    Bengaluru: Congress leader Siddaramaiah on Tuesday lauded the Supreme Court for objecting to the statements of Union Home Minister Amit Shah over Muslim quota during the election campaign in Karnataka.

    “The Supreme Court has objected to Amit Shah’s irresponsible statement over cancellation of Muslim quota of reservation during campaigning.

    “Justice B.V. Nagaratna’s observation to maintain sanctity of the subject when the matter is seized by the court and the political statement in this regard is undesirable is apt,” he said.

    “When the matter is being looked into by the court, the Solicitor General or an advocate can give their opinion. Justice Nagaratna had asked why a third person is intervening in this matter?” Siddaramaiah asked.

    He hoped the Union Home Minister would give his opinion carefully in future.

    Siddaramaiah maintained that the move of the BJP government to withdraw the reservation of Muslims and distribute it to Lingayats and Vokkaligas is nothing but to bring enmity and hatred between communities.

    New Delhi: The Supreme Court Tuesday voiced displeasure over political statements being made about withdrawal of four per cent quota for Muslims in poll bound Karnataka, after it was told Union Home Minister Amit Shah was making public statements about the hugely contentious issue at the hustings.

    Terming as “inappropriate” the political statements about the matter which is sub-judice, the apex court asserted “Some sanctity needs to be maintained”.

    The withdrawal of four per cent reservation for Muslims and its reallocation between the politically influential Lingayat and Vokkaliga communities just before the assembly elections has become a hot button issue in the southern state.

    “When the matter is pending before the court and there is court order on Karnataka Muslim quota, then there should not be any political statements on the issue. It is not appropriate. Some sanctity needs to be maintained,” a bench of Justices KM Joseph, BV Nagarathna and Ahsanuddin Amanullah said.

    Senior advocate Dushyant Dave, appearing for the petitioners who have challenged the scrapping of the Muslim quota by the state’s BJP government, said, “Every day the home minister is making statements in Karnataka that they have withdrawn the four per cent Muslim quota. Why should such statements be made?”

    Solicitor General Tushar Mehta, representing the Karnataka government, said he is not aware of any such remarks being made. He, however, contended those criticising religion-based quota are not wrong.

    “Solicitor General making a statement in the court is not a problem but someone saying anything on a sub-judice matter outside the court is not appropriate. In 1971, a West Bengal political leader was hauled up for contempt for holding a press conference defending a rationing order which was pending before the court,” Justice Joseph said.

    “We understand and respect the sentiment of the court,” said Mehta but added as a counsel, “I am saying that any religion-based reservation is unconstitutional”.

    Justice Nagarathna also expressed displeasure over statements being made outside the court on the quota issue.

    The arguments turned bitter when Dave said statements proudly claiming credit for the withdrawal of Muslim quota were being made every day. An agitated Mehta urged the court to restrain the senior lawyer from making such statements without a context.

    “This is the Supreme Court bench and don’t let it be turned into a fish market. This court has to restrain him (Dave) from making such statements. What they (Dave and others) are saying is without any context. They need to show what is the context, what is the content, and tenor of the statements. Let them file an application to this effect, we will file our reply,” he said.

    Dave told the court he will file an application and bring it on record what kind of statements are being made.

    Mehta said without any application nobody would know what statement has been attributed to him (the Union home minister).

    “Please see this statement. The Union home minister said that four per cent reservation for Muslims was unconstitutional and BJP removed it. This amounts to contempt of court,” an angry Dave told the court.

    As decibels rose, Justice Joseph asked Dave to not shout or make political statements in the court.

    “We will not allow this court to become a political forum. We are not party to it. We cannot allow the issue to be politicised in this manner. We will adjourn the matter,” the bench asserted.

    At this juncture, a lawyer appearing for the petitioners told the bench that the BJP has stated in its election manifesto it will do away with four per cent Muslim reservation if voted to power.

    The enforcement of the government order on scrapping of the Muslim quota has been kept in abeyance by the Supreme Court.

    Replying to the submission, Mehta insisted there is nothing wrong in such a manifesto and, in fact, every political party should include in their manifesto the promise that they will abolish religion-based reservation.

    Advocate Ravi Kumar Varma, appearing for Central Muslim Association, made a prayer to restrain the press from publishing such speeches, a contention Mehta opposed, saying media cannot be censored like this.

    Gubbi: Union Home Minister Amit Shah on Monday held a massive roadshow here, waving at a large enthusiastic crowd along the route, as he sought people’s support, ahead of the May 10 Assembly polls in Karnataka.

    Shah, standing on a specially designed vehicle accompanied by Tumakur Member of Parliament G S Basavaraj and other leaders, was greeted by people gathered on the sides of the roads and on nearby buildings.

