    Wrong to assume that sacked H-1B staffers have to leave America within 60 days: USCIS director

    Washington: Amid mass layoffs in the tech sector, the federal agency for immigration services has said it is wrong to assume that sacked workers holding the much-sought-after H-1B visas have to leave the country within 60 days, asserting they have multiple options to stay in the US.

    The H-1B visa is a non-immigrant visa that allows US companies to employ foreign workers in speciality occupations that require theoretical or technical expertise.

    Technology companies depend on it to hire tens of thousands of employees each year from countries like India and China.

    In a letter to the Foundation for India and Indian Diaspora Studies, USCIS Director Ur M Jaddou said: “When non-immigrant workers are laid off, they may not be aware of their options and may, in some instances, wrongly assume that they have no option but to leave the country within 60 days.” The Foundation for India and Indian Diaspora Studies (FIIDS), which has been working for laid-off H-1B visa holders, recently wrote to USCIS about the impacts of recent technology sector layoffs and sought an increase to the up to 60-day grace period.

    In the letter addressed to FIIDS director for policy and analysis strategy Khanderao Kand, the USCIS said it acknowledges the financial and emotional impact that job loss can have on employment-based non-immigrant workers and their families in the US.

    “We are aware of the issue of involuntary terminations, especially in the technology sector,” Kand said.

    Thousands of highly skilled foreign-born workers, including Indians, in the US, have lost their jobs due to the series of recent layoffs at companies like Google, Microsoft and Amazon.

    According to The Washington Post, nearly 200,000 IT workers have been laid off since November last year.

    Industry insiders say that between 30 to 40 per cent of them are Indian IT professionals, a significant number of whom are on H-1B and L1 visas.

    When a non-immigrant worker’s employment is terminated, either voluntarily or involuntarily, they typically may take one of the four actions, if eligible, to remain in a period of authorised stay in the United States, the USCIS said.

    Prominent among these include filing an application for a change of non-immigrant status and filing an application for adjustment of status.

    They can also file an application for a “compelling circumstances” employment authorisation document or be the beneficiary of a non-frivolous petition to change employer, the USCIS said.

    “If one of these actions occurs within the up to 60-day grace period, the nonimmigrant’s period of authorised stay in the US can exceed 60 days, even if they lose their previous non-immigrant status.

    “If the worker takes no action within the grace period, they and their dependents may then need to depart the United States within 60 days, or when their authorised validity period ends, whichever is shorter,” the USCIS said in its letter.

    It said that because the up to 60-day grace period is codified in the Department of Homeland Security regulations, extending it would require a regulatory change in compliance with the Administrative Procedure Act and could not be extended by USCIS through policy guidance.

    Fortunately, most individuals facing job loss already have several options to remain in the US, while continuing their job search past 60 days, the USCIS wrote.

    It said it recognises the contributions made to the United States by talented foreign-born workers, including in the STEM (science, technology, engineering and mathematics) fields.

    “We will continue to monitor the technology sector layoffs and explore appropriate measures,” Jaddou said.

    In a statement, Kand said departing the US after layoffs has an immediate impact on the families of the laid-off H1B and their school-going children.

    “Losing these professionals is also a brain drain impacting the future competitiveness of the US in emerging technologies. Hence, FIIDS has launched a multi-phase campaign from awareness building to jointly written letters to the USCIS with elected officials and other prominent organisations,” the statement said.

    FIIDS launched a media campaign in January to raise awareness about the issue.

    In February, it launched a petition which received support from various prominent organisations like the US-India Strategic Partnership Forum, US-India Business Council, American Jewish Committee, and The Indus Entrepreneurs seeking an extension of the grace period.

    “We appreciate the USCIS for clearly providing options for the laid-off H-1Bs. These official communications will improve the possibility for the H-1B holders to remain legally in the US. We will still work with the DHS to change the grace period,” Kand said.

    House of Representatives members Zoe Lofgren and Anna Eshoo, in their letter to USCIS, termed the departure of STEM professionals from the US a national security threat.

