The alleged act is said to have taken place between Saturday and Sunday at the home of Hakim, who is a member of the Moroccan national team.

24 years old a woman accuses someone who plays in Paris Saint-Germain, the star club of the French football league Achraf Hakim about rape, a French newspaper Le Parisien tells.

The woman had gone to the police station on Sunday and told that she had been raped. The alleged act is said to have taken place between Saturday and Sunday at Hakim’s home.

The woman claims that Hakimi had kissed her, taken off her clothes and inserted his fingers inside her despite the prohibitions.

Spanish sports magazine FLAT said Hakim was home alone at the weekend. His wife and the couple’s children were on vacation in Dubai. Both Le Parisien and AS said Hakim paid for the woman’s trip to the football star’s home over the weekend.

According to the woman, the two met through Instagram in mid-January.

Woman did not want to file a lawsuit against Hakim, according to Le Parisien, but the prosecutor had taken the case under investigation due to its seriousness.

Hakimi, 24, was part of Morocco’s core men at the World Championships played in Qatar at the end of last year. Morocco finished fourth in the tournament.

Hakimi, who has played in PSG’s defense since the 2021-2022 season, was not in the team’s squad on Sunday in the assembly in an away match against Marseille.

UP: Boyfriend arrested for rape, murder of minor

    [ad_1]

Unnao: A minor girl, whose mutilated body had been found near the Pariyar crossing in Uttar Pradesh’s Unnao district on February 23, had been raped by her boyfriend, who then crushed her under his vehicle with the help of his friend.

Both the accused have been arrested while the two vehicles used in the crime have also been seized, police said.

After the body of the class 9 student was found, the police had registered a case of gang rape and murder on the basis of a complaint lodged by the victim’s family.

Superintendent of Police (SP) Siddharth Meena had formed separate teams for a breakthrough into the case.

The SP said that the girl’s boyfriend Pintu Rawat, 19, a resident of Pariyar and his friend Rohit Rawat, 19, of Galharapur have been arrested.

According to the police chief, Pintu called the girl to meet him on February 22 night. After she arrived, he took her to a deserted place and forcibly established a physical relationship with her.

At the same time when Pintu received a call from the girl’s uncle on his mobile phone, he asked her to go back home, but she remained adamant and refused to return, and instead asked Pintu to take her with him.

“Pintu was so scared of this that he hatched a plan to crush the girl to death. For this, he called his friend Rohit who came in another four-wheeler, then he took the girl to Pariyar market. As soon as the girl got down from the vehicle, Pintu ran her over with his car, then Rohit also crushed her with his vehicle. After the girl died, the two fled the spot,” said an official.

  • Nawazuddin’s estranged wife accuses him of rape, files police complaint with proof

Nawazuddin’s estranged wife accuses him of rape, files police complaint with proof

    [ad_1]

Mumbai: In another twist to their ongoing saga, Bollywood actor Nawazuddin Siddiqui’s estranged wife Aaliya Siddiqui has charged him with alleged rape and lodged a complaint with Versova Police Station here on Friday.

Aaliya, who had slapped a divorce notice to Nawazuddin in 2021, herself made the announcement on her Instagram account, though police officials declined to comment.

“A rape complaint (with proof) has been filed against him at Versova Police Station yesterday (Thursday),” she said in the video post. “Whatever may happen, I will not allow my innocent kids go in their heartless hands,” Aaliya declared, becoming emotional while recounting her purported ordeal.

Married in 2009, the couple has been in the limelight for the past few weeks hurling allegations at each other on various domestic and personal issues and their children, daughter Shora and son Yaani.

In January 2022, Nawazuddin’s mother had filed a police complaint against Aaliya for allegedly trespassing into the actor’s home and she lodged a counter-complaint against her mother-in-law alleging domestic violence.

This time, Aaliya has labelled her mother-in-law as “heartless” who allegedly called her “my innocent child illegitimate” even as Nawazuddin remained silent.

Slamming Nawazuddin for seeking custody of their kids, Aaliya countered how he has never experienced the joy of the children, didn’t know how to use a diaper, didn’t realise when the kids grew up, and now he is trying to “steal” them from her to prove he is a good father.

“He is a coward dada he is stealing the kids (who are admitted to a Dubai school) from a mother by abusing his power and fame, but forgets that the Almighty is the most powerful,” she said.

Aaliya contended that she had always considered Nawazuddin as her husband, but he never accepted her as his wife though she had given the most important years of her life to him.

