SC takes giant leap towards reforms during first 100 days of CJI Chandrachud’s term

    [ad_1]

New Delhi: Chief Justice of India (CJI) D Y Chandrachud’s first 100 days in office saw the Supreme Court take a giant leap towards reforms, especially making courts more technology-friendly, and ensuring relatively fast judicial appointments including those of eight judges to the apex court.

During the tenure of Justice Chandrachud, the 50th head of the judiciary, the top court witnessed a sharp rise in disposal of cases with the number of cases getting disposed exceeding those filed.

Justice Chandrachud, son of former CJI Y V Chandrachud, was sworn in as the CJI on November 9 last year and is due to retire on November 10, 2024.

As per information shared by an apex court source, during the first 100 days of Justice Chandrachud’s stint as the CJI, several steps have been taken including those for digitization of records, online appearance slips for lawyers, RTI online portal and launch of digital courts desktop application.

“During the period ranging from November 9, 2022 to February 15, 2023, total number of cases filed are 13,764 and total number of cases disposed of are 14,209,” the source said.

On the issue of judicial appointments, eight judges have been appointed in the apex court during Justice Chandrachud’s tenure while 12 names have been recommended by the apex court Collegium for appointment of high court chief justices.

“Against these recommendations, four chief justices (including one woman and one belonging to OBC) have been appointed. In an unprecedented manner, recommendations have been made against anticipated vacancies of chief justices of two high courts,” the source said.

“Thirtyfive names (including seven names of women candidates) have been recommended by the SC Collegium for appointment of high court judges. 30 judges (including seven women judges, eight belonging to OBC, two SC, one ST, one Christian and one Muslim) in high courts have since been appointed,” he said.

He said while recommending the names for judicial appointments, the aspects of inclusion of gender diversity and the need to give due representation to marginalsed and backward sections of the society and minorities are being duly taken into consideration by the Collegium.

For the first time, CJI Chandrachud-led Collegium started the practice of providing details of deliberations in recommending the names to the Centre for judgeship.

The source said, in a conference held on the occasion of the Constitution Day in November last year, Justice Chandrachud had urged the chief justices of the high courts to accord priority to filling up vacant posts at all levels by making merit-based recommendations of suitable persons with impeccable integrity and personal and professional conduct.

He said on January 2 this year, the CJI had launched the e-SCR (Supreme Court Reports) with more than 34,000 judgments available online.

“With an aim to provide access to the judgments in scheduled languages, the new feature provides translated versions of Supreme Court judgments in Indian languages,” he said, adding so far 3,132 judgments translated in Indian languages are available.

The source said since the launch of advocate appearance slip portal, 1,42,818 online appearance slips have been submitted and equal number of paper sheets, if not more, have been saved.

“The process of scanning and providing soft paper books for paperless court functioning are inspired by the visionary outlook of the Chief Justice of India to ensure that judiciary uses technology to its optimum level. The PIL section has also started extensive use of technology and is working towards electronic processing of petitions,” he said.

He said with the decision of the competent authority to continue hearing in physical-hybrid mode, the computer cell has played a key role to ensure that video conference infrastructure and services are up and running 24×7.

“Since November 9, 2022 until February 15, 2023, the Supreme Court of India has witnessed 2,53,919 attendees for VC hearings. Further, during the same period, 43 hearings of constitution bench cases through YouTube and NIC webcast services have been live-streamed,” the source said.

The information shared by the source said the ‘Supreme Court Committee on Accessibility’ has been constituted with a broad aim to conduct an accessibility audit of the top court premises and its functioning.

It said training sessions in stress management, communication and presentation skills, organisational behaviour and ethics and value in public governance, critical thinking, problem solving and decision making for the officers and staff members of the registry are underway.

It said the ‘AI assisted Legal Translation Advisory Committee’ has been constituted to assess and monitor the progress of and to suggest measures to further enhance usage of Artificial Intelligence tools for translating judicial records in various vernacular languages in the top court.

“The RTI online portal launched on November 24, 2022 has been a giant leap towards transparency, paperless filing of applications, appeals and payment of fees through online mode such as net banking, card payments, UPI, etc. Around 450 online RTI applications have been received till date,” the source said.

He said PIL-English branch has started online processing of all petitions received electronically by e-mail and through this initiative, the SC Registry will be saving enormously in terms of papers and manpower.

“Based on the statistics of last year, 83,000 letter petitions were received electronically, and presuming that on an average each petition consists of at least two pages, the Registry will be saving 1,66,000 pages equivalent to 332 reams of A-4 size paper,” the data said.

It said on the judicial side, several initiatives have been taken and fresh and after notice matters are being listed on Monday, Tuesday and Friday and only regular matters are listed on Wednesday and Thursday.

