School Management.

    The main grievance of the complainant is that School was charging Rs 1480 per month from the students as a bus fee, an action that violates the prescribed norms of FFRC.

    Despite sending notices, the Principal Presentation Convent Higher Secondary School (PCHSS) didn’t appear before the FFRC.

    Notably, the FFRC last year in October after a detailed discussion with the stakeholders including the school in question allowed a hike of 14% to the schools on the fee being charged by them in October 2019.

    The PCHSS admitted that the school was charging Rs 1480 per month. As per the order, the school was required to hike the bus fee by 14 percent from the amount (1480 by 14%) which was being charged.

    FFRC issued a notice on 26 April this month to the school directing it to explain the position as to why was the school charging fee over and above the prescribed fee by the Committee for Fixation & Regulation of Fee.

    The next day the school came up with a reply that FFRC termed as irrelevant and out of context. The school in its reply referred to some dispute with the complainant pending in the court of law.

    “It has no bearing on the present context in which the notice has been issued to you. The law will take its own course in case the complainant has committed any crime. Therefore it is irrelevant for the present proceedings,” Chairperson FFRC Sunil Hali observed.

    He further stated that: “Your (PCHSS) reply to the notice issued by this office is that the order dated 6 October 2022 relating to the fixation of Transport Charges does not apply to your school as it applies to those schools who are providing their own transport. Also as per your explanation you have outsourced this business to some Private transporter. There is some misconception in understanding the charging of transport fee. The committee under its rules has to fix, determine and regulate the fee which includes the Transport Fee also. It is immaterial how the school provides this facility to the students whether it is school owned transport or the same is being outsourced. It is not your case that the Transport facility has been arranged by the parents with some private company then, of course, the school has no responsibility. You are directly charging transport fee from students, therefore it is your exclusive responsibility to charge fee which is permissible under law.”

    FFRC further conveyed to school that: “What are your terms and conditions with the transport company is a bilateral issue between you and the transport company. You cannot escape the responsibility of charging fees as per the order dated 6 October 2022 which provides a hike of 14% to the existing fee charged by your school. As per the receipt issued by your school, it has come to the fore that you are charging Rs 4900 for two months.”

    “Despite being asked to appear before the Chairperson FFRC you failed to appear and explain your position. You are given one last opportunity to appear before FFRC to explain your position by or before May 2 and in case you fail to appear then your action will be tantamount to violating the orders of the committee which entails consequences provided under the law which includes in first stage imposing of fine,” FFRC warned.

    The FFRC Chairperson said, “You are given one last opportunity to appear before the committee to explain your position by or before May-02 at 3 pm.”

    Hali said that in case, the school fails to appear then its action will tantamount to violating the orders of this committee which entails consequences provided under law which includes in first stage of imposing a fine.

    Srinagar: Regional Transport authorities have asked the school administrations across the valley to bring their transportation fleet in compliance with the Supreme Court guidelines, indicating that a massive drive to check for rule violations will begin next week.

    Quoting an official at the Regional Transport Office (RTO) Kashmir KNO reported that they have received several complaints about violations on various grounds committed by school bus operators in the valley.

    He said that after simplifying public transportation, a significant campaign to ensure the safety of school buses transporting children would begin next week.

    “We have been receiving numerous complaints on violations and to check on that, a big push will be initiated from next week,” the official said, adding that the Supreme Court has put down certain criteria for educational institutions regarding the safety of school buses carrying children.

    Although the educational institutions are already aware of the Supreme Court guidelines, our drive is aimed at ensuring that everyone follows the guidelines, he said, adding that the issue concerns the children’s safety and those found violating the guidelines should not expect any concessions.

    “Those who are found violating the Supreme Court guidelines will be dealt with accordingly. However, no one should expect any concession on grounds that school children will suffer, and in that case, they should plan alternate arrangements,” the official said.

    Mentioning some of the guidelines, he said the school bus should have a qualified attendant for children on the bus while boarding and deboarding them and the bus should be painted yellow.

