  • GOP goes all-out to avoid another Senate primary mess

    All told, the NRSC under Daines has now endorsed four candidates, including Rep. Jim Banks in Indiana. It’s a strategy not seen since the GOP took the Senate from Democrats in 2014 after poor showings in 2010 and 2012. Even then, the party focused on ousting unelectable candidates, rather than officially boosting its preferred picks as Daines is this year.

    “It’s been a great decision on his part. Clearly, we need quality candidates to win, we learned that in ‘22, 2010, 2012. Steve’s doing a great job getting us the most electable nominees, because that’s the way you win in November,” Senate Minority Leader Mitch McConnell said in an interview.

    Those tactics come at the expense of Senate hopefuls like Rep. Alex Mooney in West Virginia, Jim Marchant in Nevada and potential candidate Rep. Matt Rosendale in Montana — contenders who enjoy more support from the party’s conservative ranks. Leadership’s heavy hand is stirring consternation within that sizable wing of the party.

    Yet many in the GOP see it as a bet worth making. Because if Republicans don’t get it right this time, when they have one of their best maps in years, they may not have another chance to flip the Senate until 2028.

    “You can play to win or you can play not to piss people off — you can’t do both,” said Josh Holmes, an adviser to McConnell.

    The party brass’ most urgent task is keeping Rosendale out of a race against Sheehy in Montana, where the GOP fears that Rosendale would win a primary but suffer another general election loss to Sen. Jon Tester (D-Mont.). Rosendale has told colleagues he plans to run and has attacked Sheehy for being backed by McConnell. Sheehy, meanwhile, already has endorsements from Gov. Greg Gianforte and Rep. Ryan Zinke (R-Mont.) — as well as nine senators, including Daines.

    “After last cycle, there’s evidence that we’ve got to get the electable candidates on the field,” said Senate Minority Whip John Thune (R-S.D.) on Monday afternoon. He’s backing Sheehy as well: “It would be nice if we could clear the field there.”

    Daines has also endorsed Trump’s presidential campaign to help preempt any disruptions to the intraparty playing field. And GOP leaders are intent on recruiting Dave McCormick for another run in Pennsylvania; Trump backed Mehmet Oz over McCormick in the 2022 primary. Oz won the primary but lost the general election.

    Already, Mooney is making hay of Justice’s strong Washington backing as the governor leads the primary handily in recent polls — even as his coal empire faces legal scrutiny. Mooney’s campaign manager, John Findlay, said that “Jim Justice is one of the all-time worst recruits by the GOP establishment.”

    In response, Justice’s campaign manager Roman Stauffer said the governor is achieving widespread buy-in from supporters in D.C. and West Virginia because they know he “is the strongest candidate to win the U.S. Senate race.”

    But not every senator in the conference is eager to see the NRSC pick favorites in crowded fields.

    “I wish they weren’t, but I’m not in charge,” said one Republican, granted anonymity to speak candidly about party strategy. “Not everybody agrees” on which candidates are the most electable, this senator added.

    And Democrats say the aggressive GOP efforts will backfire come next November, dividing the GOP well into the summer of next year.

    “Across the Senate map, Republicans are brawling in vicious primaries and putting forward flawed candidates with disqualifying baggage. That’s a toxic combination that will lead their campaigns to defeat in 2024,” said David Bergstein, a spokesperson for the Democratic Senatorial Campaign Committee.

    In Wisconsin, the NRSC launched a concerted effort to woo Rep. Mike Gallagher (R-Wis.), a telegenic military veteran, by commissioning polling and publicly touting his strengths as a candidate. But the congressmember ultimately passed on a run against Democratic Sen. Tammy Baldwin, sending recruiters back to the drawing board just as polarizing former Milwaukee County Sheriff David Clarke began to taunt them with a potential bid of his own.

    He tweeted a Democratic poll of a possible Wisconsin Senate primary field that showed him leading by 20 points.

    Now, GOP recruiters are refocusing efforts on candidates with the resources to block Clarke and tie up Baldwin, who just reported raising $3.2 million last quarter. Eric Hovde, a wealthy businessman who lost a primary bid for the seat in 2012, is still seriously considering another run but does not have a timeline for a decision, according to a person familiar with his thinking.

    “We will continue working to recruit candidates who can win both a primary and a general election,” Daines said.

    In Nevada, the NRSC eagerly recruited Brown, a decorated Army veteran who survived an IED attack in Afghanistan, to take on Democratic Sen. Jacky Rosen. Their interest in him became more urgent once other candidates moved toward running.

