    SRINAGAR: A court in Srinagar has ordered “preliminary enquiry” into an application by a resident of Rambagh Srinagar, alleging defrauding of Rs 18 Lakh by three persons including Kiranbhai Patel who posed as a PMO official and enjoyed high security protocols prior to his arrested last month.

    “From the contents of application as well as from the material on record, it appears that the complainant has been cheated by the accused and on false pretensions has been made to pay amount of Rs 18 lakhs in two installments at Pratap Park Srinagar and Chai Jai Restaurant Srinagar,” court of City Judge Srinagar said.

    “In view of the nature of allegations leveled against the accused, it appears that cause of justice will be reserved if concerned police station is directed to conduct detailed P.E (preliminary enquiry) before formal investigation for veracity of the facts projected in the application,” the court said in an order, a copy of which lies with GNS, and directed the SHO of Police Station Kothibagh to conduct preliminary enquiry in the matter and submit detailed report before it by or before the next date on April 15. The two other persons named in the compliant include Shailesh Jain and Piyush Jain, both residents of Kolkata.

    According to the complaint filed through advocate Amir Masoodi, Patel revealed his name as Chetan Prakash resident of Begumpur, North West Delhi and projected himself as managing partner at the particular company dealing in areca nuts.

    The resident has alleged that he paid Rs.18 lakh in two instalments following the interactions with Patel at Pratap Park Srinagar and at the Chai Jai restaurant in Srinagar last year.

    Patel was arrested on March 2 for posing as a senior official in the Prime Minister’s Office. He had managed to get Z-category security protocol during his visits to the valley and attended several official meetings. Patel had also visited many sensitive areas, including the Line of Control in Uri sector.

    Pertinently, on March 29, the government ordered inquiry into the various aspects related to the visits of “Kiran Patel” who conned the security establishment in J&K into believing him to be a PMO official and enjoyed five star protocol “brazenly” for a considerable period of time prior to his arrest.

    The inquiry is being conducted by Divisional Commissioner Srinagar and he is required to submit a report within a week.

    New Delhi: The Supreme Court is scheduled to hear on Wednesday a plea filed by 14 parties, led by the Congress, alleging arbitrary use of central probe agencies against opposition leaders and seeking guidelines for the future.

    According to the list of businesses uploaded on the apex court website, the plea of opposition parties would be heard on April 5 by a three-judge bench headed by Chief Justice of India D Y Chandrachud.

    Justices P S Narasimha and J B Pardiwala are also part of the bench.

    The joint plea was mentioned for urgent hearing on March 24 by senior advocate Abhishek Singhvi.

    “I am asking for the guidelines for the future. This is a remarkable convergence of 14 parties against the misuse of the agencies, both CBI and ED,” Singhvi had said and claimed that 95 percent of cases of the Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED) are against the leaders of opposition parties.

    The senior lawyer referred to the rise in the number of cases filed by the CBI and ED after the NDA government came to power in 2014.

    “Second statistics, pre-2014 and post-2014: there is a humongous jump in cases. The rate of conviction is four to five percent. We are asking for pre-arrest guidelines and post-arrest bail guidelines,” Singhvi had said.

    The plea alleged there is an alarming rise in the use of coercive criminal processes against opposition political leaders and other citizens exercising their fundamental right to dissent.

    “Investigating agencies such as CBI and ED are being increasingly deployed in a selective and targeted manner with a view to completely crush political dissent and upend the fundamental premises of a representative democracy,” a statement issued on behalf of a petitioner alleged.

    The plea filed through lawyer Shadan Farasat cited some statistics and said they demonstrated a “shocking and unconstitutional state of affairs”.

    Besides the Congress, the parties that are part of the joint move are the DMK, RJD, BRS, Trinamool Congress, AAP, NCP, Shiv Sena (UBT), JMM, JD(U), CPI(M), CPI, Samajwadi Party, and the J&K National Conference, the statement said.

    Howrah: The situation in Howrah town, which witnessed clashes between two groups during a Ram Navami procession, is peaceful and under control on Saturday, even as prohibitory order was still in force in the affected area, a police officer said.

    Shops and markets opened as traffic movement started from the morning amid heavy deployment of police in Kazipara area.
    Taking over investigations into the clashes, CID sleuths collected samples and spoke to local people as well as police personnel who were deployed there during Thursday’s clash, the officer said.

