    In a protest against Rahul Gandhi’s ‘Savarkar remark’, Shiv Sena (UBT) chief and former Maharashtra chief minister Uddhav Thackeray on Monday announced the party’s decision to skip Congress’ dinner meet in Delhi.

    Uddhav on Sunday had warned Gandhi stating that he considers Hindutva ideologue V D Savarkar as his “idol”, and asked Congress leader Rahul Gandhi to refrain from “insulting” him.

    He said the Maha Vikas Aghadi (MVA) alliance of three parties – Sena (UBT), Congress and Nationalist Congress Party (NCP) – was formed to protect democracy and it was necessary to work unitedly for it.

    Addressing a rally in the Muslim-dominated textile town of Malegaon in Nashik district of north Maharashtra, Thackeray also said that deliberate attempts were on to provoke Rahul Gandhi.

    “Savarkar is our idol and his insult will not be tolerated if we have to fight together to protect our democracy. Savarkar suffered unimaginable torture in the Andaman cellular jail for 14 years. We can only read the sufferings. It is a form of sacrifice,” he said.

    ”I want to tell Rahul Gandhi that we have come together to save our country’s democracy and its Constitution. But you are deliberately being provoked. If we allow this time to get wasted, then democracy will cease to exist. 2024 will be the last election,” he added.

    Gandhi was disqualified from the Lok Sabha on Friday, a day after a court in Gujarat’s Surat convicted him in a 2019 defamation case. Addressing a press conference in Delhi over his disqualification, Rahul Gandhi on Saturday said, “My name is not Savarkar, my name is Gandhi and Gandhi does not offer an apology to anyone”.

    In an instance of surprise and opposition unity against Rahul Gandhi’s disqualification, Trinamool Congress leaders joined the Congress’ strategy meeting in the Parliament, dressed in black as a sign of protest.

    Trinamool leaders Prasun Banerjee and Jawahar Sircar came out in protest against Gandhi’s disqualification. “The question of walking together is due symbolism, which we undertook today – a special mark of solidarity against coordinated and undemocratic attacks on everyone,” Sircar had said.

    Mumbai: Maharashtra Navnirman Sena (MNS) President Raj Thackeray made a dramatic revelation on Wednesday of a purported dargah coming up in the Arabian Sea off Mahim, a few metres away from the shore.

    Drawing the attention of the state government, Mumbai Police and civic administration, the MNS chief also served an ultimatum to them that unless it is demolished within a month, the MNS would go and erect a Ganpati temple at the same spot.

    Hinting at a potential security threat, Raj Thackeray demanded: “The Mahim police station is close by, the BMC officials keep moving around there… Yet since the past two years this dargah’ is blatantly coming up in the sea… Another Haji Ali Dargah’… And there’s nobody to talk about it?”

    Returning with his old Laav re te video’ (Play that video) after five years, Raj Thackeray ordered playing a video, apparently shot with a drone hovering around and above what seemed to be a small islet that had come up in the Mahim sea.

    It had some green and white flags, fluttering on a pole and on strings around, with some men and women devotees’ offering prayers at a makeshift grave of an unknown person.

    “Whose dargah’ is this? Is it of some fish,” he asked in a lighter vein, but warned that such things cannot be tolerated and if it is not demolished within a month, his party would retaliate with a Ganesh temple at the same islet.

    Mumbai: Superstar Rajinikanth on Saturday met Shiv Sena (UBT) leader Uddhav Thackeray at his residence in suburban Mumbai.

    A party leader said it was a courtesy visit as the veteran actor has been an ardent supporter of the late Bal Thackeray, founder of Shiv Sena.

    “It was a non-political meeting between Rajinikanth and Uddhav Thackeray,” he said.

    Thackeray’s wife Rashmi and sons Aaditya and Tejas welcomed the actor at their residence ‘Matoshree’ in suburban Bandra.

    Aaditya Thackeray, a former minister and sitting MLA, tweeted a picture of his family welcoming Rajinikanth with a bouquet and a shawl.

    “An absolute delight to have Shri Rajnikant ji ar Matoshree once again,” Aaditya tweeted.

