    SRINAGAR: A son of a retired Jammu and Kashmir police Assistant Sub- Inspector has been booked under Public Safety Act (PSA) for his alleged involvement in theft and drug-related cases in Jawahar Nagar area of Rajouri town.

    An official said that the notorious thief has been identified as Sunny Sharma, a resident of ward No 5 Jawahar Nagar, Rajouri.

    He added that the accused has been booked under PSA for his repeated involvement in theft cases and drug peddling thereby posing a threat to the peace and order of the community.

    “He did not change his behaviour in spite of being booked in several FIRs. He was arrested by police many times but continued to  do unlawful activities,” official said.

    The official said that the accused was detained under section 8 of PSA and has been lodged in jail. (KS)

    SRINAGAR: A notorious bovine smuggler hailing from Rajdhani village of Thanamandi in Rajouri was booked under Public Safety Act (PSA).

    A police spokesman identified the bovine smuggler as Imran Ahmed son of Shabir Ahmed of village Rajdhani in Tehsil Thanamandi Rajouri.

    A police spokesman said that the accused has been booked under Public Safety Act for smuggling bovines in an organised manner and hence posing a threat to peace and order.

    He did not change his behaviour despite being booked in several FIRs and arrest by police in these cases but he continued his illegal and unlawful activity of smuggling bovines. This, police said, is likely to disturb public order particularly in Rajouri.

    “The cases in which the accused has been booked earlier include FIR No. 71/2018 of Police Station Dharamsala, 155/2019 of Police Station Akhnoor, 93/2020 of Police Station Nowshera, 129/2020 of Police Station Nowshera, 171/2020 of Police Station Thanamandi, 117/2021 of Police Station Nowshera,” it said.

    “Police said that keeping in view the activities of said accused as his activities amounts to propagating and creating feelings of enmity, hatred among communities, the accused was ordered to be detained under section 8 of Public Safety Act and has been lodged in jail,” it added.

    Senior Superintendent of Police Rajouri Amritpal Singh said that many people in the district have booked under PSA in last couple of weeks. (KNO)

    SRINAGAR: Jammu and Kashmir Police in Rajouri have booked a notorious Over Ground Worker (OGW) under Public Safety Act (PSA) for allegedly facilitating the movement of militants.

    The notorious OGW identified as Waqar Hussain Bajran son of Manir Hussain resident of Village Bhanghai in Tehsil Thanamandi of Rajouri has been booked under Public Safety Act for facilitating the movement of militants, police said in an official statement.

    The accused indulged in anti- national activities and was working as active guide and facilitator for militant organisations till his arrest.

    Earlier, he had also visited the Gulf countries viz Saudi Arabia and from where he came into the contacts of militant organisation and was actively involved in providing logistics support to the militant outfit.

    Police said that a case under FIR number 223/2021 under section 307/120-B/121/122/212/216 IPC r/w 7/27 Arms Act, 13 ULA was also registered against him in Police Station Thanamandi and keeping in view the activities of accused as he poses threat to the security of the state and under these circumstances he was ordered to be detained under Public Safety Act, police said.

    Meanwhile, police said that aggressive counter insurgency operations are going on in the area with strict against being taken against those facilitating militants in any way—(KNO)

  • HC Quashes Detention Orders Issued Under PSA

    SRINAGAR: The High Court of Jammu and Kashmir and Ladakh has quashed a series of detention orders issued under the Public Safety Act, including that against journalist Fahad Shah. The court found that the detaining authority did not apply its mind while passing the orders.

    In one case related to Srinagar resident Peerzada Mohammed Waseem’s detention, the court criticized the district administration for stating in the dossier that the accused had indulged in rioting and stone pelting in 2020, despite being in jail since 2017.

    The judge raised the question of how a detenue already behind bars and facing trial could have participated in rioting and stone pelting during that time. Judge Wasim Sadiq Nargal mentioned in his order that this proved that the detaining authority had passed the order without the application of mind.

    The court also quashed the PSA order against Amir Ali Bhat, stating that it could be safely concluded that the detaining authority had failed to provide the material relied upon for passing the detention order, making it illegal and unsustainable.

    Regarding Fahad Shah, the judge found that the dossier had not been provided to the detenue, pointing out that it was one of the main lacunae in the detention, while in the case of Naseer Ahmad Dar, the PSA order was also cancelled for similar reasons.

    The court ordered the authorities to release the detainees immediately if they were not required in any other case, highlighting the lacunae in the detention orders and reaffirming the importance of adhering to procedural requirements in passing such orders. “It is one of the main lacunae in the detention,” the court stated.

    The judge, while passing these five orders separately on April 17, asked the authorities to release them forthwith in case they were not required in any other case

  • Kashmiri Cook’s PSA Detention In Agra Jail Quashed By High Court

    SRINAGAR: The High Court of Jammu and Kashmir has quashed the detention of Ashiq Hussain Teli, a resident of Watrina Bandipora who was lodged in Agra jail under the Public Safety Act (PSA).