    Prohibitory order under Section 144 of CrPC was still in force in Kazipara and Shibpur Police Station limits while Internet connections remained suspended.

    “Situation is under control and peaceful. Life is leaping back to normalcy. We are, however, continuing with the police deployment there to keep a check on the situation,” the officer told PTI.

    A CID officer said officers of the agency have started investigations into the case.

    “At the moment, we cannot reveal much about the probe as it is in a preliminary stage,” the CID officer said.

    Meanwhile, police continued with raids throughout the intervening Friday-Saturday night and nabbed a few more people for their alleged involvement in the vandalism.

    Nearly 50 people were arrested in connection with the clashes.

    “We will be verifying their involvement with video footage we have from the spot on that day. If found guilty they will be treated as per the law,” he added.

    On Thursday evening, clashes broke out between two groups when a Ram Navami procession was passing through Kazipara in Howrah town.

    Several shops were ransacked during the violence while a number of cars including a few belonging to the police were set on fire.
    In renewed unrest, police personnel deployed in the area were pelted with stones on Friday afternoon following which prohibitory orders were imposed in the area and internet services were suspended.

    West Bengal Chief Minister Mamata Banerjee on Friday alleged that the BJP and other right-wing organisations were behind the violence.

    The saffron party denied the allegations and demanded an NIA probe into the matter.

    Governor C V Ananda Bose and the chief minister discussed the issue.

    A press statement from Raj Bhavan said Governor Bose asked the state government to “ensure foolproof arrangements to maintain law and order effectively” besides action to be taken “against miscreants.”

    Union Home Minister Amit Shah on Friday spoke to Bose on the violence in Howrah and took stock of the situation.
    Shah also spoke to BJP state president Sukanta Majumdar in this connection.

    Nagpur: Nationalist Congress Party (NCP) chief Sharad Pawar on Saturday put his weight behind the Supreme Court constituted 6-member committee, appointed by the Chief Justice of India to probe the alleged stock manipulation issue by the Adani Group, saying it would be more effective than the Joint Parliamentary Committee, (JPC) demanded by the Congress-led Opposition.

    Justifying his stand, Pawar said: “It is a common sense that the JPC will have more members from the ruling party (BJP) since it has an overwhelming majority in Parliament. Hence, in terms of effect, the JPC would not be a balanced panel as against the Supreme Court appointed committee which has independent experts.”

    On the controversy around Veer Savarkar, he said “at this juncture, it is not a national issue”.

    “Moreover, late Savarkar was more science-oriented with progressive thoughts. He built a temple in which he appointed a Dalit as a priest in Ratnagiri,” he said, adding Savarkar also had a scientific stance on the cow slaughter issue.

    Refusing to comment on clashes that took place at Sambhajinagar (Aurangabad) in Maharashtra on the occasion of Ram Navami, he said “it would not be proper to debate on the matter, and now, the priority should be to establish normalcy there”.

    Asked about the possibility of simultaneous elections to the Lok Sabha along with the Maharashtra Assembly in 2024, the former Union Minister said “there was no basis for such speculations”.

    On the Opposition unity, he said that all non-BJP parties held a meeting recently and are likely to meet soon to speed up a joint alliance against the ruling BJP for the next general elections.

    Pawar said another meeting is being convened within the next 10 to 12 days as per the convenience of other political parties to chalk out a strategy for the 2024 elections.

    Swiss prosecutors have opened an investigation into possible illegal activity in connection with government support for UBS’s rushed takeover of Credit Suisse.

    The two banks agreed to merge in March as part of an emergency deal targeted at avoiding a national financial crisis that could have had a knock-on effect globally.

    “The Federal Prosecutor’s office wants to proactively fulfill its mission and responsibility to contribute to a clean Swiss financial center and has set up monitoring in order to take immediate action in any situation that falls within its field of activity,” the authority said in a statement.

    Last month, Zurich-based UBS was forced by Swiss authorities to take over its longtime domestic rival Credit Suisse in a deal that creates a new bank.

    The prosecutor’s statement said that the intention of the probe was to “analyze and identify any criminal offenses” associated with the deal, adding that various bodies had been contacted to provide clarifications and information.

