    Thiruvananthapuram: Terming the institution of marriage as a “Sacramental union” social activist Rahul Easwer on Sunday said that the union government has taken a right stand after it opposed the plea seeking legal recogniton of same-sex marriage.

    “Everyone agrees there must be any kind of homophobia. At the same time marriage is a sacrosanct institution from many centuries. I appreciate the government for taking it very slowly and with caution,” Easwar said.

    “We need much more deliberations. Everyone agrees there should not be any kind of discrimination. There should not be any kind of phobia at the same point of time even living together,” he added.

    Centre, in its affidavit, has opposed the plea seeking legal recognition of same-sex marriage, saying that living together as partners by same-sex individuals, which is decriminalised now, is not comparable with the Indian family unit and they are clearly distinct classes which cannot be treated identically.

    The Centre has filed the affidavit countering the demand made by various petitioners seeking legal recognition of same-sex marriage.

    In the affidavit, Centre has opposed the plea and said that pleas seeking legal recognition of same-sex ought to be dismissed as there exists no merit in these petitions.

    “I think the central Government has taken the right stand,” Rahul Easwer added. “There are still debates going on in scientific communities on this subject”.

    Same-sex relationships and heterosexual relationships are clearly distinct classes which cannot be treated identically, the government said as its stand against the petition seeking legal recognition of LGBTQ marriage.

    It is for the legislature to judge and enforce such societal morality and public acceptance based upon Indian ethos, the Centre said in its affidavit and added that western decisions sans any basis in Indian constitutional law jurisprudence, cannot be imported in this context.

    In the affidavit, Centre apprised the Supreme Court that living together as partners by same sex individuals, which is decriminalised now, is not comparable with the Indian family unit concept of a husband, a wife and children.

    Centre submitted that the principles of legitimate state interest as an exception to life and liberty under Article 21 would apply to the present case. Centre submitted that the statutory recognition of marriage as a union between a “man” and a “woman” is intrinsically linked to the recognition of the heterogeneous institution of marriage and the acceptance of the Indian society based upon its own cultural and societal values which are recognized by the competent legislature.

    “There is an intelligible differentia (normative basis) which distinguishes those within the classification (heterosexual couples) from those left out (same-sex couples). This classification has a rational relation with the object sought to be achieved (ensuring social stability via recognition of marriages),” the government said.

    Jaipur: Syed Naseeruddin Chishti, the chairman of the All India Sufi Sajjadanshin Council and successor of the spiritual head of Ajmer Dargah, appealed to his community members on Sunday to educate their children so that they can deal with issues with wisdom and not stand on streets shouting slogans.

    Addressing a gathering at the closing ceremony of the annual Urs of Khwaja Fakhruddin Chishti, the eldest son of the Sufi Saint Moinuddin Chishti, in Bhilwara, he said that the youth, whether it is a girl or a boy, are the future of the country.

    “Some of your children will be an IAS officer, some will be a leader and some will be a scientist. Do not get misled by those who try to push the youth towards negative thoughts and provoke them, let us contribute to the progress of the country,” he said.

    Highlighting the importance of education of girl child, he said that a girl educates two families and therefore it is very important to impart them education.

    “We should encourage our daughters to get the best education,” he said.

    “We all are Indian first, and later Hindu or Muslim. Some selfish and extremist thinkers are misleading the youth of the country by spreading poison in the hearts of the people, especially in the minds of the youth, in the name of religion and are inciting hatred in the country which is totally wrong and against the teachings of saints,” he said.

    New Delhi: The Delhi High Court on Tuesday sought the stand of the National Investigation Agency (NIA) on a plea seeking quashing of its probe against the banned Popular Front of India (PFI) in connection with an alleged criminal conspiracy to carry out terror activities in the country.

    Justice Jasmeet Singh issued notice on the petition by arrested PFI leader Oma Salam and asked the agency to file its response.

    While the judge remarked during the hearing that “there is no question of stay” in the matter, the counsel for the petitioner said he was “not pressing it” either.

    The counsel for the petitioner argued he was assailing the NIA case on “legal grounds” as the probe was not as per the NIA Act.

    He contended that the offences being probed by the NIA have to be first registered by the state government, which has not been done in the present case.

    The petitioner’s counsel also said no report under section 173 Criminal Procedure Code should be filed by the NIA in the case on completion of the investigation.

    The case, registered in April last year, pertains to an alleged criminal conspiracy hatched by people associated with the PFI to raise funds from within India and abroad for committing acts of terror in various parts of the country.

    The NIA has alleged that the accused were conducting training camps to indoctrinate and train their cadres to carry out terrorist activities.

    A large number of alleged PFI activists were detained or arrested in several states during the massive raids preceding the nationwide ban imposed on it on September 28, 2022.

    In near-simultaneous raids across the country as part of a multi-agency operation spearheaded by the NIA, several PFI activists were detained or arrested in 11 states for allegedly supporting terror activities in the country.

    The arrests were made in states and Union Territories, including Kerala, Maharashtra, Karnataka, Tamil Nadu, Assam, Uttar Pradesh, Andhra Pradesh, Madhya Pradesh, Puducherry, Delhi and Rajasthan.

