    Seoni: A Congress MLA from Madhya Pradesh has claimed Bajrang Bali was a tribal forest dweller who protected Lord Ram.

    The Congress legislator from Barghat constituency in Seoni district, Arjun Singh Kakodiya, also claimed there was no Ayodhya, Kshatriya or Brahmin sena (army) but it was the tribal community that helped Lord Ram (in his exile).

    “Bajrang Bali was a tribal who lives in the forest. He protected Maryada Purushottam Shri Ram and helped him. There was no Ayodhya, Kshatriya or Brahmin sena but (it was) the tribal community (that) helped Lord Ram,” Kakodiya said while addressing a public meeting in the presence of MP Congress president Kamal Nath in Udepani village.

    He said the tribal community will not tolerate the insult of Bajrang Bali and those who are defaming his name.

    Bajrang Bali, also called Hanuman, is a divine monkey companion of Lord Ram. He is one of the central characters of the epic Ramayana.

    The Congress is facing backlash from BJP and right-wing organisations for bracketing Bajrang Dal with the Popular Front of India (PFI) in its manifesto for the May 10 Karnataka Assembly polls.

    In the manifesto released last week for the polls, the Congress said it was committed to taking firm and decisive action against individuals and organisations spreading hatred amongst communities on grounds of caste and religion.

    The mention of Bajrang Dal has evoked a strong reaction with BJP and right-wing organisations accusing Congress of playing appeasement politics.

    Prime Minister Narendra Modi chanted Jai Bajrang Bali’ during all three public meetings he addressed in poll-bound Karnataka on Wednesday.

    “The Congress in its manifesto has decided to lock up Lord Hanuman. Initially, they locked up Prabhu Shri Ram (Lord Ram). And now they want to lock up people who say Jai Bajrang Bali’,” the PM told a public meeting at Hospet in Vijayanagara district on Tuesday.

    More than 100 Nepali guards who risked their lives to protect British embassy staff in Afghanistan before the Taliban seized back control were secretly returned to Nepal against their wishes shortly after being airlifted to safety in the UK, the Guardian can reveal.

    Hundreds of Nepali nationals and a smaller number of Indian nationals who protected key institutions in Kabul were brought to the UK on an RAF flight during the chaotic evacuation of the Afghan capital by western countries in August 2021, as victorious Taliban forces closed in.

    It has now emerged that days after they arrived in the UK, more than 100 of these evacuees were forcibly removed to their home countries even though many had been issued with six-month visas on arrival.

    The Guardian has interviewed some of the deported guards, who believed their lives were in danger in Nepal. Some were forcibly removed from hotel rooms in the UK in areas including Northampton, Reading, Oxford and Swindon before completing what at the time was a mandatory 10-day period of Covid-19 pandemic hotel quarantine for new arrivals in the UK.

    Nepal was designated as a red-list country, with UK government instructions that people should not travel there, when the former guards were flown back in 2021.

    Some have managed to find their way back to the UK since 2021 and have claimed asylum.

    In March, at least 10 Nepali guards who protected the British embassy staff in Kabul and were still living in the UK were arrested in a raid at their west London hotel and detained by the Home Office.

    After the detentions came to light, the Home Office issued a statement saying that the removals of those detained had been paused “pending further review”. It said the evacuees were flown from Kabul as “a gesture of goodwill” with the understanding that they were expected to return to their home countries.

    More than 100 of those forcibly removed from the UK have written to Rudra Dhakal, a British resident of Nepali heritage who is supporting them, with the Home Office, Foreign Office, Ministry of Defence, Nepalese government and UNHCR copied in, in a letter titled “Urgent appeal for further humanitarian protection in the UK”.

    The deported guards wrote: “We were misled by the UK border security force. Therefore they forcefully deported us to Nepal against our will. At the time of our deportation we were never given the choice of staying in the UK for further humanitarian protection.”

    Dhakal, who is continuing to support the guards, said: “These bravest of the brave veterans said they provided frontline security … but they were left behind in the end. They were used as proxies on the frontline of the war.”

    One of those deported is Deepak Punmagar, 42. “We were always under threat in Afghanistan,” he told the Guardian. “We didn’t know if we would survive. When I arrived in the UK I felt safe but I was deported to Nepal on 17 August.”

    Some of the Nepali guards evacuated from Kabul in 2021 who were doing almost identical work in Afghanistan as those forcibly removed were granted indefinite leave to remain in the UK, including two of the 10 arrested in March, who remain in immigration detention.