    The deal has been unpopular locally and on Sunday, Swiss daily Tages-Anzeiger reported that the new entity could slash jobs by up to 30 percent.

    “If we had done nothing, [Credit Suisse] shares would have been worthless on Monday and the shareholders would have gone home empty-handed,” Swiss Finance Minister Karin Keller-Sutter said last weekend in justifying the deal.

    Thane: Maharashtra Congress president Nana Patole on Friday alleged that the Adani group has invested Rs 20,000 crore through shell companies and asked if Prime Minister Narendra Modi will show “courage” to probe it.

    He was speaking to reporters here after taking part in a demonstration against the Bharatiya Janata Party-led Centre.

    Patole said the Modi government has in the past nine years made “arrangements for his friends to grab public money”. The senior Congress leader said several government contracts have been given to companies of businessman Gautam Adani.

    Patole claimed that the Adani group has invested Rs 20,000 crore through shell companies. “Where did this money come from? The same question has also been raised by Rahul Gandhi. Will Prime Minister Narendra Modi show the courage to inquire into this?” he asked.

    The Congress has been demanding a Joint Parliamentary Committee (JPC) probe after US short-seller Hindenberg Research in January accused the Adani Group firms of “brazen stock manipulation and accounting fraud” and using a number of offshore shell companies to inflate stock prices. Adani Group has rejected the allegations.

    The Congress has stepped up its attack on the Centre after Rahul Gandhi was disqualifed as a Lok Sabha member following his conviction by a Surat court in a 2019 criminal defamation case.

    Thane city District Congress president Vikrant Chavan was among those who took part in the demonstration.

    Kolkata: As tension over clashes in West Bengal’s Howrah district over a Ram Navami procession continued on Friday, a Public Interest Litigation (PIL) was filed at the Calcutta High Court seeking a CBI probe into the matter.

    The clashes which were mainly at Sandhyabazar area of Shibpur in Howrah district on Thursday, spread to adjacent Kazipara area this morning. A group of people started pelting stones towards the high-rises in the area. A couple of vehicles were vandalised and torched.

    Even the vehicle of the state cooperation minister Arup Roy, which was passing through the area then, was not spared. The window-screen of the vehicle was totally smashed. However, the minister was not present in the vehicle.

    Finally, a huge contingent of police force, accompanied by the personnel of the Rapid Action Force (RAF), reached the spot. They resorted to massive lathicharge to bring the unruly mob under control. Some of the policemen also suffered injuries in the clashes. Till the filing of the report, the total number of arrests in this connection was 36. Though the situation has been brought under control, tension prevails in these pockets.

    Chief Minister Mamata Banerjee gave a strong message and said that her administration will not tolerate such rowdy activities. “I have asked the police to take strong action,” she said. Admitting that there had been complaints of inaction or delayed action by police, the chief minister said that these complaints will also be looked into. At the same time, she claimed that Thursday’s clashes mainly happened because of the last moment change in route of the procession.

    On Friday, Leader of Opposition in state Assembly Suvendu Adhikari filed a PIL at the division bench of Calcutta High Court’s Acting Chief Justice T.S. Sivagnanam and Justice Hiranmay Bhattacharyya, seeking a CBI probe in Thursday’s clashes.

    The PIL has been admitted and the hearing in the matter will be on April 3. Besides seeking a CBI probe in the matter, the leader of the Opposition had also sought deployment of central armed forces in the troubled pockets on this count.

    In the PIL he also claimed that the deployment of central armed forces had been necessary as the state police had failed miserably to bring the situation under control.

    The investigation is in the early stages, said the people, who were granted anonymity to discuss a confidential matter. FTC investigations can stretch on for years and are often closed without the agency taking any action. Any case would have to be brought either in federal court or the FTC’s in-house administrative court, and, if successful, the agency could get an order prohibiting the offending business practices.

    The FTC recently opened a similar investigation into Pepsi and Coca-Cola involving pricing in the soft drink market.

    The FTC declined to comment. Southern Glazer did not respond for comment.

    The alcohol investigation is yet another sign that the Biden administration is expanding its efforts to rein in big companies and flex its antitrust powers, in the technology world and beyond. That includes the world’s biggest tech firms, such as Apple and Google, and more traditional companies like Southern Glazer.

