  • Opinion | These French Riots Are Different — and Far More Disturbing

    This time, the riots followed the point-blank police shooting of 17-year-old Nahel Merzouk after a car chase. The cost of the riots in a mere week — over $1 billion in damages to businesses — towers above that of 2005, but perhaps more notable is that the discussion of the banlieues has receded, or is mediated through, the lens of the police. (In fact, this echoes a different French film, Ladj Ly’s 2019 crime thriller Les Miserables; the last prophetic image is of a young boy beside himself with trauma and anger brandishing a Molotov cocktail in the face of a cop with a gun.) Today the majority of rioters don’t have an immigrant background, and most of them are minors, some as young as 12 — in other words only a few years younger than the victim. It is their extreme youth combined with what has been characterized as their hyper violence that makes headlines.

    The images we see are shocking, yes. There’s almost a one-upmanship on social media that pits three burnt busses against one gutted city hall (and I’ll raise you two looted McDonald’s). The scale of the destruction is breathtaking; it’s frequently symbolic, but often merely opportunistic — and sometimes downright incomprehensible in its perversity, like the assaults on the medical personnel trying to put some of these kids back together.

    But today, despite all that is dystopian in these scenes of enraged children driven to trash their very own environment, almost everyone gets it. Few are actually surprised.

    This is why 2023 is different from 2005. Regardless of the mindlessness of some of the destruction, the young people rampaging across French cities and towns are also expressing a deep anger rooted in humiliation that is felt across the country, not just in the banlieues. You could argue that for many French people, regardless of where they live, the nature of governance and decision-making in the past few years means that they all feel like “riff-raff” now.

    What’s important to remember is that Macron’s governance is not incompetent — far from it. In comparison to the manner in which other major advanced democracies handled Covid, the energy crisis or inflation, France has done quite well. The trouble is that the people — the French rather than France — feel like they keep drawing the short straw when it comes to their voices and preferences being taken into account, their political and civic rights respected, their humanity protected.

    From the often violent repression of the gilets jaunes (yellow vest movement) and Macron’s broken promises of a changed governing style, to the ramming through of pension reform (without a vote) in the face of massive, violent protests, the current government, despite its technocratic prowess, has given nearly every segment of French society, across all demographics and regions, cause to feel that they are governed sometimes competently but almost always with humiliating impunity. And too many have been injured or killed by police in the process; statistics show that French police kill four times more today than they did in 2010, fueling cycles of protest and repression.

    That’s not to diminish the hardship and injustice faced far too often by some in French society rather than others. But the reality is, the oxygen behind these waves of increasingly frequent and increasingly violent displays is in part the fact that everyone in France has had at least a small taste of the humiliation that many have endured for decades — aside from those whose thirst for an order based exclusively on exaction and punishment drives them to the harder edges of the right.

    In these early days of summer 2023, what floats above the smoldering remains of the riots, is the shared sense across French society that their problems are being systematically exacerbated by the actions of the police — and by those of a judiciary that tends to criminalize the victims and treat their families with disdain. It is an irony that this is what may finally provide a shared point of reference across French towns, communities, classes and creeds: That enough is enough and that root-and-branch police reform is not only necessary but urgent after decades of combined neglect and empowerment. But instead, as already pointed out by some, France has systematically passed legislation to further arm the police year after year over the last two decades.

    The cycle of violence, from police and rioters, is taking place in a fragmented political landscape that is only going to get tougher to navigate. The riots are driving the right and far-right closer together — a tendency that is present across many European democracies and that will have profound consequences for next year’s European Parliament elections. But they also create pressures on a deeply-divided left — torn between their desires for social justice and the demands of a base that is increasingly receptive to the far-right’s promises of order.

    Macron must confront this dilemma or risk making injustice and humiliation the exclusive drivers of French politics — an outcome that will only lead to further destruction and potentially catastrophic results in the presidential election of 2027.

    Kanpur: Uttar Pradesh Chief Minister Yogi Adityanath on Tuesday hit out at the Samajwadi Party, alleging those responsible for riots and curfews in Kanpur were its candidates in the urban local body polls.

    On the last day of campaigning for the second phase of the civic polls, Adityanath addressed public meetings in Kanpur, Banda and Chitrakoot and appealed to voters to make the BJP victorious so that funds allocated by the Central and state governments for development and welfare schemes are utilized fully.

