    New Delhi: Fourteen political parties led by the Congress on Friday moved the Supreme Court against the alleged misuse of investigative agencies in arresting opposition leaders, and sought guidelines on arrest.

    Senior advocate A.M. Singhvi mentioned the matter before a bench headed by Chief Justice D.Y. Chandrachud for early hearing.

    The top court agreed to hear the matter on April 5.

    The counsel clarified that they are not attempting to affect the ongoing investigations.

    The political parties sought laying down guidelines for law enforcing agencies and courts on arrest, remand, and bail.

    The top court was informed that a majority of cases are against the opposition leaders.

    Hyderabad: Students of Osmania University (OU) are up in arms against the varsity’s administration ever since it increased the fee for PhD courses by ten times on March 16. Many students have been protesting against this move and submitted representations requesting the Dean Faculties to reduce the fee.

    In a notification issued by the Dean Faculties of various departments, the fee particulars for students who were allotted seats under Category – 2 PhD courses for the academic year 2022, in Social Sciences, Arts, Education, Commerce, Management, and Oriental Languages was set at Rs 20,000 and for Engineering, Science, Technology, and Pharmacy departments it present at Rs 25,000.

    The last date to pay the fee and complete the admission process was on March 21. Upon requests from students, it was extended to March 25, said the OU administration.

    A press release by Osmania University (OU) student union members on Tuesday said that the fee for PhD courses in Social Sciences and other departments was Rs 2000 until last year and for Engineering and other courses it was Rs 2500.

    Swapna, who got PhD admission in Political Science said that she has not yet paid the admission fee. “I am waiting to see if the university will decrease the fee. My seniors had told me that the fee was about Rs 2000 and I was utterly shocked to see that it has been increased to Rs 20,000,” she added.

    She informed that many students who got admission under Category – 2 for the year 2022 are waiting to hear if there will be a change in the decision taken by the university before paying the fee.

    Another PhD student from the Telugu department, Yadagiri, has said, “I was scared that I would lose my admission. I tried so hard to get here and even though I felt that the revised fee was too high for me I paid it. I did not tell my parents because they cannot afford to send me Rs 20,000 in less than a week. I took a loan from my friends to pay the fee”.

    He said that many students hailing from poor and rural backgrounds prefer to study at OU and this was because of lower fee structures as OU is a government university. Yadagiri said that students who were given admission in Category-1 have paid a fee of Rs 2000 and that the fee hike announced will be effective starting with candidates who were admitted through Category-2.

    Speaking to Siasat.com regarding the fee hike, Registrar of OU Prof Laxminarayana said, “Entrance exams were not conducted for the last 6 years in the university and the previous fees were in place since 2003. The university also did not have a vice-chancellor for about two years, along with this the entrance exams were delayed because of the pandemic situation. All of these factors have led to the decision being brought into effect now”.

    “A standing committee consisting of Dean Faculties has recommended the hike in fee. The departments in the university are suffering due to lack of funds and we are hoping to bridge this gap at least a little with this fee hike,” added the OU registrar.

    The Osmania University Registrar also informed that about 75 percent of the students have already paid the fee and that the Category–1 students who joined in 2022 when the previous fee structure was in effect will also be brought under the revised fee structure. “Category-1 students have been informed of this and they will be notified to pay the remaining fee soon. A time period of one month will be given to complete the payment,” he added.

    Prof D Ravinder, OU vice-chancellor told Siasat.com, “The PhD course will be conducted as per the guidelines of the University Grants Commission (UGC). This means that there are various costs involved. To provide quality education at PhD level we need to be able to provide research facilities to the students. This is not something new, recently there was a hike in Post Graduate fee and it has now been set at Rs 14,000 per annum and now the fee for PhD course has been increased to Rs 20,000”.

    The OU VC said that the steep hike was due to the fact that there had not been one in over a decade. He expressed that dissent over the fee increase will die down soon.

    OU Registrar Laxminarayana also said that this is not an arbitrary decision as the students can avail fee reimbursement from the government. “Eligible students can apply for scholarships which provide them a tuition fee of about Rs 30,000. All of the details are available to the students and the present fee is not more than Rs 25,000,” he added.