    As per the Supreme Court guidelines, the school name should be written on the back and front of the bus. The school name and telephone number should also be written and if hired ‘On School Duty’ should be clearly indicated. It should have up-to-date documents like a vehicle permit, fitness certificate, insurance certificate, valid token tax receipt, PUCC, SLD certificate, and GPS certificate.

    “School buses will be checked for the installation of speed limit devices as there is a specific and set speed limit for them,” the SC guidelines mention. “The bus should be fitted with a speed governor of specified standard with a maximum speed limit of 40 kph.”

    Highlighting the Supreme Court guidelines for a driver, the official said the driver should have at least 5 years experience of driving Heavy Motor Vehicles (HMVs) and carry a complete list of children.

    “A driver challaned more than twice a year for red light jumping, violation of lane discipline or allowing unauthorized persons to drive, or challaned even once for over speeding, drunken and dangerous driving should not be employed,” he said.

    Ankara: Turkey and Iraq will build a land and railroad transportation corridor stretching from the Iraqi province of Basra to the Turkish border, Turkey’s President Recep Tayyip Erdogan said.

    “We have tasked our minister friends, who will carry out the works for materialising the Development Road Project, extending from Basra to Turkey,” Erdogan said at a joint press conference with visiting Iraqi Prime Minister Mohammed Shia’ al-Sudani on Tuesday.

    “I believe that we will transform the Development Road Project into the new Silk Road of our region,” the Turkish President added.

    Moreover, Turkey will increase the amount of water released from the Tigris river to help Iraq tackle its water shortage, he said.

    Baghdad has been urging Ankara to secure Iraqi water share from the Tigris and Euphrates rivers which originate from Turkey, as Iraq often suffers from drought, Xinhua news agency reported.

    In their talks, the two leaders reaffirmed their commitment to fighting against all forms of terrorism, Erdogan said.

    “Our expectation from our Iraqi brothers is that they shall designate the outlawed Kurdistan Workers’ Party (PKK) as a terrorist organisation and clear their lands of this bloodshedder terrorist organisation,” Erdogan added.

    Al-Sudani, for his part, underlined that his government will not allow Iraqi lands to become a “point to launch attacks” against its neighbour.

    “Security of Turkey and security of Iraq are inseparable,” he said.

    The security officials of the two countries exchanged information on the issue during talks in the capital Ankara, al-Sudani added.

    The PKK, listed as a terrorist organisation by Turkey, the US and the EU, has been rebelling against the Turkish government for more than three decades. It has been using Iraq’s Qandil Mountains as its main base for years.

    Kulgam, Mar 19: Jammu and Kashmir police on Sunday seized 9 vehicles involved in illegal excavation and transportation of minerals in south Kashmir’s Kulgam district.

    In a statement, issued to the news agency—Kashmir News Observer (KNO), a spokesperson said during naka checking police seized 9 Vehicles loaded with illegal sand and bolders at Khudwani bypass and also arrested 9 persons.

    The statement reads a c FIR No. 17/2023 under relevant sections of law has been registered at Police Station Qaimoh and investigation is in progress.

    It reads persons are involved in this illegal practice must refrain from it, otherwise strict action under law will be initiated against them—(KNO)

    On women’s international day, Baramulla’s deputy commissioner, Dr Syed Sehrish Asgar on Wednesday said that the the administration would ensure safe transportation for the women especially the college going students and soon special services while as free environment would be ensured in public transport as well.

    Sehrish as per the news agency—Kashmir News Observer (KNO) while addressing the gathering at Women’s Day function at GDC Sopore, said that under Nayi Soch they have started the project like One Stop Solution Center (Women Cell), women empowerment and drug related issues or whatever the atrocities the women are facing would be dealt.

    Upon a query related to harassment of women especially college going students in transport service, the deputy commissioner said that they would ensure safe and smooth transportation so the outgoing girls understand the safe environment they would now be able to move in and around the district.

    As of now, it’s not possible to start the women’s special services across the district, however those routes having students flow would get the special services soon, besides hassle free and safe environment for the women would be ensured in public transportation.

    Sehrish also said that the women cell – where issues related to women are dealt with have so far received 200 cases since October and 90 percent of the cases have been resolved. “The pending cases were sort of divorce and property related issues of which the necessary legal proceedings have been initiated”, she added.
