Bilkis Bano case: SC to hear pleas against premature release of 11 convicts today

    [ad_1]

New Delhi: The Supreme Court will hear a batch of pleas on Monday challenging the release of 11 convicts who had gang-raped Bilkis Bano and murdered her family members during the 2002 Godhra riots.

The Gujarat government had granted remission to 11 convicts on August 10 last year following which they walked free on August 15, 2022.

A bench of Justices KM Joseph and BV Nagarathna will hear the case on March 27.

On March 22, Chief Justice of India DY Chandrachud said that he will constitute a bench to hear pleas. “I will have a bench constituted. Need to break two benches for it. Will look at it this evening,” he said after advocate Shobha Gupta, appearing for Bano, mentioned the plea for an early listing of the case.

Earlier also advocate Gupta mentioned the matter for urgent hearing and said that a new bench needs to be constituted by the CJI as Justice Bela M Trivedi recused from hearing the plea.

A bench of Justices Ajay Rastogi and Bela M Trivedi earlier had ordered that matter be listed before the bench, in which Justice Trivedi is not a part of as she had recused herself from hearing the case.

Besides filing a petition against the pre-mature release of convicts, Bano had also filed a review petition seeking a review of its earlier order by which it had asked the Gujarat government to consider the plea for the remission of one of the convicts.

    The review petition was dismissed.

Some PILs were filed seeking directions to revoke the remission granted to 11 convicts.

The pleas were filed by the National Federation of Indian Women, whose General Secretary is Annie Raja, Member of the Communist Party of India (Marxist) Subhashini Ali, journalist Revati Laul, social activist and professor Roop Rekha Verma and TMC MP Mahua Moitra.

Gujarat government in its affidavit had defended remission granted to convicts saying they completed 14 years of sentence in prison and their “behaviour was found to be good”.

The State government said it has considered the cases of all 11 convicts as per the policy of 1992 and remission was granted on August 10, 2022, and the Central government also approved the pre-mature release of convicts.

It is pertinent to note that the remission was not granted under the circular governing grant of remission to prisoners as part of the celebration of “Azadi Ka Amrit Mahotsav”, it had said.

The affidavit stated, “State government considered all the opinions and decided to release 11 prisoners since they have completed 14 years and above in prisons and their behaviour was found to be good.”

The government had also questioned the locus standi of petitioners who filed the PIL challenging the decision saying they are outsiders to the case.

The pleas said they have challenged the order of competent authority of the government of Gujarat by way of which 11 persons who were accused in a set of heinous offences committed in Gujarat were allowed to walk free on August 15, 2022, pursuant to remission being extended to them.

The remission in this heinous case would be entirely against public interest and would shock the collective public conscience, as also be entirely against the interests of the victim (whose family has publicly made statements worrying for her safety), pleas stated.

The Gujarat government released the 11 convicts, who were sentenced to life imprisonment, on August 15. All the 11 life-term convicts in the case were released as per the remission policy prevalent in Gujarat at the time of their conviction in 2008.

In March 2002 during the post-Godhra riots, Bano was gang-raped and left to die with 14 members of her family, including her three-year-old daughter. She was five months pregnant when rioters attacked her family in Vadodara.

  • Kashmir Journalist’s Arrest: PCI, EGI Seek Immediate Release

Kashmir Journalist’s Arrest: PCI, EGI Seek Immediate Release

    [ad_1]

    by Raashid Andrabi

SRINAGAR: A day after the arrest of journalist Irfan Mehraj by the National Investigation Agency (NIA), various media groups and human rights watchdogs have called for his immediate release. The political class is also seeing his release.

The Press Club of India expressed its strong disapproval of the application of the UAPA to journalists and expressed concern over the NIA’s arrest of Mehraj. “We vehemently oppose the imposing of UAPA on media persons,” the powerful club said in a tweet. “The misuse of this draconian law by NIA in randomly arresting Irfan Mehraj, a journalist from Kashmir ominously points towards a violation of freedom of speech and expression. We demand his immediate release.”

The Editor’s Guild of India (EGI) has also expressed their concern over the arrest. The “space for media freedom has progressively eroded in Kashmir”, said the Editors Guild of India on Wednesday.

The Guild has voiced ‘deep concern’ over the ‘excessive use’ of Unlawful Activities Prevention Act (UAPA) against journalists, citing the recent arrest of Irfan Mehraj, a Kashmir-based journalist, by the National Investigation Agency (NIA).”