    At an election rally in Kanpur, the chief minister said this city used to be known as the country’s textile hub and largest industrial city, but its neglect by the previous government was “known to everyone”.

    Referring to Kanpur’s once-booming illegal firearms industry, he said ‘kattas’ (countrymade pistols) were manufactured in Kanpur under the SP rule, but a new node of the Defence Corridor is being built here now.

    As the country’s centre for defence production, Kanpur is establishing a new identity, Adityanath said.

    “Those who were responsible for riots and curfews in Kanpur and played with people’s faith in the past are today the candidates of the Samajwadi Party. The kind of remarks they have made on women and the holy epic ‘Ramayan’ are not hidden from anyone,” the chief minister said.

    “The urban local body election is not only (a medium) to elect a mayor but also about making all the BJP candidates victorious in all the wards,” he said.

    “This election is not about hatred and personal comments. This election is about making your city a smart city, a safe city and one which has all the basic facilities,” he said at the meeting.

    Adityanath also referred to the work done by his government to clean river Ganga under the Namami Gange project.

    “Mother Ganga is our faith and our identity. Due to the neglect by the previous governments, 14 crore litres of sewage were discharged into Mother Ganga through the Sisamau drain. Under the guidance of Prime Minister Narendra Modi, the work on the Namami Gange project started.

    “At that time, there was a Samajwadi Party government in the state. The SP did not do any work for two years. In March 2017, the double-engine BJP government came to power, and today not even a single drop from the Sisamau drain falls into the Ganga,” he said.

    The chief minister also appealed to voters to add “a third engine” to the “double-engine government” and make Kanpur better again with basic facilities.

    “Double-engine” is a term often used by BJP leaders to refer to the party ruling at the Centre and in a state.

    Addressing another rally at Banda, the CM said that the Bundelkhand region has overcome the problem of barren and rugged terrain and is set to become a heaven on earth.

    “In the next four months, the work of providing pure tap water to every house in Bundelkhand is going to be completed,” he said.

    Adityanath said the entire Bundelkhand region is writing a “new chapter of development today” and recalled that for years the unveiling of Maharana Pratap’s statue was stalled which he did when he visited Banda last time.

    He said that prior to 2017, Bundelkhand faced a lot of problems related to drinking water, agriculture, employment, and security.

    Earlier women had to bring water in pitchers from far-off places, but today through the Har Ghar Nal Yojana, tap water is being provided to every house in Bundelkhand and the exercise will be completed in the next four months, he said.

    Addressing his last rally of the day at Chitrakoot, the CM said, “Chitrakoot has been freed from dacoits criminals and is being re-established as a holy place of Sanatan Hinduism.”

    Taking a jibe at the opposition parties, he added: “Dr. Lohia started the Ramayana fairs, but the Samajwadi Party, which does politics in the name of Dr. Lohia, says that Ram did not exist. Its leaders are making unsavoury comments on Tulsidas’ Ramcharitmanas as well.”

    Adityanath also said that the then Samajwadi Party government opened fire on the devotees of Lord Ram in Ayodhya.

    Adityanath was referring to police firing on ‘karsevaks’ gathered in Ayodhya on the saffron outfits’ call in 1990 when SP patriarch Mulayam Singh Yadav was the UP chief minister.

    “Their thinking is anarchic, opportunistic and dynastic. They can’t befriend a saint, but would readily garland a dacoit and allow them to exploit common people and traders,” he remarked further.

    The second and final phase of the urban local body polls in UP will be held on May 11. The counting of votes will take place on May 13.

    Aligarh: Uttar Pradesh Chief Minister Yogi Adityanath on Sunday said the double-engine government of the BJP has “put an Aligarh lock” on riots in the state.

    Campaigning for the second phase of urban local body polls in Aligarh, which is famous for its locks, Adityanath hit out at opposition parties for promoting “tamancha (countrymade pistol) culture” in the state.

    The chief minister also held public meetings in Budaun, Shahjahanpur and Bareilly, and talked about law and order and development in his speeches in these districts.

    “The double-engine government of the BJP has put an Aligarh lock over riots in the state and made UP riot-free,” Adityanath said in Aligarh.

    “Double-engine” is a term often used by BJP leaders to refer to the party ruling at the Centre and in a state.

