New Delhi: The Supreme Court, after hearing submissions for nine days, on Thursday reserved its judgment on a batch of cross-petitions of Uddhav Thackeray and Eknath Shinde groups in connection with the Maharashtra political crisis.
A five-judge constitution bench, headed by Chief Justice D.Y. Chandrachud and comprising Justices M.R. Shah, Krishna Murari, Hima Kohli and P.S. Narasimha, before reserving the verdict, shot a volley of questions at senior advocate Abhishek Manu Singhvi, representing the Thackeray group.
The Chief Justice asked Singhvi: “So, really the question is whether there was a valid exercise of power by the Governor to call for a trust vote? And what happens, if we come to a conclusion that there was no valid exercise of power by the Governor to call for a trust vote?”
Singhvi said everything falls. However, the bench that everything falls on would be simple but Singhvi stressed that is the core question and urged the court to allow him to present his case.
The Chief Justice further queried, “Then, according to you what, we reinstate the Uddhav Thackeray government? But you resigned.”
As Singhvi said Thackeray’s resignation and not facing the trust vote is irrelevant, the Chief Justice observed: “That is, the court being told to reinstate a government (which has resigned).”
To this, Singhvi said that it is a plausible way of looking at it but it is irrelevant, and asked the bench to give him an opportunity to explain his contention.
At this juncture, Justice Shah said: “How can the court reinstate a Chief Minister who did not even face floor test?” Singhvi said the court is not reinstating anyone but it is restoring the status quo ante.
The Chief Justice further queried Singhvi: “But, it would have been a logical thing to do provided you had lost the trust vote on the floor of the Assembly. Clearly, then you would have been ousted from power due to a trust vote, which is set aside… look at the intellectual conundrum that it is not that you have been ousted from power as a result of a trust vote which was wrongly summoned by the Governor. You chose not to, whatever reason you did not face the trust vote.”
The bench further said: “So you’re saying that Mr Uddhav Thackeray resigned only because he was called upon by the Governor to face a trust vote?”
Singhvi submitted, “I’m grateful. After I filed the petition, after I made it sub judice, and after I said it’s completely unknown to law and don’t allow it to go on.”
The Chief Justice then asked Singhvi: “You’re frankly accepting the fact that you resigned because the trust vote was going to go against you.” Singhvi replied that is an illegal act and consequences of it are known to his client.
The apex court heard arguments advanced on behalf of both Thackeray and Shinde groups and the office of the Governor and concluded the hearing after senior advocates Kapil Sibal, Singhvi, Devadatt Kamat and advocate Amit Anand Tiwari made their submissions.
The Shinde group was represented by senior advocates Neeraj Kishan Kaul, Harish Salve, Mahesh Jethmalani and advocate Abhikalp Pratap Singh. Solicitor General Tushar Mehta represented the office of the Governor in the matter. The hearing in the matter commenced on February 21.
On June 29, 2022, the apex court refused to stay the Governor’s direction to the Maha Vikas Aghadi government led by Thackeray to take floor test, who resigned sensing defeat. It paved the way for the Shiv Sena-BJP alliance led by Shinde to come to power in Maharashtra.
Dubai: Senior India spinner Ravichandran Ashwin’s superlative show in the fourth Test against Australia has helped him regain the top spot among bowlers in the latest ICC Rankings issued on Wednesday.
Ashwin, who grabbed a haul of six for 91 in the drawn fourth Test and was the leading wicket-taker in the Border-Gavaskar Trophy with 25 scalps, is 10 rating points ahead of England seamer James Anderson.
Fellow Indian left-arm spinner Axar Patel climbed six places to 28 among bowlers. He also rose to the fourth spot in the all-rounder’s list led by Ashwin and Jadeja.
While pacer Jasprit Bumrah, who is recovering from a recurring back injury, dropped to number seven among bowlers.
Talismanic Indian batter Virat Kohli moved seven places to 13th position after his Player of the Match performance against Australia in the fourth Test.
The high-scoring match at Ahmedabad also saw opener Shubhman Gill, who smashed a fine century, jump 17 places to 46th.
The injured Rishabh Pant (9th) and skipper Rohit Sharma (10th) are the Indian batters in the top 10.
Australia opener Usman Khawaja and New Zealand batter Daryl Mitchell have also made notable gains in the list.
Khawaja’s score of 180 in the drawn fourth Test against India in Ahmedabad has lifted him two spots to seventh position and to a career-best 815 rating points while Mitchell’s knocks of 102 and 81 in the epic victory over Sri Lanka in Christchurch has helped him reach a career-best eighth position as he touches the 800-point mark for the first time.