    Congressman Raja Krishnamoorthi said that if retained, these laid-off professionals can develop innovative products and potentially start new businesses and create new jobs while advancing research across critical industries.

    Recently, Senator Chuck Schumer told an Indian American audience that the issue can be addressed with a procedure change.

    The “White House Initiative on Asian Americans, Native Hawaiians, and Pacific Islanders” under the Health and Human Services Department also recommended an extension of the H-1B grace period.

    New Delhi: Among the 11,000 employees which Meta laid off last year in November is an Indian-origin worker who also lost her job, has shared her ordeal on LinkedIn, saying “I am not giving up”.

    Susmita Sahu, who worked in a Talent Accelerator Recruiting Team in Singapore, wrote in her LinkedIn post: “While I’m still processing what happened and I’m in true loss of the right words, I’m grateful for having an opportunity to work with some AMAZING people out there.”

    “I’m also a part of the unfortunate Meta layoffs and I’ll be ever grateful to anyone who has any job recommendations for me. I’M NOT GIVING UP!” she added.

    Sahu studied Master of Business Administration (MBA) in HR and Marketing from Biju Patnaik Institute of Information Technology and Management, (BIITM), Bhubaneswar.

    She was laid off about six months after she joined the company.

    In a follow-up post, she expressed a desire to spend more time with the company.

    “It’s a little over 4 p.m. in Singapore and with all the acceptance (still some mental denial), we all finally complete signing the separation agreement. Reminds me of how lucky I am to have something that makes saying goodbye so hard. I still wish my time at Meta was longer,” Sahu said.

    Meanwhile, Meta looks all set to lay off another 13 per cent, or roughly 11,000 jobs, in its second round of job cuts that will hit non-engineering roles hard.

    According to a report in The Wall Street Journal, citing sources, Meta Platforms is planning “additional layoffs to be announced in multiple rounds over the coming months”.

    San Francisco: Elon Musk on Twitter has taken an exit interview of a sacked worker, who asked him to confirm if he is still an employee or not.

    Ex-Twitter employee named Haraldur Thorleifsson wrote in his post: “Dear @elonmusk, 9 days ago the access to my work computer was cut, along with about 200 other Twitter employees. However, your head of HR is not able to confirm if I am an employee or not. You’ve not answered my emails. Maybe if enough people retweet you’ll answer me here?”

    To which Musk replied: “What work have you been doing?”

    Thorleifsson then talked about his job and the specific work he was doing at Twitter.

    After a brief discussion, the Twitter boss laughed at him with emojis, indicating that he had been fired.

    Moreover, the exit interview has gone viral, with many people finding Musk’s attitude rude and disrespectful.

    “Publicly humiliated his ex-employee. The guy had one shot and tried to waffle by saying he saved $500k on FIGMA,” a user wrote.

    “I’m sorry to say it doesn’t seem to be an actual question but him mocking you, someone who was just laid off. This makes me so upset I will probably cancel my subscription. I cannot support such a cruel organization. Explain yourself Elon!,” another user commented.

    Gurugram: The Gurugram couple arrested for allegedly torturing and sexually abusing a minor domestic help have been sacked from their jobs, while police began a search on Thursday for the placement agency through which the girl was employed.

    The public relations agency for which the woman worked and the insurance company where her husband was employed announced their termination on Twitter.

    On Thursday, an official of the Jharkhand Bhawan in Delhi also visited the civil hospital to meet the girl, a staffer of the health facility said.

    The girl from Ranchi in Jharkhand was hired through a placement agency and the couple made her work and also beat her mercilessly daily, according to the complaint filed by Pinky Malik, the in-charge of the Sakhi centre that along with police rescued the girl.

    Several injuries were found on her hands, feet and mouth, police had said after arresting Manish Khattar (36) and his wife Kamaljeet Kaur (34), residents of New Colony here, on Wednesday.

    According to the FIR, the girl is 17 years old and not 14 as told by a police officer earlier.