    In an apparent reference to the Samajwadi Party and the Bahujan Samaj Party, the CM said people with ‘parivarvadi’ (dynastic) and ‘jaativadi’ (casteist) mindset gave ‘tamanchas’ to the youth after coming to power.

    “We changed this tamancha culture and provided tablets to two crore youths,” he said.

    Adityanath said Aligarh is known all over the world for its locks and the BJP government is working towards its revival.

    “The lock industry (of Aligarh) will be given a global platform with the help of one district one product initiative,” he said.

    “Taala (locks), taaleem (education) and tehzeeb (culture) of Aligarh were once its identity. But the casteist mindset of the dynastic parties has shut down the lock industry of Aligarh, and created obstructions,” he said.

    “These casteist and dynastic parties have nothing to do with education and culture. They adopted the policy of divide and rule and used it to divide society on the basis of appeasement. They made an effort to increase the gulf in society. As a result of this, there was an atmosphere of fear among the people even during festivals,” Adityanath said.

    Aligarh will vote in the second phase of the urban local body polls on May 11. The counting of votes will take place on May 13.

    Adityanath said people of the state were forced to face curfews for a long time.

    “But today, you are seeing Aligarh, Uttar Pradesh and India transforming. Under the leadership of Prime Minister Narendra Modi, the perception about India has changed, and Indians are seen with respect wherever they go,” he said.

    “What could not be achieved in the last 60-65 years has been done in nine years. The government has worked hard to put an end to terrorism, Naxalism and separatism in the country,” he said.

    Referring to the Ram Temple in Ayodhya, Adityanath credited the efforts of the BJP’s double-engine government to resolve a 500-year-old dispute.

    “Today, Kashi Vishwanath Dhaam is being constructed in Kashi, whereas Mathura and Vrindavan are being decorated. Along with this, beautification of Naimisharanya, Vindhyavasini Dham, Lalapur of (sage) Valmiki and Rajapur of Tulsidas (both in Chitrakoot) is also underway,” he said.

    The CM also said that a memorandum of understanding has been signed with the Airports Authority of India for the building of an airport in Aligarh.

    “We are going to connect it with air service and for the extension of the airport, Rs 700 crore has already been released,” he said.

    “In addition, construction of the four-lane highway from Ghaziabad to Kanpur via Aligarh is going on at a fast pace,” Adityanath said, adding that a power plant is being set up at Harduaganj which will make Aligarh the centre of energy production.

    The chief minister also said that the BJP’s double-engine government has named a university after Maharaja Mahendra Pratap Singh, who fought for the country’s independence and also donated land for the Aligarh Muslim University, although there is no “shilapat (nameplate) of his in the AMU”.

    Addressing a rally in Badaun, Adityanath said till six years ago, dynastic parties used to give pistols to the youth.

    “The youth are becoming self-reliant as we are combining talent of Uttar Pradesh with technology and training. As a result of this, UP is rapidly becoming the growth engine of India’s development,” the CM said.

    In Shahjahanpur, he said that festivals have replaced nuisance and disorder in the state of today. “The atmosphere of fear and panic is over now. People celebrate festivals peacefully and with joy. Now there is no curfew, instead Kanwar yatras are taken out peacefully,” he added.

    In Bareilly, the CM said the city earlier known as a garbage dump has turned into a smart city. “Bareilly has an airport. Four-lane and six-lane roads are being constructed,” he said.

    New Delhi: The Delhi High Court on Tuesday was informed by Shahrukh Pathan that there is no role attributed to him and that the “entire case is a farce” in a matter related to rioting and causing injuries to police personnel, including one Rohit Shukla, by an armed mob during the 2020 North-East Delhi riots.

    Justice Dinesh Kumar Sharma was hearing Pathan’s bail plea. Simultaneously, Pathan is facing charges in another case in connection with pointing a pistol at a policeman.

    A trial court had rejected Pathan’s bail plea in December 2021.

    It is to be noted that the charges have already been framed against Pathan in the matter, and he had moved the high court in January last year seeking bail.

    Even though there are four more accused in the case, the petitioner is the only one not named in the FIR or identified by anyone and yet he is behind bars whereas others have been released on bail, Pathan’s counsel Khalid Akhtar told the court.

