Excise policy scam: Delhi court to hear Sisodia’s bail plea today

    [ad_1]

Delhi: A Delhi court is to hear on Friday the bail application of Aam Aadmi Party (AAP) leader and former deputy Chief Minister Manish Sisodia in connection with the now-scrapped excise policy case.

He was arrested by the Central Bureau of Investigation (CBI) on February 26 after quizzing him for several hours.

Special CBI Judge M.K. Nagpal of the Rouse Avenue Courts sent Sisodia to 14 days of judicial custody on March 6.

The CBI was given his remand for seven days before the judge sent him to judicial custody till March 20.

The judge had directed the CBI to file its response to the accused’s bail application by Friday.

It has been claimed by the accused that he had fully cooperated with the central agency during the probe.

He has stated that as all the recoveries have already been made, no fruitful purpose would be served by keeping him in custody and that the other accused persons arrested in this case have already been granted bail.

He has pointed out that he has held an important constitutional post and has deep roots in the society.

However, during the last hearing, the counsel appearing for the central agency said that at this stage, they are not seeking further CBI remand but in the next 15 days they might seek it.

In a twist, the Enforcement Directorate (ED) also arrested Sisodia on Thursday in the same case.

The ED, on the eve of his bail hearing, questioned him in connection with the alleged kickbacks of Rs 100 crore which the AAP party/leaders received through hawala channel from the south group.

He was also asked about Arun Pillai and K. Kavitha, daughter of Telangana Chief Minister K. Chandrasekhar Rao.

  • ‘I will cooperate fully’, says Kavitha on Delhi liquor policy

‘I will cooperate fully’, says Kavitha on Delhi liquor policy

    [ad_1]

New Delhi: Bharat Rashtra Samithi (BRS) MLC and Telangana chief minister K Chandrashekar Rao’s daughter K Kavitha, who has been called for questioning by the Enforcement Directorate (ED) in the alleged liquor scam on March 11, assured of cooperating fully with the agency and said she will answer all the questions, adding that “if things go out of hand, then the courts shall be approached”.

While talking to ANI, Kavitha said, “I am ready to give all answers. The truth shall remain the truth. I am not related to this liquor policy. A lot of businessmen from Hyderabad have come here and invested. So they want that somehow my name is dragged into it.”

The Central investigation agencies have alleged that Kavitha benefited from the kickbacks in the now withdrawn liquor policy of Delhi, in which Aam Aadmi Party leader Manish Sisodia has been arrested.

Reiterating her stance on the agencies functioning in the country, she said, “I will cooperate with all institutions, but there is no legitimacy and transparency in these agencies, be it CBI, ED or others. They are no more independent. In the last 10 years, the attacks on the opposition have proved it. The agencies are biased.”

“I will cooperate fully and answer all the questions but if things go out of hand, then the courts shall be approached,” she added.

Kavitha launched a scathing attack on Bharatiya Janta Party (BJP) and said that the opposition in the country is “oppressed” and “harassed” by the BJP for raising their voices.

Addressing a press conference ahead of her protest and ED visit, she said, “The double engine sarkar which actually stands for “Pradhani and Adani Sarkar,” works in the interests of only a few, and therefore the opposition is oppressed and harassed for raising their voices.”

In a statement, she said she will appear before the agency on March 11. “You can be assured of my full cooperation in the matter,” she said.

DK Aruna, BJP National vice President said, “Wherever there is corruption ED goes not PM Modi, they are scared of Modi as he said in 2014 before forming the government itself that they will not spare corruption. The investigation agencies are doing their job, wherever there is a complaint. What is the role of the BJP in this? “

Condemning Manish Sisodia’s arrest, the BRS MLC said, “I do not wish to comment on this. The behaviour of the agencies is absolutely unconstitutional. There was manhandling and we condemn the arrest. The arrest has been condemned by our party as well.”

“People should have faith that if a white colour crime is committed then the ED can be trusted. However, the people have lost faith after the actions of the ED. It is unfortunate that Mr Sisodia is arrested.”

The ED and the CBI had alleged that irregularities were committed while modifying the Excise Policy, undue favours were extended to licence holders, the licence fee was waived or reduced and the L-1 licence was extended without the competent authority’s approval. The beneficiaries diverted “illegal” gains to the accused officials and made false entries in their books of account to evade detection.