In a statement, the Guild reported that on March 20th, Irfan received a call from an investigator who asked him to come to the local NIA office in Srinagar for a brief meeting. However, after his arrival, he was arrested and later transferred to Delhi. According to the Guild, Irfan was charged under the draconian UAPA and was previously summoned to Delhi in relation to a case on “NGO terror funding”, to which he cooperated with the NIA’s investigation.

The NIA, in its press note, alleged that Irfan was a ‘close associate’ of the Kashmiri human rights defender Khurram Parvez.

Mehbooba Mufti, President Peoples Democratic Party (PDP) and former chief minister of Jammu and Kashmir also criticized the NIA’s actions. “While conmen are given a free run in Kashmir, journalists like Irfan Mehraj are arrested for doing their duty by speaking the truth,” Ms Mufti said. She criticised the abuse of “draconian laws like UAPA” and their constant use to ensure punishment through the process itself.

The arrest of Kashmiri journalist Irfan Mehraj was also condemned by Amnesty International India.

“The arrest of Kashmiri journalist Irfan Mehraj under terror charges is a travesty,” said Aakar Patel, chair of the board at Amnesty International India, in a statement. “The arrest is yet another instance of the long-drawn repression of human rights and the crackdown on media freedoms and civil society in the region of Jammu and Kashmir. The stifling of the rights to freedom of expression and association continue unabated in Kashmir.”

Patel also expressed concern over the criminalization of human rights work, stating that “Human rights defenders such as Irfan Mehraj should be encouraged and protected, not persecuted. He must be immediately released. The repression must stop. Criminalization of legitimate human rights work is extremely alarming and the authorities must put an end to this immediately.” Amnesty International has termed the arrest as “yet another crackdown on media freedom in Jammu and Kashmir.”

Expressing profound apprehension, Mary Lawlor, the UN Special Rapporteur on Human Rights Defenders, also stated her deep concern regarding the detention of Irfan.

“I’m deeply concerned about the Kashmiri HRD and journalist @IrfanMeraj. He was called to come to the @NIA_India office in Srinagar and arrested in a 2020 case, accused of serious offences. I call for his immediate release,” Mary Lawlor tweeted.

It is worth noting that Irfan was taken into custody by the NIA in Srinagar on March 20, on charges under several sections of the Indian Penal Code and the Unlawful Activities (Prevention) Act. Irfan, who is the founder of Wande Magazine, presently serves as a senior editor at TwoCircles.net. His works have been published by The Indian ExpressAl JazeeraHimal SouthasianDW, and TRT World.

    [ad_1]

Tehran: One of Iran’s prominent women activist and journalists Sepideh Qolian, was rearrested a few hours after her release from Evin prison, Iranian media reported.

28-year-old Sepideh Qolian, was released on Wednesday, March 15, after serving four-years and seven months in prison.

After her release on March 15, Qolian posted on social media platforms a video of herself without the headscarf shouting slogans against Supreme Leader Ali Khamenei outside Tehran’s Evin prison.

“Khamenei the Zahhak! We’ll take you down into grave,” she shouted.

“After four years and seven months, I was released from the Haftepe case. This time I came out hoping for the freedom of Iran! Hoping for the release of my dear ones Sepideh Kashani, Nilofar Bayani, Zahra Zahtabchi, Bahare Hedayat, Golrokh Iraei, Nahid Taqavi and all political prisoners, especially women prisoners. #Zhen_Zhian_Ezadi,” Qolian tweeted.

Five hours later, Qolian was arrested on one of the highways while she and her family were traveling to their hometown of Dezful in the southwest of Khuzestan in three cars.

Qolian was arrested in 2018 and convicted of working “against national security” for supporting a strike and protest by workers at a sugar factory in Iran’s Khuzestan province.

She was initially sentenced to 19 years and six months in prison, but this sentence was reduced to five years in the appeal court.

In an open letter in January 2023, she pointed the torture in prison against the detainees of the recent nationwide protests, along with six other female prisoners, she protested against the “issue of death sentence” against the prisoners.

Release Mirwaiz-e-Kashmir Before Ramadhan: Anjuman Auqaf Jama Masjid

    [ad_1]

SRINAGAR: Anjuman Auqaf Jama Masjid Srinagar expressed anguish over the fact that the Mimbar-o-Mihrab of the historic central grand mosque continue to remain silent due to the three and a half year detention of Mirwaiz-e-Kashmir Dr Moulvi Muhammad Umar Farooq, terming it a “matter of great concern for all of us”.

