    SC sets aside HC stay on SIT probe in Amaravati land case

    New Delhi: In a shot in the arm for the Jagan Mohan Reddy government, the Supreme Court on Wednesday set aside an Andhra Pradesh High Court order which had stayed an SIT probe into alleged irregularities in the land deals in Amaravati during the previous TDP regime.

    Through a government order of September 26, 2019, the Reddy government had appointed a Cabinet Sub Committee to examine the allegations of corruption against members of the erstwhile government which recorded a prima facie finding about certain allegations.

    On the basis of the report, the state government issued a second order and constituted the 10-member SIT, headed by a Deputy Inspector General of Police-rank IPS officer, to conduct a comprehensive investigation into various alleged irregularities, particularly the land deals in the Amaravati Capital Region, during the previous Chandrababu Naidu regime.

    Both the notifications were stayed by the high court indefinitely which led the state to approach the top court for relief.

    An apex court bench of justices MR Shah and MM Sundresh said the high court ought not to have granted an interim stay when it was not required as the entire matter was at a premature nascent stage.

    The apex court said the high court has failed to consider the fact that the state government had already made a representation to the Centre to refer the investigation to the CBI.

    “We are prima facie of the opinion that some of the reasoning given by the high court while staying the further proceedings pursuant to the two government orders may not be germane, more particularly, when the high court has observed that the new government cannot be permitted to overturn the decisions of the previous government.

    The Andhra Pradesh government had challenged a high court order of September 2020 staying the government orders sanctioning the constitution of a Special Investigating Team (SIT) to probe into the allegations of land scam in Amaravati during the previous dispensation under the Telugu Desam Party (TDP).

    The apex court said central government is yet to take a call on the letter and the consent given by the Andhra Pradesh government and it would have been better, had the high court permitted the parties to complete the pleadings, and thereafter, decided the writ petitions one way or the other by affording ample opportunity to the parties before it.

    “We are inclined to set aside the orders dated September 16, 2020, while making it clear that we have not expressed anything on the merits of the case. The high court is expected to decide and dispose of the writ petitions on merits and in accordance with law, without being influenced by any of the observations made in our order.

    “Considering the issues governing the facts and law, the high court may make an endeavour to dispose of the writ petitions finally within a period of three months from the date of receipt of the copy of this judgment,” the bench said.

    The top court said senior advocate appearing on behalf of the state is justified in submitting that the high court has misinterpreted and misconstrued the two government orders.

    “If the aforesaid two GOs are considered, it can be seen that the same cannot be said to be overturning the earlier decisions taken by the previous government and/or to review the decisions taken by the previous government.

    “The Sub-Committee and the SIT have been constituted to inquire into the allegations of acts of corruption and misfeasance of the previous government,” the bench said.

    Ahmedabad: The Supreme Court-appointed Special Investigation Team (SIT) will challenge before the Gujarat High Court the recent acquittal of all 67 accused in the 2002 Naroda Gam riot case by a special court, sources said.

    Ahmedabad-based court of S K Baxi, special judge for Special Investigation Team cases, on April 20 acquitted all 67 accused, including former Gujarat minister Maya Kodnani and ex-Bajrang Dal leader Babu Bajrangi, more than two decades after 11 Muslims were killed during post-Godhra riots in Ahmedabad’s Naroda Gam area.

    “The SIT will definitely file an appeal in the Gujarat High Court against the lower court’s order in the Naroda Gam case. Since the copy of the SIT court’s judgement is awaited, a final call will be taken after studying the verdict,” a source in SIT said.

    The massacre at Naroda Gam was one of the nine major 2002 communal riots cases investigated by the SC-appointed SIT and heard by special courts.

    The SIT took over the probe from the Gujarat Police in 2008 and arrested more than 30 persons.

    Apart from Kodnani (67) and Bajrangi, former VHP leader Jaydeep Patel was also acquitted in the case by the special court.

    There were a total of 86 accused in the case, of which 18 died during the pendency of the trial, while one was discharged by the court earlier under section 169 of the CrPC (Code of Criminal Procedure) due to insufficient evidence against him.

    Notably, lawyers of the victims’ families had already said the special court’s verdict will be challenged in the High Court.

    Riots broke out in the Naroda Gam area of Ahmedabad on February 28, 2002, during a bandh called to protest the torching of the S-6 coach of Sabarmati Express by a mob near Godhra station a day earlier. As many as 58 train passengers, mostly karsevaks returning from Ayodhya, were charred to death.

