Hyderabad: 5 persons sentenced to jail term in bank fraud case

    [ad_1]

Hyderabad: The Enforcement Directorate (ED) and the Metropolitan Sessions Judge has convicted all the accused involved in Chiakkilam Trade House Limited Bank Fraud case amounting to Rs. 2.08 crore and sentenced them to jail terms.

A case under Section 3 of the Prevention of Money Laundering Act, (PMLA) 2002 is registered against T Jayasree, M Chinna (employees of M/s Chakkilam Trade House Limited) and three bank officials namely S Narasimhan, A Sesibhushana Rao and S Arogyam for cheating the SBI bank.

All the five persons were sentenced to undergo rigorous imprisonment for a period of seven years and were asked to pay a fine of Rs. 50,000 each. Further, the Court has directed M/s Chakkilam Trade House Limited to pay a fine of Rs. 1 lakh.

Prevention of Money Laundering Act investigation was conducted by ED on the basis of a case registered by the Central Bureau of Investigation, Anti-Corruption Branch, Hyderabad under various provisions of Indian Penal Code (IPC) and Prevention of Corruption Act, 1988.

The ED investigation established that M/s Chakkilam Trade House Limited (then represented by its Director Late Sh. Chakkilam Raghuram) had fraudulently availed a loan from SBI on the basis of fabricated financial statements, board resolution and documents showing higher turnover and fake MoUs with various parties showing business dealings.

A total amount of Rs 2.08 crore sanctioned by SBI was misappropriated and laundered.

Investigation also revealed that properties, which were mortgaged with the banks for the loan, were already sold by the company and its promoters.

On conclusion of investigation, ED filed a Prosecution Complaint in December 2013 against M/s Chakkilam Trade House Limited and six accused persons, including three bank officials, involved in the offence of money laundering.

  • SC takes giant leap towards reforms during first 100 days of CJI Chandrachud’s term

SC takes giant leap towards reforms during first 100 days of CJI Chandrachud’s term

    [ad_1]

New Delhi: Chief Justice of India (CJI) D Y Chandrachud’s first 100 days in office saw the Supreme Court take a giant leap towards reforms, especially making courts more technology-friendly, and ensuring relatively fast judicial appointments including those of eight judges to the apex court.

During the tenure of Justice Chandrachud, the 50th head of the judiciary, the top court witnessed a sharp rise in disposal of cases with the number of cases getting disposed exceeding those filed.

Justice Chandrachud, son of former CJI Y V Chandrachud, was sworn in as the CJI on November 9 last year and is due to retire on November 10, 2024.

As per information shared by an apex court source, during the first 100 days of Justice Chandrachud’s stint as the CJI, several steps have been taken including those for digitization of records, online appearance slips for lawyers, RTI online portal and launch of digital courts desktop application.

“During the period ranging from November 9, 2022 to February 15, 2023, total number of cases filed are 13,764 and total number of cases disposed of are 14,209,” the source said.

On the issue of judicial appointments, eight judges have been appointed in the apex court during Justice Chandrachud’s tenure while 12 names have been recommended by the apex court Collegium for appointment of high court chief justices.

“Against these recommendations, four chief justices (including one woman and one belonging to OBC) have been appointed. In an unprecedented manner, recommendations have been made against anticipated vacancies of chief justices of two high courts,” the source said.

“Thirtyfive names (including seven names of women candidates) have been recommended by the SC Collegium for appointment of high court judges. 30 judges (including seven women judges, eight belonging to OBC, two SC, one ST, one Christian and one Muslim) in high courts have since been appointed,” he said.

He said while recommending the names for judicial appointments, the aspects of inclusion of gender diversity and the need to give due representation to marginalsed and backward sections of the society and minorities are being duly taken into consideration by the Collegium.

For the first time, CJI Chandrachud-led Collegium started the practice of providing details of deliberations in recommending the names to the Centre for judgeship.

The source said, in a conference held on the occasion of the Constitution Day in November last year, Justice Chandrachud had urged the chief justices of the high courts to accord priority to filling up vacant posts at all levels by making merit-based recommendations of suitable persons with impeccable integrity and personal and professional conduct.

He said on January 2 this year, the CJI had launched the e-SCR (Supreme Court Reports) with more than 34,000 judgments available online.

“With an aim to provide access to the judgments in scheduled languages, the new feature provides translated versions of Supreme Court judgments in Indian languages,” he said, adding so far 3,132 judgments translated in Indian languages are available.

