    Adani stocks crash: SC orders setting up of panel headed by ex-judge Sapre

    New Delhi: The Supreme Court on Thursday ordered setting up of a six-member committee headed by former apex court judge Justice A M Sapre to investigate the recent Adani Group shares crash triggered by the Hindenburg Research’s fraud allegations and other regulatory aspects related to stock markets.

    The court asked the panel to submit its report in a sealed cover within two months.

    The top court observed that the PILs pertained to “the loss of investors’ wealth over the past few weeks due to the steep decline of share prices of Adani group companies, precipitated by the Hindenburg Research report which alleged manipulations and malpractices by the Adani group companies” and also directed market regulator SEBI (Securities and Exchange Board of India) to complete its ongoing probe into the issue in two months and file a status report.

    Besides former apex court judge Justice Sapre, the other members of the court-appointed panel will be “O P Bhat (former Chairman of SBI), Justice J P Devadhar (retired judge of the Bombay High Court), K V Kamath, Nandan Nilekani, Somasekharan Sundaresan”.

    A bench headed by Chief Justice D Y Chandrachud directed the Centre, financial statutory bodies and the SEBI chairperson to render all cooperation to the Justice Sapre panel which will have to submit its report in a sealed cover within two months in the court.

    The remit of the Committee shall be to provide an overall assessment of the situation including the relevant causal factors which have led to the volatility in the securities market in the recent past, the court said.

    The committee will “suggest measures to strengthen investor awareness and to investigate whether there has been a regulatory failure in dealing with the alleged contravention of laws pertaining to the securities market in relation to the Adani Group or other companies,” it said.

    It will suggest measures to strengthen the statutory or regulatory framework, and secure compliance with the existing framework for the protection of investors, it said.

    The court directed the SEBI to inform the court-appointed committee of domain experts about the steps taken by it so far during the ongoing probe.

    The bench, however, clarified that the constitution of the committee was not an “adverse reflection” on the functioning of the regulatory agencies.

    The bench, which also comprised Justices P S Narasimha and J B Pardiwala, in a judgement, said the panel will make an overall assessment of the situation, suggest measures to make investors aware and strengthen existing regulatory measures for stock markets.

    The court also asked it to examine if there was a violation of market regulations, short selling norms or stock price manipulations.

    On the ambit of the probe to be conducted by the panel, the bench said it would “provide an overall assessment of the situation including the relevant causal factors which have led to the volatility in the securities market in the recent past.”

    The committee will also suggest measures to increase “investor awareness” besides investigating whether there was any regulatory framework to deal with the recent alleged violations of law in the securities market.

    The Justice Sapre panel will be suggesting “measures to strengthen the statutory framework and regulatory framework and secure compliance with the existing framework for the protection of existing investors.”

    “The Committee is at liberty to seek recourse to external experts. The honorarium payable to the members of the committee shall be fixed by the Chairperson and shall be borne by the Union Government,” it said.

    The Union Ministry of Finance shall nominate a senior officer to act as a nodal officer to provide logistical support to the panel, it said.

    The apex court said in order to protect Indian investors against the volatility of the kind which has been witnessed in the recent past, it was of the view that it is appropriate to constitute an expert committee for the assessment of the extant regulatory framework and for making recommendations to strengthen it.

    The top court requested the SEBI Chairperson to ensure that all requisite information is provided to the Committee.

    ” All agencies of the Union Government including agencies connected with financial regulation, fiscal agencies and law enforcement agencies shall cooperate with the Committee. The Committee is at liberty to seek recourse to external experts in its work.

    “The honorarium payable to the members of the Committee shall be fixed by the Chairperson and shall be borne by the Union Government. The Secretary, Ministry of Finance shall nominate a senior officer who will act as a nodal officer to provide logistical assistance to the Committee,” it said.

    The top court said all the expenses incurred in connection with the work of the Committee shall be defrayed by the Union Government.

    “The Committee is requested to furnish its report in a sealed cover to this Court within two months,” it said.

    On February 17, the top court, while reserving its verdict on setting up of the panel, had said that it will maintain “fullest transparency” to protect investor interest and refused to accept the Centre’s suggestion given in a sealed cover on it.

