    New Delhi The Supreme Court Friday granted bail to BJP leader Hardik Patel in a case lodged against him in connection with the violence during the Patidar stir in Gujarat in 2015 subject to his “diligent participation” in the investigation.

    A bench of Justice A S Bopanna and Justice Hima Kohli made its earlier order granting protection to Patel absolute.

    “This court had in February 2020 issued notice and had granted interim protection. Three-and-a-half years have passed since then. In these circumstances, we see no reason to alter the order at this juncture.

    “Hence, the interim protection granted to the petitioner shall continue till the completion of further process, subject to his diligent participation in the process, if called upon to do so,” the bench said while disposing of the plea filed by Patel.

    The top court was hearing a 2020 plea filed by Patel challenging the Gujarat High Court order rejecting his anticipatory bail plea after considering the government’s objection on grounds of his criminal antecedents.

    The Patidar Anamat Andolan Samiti under Patel had organised a mega rally in Ahmedabad as part of the stir demanding quota for the community in government jobs and an FIR was lodged for “unlawful assembly” as the police claimed the event did not have requisite permissions.

    The police had also contended that this unlawful gathering led to violence, in which over a dozen youths were killed and the property was damaged.

    In his anticipatory bail plea before the high court, Patel had claimed that he was being “victimised by the ruling party of the state” which has slapped “several false, frivolous and concocted cases against him”.

    The voluptuous statue of a mermaid placed in a square in a fishing village in Puglia, southern Italy, has caused a stir for being “too provocative”.

    The statue was created by students at the Luigi Rosso art school in Monopoli before being positioned in a square named after the scientist Rita Levi-Montalcini.

    The artwork, which is yet to be officially inaugurated, became a target of ridicule after photos taken during its installation were shared on social media.

    The Bari-based actor Tiziana Schiavarelli wrote on Facebook that a friend in Monopoli had “rightly expressed some perplexity about this ‘monument’”.

    “It looks like a mermaid with two silicone breasts and, above all, a huge arse never seen before on a mermaid. At least not any I know.”

    Schiavarelli stressed that she did not have an issue with the art students or the local council, which had commissioned the work. “But I am very amused by this thing … who knows if it will become a further attraction for tourists,” she added.

    Adolfo Marciano, the headteacher of the Luigi Rosso art school, defended the statue, saying it was a “tribute to the great majority of women who are curvy”. He explained that the students were tasked by the mayor of Monopoli to create several statues for the town, including one on the theme of the sea.

    “The students got together and came up with the idea of a mermaid,” Marciano said. “The council was shown the scale model and said it was good, and then decided the completed sculpture would be placed in the square.”

    Marciano said he did not want to cast judgement on the students’ inspiration, but that he viewed the work “as a representation of reality, in this case of the female body”.

    He added: “You see adverts on television with models who are very thin, but the mermaid is like a tribute to the great majority of women who are curvy, especially in our country. It would have been very bad if we had represented a woman who was extremely skinny.”

    Beppe, who lives in Monopoli, said the sculpture, which has been kept covered until its inauguration, had caused much discussion in recent days, with some people criticising it as “too provocative”.

    “It’s a shame as the art students deserve to be praised instead of criticised,” he said.

    The students also created a statue dedicated to the victims of workplace accidents, which will be unveiled on Monday. “This is much more important than the mermaid,” said Marciano.

    Female statues in other areas of Italy have caused similar controversy. In 2021, a bronze statue portraying a woman in a transparent dress in the Campania town of Sapri sparked a sexism row. The work, by the sculptor Emanuele Stifano, was intended as a tribute to La Spigolatrice di Sapri (The Gleaner of Sapri), written by the poet Luigi Mercantini in 1857. The statue, which was branded “an offence to women”, was unveiled during a ceremony attended by the former prime minister Giuseppe Conte.

    Anti-CAA stir: SC refuses to discharge Assam MLA Akhil Gogoi in NIA case

    New Delhi: The Supreme Court on Tuesday upheld an order of the Gauhati High Court which had set aside the discharge of independent Assam MLA Akhil Gogoi in connection with a case related to anti-CAA protests and suspected Maoist links.

    Allowing an appeal filed by the National Investigation Agency (NIA), the high court had remanded the matter back to the trial court to conduct a fresh hearing on the question of framing of charge against all the four accused persons including Gogoi.

    A top court bench of justices V Ramasubramanian and Pankaj Mithal confirmed the high court order in “all respects”.

    The top court, however, granted bail to Gogoi pending trial while noting that he has suffered incarceration for about 567 days.

    “He has been out as a free man for the past more than 21 months. It is important to note that his freedom was secured not by an order of bail, but by an order of discharge passed by the special court, which has now been reversed by the high court.

    “Nothing has been brought on record to show that during this period of 21 months, when the petitioner has been a free man, he has indulged in any unlawful activity,” it said.

    On the contrary, the petitioner got elected to the legislative assembly in 2021 and he is now a sitting member of the assembly, the apex court said.

    It said except in cases of preventive detention, the purpose of detaining a person in police/judicial custody, is either to facilitate fair and proper investigation or as a measure of penalty after conviction.

