Sebi to put in place framework to prevent frauds by stock brokers

    [ad_1]

New Delhi: Markets regulator Sebi on Wednesday approved a slew of proposals, including ending the practice of individuals holding permanent directorship at boards of listed companies and putting in place a framework to prevent frauds by stock brokers.

The proposals were cleared by the board of the Securities and Exchange Board of India (Sebi) during its meeting here on Wednesday.

The watchdog has approved a regulatory framework to allow private equity funds to become sponsors of mutual funds, a move that will help further deepen the mutual fund industry.

Besides, the regulator has given its nod for norms for Environmental, Social and Governance (ESG) disclosures by listed companies.

According to a release issued after the board meeting, Sebi said it has decided to end the practice of individuals having permanent seats at boards of listed companies. The move is part of efforts to further boost the corporate governance ecosystem.

Among other measures, the regulator will put in place a formal mechanism to prevent frauds and market abuse by stock brokers.

Further, Sebi will introduce fund-blocking facility for secondary market transactions like being done for Initial Public Offerings (IPOs). The measure is aimed at safeguarding investors’ money from misuse by stock brokers.

  • Disqualify me for life, put me in jail; but will keep fighting for democracy: Rahul Gandhi

Disqualify me for life, put me in jail; but will keep fighting for democracy: Rahul Gandhi

    [ad_1]

New Delhi: A combative Rahul Gandhi on Saturday said he would continue to defend democracy in the country even if he is disqualified from Parliament for life or jailed and claimed that a “panic-stricken” government has handed the Opposition a “big weapon” by disqualifying him.

Addressing his first press conference after his disqualification from the Lok Sabha, Gandhi claimed that the action against him was taken because Prime Minister Narendra Modi was “scared” of his next speech in Parliament on the Adani issue and alleged that the “whole game” was to distract people from the issue and the panic the government was feeling over the matter.

He said he would continue to ask questions on the Adani issue, adding the moot questions remain that who invested Rs 20,000 crore in Adani shell firms and what is the businessman’s relationship with the prime minister. He vowed he will keep raising these questions.

Gandhi was disqualified from the Lok Sabha on Friday, a day after a court in Gujarat’s Surat convicted him in a 2019 defamation case. The disqualification will bar Gandhi (52), a four-time MP, from contesting polls for eight years unless a higher court stays his conviction.

Asserting that “democracy has finished in this country”, the former Congress chief claimed that he never sought foreign intervention in his remarks made in the UK and accused Union ministers of “lying” against him in Parliament to which he said he wanted to respond but was not allowed.

He also said that the BJP was trying to divert the issue by alleging that he had insulted OBCs and he would continue to ask what is Modi’s relationship with businessman Gautam Adani.

“I am here defending the democratic voice of the Indian people, I will continue to do that. I am not scared of these threats, of these disqualifications, allegations, or prison sentences. I am not scared of them. These people don’t understand me yet, I am not scared of them,” he said, attacking the BJP.

“Disqualify me for life, put me inside the jail, I will keep going. I will not stop,” he said, noting that it makes no difference to him.

“I have been disqualified because the prime minister is scared of my next speech. I have seen it in his eyes. So he is terrified of the next speech that is going to come and does not want that speech to be in Parliament,” the former Congress chief alleged at the 30-minute press conference, flanked by Rajasthan Chief Minister Ashok Gehlot, Chhattisgarh CM Bhupesh Baghel and party general secretaries Jairam Ramesh and K C Venugopal.

He claimed that his attack on Adani was the reason for distraction through allegations and now disqualification.

Hitting back, BJP leader Ravi Shankar Prasad rubbished the contention that Gandhi’s conviction in a defamation case and his subsequent disqualification were linked to the latter raising the Adani Group issue and his conviction has come in defamation came for his defamatory remarks made in 2019.

Prasad alleged that Congress did not press its battery of lawyers in service to immediately obtain a stay on Gandhi’s conviction by a Gujarat court with a view to “encashing” the issue in the upcoming assembly polls in Karnataka. The former union minister also charged Gandhi with insulting OBCs, “an issue that will be taken up in all earnestness by the BJP across the country”.