She alleged how she was grappling with financial losses and now Nawazuddin has weakened her more from all sides, but she had full faith in the courts and law and expressed confidence that the verdict would be in her favour.

In earlier posts, she had alleged that her husband and mother-in-law did not give food and other basic necessities, put restrictions on her access to the bathroom, how she and her kids were reportedly kept in a room in Nawazuddin’s home, etc.

  • Kunan-Poshpora: 32 years on, justice eludes victims of mass rape

Kunan-Poshpora: 32 years on, justice eludes victims of mass rape

    [ad_1]

It was the night of February 23, 1991, when Indian Army soldiers conducted anti-insurgency searches in two sleepy twin villages – Kunan and Poshpora – in the Kupwara district of Jammu and Kashmir. They forced the men out of their homes, confined them to a faraway place, and then proceeded to mass rape over 50 women – young and old.

    What happened 32 years back

Under the guise of a search and cordon operation, soldiers of the 4th Rajputana Rifles of the 68th Brigade barged into the villagers’ homes and dragged the men to interrogation centers where they were allegedly tortured, beaten, and electrocuted throughout the night.

While the women were allegedly raped, beaten, and abused in their houses.

According to a TRT video that talks about the distressing experience, the youngest victim was 13 years old while the oldest victim was 80 years.

    After two days

Two days after the horror night, the lamberdar (zamindar) of Kunan village and one of the key witnesses Abdul Aziz Shah reported the incident to the then Kupwara district magistrate S M Yasin.

Yasin visited the village to investigate and note down the testimonies of 23 alleged victims. He later mentioned that many unmarried rape victims did not come forward fearing they would not find a suitable groom in the future.

In his report sent to the then divisional commissioner of Kashmir, Wajahat Habibullah, he mentioned that the Army men “behaved like beasts” and that he feels “ashamed to put in black and white the kind of atrocities and their magnitude that were brought to my notice”. Within 15 days of the filing of the report, he was transferred to the Muslim Auqaf Trust as a special officer.

Habibullah visited the villages and said the alleged mass rape is highly doubtful and exaggerated.

In his confidential report submitted to the government, Habibullah stated, “If in each case rape was committed by five to 15 persons as alleged, there would have to have been at least 300 men in the village doing nothing but this! In fact, the number of men was 150. It is impossible to believe that officers of a force such as the Indian Army would lead their men into a village with the sole aim of violating its women. Even if it were possible to concede this and the Army was indeed such a brutal force, it would then be impossible to explain why the officers themselves did not participate in such an orgy.”

However, speaking to the Sunday Express, Habibullah claimed that the government deleted portions of his report. “The paragraphs of my confidential report where I had recommended that the level of investigation be upgraded to that of a gazetted police officer so that this case is probed efficiently were taken out of my report. I had also asked that the Corps Commander should issue orders to ensure that the Army cooperates with the investigation because SP Kupwara had indicated that in other cases, he was not getting the required cooperation for investigation from the Army. That paragraph was also deleted,” Habibullah said.

Government’s clean chit to Indian Army

On March 8 an FIR was lodged at the Trehgam police station. The then SP of Kupwara Dilbagh Singh formed a Special Investigation Team to probe the case.

Pressure was mounting on the government to act. Subsequently, the Press Council of India appointed a committee headed by veteran journalist B G Verghese to report.

Verghese along with his team interviewed the alleged rape victims. This time, 40 women came forward to narrate their ordeal.

However, Verghese’s report did not match either Yasin’s or Habibullah’s reports. His report stated that the allegations were ‘a hoax orchestrated by militant groups and their sympathizers to defame the Indian Army.’

“Why was the incident not reported for “ten days”, since the village was “not that remote”, and if it was a question of shame, how was it that the same women talked about it “tirelessly” later on?” the report stated.

The committee felt that the “delayed medical examination” proved nothing; there was no medical report but only “women’s say so”, and a “torn hymen”, as in the case of three unmarried women, could be a result of “natural factors, injury, pre-marital sex or rape”.

Kupwara SP Dilbagh Singh was transferred. On September 23, with Verghese’s report, the case was termed ‘unfit’ for criminal prosecution and subsequently closed.

    PIL filed in 2013

In October 2011, rape victims from the villages approached the Jammu and Kashmir State Human Rights Commission (SHRC) to re-open the case. In 2013, around 50 women, under the banner of Support Group for Justice for Kunan Poshpora, filed a PIL (Public Interest Litigation) before the J&K High Court seeking implementation of the SHRC recommendations.