    Rajinikanth had met Bal Thackeray at Matoshree in October 2010.

    In July 2021, Rajinikanth announced that he would disband the Rajini Makkal Mandram, launched for his political entry, and reiterated that he had no intention of involving himself in politics in the future.

    The Shiv Sena faction led by Thackeray is a constituent of Maha Vikas Aghadi (MVA), also comprising NCP and Congress.

    Mumbai: In a big jolt to the Shiv Sena-UBT, party leader Subhash Desai’s son Bhushan Desai on Monday joined the Shiv Sena headed by Chief Minister Eknath Shinde.

    Soon afterward, Desai, a close confidante of the late Balasaheb Thackeray, and his son and former CM Uddhav Thackeray and the family for over five decades, expressed anguish over his son’s move to join the Shiv Sena, and asserted how “he (Bhushan) has nothing to do with either politics or Shiv Sena”.

    “This is very painful news for me. His (Bhushan) joining any party will not have any impact on the Shiv Sena-UBT. My loyalty to the ‘Matoshri’ will not be shaken. At this age, I cannot say much, but henceforth I shall continue my work along with many Shiv Sainiks till complete justice is done and the party regains its past glory,” Desai, also served as a minister in the erstwhile Maha Vikas Aghadi government which was toppled by Shinde after the rebellion in June 2022, said.

    Shinde and other Sena leaders welcomed Bhushan Desai to the party fold at a function this evening.

    On his entry to the Sena, Bhushan Desai told media persons that he was “impressed by the functioning style of CM Shinde” and claimed that after discussing it with his father, he decided to join the party.

    “I had made up my mind to join the Shiv Sena which runs on the ideals of the late Hindu HridaySamrat Balasaheb Thackeray I shall take up whatever responsibility the party gives me,” he said.

    Shinde and other senior leaders lauded Bhushan Desai for his move, offering him a party flag and other symbols marking his entry to the Shiv Sena.

    Mumbai: Shiv Sena (UBT) leader Aaditya Thackeray on Sunday alleged the Election Commission is “completely compromised” and said its decision to recognise the faction led by Maharashtra chief minister Eknath Shinde as the Shiv Sena and allot it the bow and arrow symbol was dangerous for democracy.

    He said the acronym “CM” of Maharashtra currently stands for a “corrupt man”, and that the “illegal and unconstitutional chief minister will surely go”.

    Addressing a meeting of the party workers in North Mumbai, Thackeray said the flaming torch (Mashaal) symbol allotted to Shiv Sena (UBT) is the only light that will brighten the darkness caused by the betrayal and back-stabbing.

    He said the rebel MLAs led by Shinde had done the “dirty work” of toppling a government which had done good work of tackling the COVID-19 pandemic and alleviating hardships of farmers affected by the cyclone and unseasonably rains when in power.

    “The Maha Vikas Aghadi government was leading Maharashtra to a golden period. An investment of Rs 6.5 lakh crore was made during the MVA rule of 2.5 years and 93 per cent of the investment proposals had been implemented,” the former minister said.

    Thackeray said the Bharatiya Janata Party must be wondering whether the happening (the pulling down of the government) was right or wrong.

    He said the most important work of the MVA government was granting a loan waiver to farmers.

    “Maharashtra didn’t like betrayals and this is the reason the local body elections, which are overdue, are not being held,” the Worli MLA said.

    He said the investments attracted by Maharashtra during the MVA rule were shifted to Gujarat (under the Eknath Shinde-BJP dispensation).

    He exuded confidence that Shiv Sena (Uddhav Balasaheb Thackeray) will win the Mumbai civic polls whenever they are held.

    “You need to have a clean heart and strength to carry the bow and arrow. Merely getting the bow and arrow (symbol) is not enough,” he said.

    Thackeray said none of the 40 MLAs who defected to the Shinde camp has categorically stated that they haven’t taken money to do so.

    The Thackeray camp has alleged the exchange of money in rebel MLAs switching their loyalties to the Shinde camp and often taunts them with “50 khoke” (boxes) jibe.

    “The 40 MLAs betrayed Uddhav Thackeray. How can they remain true to the people and the state?” he asked.