    On February 10, the top court had said the interest of Indian investors need to be protected against market volatility in the backdrop of the Adani Group stocks rout and asked the Centre to consider setting up a panel of domain experts headed by a former judge to look at strengthening the regulatory mechanism.

    The Centre had agreed to the apex court’s proposal to set up a committee, to be headed by a former Supreme Court judge, to go into the regulatory regimes.

    SEBI, in its note filed in the top court, had indicated it is not in favour of banning short-selling or sale of borrowed shares, and said it is investigating allegations made by a tiny short-seller against the Adani Group as well as its share price movements.

    Till now, four PILs have been filed in the top court on the issue by lawyers M L Sharma, Vishal Tiwari, Congress leader Jaya Thakur and Mukesh Kumar, who claims to be a social activist.

    Adani Group stocks have taken a beating on the bourses after the Hindenburg Research made a litany of allegations, including fraudulent transactions and share-price manipulation, against the business conglomerate.

    The Adani Group has dismissed the charges as lies, saying it complies with all laws and disclosure requirements.

    The US space agency, NASA, stated that it was decided to set the date for next March 2 as a new date for the attempt to launch the Falcon-9 missile carrying the Dragon spacecraft on the “crew-6” mission, which includes Sultan Al Neyadi, the Emirati astronaut, at 09:34 am UAE time. And that is if all the appropriate weather conditions coincide, and the technical problems that hindered the launch this morning are resolved, indicating that it was unable to set a launch date for today, February 28, due to bad weather.

    Today, NASA and SpaceX postponed the attempt to launch the crew-6 mission, which includes Emirati astronaut Sultan Al Neyadi to the International Space Station, in the longest journey by an Arab astronaut, due to a problem related to ground systems.

    According to NASA, the mission teams decided to postpone until the problem that prevents the data from confirming the full load of the ignition source for the “Falcon 9” launch rocket engines, represented by triethylaluminium and triethylboron, is studied.

    In early 2022, the Supreme Court expressed concerns over the retrogressing quality of legal education in the country. The court observed that the problem starts at law schools only. The comment by the Apex court on the quality of legal education must be seriously considered.

    People from different quarters of the legal fraternity from time to time have been flagging concerns over the deteriorating quality of legal education in India. In order to address the issue and improve the quality of legal education in India, the Bar Council of India envisaged a model law school with university status to act as a pace-setter for legal education reforms.”

    In line with the second-generation legal education reform proposed by the Indian Bar Council, various state governments replicated the idea, thereby paving the way for the establishment of a total of 23 such universities so far.

    While the quality of legal education is constantly deteriorating in Jammu and Kashmir, the issue can be well addressed by the establishment of a National Law University (NLU), as envisaged by the Bar Council of India.

    The proposal for the establishment of the National Law University in Jammu and Kashmir traces its origin to the resolution moved by the All India Law Ministers Conference in 1995. It was unanimously resolved to set up a law school in each state modelled on the National Law School University for raising the standard of professional legal education across the country.

    In 2018, Jammu and Kashmir’s law students were thrilled, when the then BJPDP coalition government passed the Jammu and Kashmir National Law University Bill in the assembly. After the act was passed, the piece of legislation needed the governor’s nod. The then governor  N N Vohra raised certain questions over the proposal, which stopped the process.

    However, on October 1 2019, Governor Satya Pal Malik gave assent to the bill for the establishment of a National Law University in Jammu and Kashmir.

    Soon after the bifurcation of the erstwhile State into two Union Territories, after some amendments in Jammu and Kashmir National Law University Act, the Union Ministry of Home Affairs formally adopted the Act. There has been an interlude of nearly two and half years since the Act was formally adopted by the Ministry of Home Affairs. But though approved two and half years back in 2019, there has been no headway on setting up of the University.

    After three decades of establishing the first National Law School in Bangalore, we currently have 23 such NLUs spread across the country. Maharashtra has three National Law Universities. Similarly, Madhya Pradesh has two NLUs, of which the recent one is at Jabalpur. The state of Uttar Pradesh is set to establish its second National Law University in Prayagraj. Many NLUs are in the pipeline in various states like Tripura, Uttarakhand and Sikkim.

    Regrettably, Jammu and Kashmir despite being the 12th largest among the 37 State/UT in terms of geographical area and 19th in terms of population with more than 14 million people are yet to have its own National Law University.

