    Only JPC probe into Adani row can bring out truth: Congress

    New Delhi: The Congress on Thursday said no panel other than a joint parliamentary committee can bring out the truth in the Adani row and the industrialist’s relationship with the prime minister and asserted that it will raise the demand in Parliament when it meets again on March 13.

    Congress general secretary, communications, Jairam Ramesh said he had stated on February 16 that any panel by the Supreme Court would only look into violations of SEBI rules and regulations and will not be able to bring out the truth in the Adani issue.

    “If the prime minister and the government are to be held accountable, any committee other than the JPC will be nothing but an exercise in legitimisation and exoneration,” he told reporters here, asserting that he had stated this earlier too.

    “In the Adani case, the Supreme Court committee is limited only to the investigation of violations of SEBI law and regulation. The truth of what has been the relationship between Prime Minister Modi and (Gautam) Adani will never come to the fore if JPC is not formed,” he said.

    The Congress party wants that a JPC be instituted and will raise the demand in the Parliament session beginning March 13, he noted.

    The Congress leader also asserted that it has been posing a set of three questions to the prime minister everyday but has not received any answers, and they will remain unanswered by the SC-appointed panel formed to look into the issue.

    Meanwhile, Congress leader Praveen Chakravarty, who is also head of the party’s data analytics department, urged “experts” such as Nandan Nilekani and K V Kamath on the SC-appointed panel to “not be timid” as they usually are and “be bold and diligent” in their investigation.

    Ramesh said on February 16 he had stated that any committee formed by the Supreme Curt into the Adani-Hindenburg issue would be nothing but an exercise in legitimisation and exoneration.

    Asked whether the Congress was not in favour of the Supreme Court setting up a panel, he said “we are not confident that the truth in Adani issue will come out” through it.

    The Congress and some other opposition parties have been demanding the constitution of a joint parliamentary committee to look into the Adani issue in the wake of charges of stock manipulation and financial irregularities raised by US firm Hindenburg that led to meltdown of stocks of Adani Group companies on Indian bourses.

    The party had also stalled proceedings in both houses of Parliament over the issue and it is likely to step up the heat over its demand in the forthcoming budget session of Parliament.

    The Supreme Court on Thursday ordered setting up of a six-member committee headed by former apex court judge Justice A M Sapre to investigate the recent Adani Group shares crash triggered by the Hindenburg Research’s fraud allegations and other regulatory aspects related to stock markets.

    The court asked the panel to submit its report in a sealed cover within two months.

    The top court observed that the PILs pertained to “the loss of investors’ wealth over the past few weeks due to the steep decline of share prices of Adani Group companies, precipitated by the Hindenburg Research report which alleged manipulations and malpractices by the Adani Group companies” and also directed market regulator SEBI (Securities and Exchange Board of India) to complete its ongoing probe into the issue in two months and file a status report.

    Besides former apex court judge Justice Sapre, the other members of the court-appointed panel will be O P Bhat (former Chairman of SBI), Justice J P Devadhar (retired judge of the Bombay High Court), K V Kamath, Nandan Nilekani and Somasekharan Sundaresan.

    New Delhi: The Supreme Court is scheduled to pronounce on Thursday its order on a batch of PILs on the recent Adani Group shares crash triggered by the Hindenburg Research’s fraud allegations.

    A bench of Chief Justice D Y Chandrachud and Justices P S Narasimha and J B Pardiwala is likely to deliver its verdict over setting up of a panel of domain experts for strengthening existing regulatory measures for stock markets.

    While reserving its order, the top court on February 17 refused to accept in a sealed cover the Centre’s suggestion on a proposed panel of experts.

    Observing that it wanted full transparency for the protection of investors, the top court had also ruled out the possibility of any sitting judge overseeing the functioning of the proposed panel.

    Stressing that statutory bodies like the market regulator Securities and Exchange Board of India (SEBI) are fully equipped and are on job, the central government had expressed apprehension that any unintentional message to the investors that regulatory bodies in India needed monitoring by a panel may have some adverse impact on the flow of money into the country.

    The Centre had told the bench that it wanted to provide details such as names and the scope of the panel’s mandate in a sealed cover.

    Stock market regulator SEBI, in its note filed in the top court, had indicated it is not in favour of banning short-selling or sale of borrowed shares and said it is investigating allegations made by a tiny short-seller against the Adani Group as well as its share price movements.