    According to a December 2022 Forbes report, Southern Glazer is the 11th largest privately held company in the U.S., with around $25 billion in revenue and distributing over 7,000 different brands of alcohol, wine, beer and other beverages. Republic National Distributing Company, the second largest alcohol distributor, which is not known to be a target in the probe, had 2022 revenues of around $12 billion, according to Forbes. Combined, the two companies account for the bulk of U.S. alcoholic beverage distribution.

    The Robinson-Patman Act, aimed at promoting a level playing field between small retailers and large chain stores, has been largely dormant for more than 20 years.

    The law was enforced regularly for decades by the FTC, then all but abandoned more than 20 years ago. The agency’s last case under the law was a settlement with spice company McCormick. Prior to that its most recent case was from 1988 against book publishers including Simon & Schuster and Random House. The move away from Robinson-Patman enforcement came amid increasing focus at the FTC and Justice Department on harm to consumers, namely higher prices, rather than harm to competitors.

    The FTC however wants to revive enforcement. The agency’s chair, Lina Khan, as well as Democratic commissioner Alvaro Bedoya, have, since they joined the agency, stated their intention to bring more cases under the law.

    The FTC has “been looking closely at the Robinson-Patman Act,” Khan said at an event on Monday. “We’re looking closely at areas where we might be able to do that in short order.”

    President Biden, in his 2021 executive order on competition policy, specifically called out the need to stop “unlawful trade practices in the beer, wine, and spirits markets, such as certain exclusionary, discriminatory, or anti-competitive distribution practices, that hinder smaller and independent businesses or new entrants from distributing their products.”

    In its investigation, the FTC is seeking detailed sales data on thousands of brands of alcohol and wine sold around the U.S. by both Southern Glazer and its competing distributors, according to the people. The probe includes questions about pricing and benefits Southern Glazer offers to retailers including quantity-based discounts, rebates, promotions, as well as marketing, warehousing, merchandising and other services.

    The agency is also asking about the competitive dynamics in the retail market for wine and alcohol and how Southern Glazer allocates wine and alcohol between different retailers, including whether and how it limits distribution to certain customers, the people said.

    Jammu: The Jammu and Kashmir government on Wednesday ordered a probe into the visits of conman Kiran Patel — who used to pose as a ‘PMO official’, to the union territory, an official said.

    An order issued by the Home Department appointed Vijay Kumar Bidhuri, divisional commissioner (Kashmir) as the inquiry officer who has been asked to submit his report within a week’s time.

    The order reads: “Sanction is hereby accorded to the appointment of Vijay Kumar Bidhuri as Inquiry Officer to inquire into the various aspects related to the visits of Kiran Patel to Kashmir during the past months and security arrangements made thereof.

    “The Inquiry Officer shall identify the lapses on the part of the Officers/ Officials concerned and submit a detailed report within one week,” the order read.

    Kiran Patel was on his third visit to the Kashmir Valley when he was arrested by police from a 5-star hotel in Srinagar on March 2.

    The police have told the court: “He has prima facie forged and manufactured some documents including some visiting cards on the basis of which he has defrauded not only a single or group of person but extremely elevated class of the society, including high officials of the civil administration and police authorities.

    “He succeeded in getting Z Category Security, bullet proof vehicle and enjoyed five-star protocol brazenly for a considerable period of time.

    “The documents, visiting cards and cell phone of the accused person have been sent for FSL examination, on the basis of which the alleged crime has been commuted, however the FSL examination report has not been received by the investigating agency,” the police said.

    The report also said that investigation conducted so far has suggested that the accused has visited most sensitive locations and areas of the Kashmir Valley, which are highly protected and extremely sensitive as far as the present security scenario of Kashmir is concerned.

    “This aspect of the matter has necessarily to be probed thoroughly by the investigating machinery as to how and with what motive and object the accused visited these locations and areas.

    “There is enough material available on the file, suggestive of the fact that while meeting different and variety of people and conducting meeting with highly elevated officials of civil administration and police, the accused may have received hefty amount for different purpose which areas seem not to have been investigated so far.

    “Further no recoveries have been made by the investigating agency so far, hence a detailed and thorough investigating is also required to be conducted as far as this area of the matter is concerned.

    “Meticulous and careful perusal of case diary file and material available on record reflects that during this all period some more persons have remained closely connected with the accused person whose nexus with the accused person requires proper investigation,” the police report said.