Gandhi, when asked if he was worried, quipped: “Do I look worried? I am excited, I am happy that they have given me the best gift that they could give me.”

He said when somebody is guilty of something, they want to distract everybody’s attention. “If you catch a thief, the first thing he says is ‘I didn’t do it’, the second thing he says is ‘look there, look there…’ That is what the BJP is doing.”

Asking where the money into Adani group has come from as Adani does not generate this type of money and that money has come from someone,” he said all this drama – OBC, disqualification, anti-national, is being orchestrated to distract from the panic that prime minister is feeling that his relationship with Adani is going to be exposed.

“That relationship is going to be exposed. Nobody is going to stop that. It is going to happen because the opposition is going to find that answer,” he said.

Asked if he was hopeful that his membership would be restored, Gandhi said, “I am not interested in hope. (Whether) Whether I get my membership back or not, I will do my job. Even if they permanently disqualify me I will do my job, if they reinstate me, I will do my job. It does not matter to me whether I am in Parliament or outside it. I have to do my ‘tapasya’ and I will keep doing it,” he said.

The Congress leader also thanked Opposition parties for extending support to him and asserted that going forward, all of them will work together.

Asked about the consequences of his disqualification, Gandhi said the Opposition will benefit the most from this “panic reaction of Prime Minister Modi”.

“They got into panic mode that the truth will come out. They have handed over the biggest weapon to the Opposition because people have a question on their mind… and the question is why is the prime minister saving this corrupt person,” Gandhi alleged.

He said he will continue to fight for the truth in the country and to defend the democratic nature of this country.

“I will do whatever I have to do to defend the democratic nature of the country. What does that mean? It means defending the institutions of the country, defending the voice of the poor people of the country, it means telling the people of this country the truth about people like Mr Adani who are basically exploiting the relationship with the prime minister,” Gandhi said.

He alleged that for the BJP-led government, “country is Adani and Adani is country”.

Asked about the BJP’s charge that his 2019 remarks that were the center of the defamation case were an insult to OBCs, Gandhi said he has always talked about brotherhood and the issue was not about OBCs but about Adani and his ties to the government.

In response to another question, Gandhi said, “My name is not Savarkar, my name is Gandhi, Gandhi does not offer an apology to anyone.”

Asked about the defamation case in which he was convicted, Gandhi said it is a legal matter and he will not comment on it.

He also said attacks are being made on democracy in the country and examples of it keep manifesting from time to time.

  • Kejriwal says even British had never booked those who put up posters against their rule

Kejriwal says even British had never booked those who put up posters against their rule

    [ad_1]

New Delhi: Lashing out at the Centre over the action against display of “Modi Hatao, Desh Bachao” posters, Delhi Chief Minister Arvind Kejriwal on Thursday said even the British had never booked those who put up posters against them during the colonial rule.

“Even before independence when freedom fighters used to put up posters, there were no FIRs or action against them by the British,” Kejriwal said.

“Bhagat Singh had pasted a lot of posters during the British rule, not a single FIR was lodged against him,” he said.

Addressing a public meet at Jantar Mantar, the AAP supremo said he has “no objections” about the posters that were put up against him and that those behind the same “should not be arrested”.

“Why is the prime minister so scared? I saw that posters were put up against me and I do not have any problem with that. There won’t be any FIR or arrest. Some people are taking the country towards dictatorship. Together, we have to save the country’s constitution and democracy, we have to save the country,” Kejriwal asserted.

He urged the Centre to release those who were arrested in connection with the “Modi hatao, desh bachao” (Remove Modi, Save the Nation) posters.

The chief minister further said governance gets “complicated” when a leader is “uneducated”.

“How can a leader who is uneducated make decisions for the country? When a leader is uneducated, governance is bound to get complicated. I want to ask the citizens, do they think an educated prime minister is required to run our country in this 21st century?” he asked.

Kejriwal also alleged that corruption cases have been “closed” against those leaders who switched to the Bharatiya Janata Party (BJP).

The meeting organised by the Aam Aadmi Party (AAP) was attended by Kejriwal, his Punjab counterpart Bhagwant Mann, Delhi Environment Minister Gopal Rai, Education Minister Atishi and AAP MP Sanjay Singh.