The Anjuman said that as the holy month of Ramadan is approaching, the people are hoping that the unjustified ban and restriction on their beloved leader and the tallest religious leader of Kashmir, Mirwaiz Umar Dr Moulvi Muhammad Farooq, will come to an end and he will be allowed to perform his duties towards the people.

However, today is the 186th consecutive Friday when the Mirwaiz-e-Kashmir was prevented from offering the important religious duty of Friday prayer and carrying out his official duties of ‘Qaal Allah Wa Qaala Rasool (Sallallaahu Alayhi Wasallam), the Auqaf said, adding that by such actions, the religious sentiments of the people are continuously hurt.

The Anjuman Auqaf Jama Masjid Srinagar has expressed hope that in the beginning of the holy month of Ramadan, for which there are only a few days left, the sentiments of the people will be taken care of by ensuring the unconditional release of Mirwaiz-e-Kashmir.

Republicans release top targets of Democratic-held House seats in 2024

    [ad_1]

election 2022 house new york 40307

“Republicans are in the majority and on offense. We will grow our House majority by building strong campaigns around talented recruits in these districts who can communicate the dangers of Democrats’ extreme agenda,” NRCC Chairman Richard Hudson (R-N.C.) said in a statement. “These House Democrats should be shaking in their boots.”

The list features 19 Democrats who won despite the NRCC spending heavily against them last cycle, including Reps. Yadira Caraveo of Colorado, Gabriel Vasquez of New Mexico and Pat Ryan of New York, according to FEC reports. Each of them won by just a few thousand votes. Several races the NRCC is targeting this time around were among the most expensive in terms of outside spending in 2022.

Reviewing spending for 2022 from those on the NRCC list, Slotkin’s 7th District in Michigan attracted the most money from outside groups from both parties during the general election, followed by Reps. Susie Lee, of Nevada’s 3rd District, Abigail Spanberger, of Virginia’s 7th, and Angie Craig, of Minnesota’s 2nd. All of those races featured more than $20 million of spending from outside groups, according to OpenSecrets.

The Democratic Congressional Campaign Committee released its own list of most vulnerable members last Friday. The NRCC is targeting all but one of the members on the DCCC’s list and has added Reps. Josh Harder of California, Darren Soto of Florida and Jeff Jackson of North Carolina, each of whom won by more than 12 points. Reps. Dina Titus of Nevada, Val Hoyle of Oregon, Seth Magaziner of Rhode Island and Vicente Gonzalez of Texas, who each won by single digits, are also on the list.

Iranian American detainee begs Biden to intervene for his release

    [ad_1]

An American citizen of Iranian origin, Siamak Namazi, who has been held in Tehran’s Evin prison for seven years, has beseeched US President Joe Biden for his release and two other American nationals.

51-year-old Namazi, was speaking in an unprecedented interview with CNN on behalf of himself, 58-year-old businessman Emad Shargi, and 67-year-old environmentalist Morad Tahbaz.

“I implore you, sir, to put the lives and liberty of innocent Americans above all the politics involved and to just do what is necessary to end this nightmare and bring us home,” Siamak Namazi told CNN’s Christiane Amanpour in a telephone interview on Thursday.

Namazi continued that he was “deprived of many of his rights as a prisoner,” as he is treated as a “hostage,” stressing that many criminals have more rights than him.

He pointed out that in his more than seven years of imprisonment, he spent months caged in a cell, sleeping on the floor.

“I remain very concerned that the White House does not realize the seriousness of our situation,” he said adding, Tahbaz, and Shargi are now being held at the same prison.

Namazi made a similar request to Joe Biden in January 2023, seven years after the release of five American citizens in a prisoner swap negotiated to coincide with the implementation of the 2015 Iran nuclear deal under President Barack Obama.

Namazi said it was “painful and upsetting” that Biden had not met with his family “just to give them some words of reassurance.”

Siamak Namazi, an oil executive, was arrested in October 2015 on charges of attempting to overthrow the country’s powerful clerics, an allegation he has denied.

In January 2023, Siamak Namazi went on a seven-day hunger strike in Evin prison.

His father, Baquer Namazi was also detained in 2016 when he attempted to help his son, but he was freed on medical grounds in 2022.