    Jamie Bell, of Duncan Lewis Solicitors, who is representing some of those currently detained, said: “These brave men were evacuated from Afghanistan and thereafter had their applications for permanent leave prepared and processed in the UK. They were never told of a gesture of goodwill and there was no understanding that they were liable to removal, let alone detained after a morning raid on their hotel. It is deeply concerning now to hear how many have been affected by this appalling situation.”

    A Home Office spokesperson said: “We remain committed to providing protection for vulnerable and at-risk people fleeing Afghanistan and so far we have brought around 24,500 people to safety in the UK.

    “A number of Nepalese nationals who were not deemed eligible for consideration under ACRS [the Afghan citizens resettlement scheme] were evacuated from Afghanistan as a gesture of goodwill. This came with the understanding that once in the UK, these individuals would arrange and be offered support for onward travel to the country of their nationality.”

    The Nepalese embassy has been approached for comment.

    Chandigarh: Congress leader Navjot Singh Sidhu on Monday called Punjab Chief Minister Bhagwant Mann the “most protected CM” while slamming his AAP government for pruning slain singer Sidhu Moosewala’s security last year and his own security detail now.

    Sidhu visited the Punjabi singer’s parents in Mansa district, expressing grief over the death of Shubhdeep Singh Sidhu, popularly known as Sidhu Moosewala. He was shot dead on May 29 last year, after the Punjab Police temporarily pruned the security being given then to about 400 people.

    The Congress leader came out of the Patiala Central Jail on Saturday after serving nearly 10 months in a 1988 road rage case.

    Addressing the media here, with the singer’s parents beside him, the cricketer-turned-politician slammed the Aam Aadmi Party government over law and order.

    Referring to Moosewala, Sidhu said, “He was global star. Why was his security pruned? Does it ever happen that you reduce security and make it public?”

    “What happened with him, the same thing is happening with another Sidhu today,” he added, claiming that the Z Plus security he earlier got is now down to 13 personnel.

    “I want to say that I am not afraid of death,” he added.

    Sidhu claimed that Mann used to say there was no need for any security for him.”Today you are the most protected CM,” he said, adding that vehicles cannot be seen in the dust raised by his cavalcade.

    He also raised questions over security in jail premises, referring to a purported TV interview of gangster Lawrence Bishnoi while in prison. The state government has 2G mobile jammers while the gangsters have 5G phones, he claimed.

    He said jails have turned into ‘suvidha centres’ or convenience points for crime because politicians use youths who have gone astray. Gangsters are being used “political pawns” now, he charged.

    Moosewala joined the Congress in December 2021 when Sidhu was the chief of the party’s Punjab unit. He contested next year for the Mansa seat on a Congress ticket, but lost.

    The singer’s parents recently sat on a protest outside the Punjab Assembly complex, saying that the masterminds behind his murder were still on the run.

    Sidhu, who was sentenced to a year in jail by the Supreme Court last year in a 1988 road rage case, targeted the BJP-led Centre on Saturday, saying that democracy is in fetters.

    He also claimed that a conspiracy is being hatched to impose President’s Rule in Punjab.

    Immigration groups and Florida lawmakers have pushed the Biden administration to redesignate TPS for Nicaraguans living in the U.S., which would allow them to live and work in the country without fear of deportation.

    Since taking office, President Joe Biden has leaned on TPS as a tool to grant immigration relief to hundreds of thousands of people as Congress remains in gridlock over fixes to the immigration system. Biden has designated six new countries for TPS since taking office and redesignated six other nations, making an additional 712,000 U.S. immigrants eligible for the status, according to the Migration Policy Institute. Backlogs at the U.S. Immigration and Citizenship Services have delayed approvals, but nearly 537,000 people had TPS as of November 2022.

    Nicaraguans first received TPS in 1999 after Hurricane Mitch wreaked havoc in Central America. The Temporary Protected Status designation, created by Congress in 1990, helps residents from countries struck by natural disaster, armed conflict or other “extraordinary and temporary conditions.”

    There were 4,250 TPS recipients from the country in 2021, the U.S. Immigration and Citizenship Services said in a congressional report.

    A record-number of Nicaraguans sought to illegally enter the U.S. last year, as migrants fled political persecution and poor economic conditions in the country. In fiscal year 2022, border officials said there were 163,876 encounters with Nicaraguans.

    In a letter to Department of Homeland Security Secretary Alejandro Mayorkas last month, federal lawmakers pointed to Nicaraguan President Daniel Ortega’s political “repression” of protesters, clergy and students.

    “The increasingly totalitarian nature of the Ortega-Murillo regime and the brutal political repression Nicaraguans face in their daily lives exacerbate the urgent need for the Biden Administration to redesignate and extend TPS to Nicaragua,” the letter said.