As per the allegations, the Excise Department had decided to refund the Earnest Money Deposit of about Rs 30 crore to a successful tenderer against the set rules. Even though there was no enabling provision, a waiver on tendered licence fees was allowed from December 28, 2021, to January 27, 2022, due to COVID-19.

This allegedly caused a loss of Rs 144.36 crore to the exchequer, which has been instituted on a reference from the Union Home Ministry following a recommendation from Delhi Lieutenant-Governor Vinai Kumar Saxena.

Sisodia was arrested by the CBI on February 26 in an ongoing investigation of a case related to alleged irregularities in the framing and implementation of the excise policy of the National Capital Territory of Delhi (GNCTD).

The Special Judge MK Nagpal on March 6 remanded Sisodia to 14 days in judicial custody after noting that expiry of CBI custody in the case noting that the probe didn’t demand further custody of him at this time, but it may be sought later if required.

Meanwhile, Kavitha said that a hunger strike will be held in the national capital on March 10 and that 18 political parties have said that they will participate in the protest launched to seek introduction of the Women’s Reservation Bill in the current session of Parliament.

Elaborating about the strike, Kavitha said, “The strike will start from 10 am and go on till 4 pm. Approximately 18 parties will join tomorrow. We expect the parties to keep their viewpoints. We will try and build up pressure on the government. We have also invited the Congress.”

“We have the complete list of the parties coming. I can share it. Yechury ji will start the fast. Priyanka Chaturvedi from Shiv Sena shall also join us. Apart from this, there will be several women’s organisations that have worked on this bill,” she added.

Urging that the larger political interest should be kept aside in the matter, she said, “Women make up 50 per cent of the country’s population and I have picked up their issue. The views of different parties on the matter are important.”

“This is an important and historical opportunity. The BJP has the majority, they can easily pass the bill,” she added.

MLC Kavitha requested Prime Minister Narendra Modi and President Murmu to make the Women’s Reservation Bill a reality with 33 per cent reservation since the BJP still has sessions left before the completion of its term.

Walgreens, the nation’s second-largest pharmacy chain and owner of New York-based Duane Reade, confirmed last week that it would not dispense abortion pills either by mail or at brick-and-mortar locations in several states where they remain legal.

The company announced the decision after nearly two dozen Republican state attorneys general threatened legal action if it began distributing the drugs, which have become the most popular method of ending a pregnancy in the U.S.

“We urge you not to allow these tactics to intimidate you, and to commit to making this critical medication available as widely as possible, based on a fair and unbiased interpretation of state and federal law,” Hochul and James wrote in their letter to the pharmacy executives.

California Gov. Gavin Newsom said Wednesday that the state would not renew a $54 million contract with Walgreens in response to the company’s decision. A renewal of the contract, under which Walgreens provides medications to California inmates, was scheduled to take effect May 1.

New York state does not appear to have any active contracts with Walgreens, according to a review of records with the state comptroller’s office.

The FDA announced in January that it would allow retail pharmacies to dispense the abortion pill mifepristone to pregnant people with a prescription, following the release of new data on the drugs’ safety and efficacy. Before then, patients had to get the medication directly from a doctor.

Under the new policy, pharmacies must obtain certification to dispense the medication. Walgreens has said it is working on getting certified in some states, which the company declined to name, but is not yet distributing the pills anywhere.

  • BBC faces celebrity revolt, political pressure amid Gary Lineker dispute

BBC faces celebrity revolt, political pressure amid Gary Lineker dispute

    [ad_1]

Press play to listen to this article

    Voiced by artificial intelligence.

The BBC faces a spiraling revolt by its top sporting presenters amid a row over the broadcaster’s impartiality standards, after star football host Gary Lineker was chastised for tweets criticizing the U.K. government’s new asylum policies.

Calls of hypocrisy were also leveled at the U.K. broadcaster on Saturday, as Labour leader Keir Starmer accused the BBC of “caving in” to the demands of Conservative Party members.

The broadcaster’s sporting coverage was plunged into uncertainty due to a boycott from a group of hosts and co-hosts who disagreed with the BBC for attempting to penalize “Match of the Day” presenter Lineker for his recent comments against what he called the government’s “immeasurably cruel policy” on immigration. He has been told to “step back” from his BBC presenting duties.

