Chief Justice Qazi Faez Isa Faces Backlash Over Alleged Neglect of Human Rights Cases

The Chief Justice of Pakistan, Qazi Faez Isa, is a disgrace to Pakistan’s judiciary, and reminds one the ‘hanging judge’ Judge Jeffreys.

In my video interview to the Pakistani journalist Waqar Bagga of siasat.pk I had mentioned about Qazi Faez Isa’s misbehaviour on the 15 member full bench of the Pakistan Supreme Court hearing the petitions challenging the validity of the Supreme Court ( Practice and Procedure ) Act, 2023

    Chief Justice Qazi Faez Isa
    Chief Justice Qazi Faez Isa

As a Judge, Qazi Faez Isa had taken an oath to uphold the Constitution of Pakistan, which includes a chapter on the fundamental rights of the citizens, viz Part 2, which includes the right to life and liberty, the most precious of all rights ( vide Article 9).

So after becoming the CJP on 17th September, 2023  Qazi Faez Isa should have taken up on priority basis the cases of the thousands of persons ( including former Prime Minister Imran Khan ) who were arrested and incarcerated in jail on apparently trumped up and concocted charges after the events of 9th May ( which many believe was scripted and stage managed ).

Many such persons, who are in jail for over 5 months, have families, who are suffering terribly without them. The conditions in jail; are horrible.

Many persons are being arrested, tortured, and jailed even today ( e.g. former Interior Minister Sheikh Rasheed Ahmed ) because they were known to be members or supporters of Imran Khan’s PTI party.

Yet Qazi Faez Isa, flouting his solemn oath, has turned a Nelson’s eye to all such cases, does not list them for hearing, and instead takes up old cases which have hardly any importance today, as pointed out by the journalist Sohrab Barkat of siasat.pk

For instance, he took up an appeal of Gen Musharraf against his conviction by a court, though Gen Musharraf is long dead, and hence the appeal had become infructuous.

He also took up a review petition in the Faizabad dharna case, though the dharna had ended in 2017

    https://www.theweek.in/wire-updates/international/2023/11/01/fgn45-pak-highway-protest-committee.html

In Ghani vs Jones (1970),  Lord Denning observed: “A man’s liberty of movement is regarded so highly by the laws of England that it is not to be hindered or prevented except on the surest ground.”

Whenever a habeas corpus petition (a petition praying for release from illegal custody) or bail application comes before a British judge, he sets aside all other files, and takes up the petition as having priority over every other case, since it relates to individual liberty.

But Qazi Faez Isa ignores this well established,  long standing practice, while giving regular lectures and preaching homilies on human rights, and quoting from the Quran.

I regret to say this, but ever since he became the CJP, Qazi Faez Isa has been behaving like a shameless ‘chamcha’ of the Pakistan Establishment. He will go down in the annals of judicial history in the same category as the ill reputed judge Jeffreys, who loyally obeyed the orders of King James the Second of England, instead of his own conscience

The police fired tear gas shells to disperse the demonstrators but to no avail as the law enforcers retreated.

There are reports of PTI supporters breaking into the residence of a military officer in the cantonment area in Lahore, Dawn reported.

Journalist Murtaza Ali Shah shared this information in a tweet, saying, “PTI supporters break into military officer’s house in Lahore Cantt.”

He also shared a video showing a group of men, some of them with their faces partly covered, entering a gated premises with sticks. They were later seen using the sticks to hit walls, Dawn reported.

Men in uniform could also be seen on the premise.

Meanwhile, PTI workers from Khyber Pakhtunkhwa gathered on the streets of Lakki Marwat district under the leadership of provincial party president Muhammad Iqbal after the arrest of Khan.

The PTI supporters resorted to burning tyres and closed down the Indus Highway.

After Khan’s arrest, PTI had called for protests across Pakistan following which roads were blocked on the main thoroughfares in the major cities, including Karachi.

PTI Vice Chairman Shah Mahmood Qureshi reiterated the party’s call for “peaceful protest”, following the arrest of Khan.

In a video message shared on PTI’s Twitter habdle, Qureshi could be heard urging the people to “protest peacefully and express solidarity with PTI Chairman Imran Khan”.

Qureshi said he was leaving for Islamabad where he had called a meeting of the PTI leadership and a six-member committee to determine the next course of action, Dawn reported.

Qureshi said, “In my view, the plan to hold a series of rallies earlier announced by Imran Khan Sahib still holds. We have to convert them into rallies of peaceful protests.”