    Till now, four PILs have been filed in the top court on the issue by lawyers M L Sharma, Vishal Tiwari, Congress leader Jaya Thakur and Mukesh Kumar, who claims to be a social activist.

    Tiwari, in his PIL, sought a direction from the Centre to constitute a committee monitored by a retired apex court judge to inquire into the Hindenburg Research report which has made a slew of allegations against the business conglomerate led by industrialist Gautam Adani.

    Another PIL filed by advocate M L Sharma sought prosecution of short-seller Nathan Anderson of the US-based Hindenburg Research and his associates in India and the US for allegedly exploiting innocent investors and the “artificial crashing” of the Adani Group’s stock value in the market.

    Congress leader Thakur, in his plea, has sought an investigation under the supervision of a sitting apex court judge against the Adani Group of companies in light of the allegations.

    The fourth PIL seeks a probe by multiple central government agencies under the supervision of a panel or a former apex court judge against the Adani Group following allegations of fraud and share price manipulation.

    “Direct appropriate audit (transactional and forensic audits), inquiry and investigation by appropriate agencies such as Serious Frauds Investigation Office (SFIO); Registrar of Companies (RoC); Securities and Exchange Board of India (SEBI); ED (Directorate of Enforcement) on money-laundering aspect; I-T (Income-Tax Department on aspects of offshore transactions and tax-havens involved and DRI( Department of Revenue Intelligence), ” the fourth plea said.

    Besides seeking a direction to the Centre and its agencies to render cooperation in the probe, the PIL has sought a direction to appoint a retired judge of the apex court or a committee to oversee and monitor the inquiry and investigation.

    Adani Group stocks have taken a beating on the bourses after Hindenburg Research made a litany of allegations, including fraudulent transactions and share-price manipulation, against the business conglomerate. The Adani Group has dismissed the charges as lies, saying it complies with all laws and disclosure requirements.

    Raipur: As Congress’ 85th plenary session concludes, party chief Mallikarjun Kharge on Sunday hurdled a scathing attack at the Centre over the Adani issue.

    The 85th plenary session of Congress was being held in Raipur.

    Addressing the gathering on the third and final day of the session, Kharge said, “Few people are looting the property of this country. Modi ji is giving our money and property to one person. Adani has been made so big that he become as fat as an elephant…”

    Pertinent to mention, a report by a US-based Hindenburg Research surfaced on January 24, claiming that the Adani Group had weak business fundamentals, and was involved in stock manipulation and accounting fraud, among others.

    According to the statement, the Adani portfolio and the Adani verticals are focused on bringing India into the global economy and nation-building. In the summary of the long response by Adani Group, it said the report was “nothing but a lie”.

    The report triggered a sell-off of shares of all Adani Group companies.

    However, the Adani group had termed the report “nothing but a lie”.

    The Congress chief further attacked the Centre over the border issue with China.

    “Giving a clean chit to China, we targeted ourselves. We have degraded the relations with the neighbouring country. We keep on highlighting the mistakes committed by the government. Every worker of the party will fight till last breath for the constitution of the country,” he added.

    He said the speech of former party president Sonia Gandhi was motivating and enthused new energy in party workers.

    After serious delegation, Kharge said several important decisions and proposals were passed in the session.

    “We took historic decision of keeping 50 per cent seats in CWC for women, ST, SC and youths. The meaning of Congress is patriotism, sacrifice, serving and dedication, fearlessness and discipline,” he said.

    He said the fight against the ideology of the Bharatiya Janata Party (BJP) and Rashtriya Swayamsevak Sangh (RSS) will be intensified.

    “Caste-based census is necessary and the one was carried out by our government was not published yet. National Education Policy is the policy of RSS and we are against it. They are trying to give the education of Manusmriti,” Kharge said.

    Congress general secretary Priyanka Gandhi said, “During elections, issues not relevant to the public are raised. Politics should be on how to tackle unemployment, strengthen GDP, take up our economy. BJP conducted raids on us but we are standing strong.

    “It is our job to give a platform to those people who are watching the politics of the country and understand that something is going wrong. It is our job to raise their voice. On the other hand, it is our job to tell and explain this to those people who are not understanding this. This is a huge responsibility,” she added.

    Congress called for five action from Raipur plenary session.

    In a statement, Congress said lakhs of citizens, including workers of the party, walked 4,000 km from Kanyakumari to Kashmir with Rahul Gandhi during the Bharat Jodo Yatra. The Yatra took forward an inclusive and progressive vision of India where Constitutional values reign supreme.