    The letter also mentioned the government’s release of over 222 political prisoners last month. The Biden administration orchestrated the relocation of the prisoners to the U.S. through its humanitarian parole program and have granted them this status for two years. Biden announced the parole program —aimed to curb the flow of Nicaraguans, Haitians and Cubans — in January.

    That policy forced migrants to apply for asylum from their home country, while expelling those who try to enter the U.S. unlawfully from Mexico. Migrants were only approved if they had a verified sponsor and were allowed to enter the U.S. by air. Border encounters have dropped significantly this year, which Biden officials credit to the new policy.

    Last month, the Biden administration announced a proposed rule that will bar some migrants from applying for asylum in the U.S. if they cross the border illegally or fail to first apply for safe harbor in another country. The proposal — which immigrant advocates refer to as the “transit ban” or the “asylum ban” — will take effect on May 11 and serve as its policy solution to the long-awaited end of Title 42, a pandemic-era restriction that lifts the same day.

    Lucknow: The Lucknow bench of Allahabad High Court has said that the Centre should take an appropriate decision to ban cow slaughter and declare it as a ‘protected national animal’.

    “We live in a secular country and must have respect for all religions. In Hinduism, the belief is that the cow is the representative of divine and natural beneficence. Therefore, it should be protected and venerated,” Justice Shamim Ahmad said while dismissing a plea seeking the quashing of criminal proceedings against a person under the Uttar Pradesh Prevention of Cow Slaughter Act, 1955.

    The petitioner, Mohammad Abdul Khaliq, had pleaded that the police booked him without any evidence and hence the proceedings pending against him in the court of additional chief judicial magistrate should be quashed.

    Dismissing the plea, the bench held that from the facts on record, prima facie case was made out against the petitioner.

    While passing the order, the judge observed, “The cow has also been associated with various deities, notably Lord Shiva (whose steed is Nandi, a bull) Lord Indra (closely associated with Kamadhenu), Lord Krishna (a shepherd in his youth), and goddesses in general.”

    He said, “According to legend, she emerged from the ocean of milk at the time of Samudramanthan (the great churning of the ocean by the gods and demons). She was presented to the seven sages and with time came into the custody of sage Vasishta.”

    The judge further said that a cow’s legs symbolise the four Vedas and her milk is four ‘purushartha’ (or human objectives — ‘dharma’ or righteousness, ‘artha’ or material wealth, ‘kama’ or desire and ‘moksha’ or salvation. ‘Her horns symbolise the gods, her face the sun and moon, and her shoulders ‘Agni’ (the god of fire).

    The cow has also been described in other forms: Nanda, Sunanda, Surabhi, Susheela and Sumana,’ Justice Ahmad said. He said that the origin of the veneration of the cow can be traced to the Vedic period.

    “The Indo-European peoples, who entered India in the second millennium BCE, were pastoralists. Cattle had a major economic significance that was reflected in their religion. The slaughter of milk-producing cows was increasingly prohibited. It is forbidden in the Mahabharata, and in the ‘Manusmriti’. A cow which produces milk was said to be ‘unslayable’ in the Rigveda, the court said.

    According to the high court bench, legends also state that Brahma gave life to priests and cows at the same time so that the priests could recite religious scriptures while cows could afford ghee as an offering in rituals.

    “Anyone who kills cows or allows others to kill them is deemed to rot in hell for as many years as there are hairs upon his body,” the judge said.

    New Delhi: The Supreme Court has said that it is the bounden duty of any State to ensure that the lives and properties of its citizens and other persons are at all times protected.

    It said that every attempt which succeeds at the hands of anyone “whereby the efficacy of criminal law is diluted, will remove the very edifice of the rule of law fatally”.

    A bench of Justices K M Joseph and B V Nagarathna made these observations while deciding a petition seeking to transfer a criminal case pending before a Jhajjar court in Haryana to a court in Delhi.

    The transfer petition has been filed by 38 people of Jhajjar, whose properties were allegedly vandalized during 2016 agitation by members of the Jat community who were seeking reservation in government jobs and educational institutions.

    It is the case of the petitioners that during this agitation, the members of Jat community vandalized and committed acts of arson which allegedly caused huge irreparable damage to them by setting their houses, godowns and other belongings on fire.

    The petitioners led by one Sunil Saini sought transfer of the case on the ground that due to an advocate who is alleged to be very influential and had remained President of the Bar, couple of material witnesses have been forced to turn hostile as well as material documentary evidence has not been placed on record.

    Counsel for the petitioners contended that they had an application under Section 319 of the CrPC to summon the said advocate and his son but their application was not countersigned by the public prosecutor of the case and therefore they had to knock at the door of this court to get their case transferred to another state so that interest of justice is sub-served.