    One less establishment-friendly potential candidate, Jeffrey Gunter, had a controversial tenure as Trump’s ambassador to Iceland. And Marchant, a former state lawmaker who ran unsuccessfully for Nevada Secretary of State, is already in the race. A prominent member of a group of Trump supporters who baselessly deny the validity of the 2020 election, Marchant is readying for a primary brawl.

    “Jim Marchant has never lost a primary, outspent every time. Sam Brown has never won a primary despite his attempts in multiple states,” said Rory McShane, a spokesperson for Marchant’s campaign.

    It’s not yet clear how the party will handle Ohio, where Secretary of State Frank LaRose is looking at joining a field including state Sen. Matt Dolan and businessman Bernie Moreno. That state could be a free-for-all exception to the GOP’s approach, as it looks for a candidate to take on Democratic Sen. Sherrod Brown.

    There are more headaches in Arizona, where Kari Lake could mount another statewide bid. And in Michigan’s open seat, Republicans have yet to secure a top-tier candidate, although they hope to land NYSE vice chair John Tuttle as former GOP Rep. Mike Rogers also mulls a bid.

    Even with some questions still unanswered, there’s still a new sense of normalcy in the party’s upper ranks. Senate Republicans’ top super PAC is back on the same page with the campaign arm after a high-profile break in strategy last year.

    “Aggressively recruiting quality candidates is the only way Republicans will retake the Senate majority. Every one of these top-tier races will be very tough, and sub-par candidates only help Democrats,” said Senate Leadership Fund President Steven Law.

    Rep. Barbara Lee stood to benefit from that outcome more than Reps. Adam Schiff or Katie Porter. Newsom angered some Black voters by replacing the newly elevated Vice President Kamala Harris with Sen. Alex Padilla, the state’s first Latino senator — a choice that left the Senate without any Black women. The governor later committed to appointing a Black woman if he got another Senate pick. Lee was vetted to replace Harris and was widely seen as the logical choice if Feinstein stepped down.

    Feinstein had been facing increasing calls to return or resign, including from some Democratic colleagues, as her prolonged absence prevented the Senate Judiciary Committee from advancing judicial nominations and threatened further chaos as a nearly-tied Senate faces a looming debt fight.

    But now it looks more likely that she stays through the end of her term, preserving the basic dynamics of the Senate race to date. Lee, Porter, and Schiff have all rolled out star endorsers and worked to map a path through a complex primary. Assuming Feinstein holds on, none of them will be getting Newsom’s nod or the awesome powers of incumbency.

    And what of Feinstein’s imprimatur? She hasn’t endorsed a favored successor yet or indicated she will, although she is closer to Schiff than the other contenders. But her blessing may not move the needle. Indeed, it could be a liability with the many progressive voters who are ready to put the Feinstein era in the past and shift California’s Senate representation to the left.

    Lake would likely galvanize Trump supporters to the point that many Republicans think she would be all but impossible to defeat in a primary. But GOP strategists are concerned that Lake would turn off swing voters in the general election, particularly after she contested her loss in the gubernatorial contest in 2022.

    Last year, a number of Senate contenders tied to Trump won their primaries but were defeated in the fall. In an effort to avoid another disappointing election, Sen. Steve Daines (R-Mont.), chair of the NRSC, has actively recruited candidates he believes are electable in key battleground states, including West Virginia, Montana and Pennsylvania. But Daines has not picked a favorite as of yet in Arizona.

    In a CNN interview this week, Senate Minority Leader Mitch McConnell declined to comment directly on a possible run by Lake, though he left Arizona out of his list of top four Senate battlegrounds. He said there is “high likelihood” that GOP leaders would wait until after the primary to determine whether to get involved. “I think there are some other places where with the right candidate, we might be able to compete — in Nevada, Arizona,” he said. The Arizona Senate primary won’t take place until August of 2024.

    The NRSC regularly sits down with potential and declared candidates, and such a meeting does not suggest any preference on its part. Pinal County Sheriff Mark Lamb, the only Republican who has announced a run for Sinema’s seat, had a meeting with the NRSC earlier this year, as did Karrin Taylor Robson, a businessperson who is considering a campaign. Taylor Robson lost to Lake in the 2022 gubernatorial primary.