The source also shared details about initiatives of e-committee, which includes “sensitization module for the judiciary on LGBTIQA+ community”.

He said based on a proposal of the e-Committee, the Finance Minister has announced Rs 7,000 crore budget outlay for phase 3 of the e-Courts project.

  • European Commission takes Poland to court over ‘legal Polexit’

European Commission takes Poland to court over ‘legal Polexit’

    [ad_1]

The European Commission is taking Poland to court over rulings from Polish judges considered by experts as a “legal Polexit” that fundamentally undermine the EU’s legal order.

The decision to refer Poland to the European court of justice on Wednesday – described by one expert as a bombshell – comes as Poland’s rightwing nationalist government battles to secure €35.4bn (£31.4bn) in EU Covid recovery funds that have been frozen over concerns about government-influenced courts.

The latest legal step ratchets up pressure on the Polish government, which faces elections this autumn and has been struggling to convince EU authorities to release billions of grants and loans.

The EU’s legal case is a response to a July 2021 decision by Poland’s constitutional tribunal that declared measures imposed by the ECJ unconstitutional, a fundamental breach of the principle of the supremacy of EU law, which Warsaw signed up to when it became an member state.

Legal experts have described the July 2021 decision as “legal Polexit” that could indicate a first step towards Poland’s departure from the union, despite opinion polls showing the popularity of the EU across the country.

The commission opened legal action against Poland in December 2021, but has only now decided to refer Warsaw to the ECJ, after more than a year of fruitless discussions.

Announcing the decision on Wednesday, the commission said Poland’s constitutional court had violated EU law and the government had failed to address its concerns.

“Everyone in the EU should enjoy the fundamental principles and the rights of the EU legal order, including the right to a court that is independent under EU law,” tweeted the EU justice commissioner, Didier Reynders.

The dispute over the rule of law dates back to the return to power of Poland’s nationalist Law and Justice party in 2015, when it began installing loyalists in the courts. EU officials believe Poland’s constitutional tribunal is no longer an independent and impartial court, owing to “irregularities” in the appointment of its president and senior judges.

As a result of concerns over the independence of Polish courts, the commission has withheld €35.4bn in recovery grants and loans, pending reforms to Poland’s judicial system. The head of the European Commission, Ursula von der Leyen, has laid down three conditions for releasing the funds: dismantling a disciplinary chamber for judges within Poland’s supreme court; changing the judicial disciplinary system; and reinstating judges suspended under current rules.

But Poland’s government – divided between moderate forces desperate for EU funds and hardliners who oppose backing down – has so far been unable to agree reforms that meet the EU conditions.

    skip past newsletter promotion

Adding to the uncertainty, Poland’s president, Andrzej Duda, last week refused to sign a key judicial reform bill the government had hoped would meet EU tests and unlock the funds. Duda referred the bill to Poland’s controversial constitutional tribunal for a ruling on its compatibility with Poland’s constitution.

Jakub Jaraczewski, a researcher at the Berlin-based NGO, Democracy Reporting International, described the commission’s latest legal step as a bombshell, while also criticising the EU executive for acting too slowly.

He highlighted the widespread view that Poland’s staunch support for Ukraine and help for millions of Ukrainian refugees may have slowed down the commission’s response. “Yes, I know, war, tanks, Poland first to fight, how much you can pile on a country that carries so much weight right now,” he wrote on Twitter. “But Russia will be defeated and the Polish rule of law problem won’t go away with that. So, great that this is happening, but it could have been sooner.”

Kavitha takes dig at Centre over I-T surveys on BBC offices

    [ad_1]

Hyderabad: Bharat Rashtra Samithi (BRS) MLC K Kavitha on Tuesday took an apparent jibe at the Centre over the I-T survey conducted at BBC offices, located in Delhi, Mumbai, just weeks after the UK-based broadcaster aired a documentary on PM Modi.

Taking to Twitter, Telangana CM’s daughter said, “The entire ruling Government defends against probe amidst allegation on one business house and the same Government sends its agencies behind those who show the truth! Why?”

The I-T surveys conducted at BBC offices have drawn sharp reactions from several opposition leaders, including from J-K former CM Farooq Abdullah.

While reacting to the episode, Abdullah said, “Democracy is already under threat here and media is being suppressed and this raid on BBC is an addition to this.”

The former Telangana Pradesh Congress Committee president Uttam Kumar Reddy said that this operation, carried out by officials of the I-T department, will malign the country’s image throughout the world.

Earlier this morning, Income Tax officials arrived at BBC offices located at the national capital’s KG Marg for the survey. The British broadcaster’s office at Kalina Santacruz in Mumbai was also surveyed, sources said adding that the survey was limited to the business premises of BBC only.