Islamabad: A Pakistan Tehreek-e-Insaf (PTI) leader and nine others were killed when the vehicle they were travelling came under attack in Khyber Pakhtunkhwa’s Abbottabad district, according to authorities.

Confirming the incident which took place on Monday, Abbottabad District Police Officer (DPO) Umar Tufail told Dawn news that a rival group had opened fire on the vehicle near Havelian’s Langra village which caused the fuel tank to explode.

He said that the vehicle caught fire and was completely destroyed, adding that 10 people, including PTI leader Atif Munsif Khan, died on the spot.

  • Pak police register terrorism case against ex-PM Imran, PTI leaders

Pak police register terrorism case against ex-PM Imran, PTI leaders

    [ad_1]

Islamabad: Pakistani police on Sunday registered a terrorism case against Imran Khan and over a dozen PTI leaders for indulging in vandalism, attacking security personnel and creating unrest outside the judicial complex here ahead of a court hearing in a graft case involving the ousted premier.

Clashes erupted outside the Islamabad Judicial Complex on Saturday when Khan arrived in Islamabad from Lahore to attend a much-awaited hearing in the Toshakhana case.

During the confrontation between Pakistan Tehreek-e-Insaf (PTI) workers and police, over 25 security personnel were injured, prompting Additional District and Sessions Judge Zafar Iqbal to defer the court hearing till March 30.

The case was registered against arrested PTI workers and wanted party leaders. About 17 PTI leaders were named in the FIR lodged by the Islamabad Police, Geo News reported.

The FIR states that the workers damaged the police check post and the main gate of the judicial complex, it said.

As many as 18 people were arrested for arson, pelting stones and breaking the judicial complex’s building, said the FIR.

“About two police vehicles and seven motorcycles were burned, and the official vehicle of the station house officer (SHO) was damaged,” it added.

Khan, 70, arrived in Islamabad from Lahore to appear before the court. He was accompanied by his supporters in a convoy.

Soon after he departed for Islamabad to attend the hearing, over 10,000 armed Punjab police personnel stormed Khan’s Zaman Park residence in Lahore and arrested dozens of his party workers.

The police personnel, using a power shovel, removed the barricades and tents at the entrance of the Pakistan Tehreek-e-Insaf (PTI) party chief’s residence and evicted hundreds of his supporters camping there to prevent Khan’s arrest in the Toshakhana case.

They conducted a search at the house after demolishing its main gate and walls. Punjab Police, whose action ended later, were reportedly met with resistance from PTI workers from inside, resulting in violence. About 10 workers were reportedly injured in the police operation in Lahore.

PTI leader Fawad Chaudhry said on Sunday said the party will get cases registered against police officers involved in the “illegal operations” and violence at Khan’s residence.

“Today, a meeting of the legal team has been called. The way in which the police defied the Lahore High Court’s decision entering Imran Khan s residence has trampled every rule of the home’s sanctity. [things were] stolen. [They] also took away juice boxes. Innocent people were subjected to torture,” he tweeted.

“Defying court order is unforgivable. The high court should guard its judgment. Cases are being registered on all police officers who conducted illegal operations and were involved in violence,” he said.

Earlier, Khan appeared before Lahore High Court on Friday and assured that he was ready to present himself on Saturday before Additional District and Sessions Judge (ADSJ) Iqbal handling the corruption case against him.

The PTI chief has been in the dock for buying gifts, including an expensive Graff wristwatch, he had received as the premier at a discounted price from the state depository called Toshakhana and selling them for profit.

Established in 1974, the Toshakhana is a department under the administrative control of the Cabinet Division and stores precious gifts given to rulers, parliamentarians, bureaucrats, and officials by heads of other governments and states and foreign dignitaries.

The cricketer-turned-politician was disqualified by the Election Commission of Pakistan (ECP) in October last year for not sharing details of the sales. The top electoral body later filed a complaint with the district court to punish him, under criminal laws, for selling the gifts he had received as prime minister of the country.

Khan was ousted from power in April last year after losing a no-confidence vote, becoming the first Pakistani prime minister to be voted out by the National Assembly.

Pakistan govt mulling legal options to declare PTI a banned outfit

    [ad_1]

Islamabad: Pakistan Interior Minister Rana Sanaullah has hinted that legal proceedings could be initiated to declare Pakistan Tehreek-e-Insaf (PTI) a banned outfit, state media reported.

Rana said that the legal team of ruling Pakistan Muslim League-Nawaz (PML-N) was examining the matter in light of several revelations that could lead to a reference being filed against the party, Express Tribune reported.