    Lake’s spokesperson did not provide the names of the senators she is sitting down with this week. The NRSC declined to comment on whether Daines is meeting with Lake. When Lake previously gathered with NRSC officials in February, she did not meet with him.

    Lake and her staffers have taken a number of steps recently that suggest she is either close to running for the Senate or positioning herself as Trump’s running mate, should he win the presidential nomination. Her aide, Colton Duncan, said he is “99 percent sure she’s going to run for Senate.” She is releasing a book, “Unafraid: Just Getting Started.” She has also attacked Gallego as too liberal for Arizona.

    A GOP strategist close to Lake said she is expected to announce a Senate campaign in the early fall, though others in her orbit said a kickoff could take place earlier.

    In addition, Lake has made two stops this year in Iowa, the first-in-the-nation caucus state where she happens to have grown up. Last week, she spoke at Conservative Political Action Conference Hungary and met with Hungarian Prime Minister Viktor Orbán, a venerated international figure in America’s MAGA movement. She is currently in the United Kingdom, where she appeared on “Piers Morgan Uncensored,” speaking to him about her lawsuit disputing her loss in the governor’s race as well as her future.

    “If for some reason we don’t get a fair outcome in our election, I will run for Senate, most likely,” Lake told him.

    Wyden had asked for details on the gifts Crow lavished on Thomas for over two decades, as reported by ProPublica, that included trips aboard the billionaire’s superyacht to Indonesia, New Zealand and Greece and free use of his private jet.

    Although Thomas neglected to report the gifts on his annual disclosure forms, Wyden argued they were substantial enough that Crow would have been obligated to report them on his annual gift tax returns to the IRS.

    On Tuesday, Wyden repeated a vow he had previously made to use “any of the tools at [the committee’s] disposal” to compel answers from Crow and said he would confer with his Democratic colleagues on Finance.

    In the letter to Wyden that was obtained by POLITICO, Crow’s attorney, Michael D. Bopp, argued that the Finance Committee lacks authority to compel the gift records from Crow and is “attempting to tarnish the reputation of a sitting Supreme Court Justice and his friend of many years, Mr. Crow.”

    The committee’s next steps could include subpoenaing Crow for the requested records or using a section of the tax code that vests the chairs of Congress’ tax committees with the authority to obtain a private citizen’s tax returns directly from Treasury — a power that House Democrats used last year to publish the taxes of former President Donald Trump.

    Attorneys for Trump had tried to derail that effort by insisting Democrats lacked a “legitimate legislative purpose” for seeking his returns, but federal courts rejected the argument in that case. Democrats had maintained throughout the litigation that obtaining Trump’s taxes was necessary to examine a program at the IRS that required the auditing of all sitting presidents.

    Bopp used a similar argument in defense of withholding Crow’s information, saying the committee has jurisdiction of federal gift tax laws but is not empowered to initiate tax audits to expose the activities of private citizens.

    Wyden countered that “the assertion that the Finance Committee lacks a legislative basis for an investigation of the abuse of gift taxes by the wealthy is simply preposterous.”

    “I have used my Chairmanship of the committee to shine a bright light on tax schemes undertaken by the ultra-wealthy, including untaxed transfers of wealth,” he said.

    Meanwhile, Sen. Mike Crapo, the top Republican on the Finance Committee, made it clear Tuesday that he would oppose any efforts to force Crow to provide the information, saying they would “undermine the independence of the Supreme Court and its individual Justices.”

    Sen. Mike Lee (R-Utah) and 13 other Republican senators also wrote to Wyden on Monday to express concerns about Wyden’s request to Crow. The GOP lawmakers asserted the demands amounted to intimidation of a private citizen that had the ultimate goal of discrediting Thomas.

    “We reject this manufactured ‘ethics crisis’ at the Supreme Court as a ploy to further Democrats’ efforts to undermine public confidence and change the makeup of the Court,” the Republicans wrote.

    “They’re related for sure,” Thune said of the debt limit talks and farm bill. “For better or worse, pretty much everything that we’re going to do subsequent to the debt limit discussion depends on how all that plays out.”

    Fresh in Senate GOP leaders’ minds: The 2011 sequestration fight, which resulted in steep spending cuts to farm safety net programs popular among Republicans. One Senate GOP aide, who was granted anonymity to discuss internal discussions, warned that any “across-the-board cuts [included in legislation to raise the debt limit], may effectively reduce the investments we are able to make in the farm safety net, trade, research, and other priorities.” The person added that “debt ceiling negotiators need to use a scalpel, not an ax.”