According to reports, a team of IT officials arrived at the BBC Studios office in Kalina Santacruz around 11.30 am today and a survey has been going on since then. There is no I-T activity at the BBC News office at Linking Road Bandra West.

It is learnt that the tax officials are conducting verification of certain account documents in the finance department of the BBC offices.

During the investigation, the mobile phones of all the employees present in the BBC office were taken away by the Income Tax team. The data of the computer kept in the accounts and finance department was also scanned. According to sources, officials said the devices will be returned to their owners after taking a backup.

However, as the survey was underway, the British public broadcaster BBC News released a statement, saying that it is cooperating with the Income Tax department, which is conducting a survey at its offices in New Delhi and Mumbai.

“The Income Tax Authorities are currently at the BBC offices in New Delhi and Mumbai and we are fully cooperating,” the BBC News Press Team said in a statement.

The searches come weeks after the BBC released a documentary on Prime Minister Narendra Modi – ‘India: The Modi Question,” which caused controversy on January 21. The Centre had issued directions for blocking multiple YouTube videos and Twitter posts sharing links to the controversial BBC documentary on PM Modi. The Supreme Court had on February 3 directed the central government to produce original records relating to its decision to block the BBC documentary.

  • UK PM vows to do whatever it takes amid Chinese spy balloon fears

UK PM vows to do whatever it takes amid Chinese spy balloon fears

    [ad_1]

London: British Prime Minister Rishi Sunak on Monday vowed to do “whatever it takes” to keep his country safe, amid mounting fears that suspected Chinese spy balloons could also target the UK, a day after the US military shot down a fourth flying object over the American airspace.

During a hospital visit in northern England, Sunak said the UK was in constant contact with its allies across the Atlantic and remained in readiness for any safety response.

Sunak’s response comes as his defence minister Ben Wallace confirmed the UK is launching a review into the security implications of the recent incursions into western airspace.

“I want people to know that we will do whatever it takes to keep the country safe,” Sunak told reporters.

“We have something called the quick reaction alert force, which involves Typhoon planes kept on 24/7 readiness to police our airspace. I can’t obviously comment in detail on national security matters but we are in constant touch with our allies and as I said we will do whatever it takes to keep the country safe,” he said.

On Sunday, the US military shot down its fourth flying object, indicating that they were still trying to determine the details and did not yet rule out any explanation for the objects.

“The UK and her allies will review what these airspace intrusions mean for our security. This development is another sign of how the global threat picture is changing for the worse,” said UK Defence Secretary Wallace.

Tensions were rising since a suspected Chinese spy balloon was shot down off the coast of South Carolina last week.

According to reports, US officials fear it was sent by Beijing to monitor sensitive sites but China has described it as a weather balloon.

In the UK, Transport Minister Richard Holden said it was “possible” that Chinese spy balloons had already been sent to this country.

“It is also possible, and I would think likely, that there would be people from the Chinese government trying to act as a hostile state. I think we have to be realistic about the threat these countries pose to the UK,” Holden told ‘Sky News’.

Meanwhile, the diplomatic row continues to escalate as the Chinese foreign ministry claimed on Monday that the US has flown balloons into its airspace more than 10 times over the past year.

“It’s not uncommon as well for the US to illegally enter the airspace of other countries,” said foreign ministry spokesperson Wang Wenbin at a press briefing.

“Since last year alone, US balloons have illegally flown above China more than 10 times without any approval from Chinese authorities.

The first thing the US side should do is start with a clean slate, undergo some self-reflection, instead of smearing and accusing China,” he said.

Washington is yet to respond to the allegations from Beijing.

    [ad_1]

Dausa: Prime Minister Narendra Modi on Sunday took a dig at Rajasthan Chief Minister Ashok Gehlot for reading portions from the state’s last year Budget speech while presenting the Budget for 2023-24, saying Congress governments’ “plans and announcements remained just on paper”.

The prime minister was addressing a rally here after inaugurating a stretch of the Delhi-Mumbai Expressway.

In his address during the rally, Modi also accused the Congress government in the state of lacking vision and hindering the state’s development and said a stable and growth-oriented government is needed Rajasthan to bring stability and to establish the rule of law.

Modi also referred to Gehlot’s Budget speech gaffe, saying what happened was being discussed all around.

“Anybody can make a mistake, but this shows the Congress has neither vision nor gravitas (wajan) and its plans and announcements remained just on paper,” Modi said.

While presenting the Budget for 2023-24 on Friday, Gehlot, who also holds the finance portfolio, mistakenly started reading portions from his last year’s Budget speech, leading to an uproar in the House. The uproar ended after Gehlot apologised.

