Sen. Menendez: Biden’s policies risk making him ‘asylum-denier-in-chief’

If President Joe Biden follows through with plans his administration is weighing to restart family detention for migrants, he risks becoming “the asylum denier in chief,” Sen. Bob Menendez said Sunday.
“The best part of the administration’s immigration policy over the first two years is that they ended family detention,” Menendez (D-N.J.) said during an interview on NBC’s “Meet the Press,” calling the policy a “failure.”
“When the administration opened up a legal pathway to those fleeing, it dramatically saw a reduction in assistance — an example of what you can do in a way that is both good for the border and preserves our nation as a nation that preserves asylum,” Menendez said. “But if not, if the administration does go down this path, I am afraid the president will become the ‘asylum denier in chief.’”
The comments come after reports that the Biden administration is considering reinstating the policy, which would require families who attempt to cross the U.S. border illegally to be detained as their cases work their way through immigration court.
This would only exacerbate the situation at the southern border, which Menendez noted is already tense, particularly after four Americans were kidnapped — two of whom died — shortly after crossing the border into Mexico.
“The reality is along the border communities, it is the cartels that run the border communities, not the government of Mexico,” Menendez said, adding that he is concerned the U.S. is “headed in the wrong direction in Mexico.”
“We have to engage the Mexicans in a way that says, ‘You’ve got to do a lot more in your security.’ We can help them, you know. We have intelligence. We have other information we can share. But we need them to enforce in their own country,” Menendez said.

Visva Bharati student gets show-cause notice for backing Amartya Sen on social media

Kolkata: Visva Bharati university authorities have issued a show-cause notice to one of its students after the latter supported Nobel laureate Amartya Sen on social media over the current row where the university Vice Chancellor Bidyut Chakraborty has accused the economist of unauthorised occupation of the university land in excess of his legal entitlement.
The student, Somanath Sou, is an active member of the CPI(M)’s student wing Students’ Federation of India (SFI). Recently he made a post on social media condemning the attitude of the university authorities towards Sen in the current row.
He said in his post that this is nothing but unnecessarily harassing the globally acclaimed educationist and economist. According to him, certain elements are constantly advising the vice-chancellor that by harassing Sen he would get the support of the BJP.
According to Sou, from the land records it is clear that Sen is legally entitled to the entire land including the 13 decimals of land which the university authorities claim to be held by him beyond his legal entitlement. “The real truth must be revealed since in this process an aged and globally acclaimed educationist is being harassed unnecessarily. The university authorities should come out with papers in support of their baseless claims,” he wrote in his social media post.
Soon after that he was slapped with the show-cause asking him why disciplinary action should not be taken against him for being vocal against the university despite being a student there. In the notice Sou has been warned of strong disciplinary action if he repeats a similar action in the future.
On February 11, Sen’s advocate issued a legal notice to the university authorities asking the latter to tender a public apology for their derogatory comments in connection with the continuing row over 13 decimals of land occupied by him. “The university authorities should apologise for making such derogatory comments. Else appropriate legal action will be taken,” said Sen’s counsel Gorachand Chakroborty.

Activist Shoma Sen seeks discharge in Elgar Parishad case

Mumbai: Activist-academician Shoma Sen, an accused in the Elgar Parishad-Maoist links case, on Tuesday moved an application before a special court here seeking discharge in the matter on the ground she has been falsely arrested and implicated for “exposing illegal arrests, torture and deaths of those defending their fundamental rights”.
She moved the plea, through advocate Sharif Shaikh, before judge Rajesh Katariya, presiding over the special National Investigation Agency (NIA) court.
The court will hear the matter on February 14.
Sen, an English literature professor and Dalit and women’s rights activist, was arrested on June 6, 2018. She is currently in jail under judicial custody.
“Applicant (Sen) has been falsely arrested and her implication in the present offence is with mala fide and prejudiced intent merely because she has been a consistent defender of human rights and civil liberties which, many a time, have exposed illegal arrests, torture and deaths of those defending their fundamental rights,” her plea said.
The NIA, which is investigating the case, has claimed incriminating material against the accused was found in the computer of a co-accused.
However, the activist, in her plea, said letters and communications allegedly containing incriminating material against the accused persons in the case were neither in her possession, nor addressed to her, or by her.
Hence, to infer that these communications are authored by or addressed to some of the accused is “merely a baseless and prejudiced claim” that cannot be used as a ground to frame charges against her as this evidence would be deemed to be based on hearsay, said the application.

There is no proof that the name “Shoma” in any of the so-called electronic letters/ communications refers to the applicant, the plea said.
There are simply no indications that the so-called electronic letters/communications were authored by or addressed to any member of the proscribed Communist Party of India (Maoist), it said.
The academician further claimed there is a selective and prejudicial targeting of the applicant and other accused.
Sen also sought discharge on the ground she has a host of health-related issues and is under medication for acute ailments such as glaucoma, hypertension, irritable bowel syndrome and advanced arthritis, among others.
The case relates to alleged inflammatory speeches delivered at the Elgar Parishad conclave held at Shaniwarwada in Pune city on December 31, 2017, which the police claimed triggered violence the next day near the Koregaon-Bhima war memorial located on the city’s outskirts.
The Pune police, which initially probed the case, had claimed the conclave was backed by Maoists.
Later, the probe in the case, in which more than a dozen activists and academicians have been named as accused, was transferred to the NIA.