The source said since the launch of advocate appearance slip portal, 1,42,818 online appearance slips have been submitted and equal number of paper sheets, if not more, have been saved.

“The process of scanning and providing soft paper books for paperless court functioning are inspired by the visionary outlook of the Chief Justice of India to ensure that judiciary uses technology to its optimum level. The PIL section has also started extensive use of technology and is working towards electronic processing of petitions,” he said.

He said with the decision of the competent authority to continue hearing in physical-hybrid mode, the computer cell has played a key role to ensure that video conference infrastructure and services are up and running 24×7.

“Since November 9, 2022 until February 15, 2023, the Supreme Court of India has witnessed 2,53,919 attendees for VC hearings. Further, during the same period, 43 hearings of constitution bench cases through YouTube and NIC webcast services have been live-streamed,” the source said.

The information shared by the source said the ‘Supreme Court Committee on Accessibility’ has been constituted with a broad aim to conduct an accessibility audit of the top court premises and its functioning.

It said training sessions in stress management, communication and presentation skills, organisational behaviour and ethics and value in public governance, critical thinking, problem solving and decision making for the officers and staff members of the registry are underway.

It said the ‘AI assisted Legal Translation Advisory Committee’ has been constituted to assess and monitor the progress of and to suggest measures to further enhance usage of Artificial Intelligence tools for translating judicial records in various vernacular languages in the top court.

“The RTI online portal launched on November 24, 2022 has been a giant leap towards transparency, paperless filing of applications, appeals and payment of fees through online mode such as net banking, card payments, UPI, etc. Around 450 online RTI applications have been received till date,” the source said.

He said PIL-English branch has started online processing of all petitions received electronically by e-mail and through this initiative, the SC Registry will be saving enormously in terms of papers and manpower.

“Based on the statistics of last year, 83,000 letter petitions were received electronically, and presuming that on an average each petition consists of at least two pages, the Registry will be saving 1,66,000 pages equivalent to 332 reams of A-4 size paper,” the data said.

It said on the judicial side, several initiatives have been taken and fresh and after notice matters are being listed on Monday, Tuesday and Friday and only regular matters are listed on Wednesday and Thursday.

The source also shared details about initiatives of e-committee, which includes “sensitization module for the judiciary on LGBTIQA+ community”.

He said based on a proposal of the e-Committee, the Finance Minister has announced Rs 7,000 crore budget outlay for phase 3 of the e-Courts project.

NATO’s Stoltenberg will not seek another extension of his term

    [ad_1]

    us nato 21224

NATO Secretary General Jens Stoltenberg plans to step down from his post as planned in October, his spokeswoman Oana Lungescu told German news agency Deutschen Presse-Agentur, dismissing reports of another extension to his term.

“He has no intention of seeking a further extension of his mandate,” she said.

Welt am Sonntag reported earlier Sunday that Stoltenberg’s term may be extended again as NATO seeks to maintain stability during the war in Ukraine, the latest in series of speculation that the NATO chief might stay on.

Stoltenberg’s term has been extended three times already, most recently in March last year just after Russia invaded Ukraine. Stoltenberg, an economist by training, had been designated to become Sweden’s central bank chief at the time.

  • Flexing his wins and eyeing a 2nd term, Biden will lay out contrasts with GOP in State of the Union

Flexing his wins and eyeing a 2nd term, Biden will lay out contrasts with GOP in State of the Union

    [ad_1]

    biden 72968

Though Biden won’t mention them by name, aides believe the presence of newly prominent House Republicans in the chamber will underscore his arguments. A year ago, Reps. Marjorie Taylor Greene (R-Ga.) and Lauren Boebert (R-Colo.) heckled Biden during his speech, and photographs of their shouting went viral. White House aides privately admit that they wouldn’t mind that happening again this time, creating a contrast between rabble-rousing in the crowd and steady leadership on the dais.

“The theme of a State of the Union is always ‘Who are we, who do want to be? What do we stand for, what do we want to believe?’” said Jen Psaki, Biden’s former press secretary. “That is not to ignore or deny huge problems in the country but to say ‘I will work with people to take them on.’”