Modi said Rajasthan would have progressed better if it had the double-engine government of the BJP, referring to the possibility of his party being in power both at the Centre and in the state

Six-yr-old boy takes ailing father to hospital in wooden cart in MP

    [ad_1]

Bhopal: A six-year-old boy pushed a wooden cart to carry his ailing father to a government hospital for treatment, the incident pointing fingers on yet another instance of alleged negligence in providing ambulances to the poor families in remote areas of Madhya Pradesh.

The matter came to the fore on Saturday after some locals spotted the boy along with his mother pushing a wooden cart and recorded it on the social media.

The incident was reported in Baliari town of Singrauli district where the family waited for an ambulance for more than one hour, however, delay in the arrival of the vehicle prompted the clueless boy to take his father to hospital in a wooden cart.

In a viral video, a boy dressed in a t-shirt and blue denims, is seen trying to control the movement of the cart, which he pushed around for three kilometres, while his mother was seen pushing it from the opposite end.

After the video of the incident surfaced on social media, Singrauli district administration took cognisance of the matter and ordered an inquiry in the matter later on Saturday evening.

“It has learnt that due to non-availability of an ambulance, the patient had to be taken to the hospital by his wife and innocent son. The Chief Medical Officer and civil surgeon have been directed to find out the reason for non-availability of ambulances,” Singrauli’s Additional Collector D.P. Burman told the press.

These kinds of incidents where people would be seen taking patients to hospitals or their bodies back to their homes and even pregnant women have been coming to the fore from different parts of Madhya Pradesh, especially in rural areas.

Turkey: 17-year-old Boy Takes THIS Extreme Step to Survive Under Rubble for 94 Hours- Details Here

A 17-year-old boy is sharing his story of survival after spending 94 hours trapped in rubble in the wake of the devastating earthquake that rocked Turkey early Monday.

Speaking via FaceTime from his hospital bed in Gaziantep, Turkey, Adnan Muhammet Korkut told ABC News he was asleep in his family’s home when the quake hit, and he then “got into the fetal position.”

While he was trapped, the teenager said that he drank his own urine and ate his family’s flowers to survive. “I set the alarm on my phone for every 25 minutes so I wouldn’t go to sleep. After two days, the battery went dead”, Korkut said.

As the rescue operation was going on, Korkut said, “I was hearing voices, but was worried they couldn’t hear me. I was afraid that I might get crushed during the rescue efforts. Thank you to the people who came and saved me”, the report added.

Many stories of the victims and survivors are making the headlines and garnering the netizens’ attention towards the horrible situation in the earthquake-struck region.

A toddler on Thursday was rescued after 79 hours from the rubble of a building that collapsed in Turkey’s southern city of Antakya. Footage from Turkey’s Humanitarian Relief Foundation (IHH) also showed how rescue workers looked into a narrow opening in the debris and pulled out the two-year-old.

Turkey-Syria earthquake death toll passes 28,000 as rescue hopes dwindle

The death toll in Turkey and Syria from the quake has surpassed 28,000, and hope of finding many more survivors is fading despite some miraculous rescues.

German rescuers and the Austrian army paused search operations on Saturday, citing clashes between unnamed groups.

Security is expected to worsen as food supplies dwindle, one rescuer said.

And nearly 50 people have been arrested for looting, with several guns seized, local media reported.

Turkey’s president said he would use emergency powers to punish anyone breaking the law.

An Austrian army spokesperson said early on Saturday that clashes between unidentified groups in the Hatay province had left dozens of personnel from the Austrian Forces Disaster Relief Unit seeking shelter in a base camp with other international organisations.

Nirmala Sitharaman takes on Congress, Mamata Banerjee in Lok Sabha

    [ad_1]

New Delhi: Finance Minister Nirmala Sitharaman, during her reply on the discussion on the Union Budget in Lok Sabha on Friday, slammed the Congress and also took on West Bengal Chief Minister Mamata Banerjee while imitating her “chhi-chhi” jibe.

Responding to the Opposition’s charge that allocation for minorities’ welfare had been reduced, Sitharaman criticised the Congress for the 1983 Nellie (Assam) massacre, when Indira Gandhi was the prime minister.

She took on the Congress by asking “when huge budget allocation was made for minorities that year, how did that incident happen?”

Sitharaman also referred to the anti-Sikh riots of 1984.

“Nellie chi, chi, chi… What happened in Nellie, that should be condemned with chi, chi, chi just like Mamata Banerjee’s poem,” she said.

Mamata’s ‘chhi-chhi’ remark was during the agitations against the Citizenship (Amendment) Act, 2019, in a public rally.