    Thune and Sen. Joni Ernst of Iowa, the No. 4 Republican in the upper chamber, are now among the handful of GOP leaders navigating the debt talks with the White House and the upcoming budget negotiations while trying to protect key farm bill funding. Ernst acknowledged the three legislative efforts are becoming increasingly entangled. As a result, the farm bill timeline could slip.

    “We anticipate it’s going to take a while to get the farm bill done. Sooner is better than later, but it could take a little bit longer,” Ernst said.

    GOP senators are largely supportive of their House colleagues’ demand for cuts to nutrition spending, which ballooned during the pandemic. But they’re less enthusiastic about the idea of slashing key farm safety net programs they’ve long tried to protect.

    Sen. Chuck Grassley (R-Iowa) said that he expects Senate Republican leaders will likely need to step in to protect certain pots of farm bill funding from House GOP cuts given “the importance of agriculture to our entire economy.”

    While Senate GOP leaders haven’t drawn any redlines, Thune has noted the importance of the farm bill to the rural voters his party relies on. “I think the [House Republican] leadership … understands even though on their right they’ve been getting a lot of pressure to cut, cut, cut in different areas, there are also a lot of members from agricultural states who need a farm bill,” said Thune. That includes his own state, South Dakota, where agriculture is the largest industry.

    And, he pointed out, “If you look at our map in 2024, we got a lot of rural state Republicans who are up.”

    Up to this point, McConnell and Senate Republicans have deferred to House Republicans in the debt limit negotiations with the White House, even as the U.S. inches closer to the June 1 date when the nation could hit its debt limit, according to Treasury Secretary Janet Yellen. But McConnell will be attending a White House meeting Tuesday with Biden, House Speaker Kevin McCarthy and Senate Majority Leader Chuck Schumer, which members of both parties are hoping could help begin to break the logjam.

    Democrats, meanwhile, are warning that House Republicans’ proposals to slash spending as part of the debt limit deal threaten the viability of the traditionally bipartisan farm bill on Capitol Hill. Democrats are particularly incensed by the GOP push to expand work requirements for the Supplemental Nutrition Assistance Program — the nation’s leading anti-hunger program for low-income Americans, which accounts for approximately 80 percent of farm bill funding.

    Senate Agriculture Chair Debbie Stabenow (D-Mich.), who is also a member of Democratic Senate leadership, has warned the proposed spending cuts in the House GOP debt legislation would also hit key parts of the farm bill — including critical risk management programs for crop farmers that are still being impacted by the 2011 spending cuts.

    “If the Republicans want to tank a farm bill that’s up to them,” Stabenow said in an interview. “This is the most important rural economic development and farmer safety net in our country.”

    Passing any bill would mark a political victory for Speaker Kevin McCarthy’s conference, which punted a plan to pass border legislation in the first weeks of their majority as they navigated open infighting within their ranks. Republicans view border security as a potent wedge issue heading into the 2024 campaign — and underscoring that strategy, they’re timing a Thursday vote on their bill to the expiration of a Trump-era border policy that lets the U.S. deny asylum and migration claims for public health reasons.

    But should the House GOP muscle its bill through, the win would be largely symbolic. That’s because, across the Capitol, GOP senators are warning that House Republicans will have to make concessions if they want to get a bill to President Joe Biden’s desk.

    “It’s a start,” Sen. John Cornyn (R-Texas), an adviser to Minority Leader Mitch McConnell, said of the House bill in a brief interview. “But I think everybody understands that, in order to get 60 votes in the Senate, it’s going to have to change.”

    “And the question is, what does that look like?” Cornyn added. “Will Senator Schumer agree to let us take it up, and will the House accept those changes?”

    The two chambers are miles apart: While the Senate is months or more away from even starting immigration negotiations, House Republicans are still working to get conservatives and more centrist-minded members aligned. That task isn’t fully done even as the GOP prepares to take the bill to the floor: Rep. Dan Crenshaw (R-Texas) said in a statement for this story that “Americans who care about border security should be deeply disappointed in House Republican leaders” over the proposal’s treatment of drug cartels.

    Crenshaw added that “the only mention of the cartels in this bill is a ‘study’ of the cartels that may actually give the Biden administration a pathway to make our immigration crisis exponentially worse,” noting that “multiple members” have raised worries that “are being ignored by leadership as they try to rush this bill to the floor.”