Targeting the central dispensation, Punjab Chief Minister Bhagwant Mann said the saffron party can be thrown out of power even if it had won two Lok Sabha elections.

“The Union government has sold the country. They might have won the Lok Sabha elections twice, but they can also be removed from power. One should not be too arrogant. Arvind Kejriwal has always said that no matter which chair you hold, you should always be humble,” Mann said.

Senior AAP leader Sanjay Singh alleged that the financial situation in the country is in the doldrums due to “rising inflation and unemployment”.

“We will crush the arrogance of the central government. Inflation is touching new heights, unemployment is rising. Agniveer scheme was another loss for our youths. Farmers are forced to commit suicide. We are working for the betterment of people, but the Centre is working only for (industrialist Gautam) Adani,” he said.

  • Presentation of Delhi budget put on hold, Centre and AAP govt trade charges

Presentation of Delhi budget put on hold, Centre and AAP govt trade charges

    [ad_1]

New Delhi: The presentation of the Delhi government’s budget for 2023-24, scheduled for Tuesday, has been put on hold, with the Arvind Kejriwal dispensation and the central government trading charges over allocations in various heads.

Speaking at a News 18 programme on Monday, Chief Minister Arvind Kejriwal charged that the Centre was resorting to “gundagardi” and that it was for the first time in the history of the country that a budget of a government was put on hold. A video clip of his speech was tweeted by the Aam Aadmi Party (AAP).

Sources in the Delhi government said the Ministry of Home Affairs (MHA) has stopped the Kejriwal government’s budget and it will not be tabled in the Assembly on Tuesday.

As the chief minister lashed out at the Centre, sources in the MHA said the ministry has sought clarification from the AAP government as its budget proposal had high allocation for advertisement and relatively low funding for infrastructure and other development initiatives.

Delhi Finance Minister Kailash Gahlot denied the charges as lies. The total budget size was Rs 78,800 crore, out of which 22,000 crore was earmarked for expenditure on infrastructure and just Rs 550 crore on advertisements, he said.

The allocation for advertisement was the same as in last year’s budget, he added.

In a statement, the MHA said, “The Lieutenant Governor, Delhi, had raised certain concerns of administrative nature on the proposed Budget, keeping in view the fiscal interest of the National Capital Territory on which MHA vide its letter dated 17.03.2023 has requested GNCTD to resubmit the Budget addressing these concerns for taking further action. The reply from GNCTD is awaited for last four days. For the benefit of the people of Delhi, the GNCTD should submit reply immediately.”

In a separate statement, Gahlot said, “It is now learned that the MHA expressed some concerns on Delhi government’s budget and refused to give it approval through a letter sent to the Chief Secretary on 17 March. For mysterious reasons, the Chief Secretary of Delhi kept the letter hidden for 3 days.”

“I learned about the letter only at 2 pm today… The file with MHA’s letter was put up to me officially only at 6pm today i.e. just the day before the budget was to be presented in Delhi Assembly. Subsequently, we have responded to MHA’s concerns and submitted the file back to Delhi’s LG, after CM’s approval, at 9pm today. The role of the Chief Secretary and Finance Secretary of Delhi in delaying Delhi’s budget ought to be investigated,” he said.

A source in the LG office said, “The file was received in LG Sectt at 9:25 PM and was sent back to the Chief Minister at 10:05 PM, after approval of LG, for further action as per law.”

Delhi government sources said that the finance secretary will write to the MHA on Tuesday for its approval and the budget will be tabled after its nod. They said budget will not be tabled on Tuesday.

According to sources in the lieutenant governor’s office, LG V K Saxena approved the Annual Financial Statement for 2023-2024, with certain observations on March 9, and sent the file to the chief minister.

The Government of Delhi, thereafter, sought the approval of the President as mandated by law by sending a letter to the Home Ministry.

The Home Ministry conveyed its observations to the Delhi government on March 17. The LG office is awaiting for the file to be sent to it from the chief minister.