    A dean faculty, who was a member of the standing committee, said that this was a collective decision and that a comparative analysis of fee structures of other universities such as Jawaharlal Nehru University (JNU) and Jawaharlal Nehru Technological University Hyderabad (JNTU) was done before taking the decision.

    Lack of hostel facilities, dwindling numbers of Professors, and the absence of Research Methodology classes are some issues besides the fee hike, that students of OU believe are obstacles to the completion of their PhD theses.

    Mahesh, who got admission into the PhD course in Public Administration said, “I don’t understand this sudden and steep hike in the fee. A majority of the professors will be retiring very soon and there have been no new recruitments for some time now. Who will supervise the new research scholars?”

    Across Telangana universities, 75 percent of teaching facilities are reportedly vacant. Earlier on February 7, Prof Kaseem of the Telugu department held a protest urging the Telangana chief minister K. Chandrashekhar Rao (KCR) and Telangana Governor Tamilisai Soundarajan to fill vacant teaching positions in the university.

    He said that 2000 teaching posts and 4000 non-teaching posts are vacant as per recent surveys in Telangana.

    A research scholar from OU in Social Sciences said that Research Methodology classes, which are a part of PhD coursework program, are not being held at OU. The scholar said that for the PhD candidates of the year 2022 who were admitted under Category-1, Research Methodology coursework has not been conducted in semester one and that there is no word from the university regarding it in semester 2 either.

    The University Grants Commission (UGC) under its ‘Minimum Standards and Procedures for Award of PhD Degree Regulations, 2022’ stipulates in section 7.5 that, “All candidates admitted to the PhD programmes shall be required to complete the course work prescribed by the Department during the initial one or two semesters”.

    Section 7.9 of the regulations implies that without obtaining the pass marks in coursework, a PhD candidate is ineligible to continue in the programme. Many students from OU expressed concerns over a clause in the notification issued by the university which said that admission will not be granted unless the student produces an undertaking that they will not ask for the hostel facilities.

    The registrar of OU said that as soon as the construction of two new hostels on the campus is completed, the PhD students will be given an opportunity to avail the facilities.

    Speaking about the clause the vice-chancellor said, “Owing to Covid-19 Pandemic, thesis work has been delayed and many students have not vacated their hostel rooms yet. For this reason, we had to put the clause in the notification. We are unable to provide regular PhD students hostel facilities as there are no vacancies”.

    SRINAGAR: A day after the arrest of journalist Irfan Mehraj by the National Investigation Agency (NIA), various media groups and human rights watchdogs have called for his immediate release. The political class is also seeing his release.

    The Press Club of India expressed its strong disapproval of the application of the UAPA to journalists and expressed concern over the NIA’s arrest of Mehraj. “We vehemently oppose the imposing of UAPA on media persons,” the powerful club said in a tweet. “The misuse of this draconian law by NIA in randomly arresting Irfan Mehraj, a journalist from Kashmir ominously points towards a violation of freedom of speech and expression. We demand his immediate release.”

    The Editor’s Guild of India (EGI) has also expressed their concern over the arrest. The “space for media freedom has progressively eroded in Kashmir”, said the Editors Guild of India on Wednesday.

    The Guild has voiced ‘deep concern’ over the ‘excessive use’ of Unlawful Activities Prevention Act (UAPA) against journalists, citing the recent arrest of Irfan Mehraj, a Kashmir-based journalist, by the National Investigation Agency (NIA).”

    In a statement, the Guild reported that on March 20th, Irfan received a call from an investigator who asked him to come to the local NIA office in Srinagar for a brief meeting. However, after his arrival, he was arrested and later transferred to Delhi. According to the Guild, Irfan was charged under the draconian UAPA and was previously summoned to Delhi in relation to a case on “NGO terror funding”, to which he cooperated with the NIA’s investigation.

    The NIA, in its press note, alleged that Irfan was a ‘close associate’ of the Kashmiri human rights defender Khurram Parvez.