He however clarified that it is ultimately up to the courts to officially ban a political party.

According to him, Punjab Police along with other law enforcement agencies conducted an operation against a “no-go area” in Lahore where a purported political leader had allegedly created an “atmosphere of fear”.

Rana said that the action was taken after resistance was encountered during the execution of court orders, leading to concerns of a possible terror organisation’s presence, Express Tribune reported.

“The operation resulted in the clearance of the no-go area in Zaman Park. Despite having a search warrant, officials did not enter the residential area,” he added.

The Interior Minister said that 65 people have been arrested from the outer part of the building, most of them do not belong to Punjab and their role is suspicious.

He also added that guns, petrol bomb-making equipment, slingshots and other weapons were recovered from Zaman Park, Express Tribune reported.

  • RSS’ Hindusthan Samachar replaces PTI as Prasar Bharati’s news feed source: Report

RSS’ Hindusthan Samachar replaces PTI as Prasar Bharati’s news feed source: Report

    [ad_1]

The Rashtriya Swayamsevak Sangh-backed news organisation Hindusthan Samachar will now serve as the sole source of news for India’s public broadcaster Prasar Bharati’s daily news feed.

Prasar Bharati, which operates Doordarshan and All India Radio, inked an exclusive deal with Hindusthan Samachar on February 14, 2023, nearly two years after cancelling its subscription with the Press Trust of India (PTI), India’s largest and oldest professional news agency, The Wire reported.

Since 2017, Hindusthan Samachar has offered Prasar Bharati its wire services free of charge and on an ‘evaluation basis.’

However, a written agreement between the two parties states that Prasar Bharati will give Hindusthan Samachar close to Rs 7.7 crore over the course of two years, with payment terminating in March 2025. According to the deal, Hindusthan Samachar must offer Prasar Bharati with at least 100 news pieces every day, including at least 40 ‘local stories’ in regional languages and 10 national news items, The Wire stated in its report.

Shivram Shankar Apte, a senior RSS pracharak and co-founder of the Vishwa Hindu Parishad alongside RSS ideologue MS Golwalkar, launched Hindusthan Samachar, a multilingual news organisation, in 1948.

The Narendra Modi government’s recent bitter run-ins with news organisations PTI and United News of India (UNI) during the past few years preceded Prasar Bharati’s newest decision to legally induct Hindusthan Samachar.

Sources in Prasar Bharati told The Wire that in 2017, the government gave the public broadcaster the go-ahead to stop providing these news firms’ services due to their ‘unreasonable’ subscription costs. The agencies were paid Rs 15.75 crore annually, of which over Rs 9 crore went to PTI’s costs, according to a 2017 article by The Wire.

The sources further hinted that the Modi administration wanted a news outlet that only presented ‘favourable’ views of the government and that it considered both PTI and UNI delivered ‘slanted’ news feeds.

Since 2014, the Modi government has had major and minor issues with the PTI’s independent news coverage. Nevertheless, issues came to a head when in 2020, a top Prasar Bharati official, Samir Kumar, had written to PTI’s chief marketing officer claiming the news agency’s ‘recent news coverage’ on the Ladakh stalemate was damaging to ‘national interest’ and harmed ‘India’s territorial integrity’.

“It is also mentioned that the PTI had…been time and again alerted by the Public Broadcaster on editorial lapses resulting in dissemination of wrong news harming public interest,” the letter added.

The report further states that,in the aftermath of the Ladakh border stalemate, the centre was upset by PTI’s interviews with the Chinese envoy to India and the Indian ambassador to China in 2020.

Hindusthan Samachar, whose stated mission is to present news from a ‘nationalist’ perspective, was forced to close its doors in 1986 due to a financial crisis. The RSS, however, revived it in 2002 during AB Vajpayee’s tenure as Prime Minister.

Several oppostion leaders reacted negatively to the development.

TMC Rajya Sabha MP and former CEO of Prasar Bharati Jawhar Sircar remarked that it’s ‘best’ to merge Prasar Bharati and BJP.

“Finally. Best to merge Prasar Bharati and BJP,” he tweeted.

Kerala Former finance minister Thomas Isaac called the development as bringing Prasar Bharati under the ‘RSS heel’.

“Hindustan Samachar, controlled by RSS replaces PTI as news agency for Doordarshan and AIR. An exclusive contract has been signed for this purpose by Prasar Bharati with Hindustan Samachar. Instead of granting autonomy to Prasar Bharati GoI has decided to bring it under RSS heel,” he tweeted.