    The government banned the PFI and several of its associate organisations for five years under the stringent anti-terror law UAPA, accusing them of having links with global terror groups like the ISIS.

    The matter will be heard next on July 11.

    Hyderabad: Bharat Rashtra Samithi (BRS) MLC and Telangana Cheif Minister KCR’s daughter, K Kavitha on Thursday defended his father’s statement of calling the Central government as No Data Available government and said that the party stand by it.

    “Our CM said that the NDA government is a ‘No Data Available’ government, and we stand by it as BRS party. After the Modi government came, there has been no census conducted and they (Centre) say that there are no data available for demonetisation, per capita income, Right to Information,” she said.

    Earlier in the day, Union Finance Minister Nirmala Sitharaman retorted to K Chandrasekhar Rao’s statement of calling the government as ‘No Data Available’ government and said that the State government itself don’t have any data on medical colleges in Telangana.

    “When the centre asked for the list of places to put up medical colleges, the state listed Karimnagar and Khammam, but those places already had medical colleges. Now you are telling that you did not receive a single medical college in the 157 medical colleges from the centre. You do not have the data of which places in Telagana have medical colleges and you are blaming NDA as No Data Available,” Sitharaman told reporters in Hyderabad.

    The minister also aimed at KCR for dubbing Prime Minister Narendra Modi’s ambitious target of reaching a USD 5 trillion economy as a “joke”.

    “How can you tell that aim of a 5 trillion economy is a joke? Every state should contribute towards it. Who are you laughing upon, the people? In 2014, the debt of Telangana was Rs 60,000 crores, but in the last 7-8 years it has crossed Rs 3 lakh crores,” she said.

    Amaravati: Andhra Pradesh GST collections stood at Rs 28,181.86 crore by January end recording a hike of 6.91 per cent in the same period last year, an official release said on Thursday.

    At a review meeting on revenue generating departments held here on Thursday, officials told Chief Minister YS Jagan Mohan Reddy that the State is gradually overcoming Covid-19 blues while GST and other revenues are closer to targets.

    They explained that the GST gross collections in the state till December 2022 stood at 26.2 per cent as against the national average of 24.8 per cent surpassing Telangana, Tamil Nadu and Gujarat in which the collections stood at 17.3 per cent, 24.9 per cent and 20.2 per cent respectively.

    The total tax collections (GST, Excise, professional tax and taxes on petrol and diesel) stood at Rs 43,206.03 crore by January 2023 as against the target of Rs. 46,231crore, the officials explained and said the State achieved 94 per cent of the targets fixed for tax collection.

    Officials from the Mining Department explained that they are confident of achieving the target of Rs 5,000 crore as they are striving to revive non-functioning mines.

    While the Department earned Rs 2,220 crore by February 6, 2022, it achieved the target by earning Rs 3,649 crore revenue as on February 6 in the present fiscal.

    Officials of the Transport Department told the CM that they have achieved revenue of Rs 3,657.89 crore as against the target of Rs 3,852.93 crore by January in the present fiscal.

    New Delhi: The Supreme Court on Friday warned the Centre on the delay in clearing the transfer of high court judges recommended by the apex court collegium, saying it may result in both administrative and judicial actions which may not be palatable.

    A bench comprising Justices Sanjay Kishan Kaul and Abhay S Oka told Attorney General R. Venkataramani, representing the Centre, “Don’t make us take a stand which will be very uncomfortable…”, and further added that if the transfer of judges is kept pending then it is a serious issue.

    Justice Kaul said transfer is a very serious issue and warned against the interference of third parties in the process. He told the AG that sometimes the government does it overnight and sometimes it takes longer and there is no uniformity, and added that even chief justice transfers are also pending.

    The bench orally observed, “We will have to take a difficult decision. Do not make us take a hard stand”, and told the AG, who said the court may not record anything as it is happening.

    The top court stressed, “It has been happening! But when will this happen? Things have not been happening for years together…”

    During the hearing, advocate Amit Pai, counsel representing the petitioner, said that the court is being attacked from the outside. Justice Kaul said, “We are used to it. Be rest assured that it does not bother us. It is for the authorities to know where to…” After hearing detailed arguments, the bench scheduled the matter for further hearing on February 13.

    The AG submitted that recommendations made for the appointment of the five Supreme Court judges would be cleared shortly.

    On December 13, 2022, the apex court collegium recommended the elevation of justices Pankaj Mithal, Sanjay Karol, P.V. Sanjay Kumar, Ahsanuddin Amanullah and Manoj Misra to the Supreme Court.

    On January 31, the collegium also recommended the elevation of Justice Rajesh Bindal, Chief Justice of Allahabad High Court and Justice Aravind Kumar, Chief Justice of the Gujarat High Court as judges of the top court.

    The top court was hearing a contempt petition filed by the Advocates Association of Bangalore against the Centre for breaching the timeline for judicial appointments. Earlier, the apex court had expressed its displeasure over the delay in clearing the names approved by the collegium for appointments.