    Mehbooba Mufti, President Peoples Democratic Party (PDP) and former chief minister of Jammu and Kashmir also criticized the NIA’s actions. “While conmen are given a free run in Kashmir, journalists like Irfan Mehraj are arrested for doing their duty by speaking the truth,” Ms Mufti said. She criticised the abuse of “draconian laws like UAPA” and their constant use to ensure punishment through the process itself.

    The arrest of Kashmiri journalist Irfan Mehraj was also condemned by Amnesty International India.

    “The arrest of Kashmiri journalist Irfan Mehraj under terror charges is a travesty,” said Aakar Patel, chair of the board at Amnesty International India, in a statement. “The arrest is yet another instance of the long-drawn repression of human rights and the crackdown on media freedoms and civil society in the region of Jammu and Kashmir. The stifling of the rights to freedom of expression and association continue unabated in Kashmir.”

    Patel also expressed concern over the criminalization of human rights work, stating that “Human rights defenders such as Irfan Mehraj should be encouraged and protected, not persecuted. He must be immediately released. The repression must stop. Criminalization of legitimate human rights work is extremely alarming and the authorities must put an end to this immediately.” Amnesty International has termed the arrest as “yet another crackdown on media freedom in Jammu and Kashmir.”

    Expressing profound apprehension, Mary Lawlor, the UN Special Rapporteur on Human Rights Defenders, also stated her deep concern regarding the detention of Irfan.

    “I’m deeply concerned about the Kashmiri HRD and journalist @IrfanMeraj. He was called to come to the @NIA_India office in Srinagar and arrested in a 2020 case, accused of serious offences. I call for his immediate release,” Mary Lawlor tweeted.

    It is worth noting that Irfan was taken into custody by the NIA in Srinagar on March 20, on charges under several sections of the Indian Penal Code and the Unlawful Activities (Prevention) Act. Irfan, who is the founder of Wande Magazine, presently serves as a senior editor at TwoCircles.net. His works have been published by The Indian ExpressAl JazeeraHimal SouthasianDW, and TRT World.

    Hyderabad: Following regular criticism from the Telangana government, the Centre on Thursday told the Lok Sabha that in order to seek National Project (NP) status for Kaleshwaram and Palamuru Rangareddy lift irrigation schemes, the state must first file a proposal and send it to the Jal Shakti ministry.

    The Bharat Rashtra Smaithi (BRS) government has been regularly demanding the Centre to sanction National Project status to any project in Telangana, especially Kaleshwaram.

    Minister of State for Jal Shakti Bishweswar Tudu while replying to a question by Congress MP Komatireddy Venkat Reddy in the Lok Sabha on Thursday, said that for inclusion of a project for funding under the NP scheme of Jal Shakti Ministry, it is required to be first appraised by Central Water Commission (CWC), and accepted by the Advisory Committee on Irrigation, Flood Control and Multipurpose Projects.

    The minister held that a proposal by the state, in the prescribed format for the inclusion of the project under the NP scheme is step one to be put forward for approval, adding that the Centre and state funds ratio would be 60:40 if the NP scheme is sanctioned.

    “As per norms laid down for the NP scheme, the project is then required to be considered by the ‘High Powered Steering Committee (HPSC) that will examine whether it meets the contours of the NP scheme,” Tudu added.

    “On being recommended by HPSC, and as per availability of fund, the Government of India may approve the inclusion of a project under the National Projects scheme,” the minister said.

    Bengaluru: The Centre has submitted to the Karnataka High Court that American microblogging platform Twitter cannot take protection under Article 19 of the Constitution which ensures freedom of speech and expression.

    The Article 19 of the Constitution guarantees freedom of speech and expression to Indian citizens and not to foreigners and foreign entities, the Additional Solicitor General (South) R. Sankaranarayanan representing the central government submitted to the High Court on Thursday.

    Twitter had challenged the blocking orders by the central government between February 2, 2021 and February 28, 2022. The American microblogging platform alleged that the orders “are arbitrary”.

    “Twitter can’t seek protection under Article 19 as it is a foreign company. There is nothing arbitrary under Article 14, and Section 69 (A) is properly followed,” stated Additional Solicitor General, and urged the court not to give any relief to Twitter.