    “The bail application and arguments on the charges were heard together. Bail was rejected on the ground that he [Pathan] is accused in another case, that he could be a flight risk and that there were contradictions in his statements which are the subject matter of trial. There are total five accused persons in the FIR. I am the only person who is neither named nor identified while all others were named and identified. Their addresses were also disclosed by the victim and yet all of them have been granted bail and I am the only one behind bars. This entire case is a farce,” Akhtar submitted on behalf of his client.

    Akhtar also apprised the court that the bail application has been pending for 15 months now, and that his client is lodged in jail for three years and one month.

    “No role is attributed to me. It is not their case that I shot the victim. Examination of the main victim is complete. That is full of contradiction. There is nothing,” he submitted.

    Justice Sharma then directed the special public prosecutor for Delhi Police to file a chart indicating the role of the accused persons, including Pathan, and the evidence attributed against them.

    The court then listed the matter for further hearing on July 24.

    Earlier in February, Pathan had informed the high court that the conclusion of the trial has been delayed for a long and that for more than a year now, only two witnesses have been examined out of 40.

    Akhtar had earlier submitted: “There is a huge delay in the conclusion of the trial. Only two witnesses have been examined so far out of about 40. I have been attacked in jail too.”

    New Delhi: A Delhi court has directed the Deputy Commissioner of Police (DCP) concerned to take immediate remedial action regarding an unverified, incriminating video against an accused in connection with the 2020 northeast Delhi riots.

    Additional Sessions Judge Amitabh Rawat was hearing the case fixed for orders on the point of charge against four defendants — Rahul Kumar, Suraj, Yogender Singh, and Naresh –, who have been accused of participating in a riotous mob that committed arson in a place of worship and some of its ground-floor shops on fire on February 25, 2020.

    The judge noted that while Suraj and Yogender were the subjects of CCTV film, Kumar had been recognised by a public witness. Additionally, there was a video against Naresh, who is accused of committing arson and raising a flag over a house of worship.

    “However, when the video was sent to the Central Forensic Science Laboratory (CFSL), the report was received stating that the DVD was found inaccessible in the video analyst’s system and hence, no examination was carried out. The FSL report was filed by way of a supplementary chargesheet,” the judge said.

    No other witness was found to identify accused Naresh, according to the judge, and it was “inexplicable” how the incriminating footage was discovered to be inaccessible after being given to the CFSL.

    “If it was so, the investigating officer (IO) or the station house officer (SHO) or the assistant commissioner of police (ACP) should have again sent the correct and accessible video to the FSL for their opinion and filed the same but instead, the IO has filed the supplementary chargesheet, along with the FSL report of the inaccessible video,” the judge said.

    He stated it is “difficult” for the court to frame charges against Naresh based on a “unverified DVD” because the court must do it based on the evidence that is presented.

    “But yet at the same time, if the video exists and it is verified by the FSL, it can inculpate the accused and thus, discharging him at this stage without the FSL report will hurt the conscience of this court, particularly, given the nature of the case of burning of a religious place. Moreover, the origin of the video is not disclosed,” the judge said.

    “In these circumstances, this court is of the opinion that the DCP concerned should take immediate remedial action,” he added.

    The court then listed the matter for June 7 for next hearing.

    Ahmedabad: A special court in Ahmedabad will pronounce its verdict today in the Naroda Gam case in which former BJP MLA Maya Kodnani and several other right-wing leaders are among the accused involved in the killing of 11 people from the minority community during the 2002 post-Godhra riots.

    Eleven persons were killed in communal violence in Naroda Gam area of Ahmedabad city on February 28, 2002, during a ‘bandh’ called to protest the Godhra train burning a day before in which 58 passengers, returning from Ayodhya, were killed.

    Along with Kodnani, other prominent accused are former Bajrang Dal leader Babu Bajrangi and Vishwa Hindu Parishad leader Jaydeep Patel.

    On April 16, the court of principal sessions Judge SK Baxi had fixed April 20 as the date for the verdict in the case and had also directed the accused to remain present in the court.

    Notably, all the accused in the case are currently out on bail. Out of the total 86 accused in the case, 18 died in the intervening period. Around 182 prosecution witnesses were examined during the trial.

    Apart from rioting and murder, Kodnani, 67, has also been charged with criminal conspiracy and attempted murder in the Naroda Gam case.

    It is pertinent to note that Union Home Minister Amit Shah had also appeared as a defence witness for Kodnani in September 2017.