    A spokesperson for Rep. Thomas Massie (R-Ky.) said Monday that he will vote against the border bill over its treatment of “e-verify” technology designed to help companies confirm employees’ immigration status, and an aide to Rep. Dan Newhouse (R-Wash.) said he’s “expressed concerns to leadership” about the e-verify provision.

    The White House on Monday threatened to veto the House bill if it reaches Biden’s desk as is, arguing it “would make things worse, not better.”

    House Majority Leader Steve Scalise (R-La.) said he’s still talking with conference members on the measure’s e-verify provisions. And while he didn’t rule out changing the bill in order to get it to Biden’s desk, Scalise observed that the Senate — where the filibuster requires lawmakers to work across the aisle on most issues — hasn’t been able to get the necessary 60 votes this year on a range of topics, not just the border.

    “We at least are going to show how we can pass something,” Scalise said in an interview. “If there are senators, Republican and Democrat, who want to help solve the problem, we’ve laid out a path to do it. If they’ve got better ideas, I want to start seeing their ideas.”

    On that front, behind-the-scenes conversations are happening between members in both chambers. Rep. Tony Gonzales (R-Texas), who helped negotiate a deal on the House bill, has been in touch with a bipartisan group of senators, including Sens. Thom Tillis (R-N.C.) Kyrsten Sinema (I-Ariz.) and Cornyn. Sinema and Tillis also took a trip to the border earlier this year with Reps. Juan Ciscomani (R-Ariz.), David Valadao (R-Calif.) and Gonzales.

    Senate talks about a larger immigration bill are “active” but “sporadic,” as Tillis put it. But senators aren’t deep enough into talks that they are ready to horse-trade over what a proposal would have to include in order for it to clear the chamber.

    Three Senate Democrats who would likely be integral to any deal that could pass — Judiciary Committee Chair Dick Durbin (D-Ill.), Homeland Security and Governmental Affairs Committee Chair Gary Peters (D-Mich.) and Sen. Joe Manchin (D-W.Va.) — each separately said they’ve seen few signs of movement on their side of the Capitol.

    “I believe it’s a very positive step. And there are elements of the framework that we’re going to have to consider to get votes on the Senate side, and we’re constantly working with the House,” Tillis said of the House bill, while cautioning that “we’re talking months before we would have a vote on that.”

    Congress is under renewed pressure to act on border legislation, a long-sought but elusive goal for more than a decade now, thanks to bipartisan fears that the Thursday end of the public health-related border policy known as Title 42 could spark an onrush of migration along the southern border.

    Homeland Security Secretary Alejandro Mayorkas warned Sunday on NBC’s “Meet the Press” that he was working “within significant constraints,” urging lawmakers to provide his agency with additional resources. The administration is taking its own steps, including sending 1,500 additional troops to the border.

    While the House GOP bill is expected to get little if any Democratic support this week, some in the president’s party are signaling interest in negotiating on border policy.

    Rep. Sharice Davids (D-Kansas) wrote to Mayorkas on Monday asking the Homeland chief and the White House “to join me in engaging in these conversations” with Republicans. And Rep. Henry Cuellar (D-Texas) told reporters late last week that he likes parts of the GOP’s bill while opposing others: “I’m hoping that we can sit down and work those out.”

    Tillis, Sinema, Cornyn and Manchin rolled out a bill late last week, first reported by POLITICO, that would grant a temporary two-year authority to expel migrants from the U.S., similar to what is currently allowed under Title 42.

    Despite its timing, the legislation isn’t designed as a response to the House bill; aides involved in Senate conversations about a broader border proposal say they’re continuing on a separate track.

    Meanwhile, Republicans have hammered the Biden administration over repealing Title 42 — rhetoric that GOP aides predicted would escalate this week as the policy’s expiration date nears.

    Tillis predicted, as the option of restricting migration on public health grounds evaporates, a “growing sense that if the president’s not going to put any other option on the table, that it’s going to be unsustainable, unsafe and politically unwise.”

    Sen. Lindsey Graham (R-S.C.) phrased it more succinctly in an interview: “First thing we need to do is not repeal Title 42,” he said. “We should deal with the asylum problem. That’s the magnet, right?”

    Asked about the next step to address the influx of migrants, Graham added: “Chaos.”

    Democrats have a slim majority in the Senate but not enough to prevent a Republican filibuster on legislation.