    Thackeray said their Hindutva is “inclusive and everyone’s blood is red”.

    Mumbai: Shiv Sena (UBT)’s ex-Minister Aditya Thackeray on Wednesday urged Union Minister for Civil Aviation Jyotiraditya Scindia to sanction two new airports in Palghar and Fardapur (Chhatrapati Sambhajinagar), and sought clarity on the status of the proposed airports in Pune and Nashik.

    He said that the development of these airports would boost progress and enhance passenger connectivity, industry, agriculture and tourism in these regions.

    Thackeray Jr. referred to the Union Budget 2023-2024 and welcomed the plans for 50 airports/helipads/ports to be developed/upgraded in the country, but since details were lacking leading to confusion, he asked Scindia to accord priority for civil aviation development in Maharashtra.

    He pointed out that during his tenure as a Maharashtra Minister, his focus was to push several key projects including a third airport for Mumbai at Palghar and the development of the Fardapur airfield.

    While the Navi Mumbai Airport will be ready soon, Mumbai will require a third airport in the next 10 years, and the former Chief Minister Uddhav Thackeray had asked the Maharashtra Airport Development Company to start working on the Palghar airport.

    This, he claimed in the 2-pager, would provide many benefits, including a revenue generator if it turned out to be a passenger airport, cargo hub and offer parking facilities for aircraft.

    On the Fardapur project which the Thackeray government was exploring, Thackeray Jr. said that thousands of tourist flock to view the marvels of Ajanta-Ellora caves in Chhatrapati Sambhajinagar (Aurangabad), but the nearest airport there is 160 kms away, making the trip arduous.

    Thackeray Jr. also urged Scindia to resolve the issues pertaining to the Nashik and Pune airport – the latter’s expansion plans or a new airport has been a long-debated demand that can afford the state’s cultural capital a global connectivity.

    Referring to Nashik, he said it is a matter of great pain as it is one of the holiest cities with a rich heritage like Pune and needs to be tapped with an airport of global standards.

    “I have only mentioned a few of Maharashtra’s multiple points of potential and roadblocks in the sector of civil aviation, directly linking it to industry, agriculture, tourism growth… I hope you will take cognisance of my humble request and give justice to Maharashtra’s civil aviation needs,” Thackeray Jr concluded.

    New Delhi: The Supreme Court Wednesday rejected the suggestion of the Uddhav Thackeray faction of the Shiv Sena to decide the disqualification proceedings pending against Maharashtra Chief Minister Eknath Shinde and MLAs belonging to his camp, saying it cannot assume the role of the Speaker as doing so will have “serious ramifications”.

    The Thackeray faction had on Tuesday insisted that the court decide the disqualification proceedings as that was the only way to “uphold the democratic spirit of the Constitution”.

    “Right or wrong, this is the system we have assumed as ‘We the People’. Can a court try to breach this system? Should the court enter into that area? This is an area which is worrying us,” the court observed on Wednesday.

    A five-judge Constitution bench headed by Chief Justice DY Chandrachud, which was hearing a batch of pleas related to the June 2022 Maharashtra political crisis, told senior advocate Kapil Sibal, representing the Uddhav Thackeray-led faction, that ultimately it is the Speaker of the House, who has to decide whether the rebellion by the Shinde bloc attracted the provisions of the anti-disqualification law.

    “You are saying whatever has to be done has to be done at the behest of the party. Your argument is that they (Maharashtra CM Eknath Shinde camp) have acted contrary to the interest of the party.

    “They have appointed their own whip and leader of the party and their behavior and conduct invited disqualification but all of this leads us to one area that it is the Speaker of the House who is to decide whether there is any disqualification or not. That’s an area we are unable to breach,” the court said.

    The five-judge bench, also comprising Justices MR Shah, Krishna Murari, Hima Kohli and PS Narasimha, said it understood the arguments of Sibal that in parliamentary democracy, the political party is supreme.

    “So far so good. It’s a very significant point you (Sibal) have made that they (Shinde faction) are elected representatives of Shiv Sena party and their behavior must be dictated by the party. Now, the question is, should the court enter into the area of Speaker and, if it assumes the role of Speaker, then it will have very serious ramification.