    A large number of party workers walked along with Shah’s vehicle holding BJP flags and shouting slogans praising BJP and Prime Minister Narendra Modi, amid drum sounds.

    At the end of the road shadow here in Tumakuru district, the Home Minister urged people to vote for the BJP candidate, and to ensure that a “double engine government” under the leadership of Modi comes to power.

    Former Chief Minister B S Yediyurappa and Chief Minister Basavaraj Bommai have done a lot of work for Karnataka, he said, adding that the BJP government has ended four per cent Muslim reservation and has increased the quota of Vokkaligas, Lingayats, and SC/STs.

    “If Congress comes to power, they will take back all these reservations (hiked) and once again bring in Muslim reservations. Do you want four per cent Muslim reservation? (to come back)”, he asked.

    Highlighting measures taken by the BJP government for the benefit of Areca nut farmers, Shah said: “If you ensure a double engine government comes to power in Karnataka, Modi ji will once again become Prime Minister in 2024”.

    Udupi: Lashing out at the Congress in poll-bound Karnataka on Saturday, Union Home Minister Amit Shah said that the Bharatiya Janata Party (BJP) rectified wrong done by Congress by doing away with Muslim reservation quota in Karnataka.

    The Home Minister made the remarks while addressing a gathering in Byndoor.

    Amit Shah said, “BJP has rectified the wrong done by Congress by doing away with the Muslim reservation quota in Karnataka. Congress wants to restore it. Ensure that it is not given this chance; it is unconstitutional as well as compromises the rights of Vokkaligas, Lingayats, SCs, STs and Dalits in the State.”

    Alleging that Congress was incapable of the protection of coastal Karnataka, Amit Shah said, “Only BJP can do the job of securing Coastal Karnataka. Greed for a vote bank, Congress can never ensure the security of Coastal Karnataka. We worked to provide security to fishermen by building a new port in Udupi.”

    “BJP banned the PFI and ensured peace, safety and security for Karnataka,” the Home Minister added.

    Earlier, Amit Shah said that Congress would put the state into “reverse gear”, depriving it of the benefits of “double-engine sarkar”.

    Addressing a rally at the Navalgund Assembly constituency, Shah said, “One hand, there is the Congress under the leadership of Rahul Gandhi and on the other, is the BJP under the leadership of Prime Minister Modi. This (Karnataka Assembly) election is an opportunity for you to decide if you want a double engine sarkar led by PM Modi, which will take Karnataka forward, or the Congress’s reverse gear sarkar, which will take Karnataka backwards.”

    The polls for the 224-seat assembly will take place on May 10 and the counting of votes will be held on May 13.

    Dharwad: Karnataka Chief Minister Basavaraj Bommai on Tuesday said his government has informed the Supreme Court that it will not take any decision regarding the reservation for Muslims till the matter is before the court.

    In his reaction to the media over the quota for the Muslims, he said the case is posted for hearing on May 9 and no stay order has been issued by the court.

    Bommai also said that the Congress leaders’ stand that the government gave away the quota meant for Muslims to others was not correct.

    “There are 17 sub-sects among the Muslims and all of them are in the Backward classes. Here also they get reservations about economic backwardness. They are entitled to the quota as per the decision of the government. So, there is no question of doing injustice to the Muslims as the yardsticks are not changed,” he said.

    Bommai also said that there will be no doubt that Karnataka will completely become BJP after the visit of Prime Minister Narendra Modi and Union Home Minister Amit Shah.

    He also said that he has challenged Leader of Opposition in Assembly Siddaramaiah to prove the charges levelled against him. “I know about the people who are making the charges against me unnecessarily. A lot of complaints are against Siddaramaiah and he has been caught telling lies. All the cases against him are referred to the Lokayukta.”

    He quipped that “Congress means corruption and corruption means Congress”.

    Bagalkote: Union Home Minister Amit Shah on Tuesday defended the BJP government’s decision in Karnataka of scrapping the four per cent quota for Muslims saying the party never believed in religion-based reservation’.

    The former BJP chief also took a dig at Congress for its stand that the quota would be restored if it is voted to power in the state after the May 10 Assembly polls.

    “There was a religion-based reservation of four per cent for Muslims. Without falling for the vote bank politics, the BJP government abolished the Muslim reservation,” he said addressing a public meeting at Terdal in this district.

    “We believe that religion-based reservation should not happen,” Shah opined.

    The Minister added that after abolishing Muslim reservation, the BJP government increased the reservation for the Scheduled Castes, Scheduled Tribes, Vokkaligas and Lingayats.

    Referring to the Basavaraj Bommai government’s decision to increase the SC reservation from 15 per cent to 17 per cent, Shah noted that the internal reservation of SC (Left) now stands at six per cent, SC (Right)- 5.5 per cent and other SCs 5.5 per cent.