    Malik claimed that the couple would not let her sleep in the night and also did not give her food. “Her mouth was completely swollen while injury marks were found everywhere on her body,” she said.

    According to the FIR, the victim said five months ago, her uncle left her at Khattar’s flat where he lives with his wife and daughter.

    The victim said she was humiliated and beaten every day, it said. Heated iron tongs were allegedly used on her.

    Khattar used to strip her naked and hurt her on her private parts, according to the FIR. The victim said the couple confined her at their house and did not allow her to talk to her family.

    The FIR has been registered against the couple under sections 323 (causing hurt), 342 (wrongful confinement), 34 (common intention) of the Indian Penal Code, and provisions of the Juvenile Justice Act and the Protection of Children Against Sexual Offences (POCSO) Act.

    The police have invoked POCSO Act’s section 12, which pertains to punishment for “sexual harassment”.

    A team on Thursday conducted searches in Delhi for the placement agency through which the victim is said to have been hired for Rs 10,000 a month, police said.

    Khattar, who is in police remand, claimed that he hired the girl five months ago for taking care of his daughter and got in touch with the placement agency online, SHO New Colony police station Inspector Dinkar said. While Khattar is a resident of Gurugram, his wife is a native of Ranchi.

    “Our team searched for the agency today in Delhi. The accused also confessed that when the victim made a mistake, he got angry and used to beat her. Further probe is underway,” he said.

    On Kaur’s job termination, the public relations agency tweeted: “We are shocked to learn about the human rights and child abuse allegations against Kamaljeet Kaur.”

    “As an organisation, we respect the Indian legal system and are strictly against any form of human rights abuse. The company has terminated her services with immediate effect,” it said.

    The insurance company, where Manish Khattar was employed, tweeted that it believes in upholding high levels of ethical and moral conduct at all times. “We have severed the employment of the individual with immediate effect,” the company said.

    The Jharkhand Chief Minister’s Office has urged office of the Haryana chief minister and the National Commission for Protection of Child Rights (NCPCR) to provide support for the girl’s rehabilitation.

    “Chief Minister Hemant Soren is deeply anguished at this inhuman act of child torture that’s come to light. NCPCR & cmohry are kindly requested to take due note of this grave matter with utmost importance and provide necessary support to rehabilitate the girl back to her family” his office tweeted.

    Srinagar, Jan 21: Government has dismissed six employees for secured jobs on fake degrees in the union territory of Jammu and Kashmir, officials said on Saturday.

    They told Srinagar based news agency Kashmir Dot Com that six Junior Statistical assistants of the Planning and Monitoring department who had obtained jobs on the basis of ‘fake degrees’ were dismissed from the service by the Lt governor administration.

    “It came to the notice of the department that six employees had used fake degrees to obtain the jobs. The verification conducted by the department proved that the degrees obtained by the six employees were fake ,” they said, adding that accordingly appointments were cancelled .

    The dismissed employees were identified as

    • Suhail Ahmad Sheikh, a resident of Kachdoora Vehil Shopian,
    • Feroz Hamid son of Peerzada Abdul Hamid , resident of Sopore near Bus Stand,
    • Gulzar Ahmad Wani son of Ghulam Mohiuddin Wani, a resident of Bustand Kulgam,
    • Mehraj ud din Dar son of  Mohammad Ramzan Dar, a resident of Sadar Bazar Kulgam,
    • Mudasir Ahmad Bhat son of Ghulam Mohi ud Din Bha, a resident of Wani Mohalla Kulgam, and
    • Showkat Ahmad Parray son of Mohammad Ramzan Parray, a resident of H N Pora Kulgam.

    All the six Junior Statistical Assistants from Kashmir division were selected through Service Selection Board (SSB) of Jammu and Kashmir in the year 2012.

    A top official while confirming the development to KDC said “In view of adverse verification report of qualifications in respect of all six Junior Statistical assistants, the appointments were subsequently cancelled ab-initio.” (KDC)