In the latest weekly update that also considers performances in the second Test between South Africa and the West Indies in Johannesburg, Temba Bavuma’s match-winning 172 for the home side has lifted him 14 slots to a career best 15th position.
Sri Lanka’s Angelo Mathews is another one to move up the batting rankings, his scores of 47 and 115 taking him from 19th to 17th position.
In the ICC Men’s T20I Player Rankings, Bangladesh batter Najmul Hossain Shanto’s scores of 51, 46 not out and 47 not out not only won him the Player of the Series award at home against England but have also lifted him 68 places to 16th position.
In the ODI Rankings, Nepal batters Rohit Paudel (up four places to 55th) and Aasif Sheikh (up 16 places to 62nd) and leg-spin bowler Sandeep Lamichhane (up five places to 21st) are among those to progress owing to their performances in matches of the ICC Men’s Cricket World Cup League 2 in Kirtipur, Nepal.

New Delhi, Mar, 13: With Sri Lanka losing the first Test against New Zealand in the two-match series, Australia and India have been locked in as the 2023 World Test Championship finalists.
On their tour of New Zealand, Sri Lanka had a possibility to pip India and join Australia in the final at The Oval, London starting June 7. This, only if they could have won the series 2-0, and India didn’t win the final Test in Ahmedabad. Two wins in New Zealand would’ve propelled Sri Lanka’s points percentage (PCT) to 61.11. Whereas, if India are unable to win the fourth Test to Australia, their PCT would be 58.79 or lesser depending on the outcome. With the result in Christchurch being a two wicket win for New Zealand, the permutation and combinations have been thrown out of the window.
Chasing 285 on the final day, New Zealand batters approached a win with Kane Williamson scoring a century in the second innings at the Hagley Oval. With eight runs needed off the last over, New Zealand would seal the game on the last ball of the day with two wickets in hand.
While India and Australia are still in action on the final day of the four match Test series, with the hosts leading 2-1, the result in Ahmedabad won’t effect any of their chances now to feature in the 2021/23 Test cycle final this summer.
Australia had sealed off their place in the final after their nine wicket win in the Indore Test last week, with a 68.51 PCT after that last result. The result in Indore had hit India’s PCT in the tally, as it dipped from 64.06 to 60.29. To not be dependent on Sri Lanka for qualifying in the final, India had to win the series 4-0 or 3-1 but the current holders of the ICC Test mace have done them a favor.
For India, it will be a second consecutive qualification in the summit clash, in which they squared off against New Zealand in the 2019/21 cycle, losing by eight wickets to the Black Caps. Australia on the other hand, had missed out on a final spot last time around by a 0.8 point difference to their Trans-Tasman rivals.
Assam board exam: General science question paper leaked, test cancelled
Guwahati: The Assam Government on Monday said the general science question paper of the Class 10 state board exam was leaked and the test has been cancelled.
A police case was filed and the CID has been ordered to investigate the matter, Education Minister Ranoj Pegu said.
“Last night, Secondary Education Board, Assam (SEBA) got some clue that today’s paper (general science) has been leaked. Accordingly, the exam was cancelled. The next date will be announced in due course of time,” Pegu told reporters here.
A detailed probe will reveal the source of the leak and the culprits behind it, he said.
“There is no question of involvement of teachers. The papers are kept at police stations and taken to examination centres only on the morning of the test day,” Pegu added.
But not long after Durr donned a suit and entered the Statehouse in Trenton, the TV cameras stopped following him. He soon faced the reality of his situation: He’s a backbencher in a minority party — someone with little clout and, on top of that, someone who Democrats want to work against.
Durr now finds himself facing rivals within his own party who believe his election was a fluke, who fault him for politically-damaging social media posts that emerged after his surprise victory and who believe he’s wasted a year by focusing on culture war issues that have already proven to hurt Republicans in the post-Roe era.
In terms of making laws, he’s accomplished little to nothing. And Democrats, of course, are plotting to take him down.
“There are going to be certain bills of mine they’re never going to touch because they’re too conservative,” Durr, 60, acknowledged in a phone interview. “I’ve had bills that even Democrats will probably appreciate, but they won’t move them because it’s Ed Durr.”
Since taking office, Durr has been among the top sponsors of 167 pieces of legislation — the 10th most of the state’s 40 senators. None have been signed into law, ranking him in a tie for dead last among senators who have served since the beginning of the term.