According to LG office sources, Saxena flagged that “as against proposed Budget size of Rs 78,800 crore, the expenditure on Capital components is indicated at Rs 21,816 crore, which is only 27.68%…. Further, this also includes Rs 5,586.92 crore on account of loan repayment, which, if excluded will further reduce the Capital component to Rs 16,230 crore which is only 20% of the budget.”

“Since Delhi is the country’s capital and also a large metropolis in which need for creation and improvements of infrastructure is extremely important, the allocation for Capital projects does not appear to be sufficient,” the LG said.

“It is noted that expenditure incurred by the Directorate of Information & Publicity as per the Revised Estimate 2022-23 is Rs 272.21 crore against the Budget Estimate of Rs 511.64 crore. However, the allocation for the Budget Estimate 2023-24 is Rs. 557.24 crore, which seems incomprehensible and unjustifiable,” he further said.

He claimed that the entire potential under various central schemes has not been fully utilised by Delhi.

“A case in example, the flagship scheme of Ayushman Bharat’, has not yet been adopted by Delhi due to which CSS funds under health sector are not made available. The Union Territory needs to obtain all possible funds under Central Schemes to augment its resources and also to meet national goals,” he said.

There was no clarity yet on when the budget will be presented in the Assembly. The ongoing budget session of the Assembly is scheduled to conclude on March 23.

Delhi Finance Minister Kailash Gahlot on Monday tabled an outcome budget of the Kejriwal government and the economic survey, 2022-23.

Earlier in the day, the Assembly was adjourned till 11 am on Tuesday.

Video: Sunaks told by police to put pet dog on leash in Hyde Park

    [ad_1]

London: UK Prime Minister Rishi Sunak and his wife Akshata Murty were “reminded of rules” by the police after they were spotted walking their dog in Hyde Park here without a lead – in an area where dogs are not allowed to roam free, officials said.

In a clip posted on TikTok, Sunak’s two-year-old Labrador Retriever, Nova, is seen wandering around near the edge of Serpentine lake on Saturday, in an area where signs clearly state that dogs must be kept on leads to avoid disturbing the local wildlife, the Telegraph newspaper reported.

The 42-year-old Indian-origin prime minister and his family were filmed apparently breaking the rules of Hyde Park in central London.

The police officer involved was one of the prime minister’s close protection team, the BBC reported.

The Metropolitan Police force said: “An officer, who was present at the time, spoke to a woman and reminded her of the rules,” apparently referring to Sunak’s wife Akshata.

The police said the dog was then put back on the lead, adding they would take no further action. It is not clear when the video was filmed.

A Downing Street spokesperson said it would not comment on the video when asked if Sunak would apologise.

This is not the first time a video has got the prime minister in trouble.

It comes less than two months after Sunak was fined by police for failing to wear a seatbelt in a moving car.

Sunak apologised for “an error of judgment” and was handed a fixed-penalty notice by Lancashire police for the offence, which can result in a fine of up to 500 pounds.

The incident came to light after Sunak posted a video of himself to social media while travelling in the back seat of a car.

  • Turkey earthquakes put spotlight on building code violations

Turkey earthquakes put spotlight on building code violations

    [ad_1]

New Delhi: Over a month after three devastating earthquakes struck Turkey, experts are trying to piece together information on the compliance level of buildings in the geologically fragile region.

A recent report outlining preliminary findings of damage assessment of the earthquakes shows violations of the building code stipulations in the past two decades contributed to a large number of lives lost and extensive damage to infrastructure.

Over 48,000 people have died so far in the February 6 quakes and nearly 1.2 lakh people have been injured.

The report by a team of scientists from Middle East Technical University (METU), Ankara, and colleagues also observed that in Gaziantep, Hatay, Kahramanmaras, and Adiyaman provinces, the buildings were subjected to seismic shocks larger than what the Turkish Earthquake Code (2018) design levels provided for.

The experts noted that regardless of the unprecedented nature of the earthquakes, buildings should have endured and not suffered collapses the way they did.

The ‘Preliminary Reconnaissance Report’ by the international team said that buildings designed and constructed post 2002 could be presumed to perform better during the quakes than the older buildings.

However, the report shows that more than 1,000 buildings constructed after 2000 were heavily damaged or collapsed, violating the performance objective given in the code which assesses the seismic risk of a building with respect to its geographical location.