    The matter has been adjourned to April 10.

    Prasad said that it has become Rahul Gandhi’s habit to insult the people of India and democracy on foreign soil. “How long will he mislead the country?” he questioned.

    He said Rahul Gandhi does not apologise, the BJP will run a campaign against him in which the Congress leader will be exposed.

    The BJP leader further said that “Rahul Gandhi has not expressed regret for his statement yet”.

    Addressing the former Congress president, Prasad said: “Your ego is not bigger than the country.”

    SRINAGAR: The Union Territory of Ladakh plans to declare a field firing range in the Drass area of Kargil district, covering 5.69 lakh Kanals of land. The UT administration has issued a notification inviting objections from the general public.

    The notification, issued by Umang Narula, advisor to LG Ladakh and administrative secretary, Home of the Union Territory, stated that objections must be communicated to the Deputy Commissioner of Kargil within two months from the date of issuance.

    The Ladakh administration plans to allow field firing and artillery practice on a 5,69,911 Kanals and 17 Marlas area in village Matayen Kharu, district Kargil for five years, according to a proposal issued under sub-section (3) of section 9 of the Maneuvers, Field Firing and Artillery Practice Act, 1938.

    The law requires that the State/UT administration issue an intention notice before designating an area as a field firing range for use by the forces. In 2017, the government of the former state of Jammu & Kashmir designated an area of 4,80,000 Kanals (60,000 acres) located at Mandalthang, Shayok in Durbuk sub-division, Leh district as a field firing range for five years.     SRINAGAR:  National opposition and Jammu and Kashmir regional parties on Thursday submitted a memorandum to Election Commission of India, seeking early assembly polls in the Union Territory.

    The signatories of the memorandum include National Conference president Dr Farooq Abdullah, Congress national president Mallikarjun Kharge, CPI (M) General Secretary Sitaram Yechury, NCP chief Sharad Pawar and other senior leaders of national political parties.

    The memorandum reads that Jammu and Kashmir is without a legislative assembly and an elected government for last five years.

    “In disregard of the letter and spirit of the Constitution, an unrepresentative and unaccountable bureaucracy is allowed to run the government to the discomfort and inconvenience of the general public, “ it reads.

    It reads that the panchayat elections and elections to other PRIs cannot be substitute to legislative assembly elections and the government and for that matter the ECI cannot avoid and delay assembly elections on that ground.

    “Had it been so, there would be no need to conduct assembly elections in states, that the ECI is with due dispatch and punctuality, as is evident from recently held assembly elections in Meghalaya, Tripura and Nagaland and the elections scheduled to be held in Karnataka.”

    It added in each case the argument though, inherently specious, could have been that as PRIs were in place there was no need to hold assembly elections.”

    “The Home Minister and other functionaries of Government of India have more than once stated that the government is ready to facilitate conduct of assembly elections and final call is to be taken by the Election Commission of India.”

    It reads the Election Commission of India is under a constitutional obligation to hold assembly elections in Jammu and Kashmir and delay in and denial of assembly elections would amount to denial of fundamental and democratic rights of the people of Jammu and Kashmir and a breach of constitutional obligations.

    “We however reiterate that the assembly election would be first and important step towards restoration of all the constitutional rights guaranteed in the constitution of India and fulfillment of political aspirations of the people of Jammu and Kashmir,” it reads.

    The memorandum reads, “We the signatories to this memorandum representing different political parties of Jammu and Kashmir and various national political parties implore and request the Election Commission of India to announce the assembly elections in Jammu and Kashmir without any further delay and notify the election schedule so that the democratic rights of the people of Jammu and Kashmir and access to democratic institutions is restored.”

    Earlier in the day, JK leaders during a meeting with representatives of various national opposition parties discussed prevailing situation in Jammu and Kashmir and delay in holding of assembly elections.(KNO)

    Civil society groups seek help from opposition parties to ‘save’ MGNREGA

    New Delhi: Alleging that the NDA government is on its way to gradually doing away with the Mahatma Gandhi National Rural Employment Guarantee Scheme (MGNREGA), many civil society groups and labour organisations have appealed to opposition parties to support their demands for an increase in budgetary allocation for the scheme.