Durr has introduced many bills that reflect right-wing causes and have near zero chance of passage. They include several measures that would severely restrict abortion access; ease New Jersey’ strict firearm carry and permitting restrictions; repeal vaccine requirements; punish educators and school districts that teach critical race theory; and a bill that would ban teaching younger students about gender identity and sexual orientation that critics called the New Jersey version of the Florida law activists have labeled “Don’t Say Gay.”
“I didn’t have any expectations. I just knew that I wanted to get in there and be a voice for my constituents,” Durr said. “And I think I have, to be quite honest with you.”
Democrats eye a comeback as Durr, GOP feud
Democrats are working to oust Durr this year. Sweeney, who is considering running for governor in 2025, had been mulling whether to challenge Durr in November but reportedly will stay out of the Senate race and his old district running mate, former Assemblymember John Burzichelli, will run instead.
As such, Durr said that he’s even gotten shunned by Democrats on his more policy-focused bills, like a measure inspired by Billy Cray, a developmentally-disabled man who died in his group home. The bill, which would allow adult group homes to give residents the choice to have electronic monitoring devices in common areas and private rooms, had been sponsored by state Sen. Fred Madden, another South Jersey Democrat, before Durr entered office.
Durr said he asked Madden to again sign onto that bill, “and he chose not to.” The Democratic chair of the state Senate Health Committee, Joe Vitale, has refused to advance it as well, Durr said.
“You tell me why he won’t. He’ll give you a lame excuse, but it’s clearly me,” he said.
Vitale said he’s not blocking the bill because of Durr.
“I told him to do the hard work. There are likely as many individuals and organizations in favor and as many opposed,” Vitale said. “I’ve asked him to do the hard work and reach out to those who don’t support the bill, work with them on potential language changes and let me know how he wants to proceed.”
Madden also cited advocates’ opposition to the measure as the reason he chose not to sign on again, saying he’d rather stay off the bill until those issues are resolved.
“That’s it,” Madden said. “Here we are a year later, and you’re telling me he’s claiming I won’t go on a bill because I was told not to do something? It’s just bizarre.”
Burzichelli, who lost in 2021 to Durr’s Assembly running mates, said Durr has not reached out to the right people to be an effective senator.
“Clearly the people who took our place have been ineffective at building relationships, ineffective at delivering anything of significance for the legislative district. And there’s no indication it will get better,” Burzichelli said.
Burzichelli, who was chair of the influential Appropriations Committee, said he and his defeated district-mates had lined up somewhere around $1 billion in programs that were to “find their way to the district” but “that momentum stopped” with Durr’s swearing-in.
“I’m not aware of anything they’ve gotten done,” Burzichelli said. “That’s not a harsh statement about personalities. It’s just a fact like a report card.”
Meanwhile, Durr and one of his two former running mates, Assemblymember Beth Sawyer, have spent much of the last year feuding. Now, Sawyer is expected to run for Assembly in the Republican primary on a slate opposite Durr’s, headed up by Salem County Commissioner Mickey Ostrum. (Sawyer did not respond to a call seeking comment and Ostrum said he would hold off commenting pending a formal announcement).
But Adam Wingate, a Republican candidate for Gloucester County commissioner in 2022, blamed Durr in part for his loss — noting Democrats tried to link him to Durr’s social media posts, including one 2020 Facebook post in which Durr said, “A woman does have a choice! Keep her legs closed.”
“Ed’s been polarizing since day one,” Wingate said. “Just his social media presence and the way he carries himself.”
Nevertheless, Durr has managed to secure Republican Party backing in two of his district’s three counties, which makes him the favorite for reelection.
Durr’s brief national fame never translated to fundraising prowess, however. In the last three months of 2022, his campaign reported raising just $1,800, and he began the new year with about $35,500 in the bank. Should Burzichelli run, he’d likely be able to count on the help of multi million-dollar super PAC unofficially controlled by South Jersey Democratic power broker George Norcross.
Durr said he’s worked hard on constituent services in the district, telling POLITICO his office has fielded calls from constituents to help navigate the bureaucracy of the Motor Vehicles Commission and Unemployment Insurance fund, both of which have had major customer service issues since the pandemic.
“When I’m out and about throughout the district, just to have someone come up and say how good they feel that somebody’s actually listening to them and paying attention,” Durr said.
And Durr said the district was still plagued with problems after 20 years of Democratic representation, like one town where the only place to buy food is a dollar store.
“There are issues throughout the district that were not addressed when Sweeney was Senate president and Burzichelli was Appropriations chair,” Durr said. “To complain about our ineffectiveness given that we’ve only been in one year and are the minority seems laughable for the lack of progress they made for the 20 years they were in office.”

