Delhi riots: Court rejects police revision petition against separate FIR order

    [ad_1]

New Delhi: A court here has dismissed a revision petition filed by the Delhi Police against the order of a magisterial court to register a separate FIR on the basis of a complaint pertaining to the 2020 northeast Delhi riots.

Upholding the order directing the station house officer (SHO) concerned to register a case, the sessions court said that just because there was a flood of complaints, the investigating agency could not make an exception to the mandate of law.

The court also observed that an excess number of complaints cannot be a reason for the clubbing them together unless there was the proximity of time and place showing “continuous action” by the perpetrators in the alleged crime.

The court was hearing the matter wherein the complainant, Mohd Vakil, had moved an application for the registration of a separate case, rather than attaching his complaint in an FIR registered by Karawal Nagar police station, and the magisterial court in November last year had allowed his plea.

Against the magisterial court’s order, the Delhi Police had filed the present revision petition in the sessions court.

“Excess number of complaints cannot be a ground to club all or several complaints without there being the proximity of time and place of the alleged crime, so as to show continuous action of the perpetrators,” Additional Sessions Judge Pulastya Pramachala said in an order passed on Tuesday.

The judge also said there was no “illegality” committed by the magistrate.

The judge noted that complainant Mohd Vakil, a resident of Shiv Vihar, claimed to have been injured by an acid bottle thrown on his house by some rioters on February 25, 2020, and his complaint was clubbed in FIR number 138/20.

This FIR was registered on the complaint of a man called Furkan Ansari, of another lane in the same locality, who had alleged damage to his car and house by rioters during his absence on the same day, the court noted.

The judge also noted that during the proceedings, the prosecution informed that the final report in the FIR was not yet filed and they were about to file an “untrace report” (regarding the offenders remaining untraceable).

“The complainant in a case is conferred with certain legal remedies, in case he is not satisfied with the investigation carried out by the investigating agency and clubbing all complaints of several incidents, in one FIR cannot be termed legal, unless all these complaints on the face of it show the time and place of such incidents to be the same and indicate towards the same perpetrators of the crime i.e, on the basis of continuity of action of the perpetrators,” the judge said.

ASJ Pramachala further said that “just because there was a flood of complaints, investigating agency could not make an exception to the mandate of law”.

The judge said, “I also find that the FIR no. 138/20 cannot be termed as a sufficient step taken on the complaint of the respondent (Mohd Vakil) herein. The place of incident in aforesaid FIR and the place of incident as disclosed in the complaint of the respondent herein were apparently different places.”

He said that even though both incidents were outcomes of riotous acts, still the investigation in both could not be the same.

The judge said that Ansari was not present at his house during the alleged incident, and according to him, the incident occurred at an unknown time and date, while Vakil had claimed to be an eyewitness of the incident, besides mentioning the concrete date and time of the alleged incident.

“The case laws referred by the state are not applicable to the situation involved herein. It is not a case of two versions of the same incident,” the judge said rejecting the arguments of the petitioner (Delhi Police).

According to Delhi Police, the magisterial court had failed to consider that Vakil’s complaint was clubbed in accordance with the law and that Vakil had no grievance against the police regarding the quality of the investigation.

Oppn unity on test as Kavitha, Sibal to hold separate events in Delhi

    [ad_1]

New Delhi: Opposition unity will be on test on Friday and Saturday when two back to back events are being organised — one by the Telangana CM’s daughter K Kavitha for pressing the demand for women’s reservation and the other on Saturday by Independent MP Kapil Sibal for the launch of ‘Insaf Ke Sipahi’.

Kavitha had praised Sonia Gandhi but had hit out at the Congress alleging arrogance on the issue of an opposition alliance. Sibal will be launching the website ‘Insaaf’. “On 11th of Mar Pls join me at Jantar Mantar at 3.30 PM where I will unveil a new vision for India for the future different from the one we live in today,” he said in a tweet.

Sibal has got support from former J&K chief minister Farooq Abdullah and Delhi CM Arvind Kejriwal.

“This is an important initiative of Kapil Sibal Saheb. I appeal to everyone to join this initiative and we all together will fight against injustice,” Kejriwal tweeted in Hindi.

Jammu and Kashmir National Conference president and former CM Farooq Abdullah on Wednesday extended support to senior political leader and legal luminary Kapil Sibal’s newly announced platform ‘Insaaf ke Sipahi’ to fight injustice.

According to a statement, Abdullah said, “Sibal sahab is a veteran leader and a seasoned lawyer, considered an important voice of the Opposition, and his talk of bringing opposition parties and leaders together should be welcomed. There is nothing better than everyone uniting against injustices.”

He added, “National Conference firmly stands with Kapil Sibal sahab in his new initiative. The party rank and file, including Omar Abdullah, is of the firm belief that the initiative will act as a catalyst in bringing the opposition parties together for a common cause of fighting injustices.”

Kavitha a day ahead of the hunger strike praised Sonia Gandhi for pushing the Women Reservation Bill during the UPA’s tenure.

She has invited 18 political parties, including the Congress to join the one-day hunger strike to press the demand. She said around 6,000 people will be present and her organisation Bharat Jagruti Manch has reached out to the like-minded parties and organisations.

“I salute Madam Sonia Gandhi for having backed the Women’s reservation Bill despite leading a coalition govt at Centre,” she said.

Kavitha said she has spoken to Congress president Mallikarjun Kharge and general secretary K.C. Venugopal to send a representative to the protest.

Sibal on Saturday had announced that he will launch a website, titled ‘Insaf ke Sipahi’, to help citizens fight against injustice and appealed to the opposition Chief Ministers and parties to help him in the initiative.