This, the report said, appeared to be an important observation demanding further investigations on the design and construction quality of those buildings.

“Inadequacies could also develop due to the presence of “soft stories,” which are entrances or basements not having continuity of its walls with those of the upper storeys,” explained Bora Sezer, a structural earthquake engineer based in Istanbul, Turkey.

“The structures were poorly built. Normally, checks should be done during the construction of the structures,” added Seda Torisu, a Turkish-origin geotechnical engineer, currently working in Japan.

“If there was no problem with the design of the structure, then problems happened during the application [or construction] of the design on site,” Torisu, a survivor of the 1999 Izmit earthquake, told PTI in an email.

The team assessed the performance of all kinds of infrastructure such as residential structures, bridges, tunnels, coastal structures and historic structures.

They found that inadequate foundations, as a matter of fact, were also the reason for “pancake” collapses of multiple buildings.

Pancake collapse refers to a type of structural collapse which occurs from the top down as upper floors settle into lower floors of a building.

Similar findings were outlined in the report as well, which divided the building damage inventory in the region into two, based on their construction periods — before and after 2002.

This is because “a significant change is believed to have occurred in Turkiye between 1998 and 2001,” the report said.

A modern earthquake code was put into effect on September 2, 1998. Two destructive quakes occurred on August 17, and November 12, 1999, in Kocaeli and Duzce, raising awareness for seismic resistance.

A modern reinforced concrete design guideline (TS-500) came into force on October 12, 2000, making use of ready mix concrete and ductile low carbon content steel as reinforcement. A Building Inspection Law was enacted on July 13, 2001.

“When we compare the pre-1998 earthquake regulation with today’s regulations and construction methods, there are serious changes made in terms of regulation acceptances, material quality and application details in construction methods,” explained Sezer, who is working with professors who revised The Turkiye Earthquake Code 2007 and 2018.

“For these reasons, we expect more damage to structures built before 2000,” Sezer told PTI in an email.

Examples of “serious changes” which were strictly unacceptable in the revised regulations includes reinforcement bars used for construction not being ribbed, insufficient stirrup tightening — provided to laterally confine steel reinforcement — insufficient concrete quality, and low quality of materials used.

“Damage to old structures has been enormous. However, we have also seen in these earthquakes that many new buildings built after 2000, which were not well engineered or not well-inspected or whose soil-structure relationship remained unestablished, were damaged or demolished beyond expectations,” said Sezer.

A strong example which demonstrates this point is that of Erzin in Turkey’s Hatay province, where there were no structural collapses or casualties.

“The local government did not allow the construction of structures in Erzin, which had not been well-engineered or whose ground-structure interaction was not resolved,” Sezer said.

“They also carried out strict controls on the construction processes of all buildings. In addition, the buildings in Erzin are low-rise and designed and built in accordance with the earthquake code and regulations,” he added.

  • ‘Should be put on hold’, SC on CBI probe into BRS MLAs poaching case

‘Should be put on hold’, SC on CBI probe into BRS MLAs poaching case

    [ad_1]

New Delhi: The Supreme Court on Monday said the CBI should put on hold its investigation into the alleged criminal conspiracy behind an attempt to poach BRS MLAs allegedly by the BJP while hearing an appeal filed by the Telangana Police against the high court order in the matter.

A bench comprising Justices Sanjiv Khanna and M.M. Sundresh orally observed that the CBI should not proceed with the matter, while listing the case for further hearing in July.

Senior advocate Dushyant Dave, appearing for the Telangana Police, vehemently opposed the transfer of probe to the CBI. The top court was informed that the case materials have not been handed over to the central agency so far. The bench said it is making it very clear that the CBI probe should not be continued while the matter is sub-judice.

Earlier, Dave had argued that the consequences of transferring the case to CBI, which was allegedly under the Centre’s control, would be serious. He had submitted that it would go to the heart of democracy.

A division bench of the Telangana High Court on February 6 upheld the earlier order of a single judge on December 26, 2022 transferring the case to the CBI. The Telangana Police had moved the apex court challenging this order.