    In a briefing held for the Members of Parliament on March 14 at the Deputy Speakers Hall, Constitution Club, New Delhi, the civil society members urged them to raise the issues of crores of labourers and workers who have “not been paid since December 2021”.

    They highlighted the issue of inadequate funding, adverse changes in the attendance system as well as the method of payment. The broad aim of the briefing was to help MPs defend peoples’ right to work under the MGNREGA.

    MPs of the opposition parties who attended the event were Sanjay Singh (Aam Aadmi Party), Digvijaya Singh, Uttam Kumar Reddy and Kumar Ketkar (Congress Party), S. Senthilkumar (Dravida Munnetra Kazhagam), Jawhar Sircar (All India Trinamool Congress Party) among others.

    They deliberated upon the ways to force the government to enhance budgetary allocation and reverse the recent amendments in the mode of payment which has proved “disastrous” to the interest of workers.

    Beginning the presentation, Jean Dr ze, visiting Professor at Ranchi University, alleged that the National Democratic Alliance (NDA) government has unleashed an unprecedented three-pronged attack on MGNREGA — inadequate funding, the introduction of an Aadhar-based Payment System (ABPS) and the inception of a real-time attendance system through the National Mobile Monitoring Software (NMMS) app.

    Prof Dreze claimed that this year’s funding is only Rs 60,000 crore which is the lowest allocation ever in the history of the programme.

    “Funds run out and projects come to a halt. The wages get delayed and are accumulated for months,” Prof Dreze said, adding that the introduction of digital attendance has deprived the workers of their wages due to technical and network glitches.

    “Aadhar-based Payment is so complicated system that even many bankers fail to understand its functionality and the majority of workers cannot be paid through this system. It is illegal and criminal not to pay wages to workers for the work that they have done” he added.

    Other speakers who expressed their concerns and shared the problems of workers were Nikhil Dey (Mazdoor Kisan Shakti Sangathan, Rajasthan), James Herenj (NREGA Watch, Jharkhand), Ashish Ranjan (Jan Jagran Shakti Sangathan, Bihar), Richa Singh (Sangtin Kisan Mazdoor Sangathan, UP), Anuradha Talwar (Paschim Bangal Khet Mazdoor Samiti, West Bengal) and Supreme Court lawyer Prashant Bhushan among others.

    They presented testimonies to show that the Aadhar-based Payment and Mobile Monitoring Software App are “depriving a large number of workers of payment” of wages to them. They said that according to the data from the Ministry of Rural Development (MoRD), only 43 per cent of NREGA workers are eligible for ABPS.

    “The current changes in MGNREGA impact 15 crore workers across the country which is a huge number. We want a political response from opposition parties to support people on the ground to give them their rights under the law,” Dey said.

    Civil society members requested MPs to issue a Privilege Notice in Parliament to demand an explanation from the Rural Development Minister on his remarks to the media suggesting that the state government should also contribute to the wage liability under the programme, contrary to the provisions of MGNREGA.

    Assuring the civil society members of full support, Congress leader Digvijaya Singh said that workers’ plight is genuine.

    “The intent of this government is always opposed to the ideals of the Mahatma Gandhi National Rural Employment Guarantee Act of 2005. They are cutting down all social service budgets. I am all for the support which is expected from us,” he said.

    AAP MP Sanjay Singh said the BJP government admitted in Parliament while responding to his questions that the dues of states under MGNREGA run over Rs 3,000 crore.

    “It is very surprising to know that out of guaranteed 100 days of work, the labourers are getting only 34 days of work due to lack of adequate funds. We will raise the issue in Parliament but at the same time we should also think about starting a people’s movement,” he suggested.

    Other MPs also pledged support and said they will do their level best to help highlight the plights of the workers.

    MGNREGA Sangharsh Morcha is a coalition of organisations working with rural labourers and workers around the country. It is in the midst of a 100-day dharna at Jantar Mantar, to protest against “recent attacks” on the scheme.
