  • Bombay HC Rejects Professor’s Plea To Quash FIR For “Aug 5 Black Day For JK” Status

    [ad_1]

SRINAGAR: The Bombay High Court has declined to dismiss a criminal case against a college professor from Kolhapur, who shared a message on his WhatsApp status that referred to the abrogation of Article 370 as “August 5 Black Day (for) Jammu and Kashmir.” The basis for the FIR was two WhatsApp statuses he posted, one stating “AUGUST 5 BLACK DAY JAMMU & KASHMIR” and the other saying “14th August Happy Independence Day, Pakistan.” The Central government revoked Article 370 of the Indian Constitution, which provided special status to Jammu and Kashmir, on August 5, 2019, reported The Hindustan Times.

“In our view, this message has the tendency to play with emotions of different groups of people as there are strong feelings of contrasting nature about the status of Jammu and Kashmir in India,” The Hindustan Times reported while quoting the bench of justice Sunil Shukre and justice MM Sathaye while rejecting plea filed by Javed Ahmad Hajam, a professor with Sanjay Ghodawat College in Kolhapur.

Hajam appealed to the High Court to dismiss the FIR filed against him by the Hatkanangale police station in Kolhapur district under Section 153-A of the Indian Penal Code, on charges of promoting enmity between different groups based on religion, race, place of birth, residence, language, caste, community, or any other grounds that could lead to disharmony or feelings of hatred or ill-will. The FIR was based on two WhatsApp statuses that he posted, one stating “AUGUST 5 BLACK DAY JAMMU & KASHMIR” and the other saying “14th August Happy Independence Day, Pakistan.” Hajam was a member of a parent-teachers association WhatsApp group at the college, and someone from the group reported the matter to the police.

Hajam argued that he did not share any derogatory message or any message with the intention of stirring up hatred or ill-will. He claimed that his status messages did not cause any disharmony or disturbance of public tranquillity. However, a prosecutor opposed his plea, stating that the petitioner, a college professor, expressed his likes and dislikes in a casual manner without providing any reason or justification, which could lead to an initial inference of an offense punishable under Section 153-A. The High Court agreed with the prosecutor’s argument and rejected Hajam’s petition.

The bench said in a democratic country like India, with a fundamental right of freedom of speech and expression available to its citizens, “every word of criticism and every view of dissent is important for maintaining democracy in a good state of health.”

The court stated that in sensitive matters, it is important to express critical words or dissenting views only after conducting a thorough analysis of the situation and providing reasons for the criticism or dissent. The bench added that this is particularly important when emotions and sentiments surrounding the thing or aspect being criticized vary greatly among different groups of people. In such cases, criticism or disagreement should be accompanied by in-depth analysis and reasons so that it appeals to reason rather than emotions.

“Whenever an appeal is to the reason, there is the least possibility of stirring up emotions and whenever an appeal is to the emotions, the reason is the casualty,” the bench said. “And, when reason falls victim to emotions, there results ill-will, hatred, public disturbance and negativity all around. Such is the importance of criticism based upon critical analysis and same being not here, now it would be required to be examined on merits; if the WhatsApp status message in question, really brought about the consequences contemplated under Section 153-A of the IPC or not, which would be possible only upon appreciation of evidence at the trial.”

HC said prima facie posting of the DP constituted an offence under section 153-A of IPC.

  • DU planning to give professors 5-year extension post retirement to boost research culture

DU planning to give professors 5-year extension post retirement to boost research culture

    [ad_1]

New Delhi: The Delhi University is paving the way to give professors and senior professors an extension of five years following retirement to promote research culture and re-employ research oriented academicians, a senior varsity official said on Tuesday.

At present, the retirement age of the faculty is 65 years and no extension was given to teachers.

The university has prepared a set of guidelines for the re-employment of “research-oriented academicians”.

    MS Education Academy

The official, however, stated that the guidelines will only apply to professors teaching at the varsity departments, centres, schools, and institutions, and are not applicable to colleges of the university.

The re-employed professors will hold the positions on a contract basis, he said.

The 14-point guidelines, prepared by a committee, will be presented during the upcoming meeting of the Executive Council (the highest decision-making body of the university) on April 10 for approval.

“The retirement age of academicians at the university is 65 years. However, the university wishes to bring provisions to give an extension of five years for professors. We are hopeful that the guidelines will be approved in the next meeting. This step will help in promoting a research culture and for the re-employment of research-oriented academicians,” the official said.

According to the guidelines, the application for the same should be submitted before the date of superannuation of the teacher. The application will be then placed before the screening committee for further processes.

The screening committee will have a chairperson nominated by the vice chancellor. Besides the chairperson, the panel will also have chairperson of the research council; Dean of Research; Dean of the faculty concerned; Dean of Academic Affairs; Head of the Department concerned, and Joint Registrar, as members.

The re-employed professor will not hold any administrative position and the financial power will be limited to him, the guidelines stated.

“The re-employment of a professor/senior professor shall be subject to the University’s clearance with respect to her/his conduct as a teacher, her/his disciplinary record as well as financial prudence,” the guidelines read.

“No teacher shall continue to remain in such re-employment after attaining the age of 70 years. The re-employed professor/senior professor shall be given an office in the department and if required shall share the laboratory with another faculty,” they added.

The re-employment will also be subject to the university’s clearance concerning his conduct as a teacher, his disciplinary record as well as financial prudence, mentioned the guidelines.

Meanwhile, a section of teachers has opposed these guidelines, saying it would give rise to favouritism culture.

“Moreover, they (the university) are trying to build a hierarchy system within the university guideline that would not be applicable for college teachers,” Rajesh Jha, a former Delhi University Executive Council member, said.

  • Salary-deprived professors of DU’s Maharaja Agrasen College polish shoes

Salary-deprived professors of DU’s Maharaja Agrasen College polish shoes

    [ad_1]

New Delhi: The professors of Maharaja Agrasen College affiliated to the Delhi University on Friday polished shoes on the footpath as a protest against the Arvind Kejriwal-led AAP government after not receiving their salaries for the last four months.

A large number of students also participated in the shoe-polishing demonstration.

The staff of Maharaja Agrasen college have been facing the problem of not receiving their salaries regularly.

The professors alleged that the ad hoc teachers at the college had not yet received the arrears of the Seventh Pay Commission.

Since the last three years, teachers had not received reimbursement of medical bills, payment of LTC facility and child education allowance.

Notably, 12 colleges affiliated to DU are fully funded by the Delhi government and all of them have been facing financial problems.

The professors said that there have been cases of shortfall and delay in receiving grants in these colleges in the last three years.

Professor PK Sharma said that the teachers and employees of Maharaja Agrasen College have not received their salaries since four months which has led to them facing financial problems, including inability to pay their children’s school fees and the loan EMIs.

Many staff and teachers faced the tragedy of family members falling ill during the pandemic and many cases of the staff seeking loans to perform the last rites of their deceased family members also came to light.

The professors of Maharaja Agrasen College faced the issue of not receiving their salaries in the pandemic too.

The teachers then took up the issue of irregular salaries with the principal of the college, the governing body of the college, the Delhi University Teachers Association (DUTA), the vice-chancellor of Delhi University, the Lieutenant Governor of Delhi and the Delhi government but to no avail as no permanent solution has been found so far.

In this situation, the teachers have now decided to agitate in new and innovative ways to ensure that the government takes concrete steps in the matter.

The teachers have demanded regular salary every month.

In the demonstration, the professors polished the footwear of the people and their students on the road outside the college and mobilised support.