The plea argued that the high court did not appreciate that the CBI directly works under the Centre and is under the control of the office of the Prime Minister and the Home Ministry. The state government alleged the involvement of some top BJP leaders to poach its four MLAs, was an attempt to topple the government.

The plea said: “The Bharatiya Janata Party is in power in the Central Government and the allegations in the FIR are squarely and directly against the said party adopting illegal and criminal steps and methods to destabilize the Government of Telangana, the Hon’ble High Court therefore could not have entrusted the investigation to CBI in any case.”

The plea further added, “The High Court has unnecessarily drawn the conclusion that release of the CD by the Chief Minister on 03.11.2022 amounted to interference with the investigation and therefore concluded that investigation was not fair and violated the rights of accused for fair investigation.”

Three persons Ramachandra Bharati alias Satish Sharma, Nandu Kumar and Simhayaji Swamy, named as accused have already been granted bail.

According to the FIR, MLA Rohith Reddy alleged that the accused in October last year, offered him Rs 100 crore and in return the legislator had to leave the BRS.

It was also alleged that they asked Reddy to bring some more BRS MLAs by offering Rs 50 crore each to join the BJP.

In November last year, the state government had formed an SIT, comprising state police officers to investigate the matter.

Biden to put Arctic waters off limits to new oil leases as Willow decision looms

    correction biden drilling 42133

The White House has been mulling the Willow decision for weeks. The deliberations have focused on the legal constraints posed by the fact that Conoco has held some leases for decades and “has certain valid, existing rights granted by prior Administrations, limiting the Biden Administration’s options,” the official continued.

Stopping new oil leases, plus other measures meant to conserve the Arctic from new drilling, is meant as a “fire wall” to protect 16 million acres of land and water in the state, said the official.

The Sierra Club environmental group gave tempered support to any new rules.

“These unparalleled protections for Alaskan landscapes and waters are the right decision at the right time, and we thank the Biden Administration for taking this significant step,” Sierra Club Lands Protection Program Director Athan Manuel said in a prepared statement. “However, the benefits of these protections can be undone just as quickly by approval of oil and gas projects on public lands, and right now, no proposal poses a bigger threat to lands, wildlife, communities, and our climate than ConocoPhillips’ Willow project.”

Assets Of JK Put On Sale: Mehbooba Mufti

    [ad_1]

SRINAGAR: People’s Democratic Party (PDP) chief Mehbooba Mufti on Sunday slammed the Jammu and Kashmir government’s decision to outsource a golf course located in Srinagar, alleging that the assets of Jammu Kashmir were being put on sale.

Reacting to the latest order on the Srinagar Golf course, Mufti said that the sale of Royal Golf Spring is another example of how the administration is “developing” this region post August 5, 2019, a PDP statement read.

There were speculations that the Jammu Kashmir admin is going to outsource the Royal Springs Golf Course in Srinagar. “Everything has been put on ‘sale’ “; she alleged and said, “This is yet another step to sell our assets to non-local businesses”.

The former Jammu Kashmir Chief Minister said that Kashmir is the oldest golfing destination not just in South Asia but perhaps East of Suez. Gulmarg, Kashmir Golf clubs are the second oldest after Calcutta. Our golf clubs are not merely real estate as the Government of India is treating the state as an essential part of our identity and heritage.

She said, if the present administration finds the maintenance difficult because of its inherent inefficiency and agenda, it should focus on improving the organization running golf courses and hire experts from anywhere.

“Whether in Jammu or Kashmir, selling golf courses is unacceptable, as we’ve witnessed that this outsourcing generally ends up in ownerships and is irreversible”, she added.

Tourism being our key sector, the order says, many properties of JKTDC and the tourism department are being given out. This happens at a time when they are not renewing the leases with the local hoteliers, in Gulmarg, she alleged.

She said this looks like taking every important avenue from our hands. On the one hand, poor people are being hounded out of what has been theirs for generations, and on the other premier assets are up for sale.

“The August 5 decision led to rampant exploitation of land resources, jobs, and rivers in the region, with outsiders being given preference over locals. This has resulted in a rise in unemployment, drug abuse, mafia activities, environmental degradation, and above all dispossession and dis-empowerment of locals”, she added.