    “Right or wrong, this is the system we have assumed as ‘We the People’. Now, will the court try and breach this system that is worrying us,” it said.

    Sibal, assisted by advocate Amit Anand Tiwari, said this court has held that illegality cannot be allowed to be continued even for a day.

    He said all these acts (by Shinde camp) were perpetuated by two orders of this court dated June 27, 2022 by which this court kept in abeyance their disqualification proceedings before the Deputy Speaker, and of June 29, 2022 by which the court refused to stay the direction of the Maharashtra governor to the 31-month-old Maha Vikas Aghadi (MVA) government to take a floor test in the assembly to prove its majority.

    He submitted the top court should be worried because if this becomes a precedent, it can happen in other cases too.

    The bench said if such a situation arises because of a judicial order, then it is a duty of the court to rectify that situation.
    “Now, assuming that if we do so and place ourselves in a situation before June 27, 2022, then we would have said that let the Speaker decide and your argument would have been till the Speaker decided their disqualification, there should not be a trust vote.

    “It would be very difficult to retrace our steps back in this scenario as the question would arise which Speaker or that Speaker,” the bench said.

    Sibal said this was exactly what was done in the 2016 Nabam Rebia case, where the court set the clock back and ordered status quo ante by restoring the Arunachal Pradesh government.

    The bench said, “Mr. Sibal you want Nabam Rebia (judgement to be followed) when it suits you and you don’t want it when it does not suit you. Today, we have a Speaker in a democratically elected house and after that can we now say that let the then deputy speaker take a call on disqualification. Sorry, it will be very difficult to retrace our steps back.”

    Sibal submitted all these developments took place after the court order which allowed the status quo to be changed.

    The bench said those two orders were passed after hearing arguments from both the sides and that retracing the steps would mean invalidating the trust vote which took place subsequently.

    He said Parliament, in its wisdom, has used the term ‘Political Party’ under the provisions of Para 2(1)(b) of the Tenth Schedule, wherein a member attracts disqualification for going against the wishes or directions of the political party.
    “Democracy only thrives when the institutions uphold the sanctity of the Constitution. In this case, the governor did not stop them (Eknath Shinde faction) or chose not to stop them. He never asked them who you represent or which party you represent. Unless Nabam Rebia is overruled, these situations are bound to happen.

    “Governors are actively playing a role which is disturbing the polity of the state. I leave this court to find answers to these issues,” he said.

    The hearing remained inclusive and will continue on Thursday.

    On Tuesday, the top court had told the Uddhav Thackeray faction of the Shiv Sena that the Speaker of a House functions like a tribunal in matters related to defection under the anti-defection law.

    New Delhi: After the Election Commission gave Shiv Sena’s name and poll symbol to the Eknath Shinde faction, the Uddhav Thackeray group suffered another major setback as the office allotted to Shiv Sena in the Parliament House in Delhi was given to the Shinde faction.

    The Lok Sabha Secretariat allotted room number-128, earlier allocated to Shiv Sena party, to Eknath Shinde faction on Monday.

    The Secretariat wrote a letter to Rahul Shewale, the leader of the Eknath Shinde faction in Lok Sabha, informing him of the same.

    Moreover, the Supreme Court on Tuesday agreed to hear on Wednesday a plea by Uddhav Thackeray against the Election Commission of India (ECI) decision recognising the Eknath Shinde faction as the official Shiv Sena.

    On February 17, the Election Commission allotted the Shiv Sena party name and the bow and arrow symbol to the faction led by Eknath Shinde.

    New Delhi: The Supreme Court on Tuesday agreed to hear on Wednesday a plea by Uddhav Thackeray against the Election Commission of India (ECI) decision recognising the Eknath Shinde faction as the official Shiv Sena.

    Senior advocate Kapil Sibal, representing Thackeray, submitted before a bench headed by Chief Justice of India D.Y. Chandrachud that if the ECI order is not stayed then they will take over everything, bank accounts, etc. Sibal said, “My only request is, take up the matter tomorrow morning with the constitution bench matters.”