    “In this case, (i) the investigation is over and (ii) the petitioner is not yet a convicted criminal. Therefore, we do not think that any purpose will be served in allowing the Special Court to remand him to custody and then enabling him to move an application for bail.

    “In fact, the offences under the Indian Penal Code alleged against the petitioner are punishable only with imprisonment for a period of up to 3 years. It is only the offences alleged under the Unlawful Activities (Prevention) Act, which are punishable with larger terms of imprisonment,” it said.

    The bench said if the offences under the IPC alone are taken into account, the petitioner has served, as an undertrial prisoner, more than half of the maximum period prescribed under the relevant provisions.

    “Therefore, this is not a case where the petitioner should be allowed to be detained in custody, especially after having secured an order of discharge, rightly or wrongly,” it said.

    The lawmaker, who has allegedly been vocal against the central government during the anti-CAA protests, had moved the top court against the February 9 order of the high court allowing the special NIA court in Assam to proceed with the framing of charges against him in one of the two cases.

    The RTI activist continued to be in judicial custody as he was rejected bail in the second case related to anti-CAA violence and was being investigated by the NIA.

    Later, the special NIA court on July 1, 2021 released Gogoi and his three associates for their alleged role in the violent anti-Citizenship (Amendment) Act stir in the state in December 2019 and observed there was nothing to indicate that the “talk of blockade” threatened the country’s economic security or was “a terrorist act”.

    The NIA then moved the Gauhati High Court appealing it to allow the agency to frame charges under various sections, including sedition, of the IPC and the Unlawful Activities (Prevention) Act, 1967.

Yediyurappa, state unit BJP president Nalin Kumar Kateel and Union Minister of State for Agriculture and Farmers’ Welfare, Shobha Karandlaje.

    Former Deputy Chief Minister Lakshman Savadi in the Yediyurappa-led Cabinet has recently quit the Bharatiya Janata Party (BJP) and joined the Congress.

    Reacting to this, BJP in-charge for Karnataka polls, Arun Singh, on Friday said Savadi will not have any future in the Congress party.

    “He has committed a blunder by joining Congress. He will repent,” Singh said.

    “The doors would be permanently closed for those who deserted the party. It might take 20 years for the party to accept them back. His decision is selfish,” Arun Singh has stated.

    Chief Minister Basavaraj Bommai said he was sad as Savadi saw a political future with the Congress.

    Talking to reporters here on Friday, he said “it is common that there will be more aspirants in the ruling party. The party workers are with them”.

    “The BJP will win the coming Assembly election with a thumping majority. Some of them have quit the party to become MLAs but the BJP workers are with them,” Bommai said.

    The chief minister said the second list of candidates has already been released and the third list will be out soon. He will be filing his nomination papers in Shiggaon on Saturday.

    Meanwhile, Union Minister for Mine, Coal and Parliamentary Affairs Pralhad Joshi has stated that he is confident of former chief minister Jagadish Shettar getting a ticket.

    The matter has been discussed with the national president and everything will end well, he said.

    “The BJP won’t give tickets to fathers and sons like Congress. There were many candidates in the BJP party and this has led to confusion. The winning party will have more demand. In another two days, these confusions will end,” Joshi said.

    Meanwhile, Karnataka unit Congress president D.K. Shivakumar said that 25 leaders of the BJP and the JD-S will join the Congress in the coming days.

    “BJP will only win 60 seats and JD-S will not get more than 24 seats. The Congress is going to win 141 seats,” he said.

    An uninhabited island in Okinawa Prefecture of Japan was reportedly bought by a Chinese woman, whose identity was not revealed. Japan Times reported on Saturday (February 11) that the woman’s claims were made on social media, which led to a stir online. According to the report, a few users highlighted that the move would be part of Beijing’s attempt at “an expansion of Chinese territory”.

    The firm specialises in Chinese businesses, public records showed, the report added. Sharing details, the office of Izena village in Okinawa said that the company owns about 50 percent of the total land, the report said, adding that its beaches are mostly controlled by the local government.

    The woman had earlier posted a video on social media showing her first visit to the island. Japan Times reported that an Izena Island resident had taken the woman and another woman on a trip to Yanaha Island by boat.

    Kalaburagi: Senior Congress leader and former Karnataka chief minister Siddaramaiah on Monday alleged that ‘Manuvada’ and ‘Hindutva’ encourage murder, violence and discrimination.

    The former CM said he is also a Hindu who follows Hindu Dharma but stands against Hindutva.

    “Hindutva and Hindu Dharma are different. I’m always projected as anti-Hindu and anti-Hindu Dharma. I’m not anti-Hindu Dharma. I’m also a Hindu, but I’m anti-Manuvada and Hindutva,” Siddaramaiah said.

    Addressing a gathering here, he said, “Does any religion encourage murder or violence? But Manuvada and Hindutva encourage murder, violence and discrimination. That’s the difference between Hindu Dharma and Hindutva.”

    The Leader of Opposition had earlier too made his anti-Hindutva stands clear.

    Assembly elections are due in Karnataka by May.