    “Whenever you’ve got 41 senators who are unwilling to bring debate to a close on any legislation, it cannot pass. We’ve now got more than enough to stop exactly the kind of legislation that Joe Biden wants,” he said to Bartiromo.

    Lee added: “What that means is that the White House is going to come to the table and enter into real talks with the House Republicans, starting with Speaker Kevin McCarthy,” Lee said.

    House Republicans passed legislation on April 24 that would allow for the debt ceiling to be raised but which would also attempt to put the brakes on federal spending in the future, as well as roll back or cut specific programs. The vote was 217-215.

    Biden and other Democrats have said they are open to budget negotiations but want the debt ceiling treated as a separate issue, as it has been in the past. The expectation is that the the federal government will bump up against the debt ceiling at the start of June.

    Bartiromo asked Lee if he was confident that McConnell and other Senate Republicans would stand firm. Lee said he expected they would.

    “Even if we lost one or two here or there, we’d still be fine,” Lee said, “and I don’t think we’re going to the lose any of them.”

    What Biden’s expected Joint Chiefs pick will likely face in the Senate

    Brown, who POLITICO first reported is Biden’s choice to succeed Milley, is likely to survive his confirmation battle in the Democratic-led Senate.

    But the process probably won’t go as smoothly as it did three years ago, with the four-star general potentially facing tough questions about China’s possible invasion of Taiwan, the future of Ukraine’s fight to repel Russia and diversity policies conservatives have derided as distracting the military from its main missions.

    Previous hearing room exchanges offer clues about how Brown will perform at his confirmation. By all accounts, he’s a cool customer: even-tempered, serious, succinct and direct. But the questions he faced were about the Air Force, well within his comfort zone.

    Here’s a breakdown of some of the issues you can expect senators to focus on, and how Brown might answer:

    Diversity and other Biden policies

    Brown could see harsh questions by conservative senators on a variety of Pentagon policies they regard as a distraction from the military’s mission of fighting the nation’s wars.

    Republicans have largely opposed efforts by the Biden administration to promote diversity and root out extremism in the ranks as well as combat the effects of climate change. Milley and Defense Secretary Lloyd Austin are routinely pressed on those and other personnel issues in their appearances on Capitol Hill. Milley made waves in the House for his defense against criticism that the military is distracted by those programs.

    Brown, who is the highest-ranking Black military leader since Colin Powell chaired the Joint Chiefs in the early 1990s, spoke out about his own experience as one of the few Black pilots following the murder of George Floyd in the summer of 2020. In an emotional video, Brown reflected on “my own experiences that didn’t always sing of liberty and equality.”

    Brown could also face pressure from Sen. Tommy Tuberville (R-Ala.) or others over policies implemented by Austin to shore up troops’ access to abortion following the Supreme Court’s reversal of Roe v. Wade. Democrats have praised the move, but Republicans want it reversed, arguing it politicizes the military and undercuts laws that bar taxpayer funding for abortions.

    After the ruling in 2022, Brown was asked in an interview at the Aspen Security Forum how it would affect the Air Force.

    “We have a responsibility to comply with the law. But we also have an obligation to take care of our airmen and their families,” Brown said.

    Russia and Ukraine

    While Milley has weighed in extensively on the Ukraine war, Brown’s views have been aired far less frequently — and when they have, they’ve made headlines.

    Brown has Europe experience: Just before Russia invaded Ukraine in 2014, he was headquartered in Germany as the lead for strategic deterrence and nuclear integration at U.S. Air Forces in Europe.

    At the Aspen Security Forum last summer, Milley said no decisions had been made to offer Ukraine Western fighter jets and pilot training, a hot-button issue rippling through Washington and the NATO alliance.

    But Brown — who has a history in the cockpits of the F-16, B-1 and B-52 — offered some much-discussed speculation that such training was a possibility, and he riffed on what types of aircraft Ukraine might eventually receive.

    “I can’t speculate what aircraft they may go to,” Brown said, but the U.S. has a “responsibility” to train its allies and, when it comes to Ukraine’s needs, “meet them where they are.”

    “There’s U.S. [aircraft], there’s Gripen out of Sweden, there’s the Eurofighter, there’s [the French] Rafale. So there’s a number of different platforms that could go to Ukraine,” Brown said, adding with a smile: “Maybe not MiGs. It’ll be a lot tougher to get parts from the Russians in the future.”

    Two Ukrainian pilots came to the U.S. in March for a fighter skills assessment at Tucson’s Morris Air National Guard Base.