    Teli, who worked as a cook, was arrested by police in Bandipora in January 2022 on charges of stone-pelting.

    However, his lawyer, Advocate Bashir Ahmed Tak, argued that the detaining authority did not attribute any specific allegation against Teli and that he was arrested on old cases and fake charges.

    Justice Sanjay Dhar, presiding over the case, ordered Teli’s release from the Agra Jail.

    SRINAGAR: On Thursday, the Jammu Kashmir High Court overturned the Public Safety Act of Kashmiri journalist Fahad Shah, who has been detained at Kot Balwal jail in Jammu since June 2022, nearly 300 kilometres away from his home in Srinagar’s Soura. Despite calls from organizations such as the Committee to Protect Journalists (CPJ) for his release, Fahad has remained in detention for over a year.

    Fahad was initially arrested by Pulwama Police on February 4, 2022, for social media posts that were deemed to glorify terrorist activities and harm the image of law enforcement agencies, as well as cause ill-will and disaffection towards the country.

    Although he was granted bail in that case on February 26, he was arrested again by Srinagar police on March 5 in connection with a report on his news portal from January 2021, and was granted bail again on March 14 before being moved to Kupwara District jail on March 16. He was later shifted to Kot Balwal jail on June 9, after being booked under the Public Safety Act.

    In the PSA dossier submitted to the District Magistrate of Srinagar, the Jammu and Kashmir police accused Fahad of propagating stories that were in line with ISI/separatist propaganda, posting anti-national content, and glorifying stone pelters, terrorists, and separatism.

    The dossier also claimed that Fahad’s news portal, The Kashmir Walla, published stories that were against the interest and security of the nation, and that they mostly highlighted the allegations of the Kashmir conflict and the “Indian state’s highhandedness.”

    Despite securing bail twice before, Fahad was arrested for the third time and booked under a fresh PSA case on Monday. The police described Fahad as an “instigator” and accused him of working against the ethics of journalism by posting anti-national content that had a negative impact on the sovereignty and unity of the country. The PSA dossier concluded that Fahad could pose a serious threat to the security of J&K by way of his unlawful activities. (KDC)

    SRINAGAR: Jammu and Kashmir Police have booked a notorious drug peddler under Public Safety Act (PSA) after obtaining necessary sanctions from the authorities in Baramulla.

    The notorious drug peddler namely Rafeeq Ahmad Khan alias Raja Rafi son of Ghulam Hassan Khan resident of Gubdar Trikanjan Boniyar has been booked under JK PSA after obtaining necessary sanctions from the competent authority. The booked drug peddler has been detained and subsequently lodged in Central Jail Kot-Balwal, Jammu, a police spokesman said in a statement.

    “It is pertinent to mention that three cases are registered against the said drug peddler and he was involved in promoting drug abuse trade by supplying drugs to local youth of Boniyar and other areas of district Baramulla. Despite his involvement in many FIRs he did not mend his activities and was again involved in promoting drug abuse trade by supplying drugs to local youth.” (KNO)

    SRINAGAR: Police on Thursday booked two notorious thieves under Public Safety Act (PSA) after obtaining necessary sanction from the authorities in central Kashmir’s Budgam district.

    A police spokesperson said that two habitual notorious thieves namely Azad Mukhtar Son of Mukhtar Ahmad Hajam and Altaf Ahmad Dar son of Ghulam Mohammad Dar, both residents of Hanjiveera Pattan were detained under Public Safety Act by Police for their unrelenting criminal acts of burglary and theft. The booked notorious thieves have been detained and subsequently lodged in Kot Bhalwal Jail Jammu.

    Pertinent to mention here that the booked thieves were involved in 14 cases of burglary and theft in different Police Stations across Kashmir.

    SRINAGAR: The High Court of Jammu Kashmir and Ladakh has quashed the detention of two persons from south Kashmir’s Anantnag district lodged in Central Jail Kot Balwal Jammu under the Public Safety Act (PSA).

    The detainees – Muhammad Abbas Khan, son of Nazir Ahmed Khan and Hadayat Ullah Kuttay, son of Abdul Razak Kuttay, both residents of Srigufwara Anantnag had been arrested in April last year and subsequently, shifted to Kot Balwal Jail under Public Safety Act.

    The detention orders under PSA were issued by District Magistrate Anantnag vide numbers 07 and 08/DMA/PSA/DET/2022 dated 08.04.2022. The duo was accused of being militant sympathizers.

    The counsel for both the petitioners’ Advocate Bashir Ahmed Tak challenged the impugned order on the grounds that the allegations made on the grounds of detention are vague and non-existent and that there has been non-application of mind on the part of the detaining authority.

    Advocate Bashir Ahmed Tak argued that the detaining authority has not attributed any specific allegation against the detainees. He contended that the detainees were arrested in old cases and on frivolous charges.

    The court of Justice Vinod Chatterji Koul accordingly quashed the detention of both persons and ordered their release from the Kot Balwal Jail.