    “In celebrating diversity, equality and fraternity, it presented a clear alternative to the BJP’s vision of India. In a few months, we will be celebrating the centenary of the Seva Dal, a crucial grassroots organisation of Congress workers. This will be an occasion to impart fresh energy into our mass contact programmes,” the statement said.

    Congress said it is the only party that has never compromised with the BJP and RSS and its “despicable politics.”

    “We will always fight to protect our political values against the BJP’s authoritarian, communal and crony capitalist onslaught. We are prepared to work with like-minded political parties on the basis of a common, constructive programme to preserve and protect the Constitution in letter and spirit and to address the three main challenges facing the country: growing economic inequality, intensifying social polarisation and deepening political dictatorship,” the statement said.

    Congress asked party leaders and workers to work with discipline, solidarity and complete unity to ensure victory in important state elections in Karnataka, Chhattisgarh, Madhya Pradesh, Mizoram, Rajasthan and Telangana this year. “The results of these elections will set the tone for the all-important 2024 Lok Sabha election,” the statement said.

    The party said its governments in Chhattisgarh, Himachal Pradesh and Rajasthan are models for the rest of the country.

    In the decade from 2004-2014, Congress delivered the highest ever GDP growth, pulled crores of Indians out of poverty, and introduced many transformational rights-based legislations, such as MGNREGA, Forest Rights Act and National Food Security Act, the party said.

    “The time is now ripe for a new vision to empower the nation’s producers and reboot the economy. MSMEs that have been destroyed in the last eight and a half years must be revived and made the engine of rapid growth and employment, through cluster-based skill development programmes for the youth, and dedicated funding and technological support for labour-intensive manufacturing. GST must be drastically simplified and significantly improved for the benefit of small businesses and traders, and GST compensation for states must be extended for another five years,” the statement said.

    It further stated that agricultural policies and reforms must be reoriented to place farmers and farm workers at the centre, and not only production goals. Farmers must be safeguarded through measures such as debt relief and legally guaranteed MSP. To ensure the fruits of rapid growth benefit all sections of society, Sampoorna Samajik Suraksha must be introduced, especially a women-centric NYAY programme and a Universal Right to Health Act. To cement the foundations of social justice an immediate Caste Census is critical.

    “India awaits a reinvigorated Congress and we owe it to the people to fulfill their expectations. Crores of workers of the Congress party must build on the momentum of the Bharat Jodo Yatra to defeat the divisive forces of the BJP and RSS. A mass awareness campaign will be launched against the crudest example of crony capitalism which the entire country and the world is seeing. We end the Raipur plenary with a renewed resolve and common purpose to build a stronger and united India,” added the Congress statement.

    Mumbai: With the Election Commission (EC) recognising Maharashtra Chief Minister Eknath Shinde’s faction as the real Shiv Sena, it remains to be seen whether his group also stakes claim to the party headquarters ‘Shiv Sena Bhavan’ and party mouthpiece ‘Saamana’, both currently controlled by the Uddhav Thackeray camp.

    While the Shiv Sena Bhavan is located at Dadar in central Mumbai, the ‘Saamana’ head office is situated in the nearby Prabhadevi area. Both these establishments are currently run by different trusts.

    CM Shinde has maintained that he would not stake claim to the Shiv Sena Bhavan even though he has got the party name and symbol. However, the rival camp is wary and on guard. Recently, Shiv Sena (Uddhav Balasaheb Thackeray) leader and Thane MP Rajan Vichare submitted a letter to Thane Police Commissioner Jai Jeet Singh, urging him to thwart any attempts by the Shinde group to usurp the Shiv Sena ‘shakhas’ (local party offices) in the city.

    The EC last week recognised the Shinde faction as the real Shiv Sena and allotted it the party’s ‘bow and arrow’ symbol, giving a jolt to the Thackeray camp. Earlier, the Shinde group was officially referred to as ‘Balasahebanchi Shiv Sena’ and the Thackeray group as Shiv Sena (Uddhav Balasaheb Thackeray). The Supreme Court is hearing various petitions related to the tussle between the Shinde and Thackeray factions.

    Due to the EC verdict, the Thackeray family lost control of the party that was founded in 1966 by Bal Thackeray. The party, founded on the principles of justice for the sons of the soil, had adopted Hindutva as its key ideology and partnered with the Bharatiya Janata Party (BJP) in 1984, an alliance that continued till 2019 when Uddhav Thackeray joined hands with arch-rivals Nationalist Congress Party (NCP) and Congress to become the chief minister.