    The bench, also comprising Justice P.S. Narasimha, said they don’t want to disrupt the constitution bench as there are three judges waiting and added, “we will finish the constitution bench and get up a little early and then take it up tomorrow”. Sibal requested the bench to take up the matter Tuesday only.

    The Chief Justice said, “We have not read it yet…tomorrow.” The bench decided to take up the matter at 3.30 p.m. on Wednesday.

    Thackeray, in the plea filed through advocate Amit Anand Tiwari, said the ECI has failed to appreciate that the petitioner enjoys overwhelming support in the rank and file of the party. “The petitioner has an overwhelming majority in the Pratinidhi Sabha, which is the apex representative body, representing the wishes of the primary members and other stakeholders of the party. The Pratinidhi Sabha is the apex body recognised under Article VIII of the Party Constitution. The petitioner enjoys the support of 160 members out of approximately 200 odd members in the Pratinidhi Sabha”, it added.

    The plea contended that the ECI has failed to discharge its duties as a neutral arbiter of disputes under para 15 of the symbols order and has acted in a manner undermining its constitutional status.

    On February 17, the Election Commission allotted the Shiv Sena party name and the bow and arrow symbol to the faction led by Eknath Shinde.

    “The ECI has disregarded the party Constitution of 2018 (which was admitted even by the respondent No.1 to be the Constitution governing the parties) on the ground that such a constitution is undemocratic and that it was not communicated to the Commission. These observations are totally erroneous as the amendments in the Constitution were categorically communicated to the Commission in 2018 itself and the petitioner will place clear evidence in this regard,” said the plea, seeking interim stay on the ECI order passed on February 17.

    Mumbai: In a stunning statement, Shiv Sena-UBT President and former Maharashtra Chief Minister Uddhav Thackeray on Monday said the party name-symbol verdict of Election Commission was “unacceptable” and demanded that the poll panel must be “disbanded”.

    Thackeray’s shocker came at a media conference when he termed the EC ruling of last Friday as “incorrect” and said his party has challenged it in the Supreme Court, while apprehending a “dictatorship” in the country after 2024.

    “Such undemocratic decisions cannot be made on the basis of money power… It’s an unconstitutional verdict. We demand that the ECI should be dissolved, an impartial EC should be elected like the judges, and till then its work should be handled by the Supreme Court,” roared Thackeray.

    He sought for the need to “elect” and not “appoint” election commissioners with a proper procedure, on the lines of the procedures of appointing judges in the Supreme Court.

    Thackeray warned that if the scenario is not halted, then the 2024 elections may be the last in the country and after that anarchy will begin, and called upon all parties to remain vigilant.

    He termed the latest political developments as the Bharatiya Janata Party’s strategy to systematically destroy the Shiv Sena for which it had contracted (Chief Minister) Eknath Shinde.

    Last Friday, the EC had declared the faction led by CM Shinde as the “real” one and awarded it the original party’s name Shiv Sena and election symbol of bow and arrow, sparking howls of protests from the Thackeray side.

    Questioning the haste in the matter, Thackeray pointed out that his group had requested the EC to defer its ruling till the matter of suspended MLAs is pending in the SC.

    If the EC wanted to select who would get the party name-symbol on the basis of their legislative strength, “then why did they ask for affidavits, certificates and other documents for which we spent lakhs of rupees”, he said, adding that they should have taken into consideration the timeline of the chain of events in the matter.

    “Everything has been stolen from us… The name and symbol of our party, even the (temporary) symbol of ‘Flaming Torch’ may be snatched, but they cannot steal the name Thackeray. We have challenged the EC ruling in the SC and the matter will come up tomorrow (Febeuary 21),” said Thackeray.

    After the EC’s order, a livid Sena-UBT chief spokesperson and MP Sanjay Raut claimed on Sunday that an amount of over Rs 2,000 crore was spent to grab the party’s name-symbol and has threatened to make more exposes on this in the coming days.

    Thackeray held discussions with his top leaders and district party heads to decide the future course of action, the upcoming Budget Session of Maharashtra Legislature, the upcoming cases in the SC, etc., even as his party units protested in different parts of the state against the EC.
