‘Hare-brained idea’, SC on registration of live-in relationships with Centre

    [ad_1]

New Delhi: The Supreme Court on Monday junked a PIL seeking framing of norms for registration of every live-in relationship with the central government, saying it is a “hare-brained” idea.

A bench headed by Chief Justice of India D.Y. Chandrachud told the counsel, representing the petitioner, “What does the Centre have to do with registration of live-in relationships? What kind of hare-brained idea is this?”

The bench, also comprising Justices P.S. Narasimha and J.B. Pardiwala, asked the petitioner’s counsel if she wanted to foster the security for these people or she does not want them to get into live-in relationships. The plea was filed by lawyer Mamta Rani.

The petitioner’s counsel submitted that the petitioner wanted the relationship to be registered, which would enhance their social security.

The bench said, “It is high time this court starts imposing costs on petitioners who file these kinds of PILs. Dismissed.”

The plea had cited the recent killing of Shraddha Walkar allegedly by her live-in partner Aaftab Amin Poonawala. The petitioner sought framing of rules and guidelines for registration of such relationships.

The PIL contended that registration of live-in relationships would result in accurate information pertaining to both live-in partners about each other. The plea argued that it would help the government to know about them, which is regarding their marital status, criminal history, and other relevant details.

The plea sought a direction to the central government to formulate rules for registration of live-in relationships against the backdrop of increase in crimes like rape and murder, which were allegedly committed by live-in partners.

  • Vehicle Registration Cancellation Order: Government’s big action

    [ad_1]

In order to control pollution and promote circular economy, the Union Ministry of Road Transport has issued a notification of amendment in the Motor Vehicle Act, due to which the registration of these vehicles will be compulsorily cancelled.

In order to control pollution and promote circular economy, the Union Ministry of Road Transport has issued a notification of amendment in the Motor Vehicle Act, according to which the registration of all government vehicles older than 15 years will be compulsorily cancelled.

Vehicles whose registration has been renewed (beyond 15 years) will also automatically be considered cancelled. All such old vehicles will have to be disposed of at a registered scrap centre.

Vehicles of Central Government, Vehicles of State Governments, Vehicles of Union Territories, Vehicles of Corporations, Vehicles of State Transport, Vehicles of PSUs (Public Sector Undertakings) and Government Autonomous Institutions all vehicles older than 15 years will have to be scrapped. However, army vehicles are not included in this. This new order will be applicable from April 1, 2023.

Significantly, in November last year, the Ministry of Road Transport had issued a draft, in which it was said that all 15-year-old vehicles of the Central and State Governments would have to be scrapped. It was said to apply this rule to the buses and vehicles of the Corporations and the Transport Department as well. Then the government had sought suggestions and objections on the draft in 30 days. Now the government is going to implement this rule.

In November last, Union Minister Nitin Gadkari had said that government vehicles that are more than 15 years old will be converted into junk. The policy related to this has been sent to the states. He had said, ‘Signed a file under the guidance of Prime Minister Narendra Modi, under which all vehicles of the Government of India that are more than 15 years old will be turned into junk. I have also sent this policy to all the states, they should also adopt it.

SRINAGAR: Hours after Jammu and Kashmir Police arrested a duo for allegedly stalking and intimidating a girl in Srinagar, Regional Transport Officer has ordered for immediate suspension of the Registration Mark of the two-wheeler used in the commission of the offence.

As per the order issued by Syed Shahnawaz Bukhari, RTO Kashmir “In view of the complaints on social media and other verified reports and also in view of the fact that an FIR number 35/2023, Dated 05-03-2023 under Section 341, 506, 509, 294, 354D of IPC has been registered in the Police Station Ram Munshi Bagh Srinagar, I am of the considered opinion that Motor Cycle Without Gear (MCWOG) bearing Registration Mark JK01AG-5814 (Owned by Mr. Peerzada Sajad Arif son of Haji Shareef-u-Din, resident of Kwajapora, Srinagar) has been used in commission of the cognizable offence and an act which is likely to cause nuisance and danger to the public and has, therefore, failed to comply with the requirements of the Motor Vehicle Act, 1988 and the Rules made there under”, reads an order copy.

“Therefore, in exercise of the powers vested in me under Section 53 of Motor Vehicle Act, 1988, the Registration Mark JK01AG-5814 is, hereby, suspended with immediate effect”, the order further reads.

The Police in a statement issued earlier, maintained, “On 4-03-2023, a girl was stalked and harassed by two boys, riding a scooty. The boys had made lewd gestures and comments against the girl. The girl had posted about the incident on her social media account and subsequently also approached police post Nehru Park with a written application. On receipt of the complaint, an FIR was lodged under relevant sections of the law in Ram Munshi Bagh Police Station against the accused boys.”

The accused duo was arrested on Sunday and the two-wheeler used by them in the commission of crime also seized by a police team.

Meanwhile, deputy commissioner Srinagar Dr Aijaz Asad on his official Twitter handle also informed that registration of the two-wheeler has been cancelled.

Reacting over the incident of eve teasing, he said there is zero tolerance for such unlawful behaviour.

“The Registration of scooty bearing Mark JK01AG-5814 linked with Eve-teasing case of yesterday in the Dal Gate area is hereby suspended with immediate effect under Section 53 of Motor Vehicle Act, 1988. Zero tolerance for such unlawful behaviour,” he tweeted. (GNS)

Mumbai: The Reserve Bank of India on Thursday said it has cancelled the registration of Guwahati-based Rhino Finance Private Ltd for irregular lending practices.

In a release, it said the Certificate of Registration (CoR) of Rhino Finance has been cancelled on account of violation of RBI guidelines on outsourcing and Fair Practices Code in its digital lending operations undertaken through third party apps which was considered detrimental to public interest.

“The company was also not complying with the extant regulations pertaining to charging of excessive interest and had resorted to undue harassment of customers for loan recovery purposes,” the RBI said.

Name of the services provider/mobile app associated with the company include Hello Loan, Credithub, KoKo Cash, Flash Loan, Bridge Loan, Crazy Bee and Rupee Bus.

With cancellation of the CoR, Rhino Finance shall not transact the business of a non-banking financial institution, the central bank said.