    The accused were booked under Indian Penal Code sections 302 (murder), 307 (attempt to murder), 143 (unlawful assembly), 147 (rioting), 148 (rioting armed with deadly weapons), 120 (B) (criminal conspiracy), and 153 (provocation for riots), among others

    The then-BJP president Amit Shah, now Union Home Minister, had in September 2017 appeared in the trial court as a defence witness for Kodnani. She had requested the court to summon Shah to prove her alibi that she was present in the Gujarat Assembly and later at Ahmedabad’s Sola Civil Hospital, and not at Naroda Gam, where the massacre took place.

    Six different judges have presided over the case since the trial started in 2010.

    Lucknow: The three assailants, who shot dead gangster Atiq Ahmad and his brother Ashraf, were trained to behave like real journalists before they joined a group of media persons at the hospital where the brothers were shot dead.

    Three men, who helped the main accused in the murder of gangster Atiq Ahmed and his brother, in pretending to be a reporter have been detained by the Special Investigation Team, the police said on Thursday.

    Three men, who work for a local news website, showed the ropes of reporting to Tiwari and helped him buy a camera, the police said.

    They have been detained from the railway station in Banda by the Special Investigation Team probing the case.

    The killers, Lovelesh Tiwari, Arun Maurya and Sunny Singh, had trailed the arrested gangster as journalists for an entire day before shooting him in front of television cameras and dozens of policemen on April 15, said the police.

    Meanwhile, search for Shaista Parveen continued on Thursday also. “Raids were conducted in search of Shaista Parveen, wife of gangster Atiq Ahmed. A search operation was conducted after receiving information about some criminals hiding. The operation lasted for about two hours. A drone camera was also used in the operation. However, the operation did not prove successful today,” senior police officer Samar Bahadur said.

    Atiq Ahmed was accused in the murder of BSP MLA Raju Pal in 2005, as well as in the killing of Umesh Pal, a key witness in the BSP leader’s murder, in February this year.

    Kozhikode: The Special Investigation Team (SIT), which has been probing the train arson incident of Kerala that resulted in the loss of three lives, on Monday said the accused is a “highly radicalised” person who reached the state to commit the crime in a pre-planned manner.

    ADGP (Law and Order), M R Ajith Kumar, who heads the SIT, said the accused Shahrukh Saifi used to watch radicalised videos of controversial Islamic preacher Zakir Naik and said provisions of the Unlawful Activities (Prevention) Act, have been invoked against him based on the scientific evidence collected.

    The investigation team has invoked Section 16 of the UAPA which deals with punishment for terrorist acts.

    “We went to various states and based on scientific, documentary and oral evidence collected, conducted a comprehensive probe and decided to invoke the concerned provisions of UAPA. He is highly radicalised. He saw radicalised videos of Zakeer Naik and others. He came here in a pre-planned manner to commit the crime,” Kumar told the media here.

    The senior police official said the accused is 27 years old and has completed plus two education from National Open School.

    He said the investigation team has found evidence in connection with the accused and the crime he committed and was probing whether he received any help from anyone else.

    The investigating team, which has been granted custody of Shahrukh Saifi, had on April 12 taken him to Kannur for collecting evidence from the two train coaches of the Alappuzha-Kannur Executive Express train in which he had set fire to some passengers leading to the death of three persons, including a two-year-old child.

    Saifi’s police custody is set to expire on April 18.

    A Kozhikode First Class Judicial Magistrate had granted 11-day custody of Saifi to police after he was discharged from the hospital upon undergoing treatment for the injuries he suffered during an attempt to escape from the moving train.

    Saifi has also confessed to the crime committed by him, according to the police.

    On the night of April 2, Saifi had set his co-passengers on fire onboard the Alappuzha-Kannur Executive Express train when it reached the Korapuzha bridge near Elathur in Kozhikode.

    Nine people had suffered burn injuries in the incident while three, including a toddler, were found dead on the tracks. Police suspect that they fell while trying to escape from the fire.

    Hyderabad: A suspect in the Telangana State Public Service Commission (TSPSC) paper leak case, Prashant Reddy, sent an email to Special Investigation Team (SIT) claiming that he is innocent.

    Prashant Reddy, who is reportedly hiding in New Zealand after absconding, is a close relative of S Rajasekhar Reddy, the prime suspect in the case. 

    He had allegedly obtained the Group 1 prelim question paper from Rajasekhar Reddy. After appearing for the exam, he reportedly fled the country.