    The Shiv Sena Bhavan is controlled by ‘Shivai Seva Trust’. Its founding trustees include late Bal Thackeray and his wife late Meena Thackeray. Many of the founding trustees are not alive now.

    Its present trustees include senior leaders Subhash Desai, Diwakar Raote, Leeladhar Dake, former Mumbai mayor Vishaka Raut and Uddhav Thackeray himself.

    While ‘Saamana’, the Shiv Sena mouthpiece founded by late Bal Thackeray, is managed by Prabhodhan Prakashan, whose printer-publisher is Thackeray loyalist Subhash Desai.

    Uddhav Thackeray had resigned as the editor of ‘Saamana’ after assuming the chief minister’s charge in November 2019. He had handed over the editor’s post to his wife Rashmi Thackeray in March 2020. However, after the Shiv Sena split, Uddhav again took over as the editor in August 2022. Sanjay Raut is the executive editor of the party mouthpiece.

    Senior journalist Prakash Akolkar, who has written ‘Jai Maharashtra’ – a book on Shiv Sena’s history, said, “CM Shinde has taken a mature decision of not staking claim to the Shiv Sena Bhavan and Saamana as both these institutions are operated by private trusts. Staking claim to these establishments would lead to further legal complications. It is also his indirect message to supporters to exercise restraint.”

    Harshal Pradhan, a close aide of Uddhav Thackeray, said there are 350 Shiv Sena ‘shakhas’ in Mumbai, while outside Mumbai there is one such unit in each municipal ward.

    Shakhas are the premises where the Shiv Sainiks (party workers) gather for political meetings, resolving local issues of citizens.

    Vaibhav Purandare, the author of ‘Bal Thackeray and the Rise of the Shiv Sena’ said, “As a political party, the Shiv Sena directly owns very few properties. Shiv Sena Bhavan and Saamana are owned by trusts. While most of the Shiv Sena shakhas are either owned by the ‘shakha pramukhs’ or by private individuals who have given their property to set up these offices. It is up to these individuals to decide which way to go.”

    About the present controversy, Ravi has stated on Wednesday that he has been brought up by a traditional Hindu family. “Unlike Siddaramaiah, I won’t dare to say that I will enter a temple after eating non-vegetarian food. I am not going to be the victim of the toolkit politics of Congress,” he maintained.

    New Delhi: India and China on Wednesday held diplomatic talks in Beijing and discussed proposals for disengagement in the remaining friction points along the LAC in eastern Ladakh in an “open and constructive manner”, but there was no indication of any breakthrough.

    During the meeting held under the WMCC framework, the two sides agreed to hold the 18th round of military talks at an early date to achieve the objective in accordance with the existing bilateral agreements and protocols, the Ministry of External Affairs (MEA) said.

    The Working Mechanism for Consultation and Coordination on India-China Border Affairs (WMCC) was established in 2012 as an institutional mechanism for consultation and coordination for the maintenance of peace and tranquillity in the border areas.

    “The two sides reviewed the situation along the Line of Actual Control (LAC) in the Western Sector of India-China border areas and discussed proposals for disengagement in the remaining areas in an open and constructive manner, which would help in the restoration of peace and tranquillity along the LAC in Western Sector and create conditions for the restoration of normalcy in bilateral relations,” the MEA said.

    “To achieve this objective in accordance with the existing bilateral agreements and protocols, they agreed to hold the next (18th) round of the Senior Commanders meeting at an early date,” it said in a statement.

    The MEA said the two sides agreed to continue discussions through military and diplomatic channels.

    “The 26th meeting of the WMCC was held on 22 February 2023 in person in Beijing. This was the first WMCC meeting since the 14th meeting held in July 2019, to be held in person,” it said.

    The Joint Secretary (East Asia) from the Ministry of External Affairs led the Indian delegation. The Chinese delegation was led by the Director General of the Boundary and Oceanic Affairs Department of the Chinese Ministry of Foreign Affairs.

    The 17th round of military talks was held on December 20 but there was no indication of any forward movement in the resolution of the remaining issues.

    A joint statement released after the talks had said that both sides exchanged views in an “open and constructive” manner to resolve the “relevant issues” and described the talks as “frank and in-depth”.