Ahmedabad: Two persons were arrested from Rewa district in Madhya Pradesh by Gujarat police in connection with a bulk video and voice message released allegedly by a pro-Khalistan group threatening to storm Narendra Modi Stadium ahead of the India-Australia cricket match that started on March 9 in Ahmedabad, an official said on Sunday.
Ahmedabad police’s cyber crime cell traced the origin of the message to a facility set up in Rewa in the neighbouring state for call spoofing and arrested two persons from there, the official said.
The bulk message, urging people to stay safe at home as a pro-Khalistan group planned to storm the cricket stadium and install its flag, was released ahead of the India-Australia cricket match that was witnessed by Prime Minister Modi and his Australian counterpart Anthony Albanese.
“We have arrested two persons from Rewa district and busted a facility set up there for call spoofing. We traced the threat video message from the facility and recovered 11 SIM boxes, around 300 SIM cards, 4-5 routers,” Assistant Commissioner of Police (Cyber Crime) Jitendra Yadav said.
He identified the accused as Rahul Kumar and Narendra Kushwaha, who hail from Satna in MP.
“The threat was issued on a recorded message, and the call is jumped, spoofed in such a way that it becomes difficult to locate them. We have busted the centre from where the call was being spoofed. Further investigation will reveal who all are behind the recorded message,” Yadav said.
The messages, released purportedly by Gurpatwant Singh Pannun, founder of US-based terrorist organisation ‘Sikhs for Justice’, threatened to disrupt the cricket match, with police saying it was aimed at creating panic among people.
“People of Gujarat, stay home and stay safe on March 9 (the day of opening of match between India and Australia) because pro-Khalistani Sikhs are going to storm Narendra Modi stadium and install Khalistani flag,” said message relayed through bulk messaging and mass voice call.
This was received by a number of people on their phones, as per police.
Ahmedabad: Virat Kohli finally ended his Test century drought as he slammed an outstanding ton to put India in a commanding position on Day 4 of the ongoing fourth Test match against Australia here at Narendra Modi Stadium in Ahmedabad on Sunday.
At the time of tea break, India’s score read 472/5 with Kohli (135)* and Axar Patel (38)* unbeaten at the crease. The hosts still trail by just 8 runs.
Kohli ended his Test century drought as he slammed his first Test century since November 2019.
After lunch, Indian batsmen Virat Kohli and Srikar Bharat opened their hands and slammed Australian bowlers at regular intervals for boundaries.
Cameron Green was on the receiving end with Srikar Bharat smashing him for 21 runs with the help of two boundaries and two sixes in an over.
Srikar Bharat’s blistering stint at the crease came to an end as he was dismissed by Nathan Lyon for 44. The left-handed batter Axar Patel then came out to bat at the crease.
Kohli ended his Test century drought as he slammed his first Test century since November 2019. The former India captain brought up his much-needed hundred in 241 balls. It was the most-awaited ton as his last century came against Bangladesh in November 2019. With this century, he took his international century tally to 75.
Kohli continued his blistering form and slammed Mitchell Starc for brilliant two boundaries collecting 9 runs. Kohli along with Patel took India’s total beyond the 400-run mark in the 140 overs of the game.
The duo of Kohli and Patel stitched up their 50-run partnership stand –the 6th consecutive 50-run partnership for Team India.
The Indian pair remained unbeaten as the visitors ended the session at 472/5.
Earlier, Kohli and Srikar Bharat showed remarkable skill and determination to frustrate the Australian bowling attack in the opening session of Day 4.
The batting pair of Ravindra Jadeja and Virat Kohli were decisive in their approach and made the Australian bowlers toil hard making merry of the excellent batting conditions on offer.
Australia skipper Steve Smith introduced Cameron Green into the attack in the very first over of day 4 and the bowler concede just 4 runs. Australia started with spin with Nathan Lyon and Todd Murphy bowling in tandem from both ends.
The duo of Jadeja and Kohli took India’s total beyond the 300-run mark in the 102nd over of the game. However, the 64-run partnership stand was broken by Murphy who dismissed Jadeja for 28 runs. Srikar Bharat then came out to bat.
The Indian batters rotated the strike brilliantly, not allowing the Australian bowlers to settle down while whacking the loose balls on offer.
Kohli and Srikar Bharat both were aggressors of the batting pair, smashing boundaries regularly. The duo stitched a solid 50-run partnership for Team India.
The Indian pair took India’s score beyond the 350-run mark as the first session ended.