Addressing a press conference, Sibal had said during the official launch on March 11 at the Jantar Mantar, that he will also unveil a vision document for the country. He asserted that this was not a political move but a catalyst for change.

The Independent MP said lawyers should raise their voices, adding that “I want to start a movement as there is injustice everywhere be it business, journalism, people and opposition.”

Sibal had alleged that the elected governments had been destabilised and that among 121 cases of the ED, 115 are against the opposition leaders.

Muslims attacked in separate incidents for ‘cow smuggling’ in Haryana, Bihar

    [ad_1]

Members of the Muslim community were attacked in two separate incidents on allegations of cow smuggling and beef consumption in Haryana and Bihar respectively.

    Haryana

Two Muslim youths – Saleem and Mujahid – had gone to Manpur village to buy cattle. Saleem and Mujahid sell cattle to zamindars for a living.

“Suddenly someone shouted, ‘These two are Muslims’ and we were surrounded by men with axes,” Saleem alleged.

On seeing the mob, Mujahid said that he started his motorbike but was attacked. “My bike fell to the ground. I ran away to save my life,” Mujahid alleged. Saleem however could not escape. “They tried to aim my head but I raised my hand and got cut. I also got hit on my legs,” he alleged.

According to Saleem, he heard one of them shouting, “Take him to the room and electrocute him.”

“I remember one of my attackers is the nephew of the sarpanch,” Saleem said adding, “They took away my watch and Rs 50,000.”

Fortunately, a man, who was also a Hindu, went to save Saleem. He asked the attackers to stop and told Saleem to run. “He was also a Hindu. He told the attackers that he knows me and asked me to leave the place,” Saleem said.

Later Saleem lodged an FIR at the Mundkani police station.

However, Siasat.com spoke to Mundkani police who although agreed there was an FIR lodged by Saleem but denied any such incident took place.

“There was a small fight between Saleem and the accused – Manish. An FIR was registered and Manish was arrested yesterday,” the police said.

Manish is currently on bail, police added.

Saleem and Mujahid are residents of Roopraka village in Haryana. Saleem has six children, the oldest being nine years old.

    Bihar

On February 20, police arrested a 58-year-old Muslim man – Ansarul Sheikh – on charges of allegedly carrying beef. A video has emerged on social media from Raxaul, Bihar, where a distraught Sheikh can be seen begging a mob that it is not cow’s meat, but buffalo’s.

A case was registered against Sheikh and he was produced before the court that sentenced him to jail. Sheikh is currently lodged in Motihari jail.

Siasat.com spoke to Raxaul police station when officials said that the investigation is still on. “We have sent the meat sample to the veterinary doctor who is yet to confirm if it is cow’s or buffalo’s meat,” police said.

  • IWT: India questions World Bank’s decision to start two separate processes

IWT: India questions World Bank’s decision to start two separate processes

    [ad_1]

New Delhi: India on Thursday questioned the World Bank’s decision to appoint a Court of Arbitration and a neutral expert under two separate processes to resolve differences between New Delhi and Islamabad over the Kishenganga and Ratle hydroelectric projects in Jammu and Kashmir.

Last week, India issued a notice to Pakistan seeking a review and modification of the 62-year-old Indus Waters Treaty (IWT) for management of cross-border rivers following Islamabad’s “intransigence” in handling disputes.

“I do not think they (World Bank) are in a position to interpret the treaty for us. It is a treaty between our two countries and our assessment of the treaty is that there is a provision of graded approach,” External Affairs Ministry Spokesperson Arindam Bagchi said.

India took the significant step of sending the notice to Pakistan conveying its intent to amend the treaty months after the World Bank announced appointing a neutral expert and a chair of Court of Arbitration to resolve the differences over the Kishenganga and Ratle hydroelectric projects.

New Delhi has been particularly disappointed over the appointment of the Court of Arbitration.

“India’s Indus Water Commissioner issued a notice on January 25 for the modification of the Indus Waters Treaty of 1960 to his Pakistani counterpart,” Bagchi said at a media briefing while replying to a question on the matter.

“This notice was issued with the intent to provide an opportunity to Pakistan to enter into government-to-government negotiations to rectify ongoing material breach of the treaty,” he said.

Bagchi said India called upon Pakistan to notify a suitable date for the commencement of inter-state bilateral negotiations under article 12(III) of the treaty within 90 days.

“I am not aware of a response from Pakistan as yet. I am not aware of any response or comment by the World Bank,” he said.

The World Bank’s role is procedural and it appoints neutral experts or the chair of the court of arbitration in case of differences between India and Pakistan on issues relating to cross-border rivers.

“I do not think they (World Bank) are in a position to interpret the treaty for us. It is a treaty between our two countries and our assessment of the treaty is that there is a provision of graded approach,” Bagchi said.

New Delhi considers the start of the two concurrent processes to resolve the dispute a violation of the provision of the graded mechanism prescribed in the pact and wondered what will happen if the mechanisms come out with contradictory judgements.

“The world bank itself, around five-six years ago, acknowledged the problem of having two parallel processes. Our interpretation and assessment is that this is not in consonance with the provisions of the treaty and hence we have been talking about a graded approach,” Bagchi said.

The spokesperson said India’s position on the matter has not changed at all.

“I do not know whether the World Bank has changed its position on it,” he said.

India has not cooperated with the Court of Arbitration.

Under the pact, any differences need to be resolved under a three-stage approach. However, in the cases of Kishenganga and Ratle hydroelectric projects, the World Bank started two concurrent dispute redressal processes at the insistence of Pakistan that India felt was a breach of the IWT, according to sources.