But the subtext of the address will not be the lawmakers in the seats but the campaign ahead. Biden has not yet declared his candidacy but the State of the Union could very well double as a soft launch for a 2024 bid. The president has said he intends to stand for re-election, though some of his closest advisers caution that a final decision has not yet been made. In somewhat classic Biden fashion, the timeline for an announcement has shifted, according to four people familiar with the decision.

Originally pegged to March or April, in part for fundraising purposes, there had been talk of moving an announcement up to late February. That now may have slipped again as the White House grapples with the appointment of a special counsel to investigate the discovery of mishandled classified documents at Biden’s Delaware home and former office.

Biden advisers have downplayed the impact of the discovery — pointing to his unchanged approval rating in the face of the controversy. They believe the Democrats’ triumphs in November squelched any talk of an intra-party challenger and bought the 80-year-old president time to make his decision.

Still, Biden faces challenges heading into Tuesday’s address.

A divided Washington and a growing array of challenges could define his presidency in the months ahead. House Republicans are ramping up their investigations. The battle for Ukraine continues to rage. And in just the last fortnight, the nation has been left reeling by video of a brutal deadly assault of a Black man at the hands of police.

Biden is expected to rally Americans on Tuesday with the notion that the nation is at an inflection point as it emerges from the COVID pandemic and the trials put forth by Donald Trump’s time in office.

A year ago, Biden delivered his first State of the Union just days after Vladimir Putin sent his Russian forces over the Ukrainian border. The fate of Kyiv hung in the balance and Biden used a sweeping portion of his speech to argue that the defense of Ukraine was a defense of democracies around the globe.

Now, the case will be different. Ukraine has shown remarkable resilience, repelling much of Russia’s aggression, but the war has settled into a grinding slog with Kyiv clamoring for more weapons to defend itself for months if not years. Biden, aides said, will outline to the public why continued, sustained American involvement is needed. He will urge Republicans to ignore the voices in their own party who want to curtail funding to Ukraine.

Another standoff with Republicans will also be central to Biden’s pitch: the need to lift the nation’s debt ceiling. He will make clear that he will not negotiate on the country’s fiscal future, connecting it to his stewardship of the economy. Though inflation remains high, it has begun to cool, and the president is expected to point to historically low unemployment, strong jobs numbers and a growing feeling among economists that the nation could avoid a recession.

“There should be a focus on tone: be firm without [being] combative,” said Kevin Madden, a Republican strategist who was a senior adviser on Mitt Romney’s 2012 presidential campaign. “And there has to be an acknowledgment of the pain inflation has caused. It can’t just be ‘happy talk’ about what they’ve done on the economy. You run the risk of looking out of touch.”

Any State of the Union is of the moment, and reflective of the challenges facing the country when it is delivered. In recent days, Biden aides have inserted sections into the speech on the collective traumas suffered by the nation last month.

In the wake of several mass shootings, including two in California just days apart, Biden will again call for a ban on assault weapons, an idea that has little chance of receiving Republican support. And he will likely mourn with the nation over Tyre Nichols, a Black man who died at the hands of Memphis police officers last month, trying to thread the needle of showing support for law enforcement while also advocating for police reform.

Even if some legislation — like the George Floyd Policing Bill and the assault weapons ban — have little chance of becoming law, there is still value in the president proposing something that polls show is popular with most Americans, aides said.

Some of Biden’s speech will be backward-looking, reflecting the political reality of a divided Congress unlikely to pass meaningful legislation against a backdrop of GOP probes into the president’s administration and family. But White House aides believe that could be to their advantage, allowing the president to blame the GOP for gridlock while he can extoll the accomplishments of the last two years.

One example will be infrastructure. Aides plan for Biden to highlight the projects underway thanks to the $1 trillion in federal funding and point to last week’s schedule — the president visited one project in Baltimore and another in New York City — as a preview of the year ahead. Biden will start criss-crossing the country to tout work funded by his administration, beginning with a post-speech barnstorming tour across the Midwest later this week.

The president, always deliberative, will consider his political future by making more rounds of calls to his longtime allies, talking through themes and timing, pushed by a belief that he remains the one Democrat who could defeat Trump. Most close to Biden believe that, soon enough, an official campaign will begin in earnest.

“He should focus attention on … big legislative achievements, the national pandemic emergency ending, the economy stabilizing and still growing, and how the midterms went very well for his party,” said Julian Zelizer, a presidential historian at Princeton University. “If this was any other president, without the age issues or concerns about what the Republican campaign might look like, this would be a message to launch 2024.”