Although the J&K police reasons why the case should remain closed, the Kupwara magistrate dismissed it and directed further investigations.

The case was shifted to the J&K high court which ordered the state government to compensate the victims. The state government then filed a petition in the Supreme Court challenging the HC’s order.

On March 10, 2015, the Supreme Court stayed the proceedings and 23 years later the Kunan Poshpora case remains unresolved.

  • High Court Allows Minor Rape Victim To Terminate 19 Weeks Pregnancy

    [ad_1]

SRINAGAR: The High Court of Jammu & Kashmir and Ladakh directed the authorities to proceed with the termination of a 18-20-week pregnancy of an alleged minor rape victim after having a fresh examination of the victim and after father of a minor gives “extra high risk consent.”

The victim’s father had approached the court seeking termination of pregnancy of the minor. In the rape case, an FIR was registered at a police station in north Kashmir on February 14.

According to report published by LiveLaw.in, Justice Javed Iqbal Wani on February 17 had directed a Medical Board of LD Hospital in Srinagar to ascertain as to whether the termination of pregnancy is advisable or not.

Mohsin Qadiri, Sr. Additional Advocate General on Tuesday submitted a report addressed by the Head of Department, Gynaecology and Obstetrics, Government Medical College, Srinagar, to the Medical Superintendent, Government LD Hospital, Srinagar stating that the patient has a 19 weeks of pregnancy and runs a very high risk for MTP as it is a case of teenage pregnancy.

The report further said that MTP could be undertaken subject to the “extra high risk consent given by guardians/parents.” In court, the father of the victim volunteered and agreed to extend the consent as solicited by the medical board.

The court directed the authorities to proceed with the case of termination of pregnancy of the minor victim by the experts in the field after having a fresh examination of the victim.

“In the event a final call is taken by the experts for termination of pregnancy of the minor victim, necessary measures shall also be taken in association with respondents 3 and 4 for the preservation of the DNA sample of the fetus. It is further directed that in case the process of termination of pregnancy is undertaken, the minor victim be provided all necessary medical facilities free of cost by the respondent 2,” LiveLaw.in quoted the court as having said.

Kathua gang rape: Delhi HC orders media fines to be deposited in J&K legal aid

    [ad_1]

New Delhi: The Delhi High Court on Thursday directed its Registrar General to transfer the sum paid by media houses as fined for disclosing the Kathua rape case victim’s name to the Victim Compensation Fund maintained by Jammu & Kashmir State Legal Services Authority.

The amount is for donating the victims or family of deceased victims of sexual violence.

A division bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad said: “The Registrar General of this court is directed to transmit the amounts so deposited by respondents no.8, 28 (two media houses) and by other respondents (media houses) in the present case, if any such amount is still lying with the court, to the Victim Compensation Fund maintained by the Jammu and Kashmir State Legal Services Authority for disbursement of funds to the victims/families of the deceased victims of sexual violence.”

In the 2018 brutal gangrape was followed by the victim’s murder, the High Court in the same year took by itself the decision against media houses for their reports disclosing the victim’s name, violating Sections 23 and 228A of the Protection of Children from Sexual Offences Act.

“The manner of reporting of the incident is also against the public justice,” said the bench.

The court had issued notices to over 15 media houses and directed them to deposit Rs 10 lakh each.

With time, more media organisations were asked to pay the compensation.

Earlier, the court had called the media houses’ move of displaying the photograph of the victim “unfortunate” and “extremely distressing”.

The incident dates back to January 10, 2018, when the eight-year-old had disappeared from near her home in a village near Kathua in Jammu and Kashmir. A week later, her body was found in the same area.

  • Judge rejects Trump DNA offer in E Jean Carroll rape defamation case

Judge rejects Trump DNA offer in E Jean Carroll rape defamation case

    [ad_1]

Donald Trump missed his chance to use his DNA to try to prove he did not rape the writer E Jean Carroll, a federal judge said on Wednesday, clearing a potential roadblock to an April trial.

The judge, Lewis A Kaplan, rejected the 11th-hour offer by Trump’s legal team to provide a DNA sample to rebut claims Carroll first made publicly in a 2019 book.

Kaplan said lawyers for Trump and Carroll had more than three years to make DNA an issue in the case and both chose not to do so.