    Presently,  Jammu and Kashmir has a total of three government Universities and seven private law colleges which offer law courses like LLB and BA-.LLB. Government universities include the University of Kashmir, the University of Jammu, Central University of Kashmir. Private law colleges include Kashmir law college, Vitasta School of Law and Humanities, Kashmir Creative Education Foundation (KCEF) Law College, Sopore Law college in Kashmir division and KC Law College, Dogra Law College and Ashoka Law College in Jammu division.

    But the aforementioned government universities and private law colleges are incomparable with the National Law Universities in terms of quality of education, admission criteria, curriculum, examination, and the qualifications of the faculty members.

    Starting from low placement records to lack of infrastructure, law schools in Jammu and Kashmir, are today grappling with a series of problems. They are not student-friendly. They don’t have student bodies which could represent the academic interests of students and properly put the grievances and demands of students before the administration.

    The government universities and private law colleges here are more focused on teaching theory and hardly give any training for mooting, debating etc. Their pedagogy and teaching methods are antiquated. Here in most colleges internship is still unheard of concept.

    In these law schools, the classic examination pattern is used where students’ grades are based on their ability to memorise a few topics rather than their analytical and practical abilities. Students memorise the laws but are left confused by their application to our daily lives.

    In fact, legal education in private colleges of Jammu and Kashmir has now developed as a potential business activity for law institutions, where legal education rules go for a toss repeatedly. These collages are still accustomed to the traditional style of lecturing in a classroom. As a result, the students studying in these colleges not only lack adequate knowledge of the subject but also lack the requisite skills to adequately practise in the courts.

    Legal education is one of the most important fields for the country’s development and preservation of democracy and the rule of law. With such serious observation by the SC and declining standards of legal education, the Jammu and Kashmir government must acknowledge this demand and set up an NLU, where every bright mind from the various socio-economic class of society could make a career in law.

    Lucknow: With a focus on the 2024 Lok Sabha polls, the Uttar Pradesh BJP is setting up new booth committees and has asked all regional and district chiefs to provide details of the existing ones by February 10.

    In a letter to all regional in-charges and presidents, and district in-charges and presidents on Saturday, BJP’s general secretary (organisation), Uttar Pradesh, Dharampal Singh directed them to form booths on the basis of the recent voters’ list.

    In the run-up to the 2022 assembly elections, a booth was set up for a maximum of 1,200 voters, but according to the voters’ list published on January 5, every booth will now have 1,500 voters, Singh said.

    Due to this, the number of booths will come down.

    The number of regions in the state, however, will remain the same, Singh said.

    He has also sent the delimitation format to the office-bearers. It has to be completed and sent to the election management committee of the state headquarters by February 10, according to the letter.

    The organisational structure of the BJP consists of ‘Shakti Kendras’, with each of them comprising five to six booths.

    In Uttar Pradesh, the BJP has more than 27,000 ‘Shakti Kendras’, 1,918 regions and 98 organisational districts. The party has divided its manpower across the state into six regions — Kashi, Gorakhpur, Awadh, Kanpur-Bundelkhand, Braj and West.

    In a meeting of the BJP’s state working committee here last month, Uttar Pradesh unit president Bhupendra Singh Choudhary gave the office-bearers the target of winning all 80 seats in the state in the general elections.

    In the 2019 Lok Sabha elections, the BJP and its ally Apna Dal (Sonelal) won 64 of the 80 seats. The Congress won one seat, the Samajwadi Party five and the Bahujan Samaj Party (BSP) 10. The SP and the BSP had contested the elections together.

    San Francisco: Meta-owned messaging platform WhatsApp is facing a server-side issue, making it impossible to update the privacy setting “who can see when I’m online,” globally on iOS.

    This outage is not because of a broken update, reports WABetaInfo.

    It is still unclear how many users are affected by this issue and what is causing the current issue.

    The company has not yet released any official statement or provided any information on the reasons behind the issue.

    The report also mentioned that if someone’s online presence on the platform is hidden, then the current configuration is safe and nobody can see when they are online.

    In October last year, the messaging platform had suffered a global outage including in India that lasted for over two hours.

    According to the outage monitor website DownDetector, over 85 percent of people had reported problems while messaging, 11 percent while using the app, and 3 percent while using the website.