    The bench, in its recent verdict in the matter, did not transfer the case on the ground that 42 witnesses have already been examined but said that the matter requires that some observations and directions be passed.

    “The State exists on the basis of implied consent of the Governed. The principal reason for people to come together under the organization of the State is the fundamental principle that the State will be in a position to always protect the lives and properties of the citizens. This is the fundamental unalterable premise for the creation, existence and preservation of any civilized State. It is all the more so, when the State is functioning under a written constitution which guarantees fundamental rights such as ours,” the bench said.

    The top court further said, “It is accordingly that rule of law is rightfully treated as part of the basic structure of the Constitution. It is the bounden duty of any State to ensure that the lives of its citizens and other persons are at all times protected. The same goes for their properties.”

    The bench added that this is the elementary function of the State but “we are not at this stage called upon to deal with the duties of the State with the mantle of a welfare State falling upon it. Even if this indispensable function to constitute a State is not performed, it would be a lamentable state of affairs”.

    It said that the principal mechanism for vindicating the rule of law and upholding the rights of the citizens is the judicial branch of the State.

    “One of the fundamental methods by which rule of law is preserved consists of sanctions of which the criminal law is the principal branch. The criminal courts must be allowed to function in a manner by which at the end of the day the guilty are punished and the innocent are exonerated,” it said.

    The top court further said that the role of the public prosecutor in all of this is paramount and he is duty bound to always act in a fair manner; not of course, to secure conviction by hook or crook but at the same time, it is his duty to fearlessly adduce evidence so that those who are guilty do not get away scot free.

    “Unless this is done, it is very likely that the common man will cease to have faith in the very functioning of the State itself. It is, therefore, integral to the upholding of the integrity of the State itself that the access to justice which is also comprehended in the principle that an offence is committed against the State and the State therefore prosecutes the offender is always borne in mind,” the bench said.

    The top court said that it is, therefore, of the utmost importance that in the case in hand, the Special Public Prosecutor who has been appointed will hopefully uphold the highest principles and play the difficult role so that while the innocent are not convicted, the guilty do not escape due punishment.

    The bench noted that the Special Public Prosecutor for the case has been appointed only recently and not being unmindful also of his credentials which have been brought to court’s notice, at this stage “we are not persuaded to direct that another person be appointed in his place. However, this is not to be the end of the destiny of this case”.

    It said that it will be open to the petitioners to approach the Director of Prosecution in case they believe that even the Special Public Prosecutor appointed is not discharging his duties in a fair and impartial manner.

    “It is thereupon for the Director (Prosecution) to look into the matter and take appropriate steps. As far as protection to the witness is concerned, it will be open to the petitioners to move the presiding Judge or Special Public Prosecutor or the Superintendent of Police of the concerned district seeking protection in which case needful shall be done in accordance with law,” the bench directed.

    Srinagar: PDP president Mehbooba Mufti on Saturday said the people of Jammu and Kashmir have now come to realise how Article 370 of the Constitution acted as a protective shield for them, after the BJP-led government used bulldozers to demolish houses and businesses of the poor.

    She also defended her father Mufti Mohammad Sayeed’s decision to join hands with the BJP to form the government in Jammu and Kashmir after the 2014 Assembly polls, saying the PDP patriarch had successfully “caged the beast”.

    “When Article 370 was abrogated, some people thought it would only affect the People’s Democratic Party (PDP) and the National Conference (NC). When the bulldozers came to demolish our homes, businesses and even the shelters for our domestic animals, people realised how Article 370 was a protection for us,” Mufti said at a function of her party here.

    Defending Sayeed’s decision to ally with the Bharatiya Janata Party (BJP) for government formation after the 2014 Assembly polls, the former Jammu and Kashmir chief minister said her father had caged the beast and stopped it from wreaking havoc.

    “No one understands that Mufti sahib had caged the beast. He had caged the BJP,” she said.

    Mufti said after winning three seats in the 2014 Lok Sabha polls, the PDP had expected to win 43 Assembly seats in Jammu and Kashmir, but won only 28, while the BJP bagged 25 seats in Jammu.

    “It took Mufti sahib three months (to form the government). We have been accused of bringing the BJP into Jammu and Kashmir but how would one stop them? They had the majority in Parliament, they won the majority in Jammu and also, two seats in Kupwara.

    “Mufti sahib grabbed the BJP’s hand so that he could stop them. For one year, Mufti sahib was the chief minister and I was the chief minister for two years. We implemented our agenda, the Jammu and Kashmir agenda,” she said.

    Mufti claimed that she would have continued to be the chief minister of Jammu and Kashmir even today had she followed the BJP’s line. “Since I did not, they pulled out of the government,” she said.