    Responding to Congress president D K Shivakumar who has promised to restore the Muslim reservation if his party comes to power, Shah sought to know whose quota the party will scrap if it manages to form the government in Karnataka.

    “Whose reservation will be decreased if four per cent reservation for Muslims is restored? Will it be Vokkaligas or Lingayat, Dalits, Scheduled Tribes or the Other Backward Castes?” the Minister asked.

    At the fag end of its term, the BJP government decided to abolish the four per cent reservation for Muslims under 2-B category. The four per cent was later split into two and distributed among Vokkaligas in 2-C category and Lingayats in 2-D category.

    Vokkaligas and Lingayats are the two major dominant communities of Karnataka. Shah’s statement came on a day when the Supreme Court directed that the state government’s decision of scrapping the quota for Muslims will not be implemented till May 9.

    Hyderabad: AIMIM president Asaduddin Owaisi has slammed Union Home Minister Amit Shah over his promise that if the BJP is voted to power in Telangana, it will scrap reservations for Muslims in the state.

    Owaisi said while Prime Minister Narendra Modi talks of reaching out to backward Muslims, Shah is promising to remove their reservation.

    Addressing a public meeting at Chevella near Hyderabad on Sunday evening, Shah had promised to do away with reservations for Muslims.

    He called the quota for Muslims “anti-Constitutional” and said that reservation is the right of the Scheduled Castes (SC), Scheduled Tribes (ST) and Other Backward Classes (OBC).

    “After the BJP government is formed in Telangana, we will end Muslim reservation. This is the right of SCs, STs, OBCs,” he said.

    Owaisi said if Shah was serious about justice for SCs, STs and OBCs, he should introduce a Constitutional amendment to remove the 50 per cent quota ceiling.

    This is not the first time that Shah has spoken about removing reservations for Muslims in Telangana.

    He made the promise on several occasions in the past and reiterated this in view of Assembly elections scheduled later this year.

    Last month, the BJP government in Karnataka scrapped 4 per cent quota for OBC Muslims.

    “All they can offer is fake encounters, surgical strikes on Hyderabad, curfews, releasing criminals & bulldozers. Why do you hate people of Telangana so much?,” he asked.

    Shah had alleged in his speech that the steering of the ‘car’ (poll symbol of BRS) is in the hands of Owaisi.

    He also alleged that the BRS is not celebrating Telangana Liberation Day as it is afraid of Owaisi.

    New Delhi: Union Home Minister Amit Shah on Saturday alleged that Congress provided 4 per cent reservation to Muslims in Karnataka in an “unconstitutional manner” and that Bharatiya Janata Party government in the State had put an end to the practice.

    Speaking at a media conclave organised by India Today, Shah said that the BJP ended the “special favour” meant for “scoring political points” and gave the rights to persons deserving the reservation, the OBCs.

    The Home Minister said that the Constitution does not allow reservation on the basis of religion and slammed the Congress party for doing so.

    Speaking at the conclave, Shah said, “As far as justice is concerned with the social point of view, the Congress government had given 4 per cent Muslim reservation in an unconstitutional manner in Karnataka. It was unconstitutional because our Constitution does not approve reservation based on religion but it was prevailing in Karnataka.”

    “The state government scrapped the 4 per cent reservations for Muslims and increased the reservation for SC, ST, Vokkaliga and Lingayat. We have ended the special favour meant for scoring political points. We brought the Constitution to order and gave the rights to those deserving,” Shah said.

    Earlier this March, the Karnataka government decided to scrap the four per cent quota for minorities and add it to the existing quota of two dominant communities of the poll-bound state.

    The 4 per cent reservation given to Muslims under the 2B classification of the OBC category will now be divided into two equal parts and added to the existing quota of Vokkaligas and Lingayats for whom two new reservation categories of 2C and 2D were created during the Belagavi Assembly Session last year.

    The state government’s move was slammed by the opposition and Congress vowed to cancel the move if it comes to power in the upcoming Assembly elections slated on May 10.

    “As soon as our government comes, we will cancel the reservation issue and will protect the minority interest,” state Congress president DK Shivakumar had said.

    On April 14, former Karnataka Chief Minister Veerappa Moily who introduced the 4 per cent reservation said that it given to the Muslims in his regime was on a scientific basis and it was not on the basis of religion.

    While speaking to ANI, Veerappa Moily said, “This reservation was given by me when I was CM in 1993 and it was done on basis of scientific data and not on the basis of religion. Muslims as a class were included in the backward category and it was absolutely legal. When we took the decision data was there. BJP has scrapped this reservation without any report”.

    Veerappa Moily further stated that Congress will restore the 4 per cent reservation quota after coming back to power in Karnataka.
    “We will restore it once we come back to power. This decision was unjustified and unscientific,” he said.