He said it would almost surely delay the trial scheduled to start on 25 April to reopen the DNA issue four months after the deadline passed to litigate concerns over trial evidence and weeks before trial.

Trump’s lawyers did not immediately comment. Carroll’s attorney, Roberta Kaplan, declined to comment.

Carroll’s lawyers have sought Trump’s DNA for three years to compare it with stains found on the dress Carroll wore the day she says Trump raped her in a department store dressing room in late 1995 or early 1996. Analysis of DNA on the dress concluded it did contain traces of an unknown man’s DNA.

Trump has denied knowing Carroll, saying repeatedly he never raped her and accusing her of making the claim to stoke sales of her book. She has sued him for defamation and under a New York law which allows alleged victims of sexual assault to sue over alleged crimes outside the usual statute of limitations.

After refusing to provide a DNA sample, Trump’s lawyers switched tactics, saying they would provide one if Carroll’s lawyers turned over the full DNA report on the dress.

But Kaplan said Trump had provided no persuasive reason to relieve him of the consequences of his failure to seek the full DNA report in a timely fashion.

The judge also noted that the report did not find evidence of sperm cells and that reopening the dispute would raise a “complicated new subject into this case that both sides elected not to pursue over a period of years”.

He said a positive match of Trump’s DNA to that on the dress would prove only that there had been an encounter between Trump and Carroll on a day when she wore the dress, but would not prove or disprove that a rape occurred and might prove entirely inconclusive.

Kaplan added: “His conditional invitation to open a door that he kept closed for years threatens to change the nature of a trial for which both parties now have been preparing for years. Whether Mr Trump’s application is intended for a dilatory purpose or not, the potential prejudice to Ms Carroll is apparent.”

The Associated Press typically does not name people who say they have been sexually assaulted unless they come forward publicly, as Carroll has done.

The Carroll case is just one source of legal jeopardy for Trump, who is now one of two candidates for the Republican presidential nomination in 2024.

He also faces an investigation of a hush money payment to a porn star who claims an affair, investigations of his financial and tax affairs, investigations of his election subversion attempts, and investigation of his retention of classified records.

  • Woman facilitating rape can be prosecuted for ‘gang rape’: Allahabad HC

Woman facilitating rape can be prosecuted for ‘gang rape’: Allahabad HC

    [ad_1]

Prayagraj: The Allahabad High Court has observed that “no doubt a woman cannot commit the offence of rape but if she facilitates the act then she can be prosecuted for the offence of ‘gang rape’ under section 376D of Indian Penal Code (IPC) in view of the amended provisions”.

Elaborating the provisions of section 375 (rape) and 376 (punishment for rape) of the IPC relating to the offence of rape, as amended in the year 2013, Justice Shekhar Kumar Yadav rejected the plea that a woman cannot be prosecuted for the alleged commission of the offence of gang rape.

With these observations, the court dismissed an application filed under section 482 (inherent powers of high court) of criminal procedure code (CrPC) filed by one Sunita Pandey, who had challenged a summoning order passed by the additional district and sessions judge, Siddharth Nagar, to face trial under sections 376D (gang rape), 212 (harbouring offender) of IPC in connection with the alleged rape case of a 15-year-old girl.

“A woman can not commit the offence of rape but if she facilitated the act of rape with a group of people then she may be prosecuted for gang rape in view of the amended provisions,” observed the court while rejecting the plea of the woman applicant.

Taking into account the facts of the case, the court, at the outset, noted that the argument that a woman cannot be prosecuted for gang rape is not correct as per the amended provisions of sections related to rape, which relates to the offence of rape.

The court observed that though it is clear by the non-ambiguous language of section 375 of IPC that a woman cannot commit rape as the section specifically states that the act of rape can only be done by a ‘man’ and not by ‘a woman’, the same is not the case with section 376D (gang rape) of IPC.

The incident took place in June 2015 and FIR was lodged by the father of the girl against unknown persons in July 2015 under sections 363 (punishment for kidnapping) and 366 (kidnapping, abduction or inducing woman to compel her marriage, etc.) IPC, alleging therein that someone had enticed his daughter aged about 15 years, and took her with him.

In her statement before the court under section 164 of the Criminal Procedure Code, the victim stated that the applicant was involved in the alleged incident. However, the applicant was not named in the charge sheet.

Thereafter, the father of the victim filed an application under section 319 CrPC for summoning the applicant and the court below allowed the said plea.