    New Delhi: A court here has convicted a father-son duo for rioting and arson in a case of the 2020 North East Delhi riots, saying the prosecution proved the charges against them beyond a reasonable doubt.

    The case against Mithhan Singh and his son Jony Kumar was being heard by Additional Sessions Judge (ASJ) Pulastya Pramachala.

    The duo was accused of being part of a riotous mob that set many properties on fire in lane number 4 in Khajuri Khas on February 25, 2020.

    “I find that it is proved beyond doubt against both the accused that they were part of the mob which burnt the property (of complainant Shabana Khatoon). Thus, they are held guilty of the offences under sections 147 (rioting) 148 (rioting, armed with a deadly weapon) 436 (mischief by fire or explosive substance with intent to destroy house, etc) read with section 149 (every member of unlawful assembly guilty of offence committed in prosecution of common object) of the Indian Penal Code and convicted accordingly,” the judge said.

    The court posted the matter for filing affidavits on April 19, following which the proceedings on sentencing will commence.

    An unlawful assembly was established with the shared goal of harming the properties of a specific community, according to ASJ Pramachala, who took note of the statements of various public witnesses. The riotous mob also committed acts of vandalism and arson, according to the judge.

    Regarding the claim that the two were members of the mob, the judge stated that none of the complainants, locals, or other witnesses backed the prosecution’s evidence and refused to label the accused as mob members.

    The judge stated that prosecution witnesses Mohd. Tahir and Constable Rohtash were the only witnesses to identify the duo as mob members.

    He said Tahir’s testimony was “reliable” to show both accused were out in the lane and that they had joined the riotous mob raising slogans, while Constable Rohtash was the beat officer of the area and saw the duo as part of the mob that torched Khatoon’s property.

    Because there was no entry in the daily diary or formal report on the occurrence, the judge ruled that the police official’s testimony could not be discarded.

    Based on the evidence of the two witnesses, there was “no doubt that both accused persons were part of the mob” that indulged in the incident of arson at Khatoon’s property, the judge said.

    Delhi riots: In arson of Muslim woman’s property case, father-son duo convicted

    New Delhi: A court here has convicted a father-son duo for rioting and arson in a case of the 2020 North East Delhi riots, saying the prosecution proved the charges against them beyond reasonable doubt.

    Additional Sessions Judge Pulastya Pramachala was hearing a case against Mithhan Singh and his son Jony Kumar, who were accused of being present in a riotous mob that torched several properties in lane number four of Khajuri Khas on February 25, 2020.

    “I find that it is proved beyond doubt against both the accused that they were part of the mob which burnt the property (of complainant Shabana Khatoon)… Thus, they are held guilty of the offences under sections 147 (rioting) 148 (rioting, armed with a deadly weapon) 436 (mischief by fire or explosive substance with intent to destroy house, etc.) read with section 149 (every member of unlawful assembly guilty of offence committed in prosecution of common object) of the Indian Penal Code and convicted accordingly,” the judge said in an order passed on Monday.

    The court posted the matter for filing affidavits on April 19, following which the proceedings on sentencing will commence.

    ASJ Pramachala noted the statements of several public witnesses and said it was safe to conclude that an unlawful assembly was formed with the common intention of attacking the properties of a particular community and that the riotous mob engaged in incidents of vandalism and arson.

    Regarding the identification of the duo as part of the mob, the judge said none of the public witnesses or residents of the lane, including the complainants, supported the prosecution’s case and refused to identify the accused persons as members of the mob.

    The only witnesses who identified both accused as members of the mob were prosecution witnesses Mohd. Tahir and Constable Rohtash, the judge said.

    He said Tahir’s testimony was “reliable” to show both accused were out in the lane and that they had joined the riotous mob raising slogans, while Constable Rohtash was the beat officer of the area and saw the duo as part of the mob that torched Khatoon’s property.

    The judge said the testimony of the police official could not be discarded because of the absence of the daily diary (DD) entry or a formal report on the incident.

    Based on the evidence of the two witnesses, there was “no doubt that both accused persons were part of the mob” that indulged in the incident of arson at Khatoon’s property, the judge said.

    The Khajuri Khas police station had registered an FIR against the duo on the basis of Khatoon’s statement. Later, six other complaints were also clubbed with the case.