    In his email, Prashant Reddy claimed that he prepared for the exam on his own and that he has no connection with the paper leak issue. 

    During the investigation, the SIT found that Rajasekhar Reddy installed a remote desktop access application on the computer of TSPSC employee Shameem and sent the question paper to Prashanth Reddy.

    Hyderabad: Two more persons were arrested in the TSPSC paper leakage case by the Special Investigation Team on Friday.

    The duo was identified as Laukik and Sushmitha. Laukik Sai had bought the DAO exam question paper from Praveen, the prime suspect for Sushmitha, his wife.

    The police arrested them based on the information provided by the suspects arrested earlier, during interrogation by the SIT.

    Jammu: The J&K government has ordered a probe by a Special Investigation Team (SIT) into the illegal lease of temple properties in Kashmir.

    Officials said that a letter addressed to all the 10 deputy commissioners in the Valley has directed them to probe the illegal lease of temple properties and the nexus involved therein.

    “The deputy commissioners will furnish an updated inventory of such properties within one week.

    “The inventory should include updated details of religious minority properties, including temples, Gurudwaras and others,” officials said.

    The officials added that the directions received from the Lt. Governor’s secretariat in this regard have been communicated to all the deputy commissioners by the divisional commissioner (Kashmir).

    Srinagar, Apr 07: The Jammu and Kashmir administration led by Lieutenant Governor Manoj Sinha has ordered a Special Investigation Team (SIT) probe into illegal lease of temple properties in the Valley while Deputy Commissioners (DC) have been directed to furnish the updated inventory within a week’s time.

    According to the news agency—Kashmir News Observer (KNO), on the directions of Lieutenant Governor’s Secretariat References Monitoring Cell, Jammu & Kashmir, a letter has been issued to 10 DCs of Kashmir, wherein they were asked to probe the illegal lease of temple properties and nexus in temple properties being used illegally.

    “I am hereby directed to enclose herewith copy of communication along with its enclosures bearing O.M no. GAD-RMC/256/2022-LGRMC-GAD dated 20-05-2022 received from Lieutenant Governor’s Secretariat References Monitoring Cell, Jammu & Kashmir with the request to ascertain any such instances in your district and take appropriate necessary action under rules with intimation to this office,” a letter issued from Divisional Commissioner’s office under number DIV.COM/Mig-121/7150795/46-57, reads.

    Besides, the DCs have been asked to furnish the updated inventory of Religious Minority Properties (Temple, Gurudwara, Others) within week’s time positively—(KNO)

    SRINAGAR: A Special Investigation Team (SIT) has been directed by the Government of Jammu and Kashmir to investigate the unauthorized leasing and usage of temple properties in the Kashmir region.

    Aadil Fareed, Assistant Commissioner under the Divisional Commissioner, has written to all deputy commissioners in Kashmir, quoting a communication received from the LG’s office.

    The letter requests the deputy commissioners to “identify any cases of illegal leasing of temple properties in your district and take appropriate action under the rules, while keeping this office informed. Additionally, please provide an updated inventory of Religious Minority Properties (such as temples, Gurdwaras, and others) to this office within one week.”

    Hyderabad: The Special Investigation Team (SIT) has summoned the Telangana State Public Service Commission (TSPSC) Secretary and a member of the constitutional body to appear before it on Saturday, in connection with the question paper leak case.

    According to a senior police official on Friday, notices have been issued to the TSPSC Secretary and the member asking them to appear before the SIT for examination as witnesses today.

    Meanwhile, Telangana Congress president A Revanth Reddy made a representation to the Enforcement Directorate (ED), to probe into the money laundering angle in the leak of question papers of Group-I Preliminary examination and other exams conducted by TSPSC.

    In a related development, YSR Telangana Party (YSRTP) president Y S Sharmila was prevented by the police from “besieging” the TSPSC office here in protest against the “callousness and delay in conducting a fair investigation to protect the big fish involved” in the case, a party release said.

    A total of 15 people, including some employees of TSPSC, have been arrested since March 13 over their alleged involvement in the data breach — for stealing and leaking question papers of TSPSC’s Assistant Engineer (Civil) examination, among other exams.

    The TSPSC had on March 15 cancelled the Assistant Engineers (AE) exam held on March 5, following allegations that the question paper had been leaked.

    Amid protests by opposition parties and students’ groups over the issue, the Commission had cancelled the Group-I preliminary exam and two other tests as well.

    On Tuesday, the TSPSC rescheduled the written examination for the post of Horticulture Officer from April 4 to June 17.