    The WMCC meeting in Beijing came a week before the G20 foreign ministers’ meeting in Delhi. Chinese foreign minister Qin Gang is expected to attend the meeting on March 1 and 2.

    In line with a decision taken at the 16th round of military talks, the two sides carried out disengagement from Patrolling Point 15 in the Gogra-Hotsprings area in September last year.

    India has been maintaining that its ties with China cannot be normal unless there is peace in the border areas. The eastern Ladakh border standoff erupted on May 5, 2020, following a violent clash in the Pangong lake area.

    The ties between the two countries nosedived significantly following the fierce clash in the Galwan Valley in June 2020 that marked the most serious military conflict between the two sides in decades.

    As a result of a series of military and diplomatic talks, the two sides completed the disengagement process in 2021 on the north and south banks of the Pangong lake and in the Gogra area.

    New Delhi: The Congress on Saturday asked the government whether instructions were issued to LIC and SBI to invest in the Adani Enterprises FPO despite a drastic fall in its share price after a Hindenburg report on the conglomerate.

    Posing a set of three questions to the government as part of the party’s “Hum Adani ke Hain Kaun” series, Congress general secretary Jairam Ramesh asked Prime Minister Narendra Modi to break his silence on the issue today.

    He claimed that among the anchor investors in the Adani Enterprises follow-on public offering (FPO) were the Life Insurance Corporation of India which bid Rs 299 crore, State Bank of India Employees’ Pension Fund which bid Rs 99 crore, and SBI Life Insurance Company which bid Rs 125 crore.

    “These publicly owned institutions participated in the FPO despite the fact that the market price had dropped far below the issue price and that both LIC and SBI already owned large chunks of Adani Group equity. Were instructions issued to LIC and SBI to deploy the savings of crores of Indians to once again bail out the Adani Group,” he asked in a statement.

    Posting the questions, Ramesh tweeted, “Mahashivaratri today and along with it here is HAHK (Hum Adani ke Hain Kaun)-13. The 13th set of questions to the PM. Aaj Toh Chuppi Todiye Pradhan Mantriji (Break your silence today, Prime Minister)!”

    Under the HAHK series, the opposition party has been posing questions to the government on the Adani issue.

    In its latest set of questions to the prime minister, the Congress asked, “Is it true that a high-profile Union Minister with longstanding commercial links made personal calls to five-six of the most well-known businesspersons on behalf of Gautam Adani and asked them to invest their personal funds in the FPO to save Gautambhai from embarrassment? Does this not represent a conflict of interest worth investigating? Did this Union Minister act on instructions from you?”

    The Congress leader also asked if the family offices that were pressured to bail out the Adani FPO given assurances that this was only to save Gautam Adani’s reputation and that the FPO would be subsequently cancelled and the money returned to the investors.

    “Is it not a violation of Indian securities regulations to hide this relevant information from most investors and only to share it with a select few? Is it ethical to dupe FPO investors in this way,” he asked.

    Recently, Adani Group stocks had taken a beating on the bourses after the Hindenburg Research made a litany of allegations, including fraudulent transactions and share-price manipulation, against the business conglomerate.

    The Gautam Adani-led group has dismissed the charges as lies, saying it complies with all laws and disclosure requirements.

    The Congress has demanded a joint Parliamentary Committee probe into the Adani issue. The opposition party also stalled proceedings of both Houses of Parliament during the first part of the Budget Session.

    Bengaluru: In a tragic turn of events at a cricket tournament held ahead of the Shivaratri festival, two youths were stabbed to death by a group of people who had come to watch the match.

    The incident took place on Friday at the Karnataka Public School ground in Doddabelavangala village on the outskirts of the city. The deceased have been identified as Bharath kumar (23), an engineering graduate, and Prateek (17), a pre-university student.

    According to police officials, the youth were stabbed by four men over an argument on parking their four-wheeler inside the playground. The accused had come to watch the cricket match and were trying to park their vehicle in the ground when some of the spectators and organisers objected to it.

    With the argument escalating, the accused and their car were attacked. The two victims were not involved in the fight, a police official stated.

    However, the accused who fled the scene later accosted Bharath and Prateek, who clad in T-shirts provided by the tournament organisers, were waiting at a bus stop. The accused repeatedly stabbed the two youths and escaped from the spot. The victims were rushed to hospital where they succumbed to their injuries.

    The accused have been identified and special teams have been formed to apprehend them, the police stated.