    Senate Armed Services members Mark Kelly (D-Ariz.), Tammy Duckworth (D-Ill.), Tim Kaine (D-Va.) and Tuberville, may push Brown for his views about sending F-16 jets to Ukraine, after they queried the Pentagon on the topic. And what about an Air Force plan to send uncrewed aircraft?

    Top civilians have said fighters would take too long to deliver and that the emphasis should be on ground-based air defenses such as Ukraine’s S-300s, German IRIS-Ts or newly arrived Patriots.

    Months earlier, Brown credited Russia’s lack of dominance over Ukraine’s skies to Kyiv’s use of those defenses, both donated and indigenous.

    “Air superiority cannot be assumed, and one of the things that the Ukrainians have been able to do based on their air defense capability is actually threaten Russian air power,” he told Senate Armed Services member Joe Manchin at a hearing last year.

    China and Taiwan

    Brown will meet a Senate that’s grown more hawkish on China and he’ll face questions about what more the U.S. must do to deter Beijing from launching an invasion of Taiwan in the coming years.

    Democrats and Republicans have pushed for more funding to better position the military in the Indo-Pacific region as well as to pump up arms sales to Taiwan. But lawmakers are also concerned the Pentagon isn’t moving fast enough to arm the self-governing island. Top Senate Armed Services Republican Roger Wicker of Mississippi has argued the window is closing for the U.S. to buy the weapons and equipment that might be needed if a conflict breaks out before the end of the decade.

    Brown’s main competition for the top job, Marine Commandant Gen. David Berger, is hailed for retooling the Corps to focus on a Pacific fight. Brown, meanwhile, commanded Pacific Air Forces before taking over as the service’s top officer. He’ll likely draw on that experience in his pitch to senators.

    “He is literally on the front lines in implementing the National Defense Strategy, which has a focus on great power competition, particularly China as the pacing threat to our nation for the next 50 to 100 years,” Sen. Dan Sullivan, (R-Alaska) who previously delayed a vote on Brown over a decision on basing aerial tankers, said before his confirmation as Air Force chief of staff in June 2020. “Gen. Brown is in that battle right now, front-lines every day.”

    Arnold Punaro, a former staff director for the Senate Armed Services Committee, said Brown’s experience will give him “credibility” to spur the military to adapt to the Pacific.

    “We have not yet made the needed adjustments to deal with the threat posed by China,” he said. “As chairman, General Brown will be in a position to drive the joint force and joint operations to deal with the threats posed not only by China, but also Russia, Iran, and North Korea.”

    But will China invade?

    Top leaders testifying before Congress have given a broad range of answers when asked if, and when, China might invade Taiwan.

    But Brown’s response to one particularly fiery prediction offers clues as to how soon he thinks the threat may actually come.

    Gen. Mike Minihan, Air Mobility Command head, made waves in January following news reports of a memo showing he predicted war with China in two years.

    In the memo, he told the officers in his command that “I hope I am wrong. My gut tells me we will fight in 2025.” He added that his leaders should “aim for the head.”

    Brown, when asked about the memo, told reporters there were “aspects” of the missive that disappointed him. “It detracted from the key message of the sense of urgency that is required,” he said.

    Caught in a promotions logjam?

    Regardless of how he does before the committee, Brown’s nomination will land in a Senate that’s mired in a partisan deadlock over confirming military promotions, which have typically been approved with little opposition.

    Tuberville has blocked the speedy confirmation of all senior military officer picks over policies implemented by the Pentagon in February that allow troops to be reimbursed for travel expenses and take leave to obtain abortions or other reproductive care.

    The resulting standoff has meant that no nominees for general or admiral ranks have been confirmed in months. It’s a stalemate that Pentagon leaders say will hurt military readiness as commanders leave their posts or retire and aren’t replaced by permanent leaders — even uniting nearly all living U.S. defense secretaries this week in opposition to the blockade.

    The backlog is building and could ensnare Biden’s picks for the Joint Chiefs if it drags on.

    There are ways to slip through the blockade and ensure there are no vacancies at the most senior military posts. Once Brown clears the Armed Services Committee, Majority Leader Chuck Schumer could hold a cloture vote on Brown’s nomination, a procedural tactic to escape holds in the Senate.

    It’s a road Democrats may not want to wait to take until it’s absolutely necessary. Tuberville has argued that he isn’t preventing anyone’s confirmation, only forcing the Senate to take time to vote on nominees.