In a March 7 tweet, the ex-England international footballer compared the U.K. government’s new policy on illegal migrants with the language of Nazi Germany, prompting a backlash from Conservative MPs and members of the government. The BBC says the tweet violated its impartiality standards.

The U.K.’s new asylum policy would block undocumented migrants from entering the country on small vessels. The bill has been condemned by the United Nations, which said it amounts to an “asylum ban.”

“Match of the Day” — a flagship BBC football show for Premier League fans — found itself without regulars Ian Wright, Alan Shearer, Jermaine Jenas, Micah Richards and Jermain Defoe, who all pledged to stand by Lineker in the dispute. The BBC said “Match of the Day” would be aired Saturday without presenters or pundits.

Popular broadcasts “Football Focus” and “Final Score” have also been deleted from the BBC’s schedule this weekend, after Alex Scott, Kelly Somers and Jason Mohammad all backed Lineker’s corner. BBC Radio 5 Live’s football build-up transmission was ditched minutes before airing, as other leading hosts and pundits joined forces against the broadcaster’s disciplining of Lineker.

BBC Director General Tim Davie apologised for the disruptions and said “we are working very hard to resolve the situation.” In an interview with BBC News late Saturday, Davie said “success for me is getting Gary back on air.” Davie said he would “absolutely not” be resigning over the row.

The BBC boss said he was prepared to review impartiality rules for freelance staff like Lineker.

In an earlier statement, the BBC said it considers Lineker’s “recent social media activity to be a breach of our guidelines.”

“The BBC has decided that he will step back from presenting Match of the Day until we’ve got an agreed and clear position on his use of social media,” according to the statement.

A five-year contract that Lineker signed in 2020 includes guarantees to adhere to the BBC’s impartiality code. He is on a reported £1.35 million-a-year salary.

Labour’s Starmer accused the BBC of pandering to the demands of the Conservative Party on Saturday.

“The BBC is not acting impartially by caving in to Tory MPs who are complaining about Gary Lineker,” Starmer told broadcasters at Welsh Labour’s conference in Llandudno, Wales. “They got this one badly wrong and now they’re very, very exposed.”

Conservative MP Nadine Dorries tweeted on Friday that Lineker needs to decide whether he is “a footie presenter or a member of the Labour Party.”

Prime Minister Rishi Sunak defended the government’s asylum policy in a statement on Saturday and said the impartiality dispute is for the broadcaster and the presenter to sort out.

“I hope that the current situation between Gary Lineker and the BBC can be resolved in a timely manner, but it is rightly a matter for them, not the government,” Sunak said in the statement.

Liverpool football club manager Jürgen Klopp backed Lineker when asked about the controversy on Saturday.

“I cannot see why you would ask someone to step back for saying that,” Klopp said. “Everybody wants to be so concerned about doing things in the right manner, saying the right stuff. If you don’t do that then you create a shitstorm, it is a really difficult world to live in,” he said.

“If I understand it right, it is a message, an opinion about human rights and that should be possible to say,” Klopp said.

The links between the BBC and the U.K.’s governing Conservative Party run deep. The corporation’s chairman, Richard Sharp, was previously outed as having facilitated an £800,000 loan for Boris Johnson, the former U.K. prime minister. On Saturday, Liberal Democrat leader Ed Davey called for Sharp to resign.

The communications officer for former Conservative Prime Minister Theresa May — Robbie Gibb — has sat on the BBC board as a non-executive director since 2021. Current BBC Director General Tim Davie previously stood as a councilor for the Conservative Party in Hammersmith, a London constituency.

Kavitha to be questioned in Delhi liquor policy case tomorrow

    [ad_1]

New Delhi: In a major development in the ongoing investigation in the Delhi Excise Policy 2021-22 alleged money laundering case, the Enforcement Directorate (ED) has summoned Bharatiya Rashtriya Samiti (BRS) MLC and Telangana Chief Minister K Chandrashekhar Rao’s daughter K Kavitha for questioning on Thursday, sources said.

The summons comes close on the heels of former Deputy Chief Minister of Delhi and senior Aam Aadmi Party leader Manish Sisodia’s arrest by the Central Bureau of Investigation in the case.

Kavitha was questioned by the CBI in December last year.

Sisodia was arrested on February 26 in an ongoing investigation of a case related to alleged irregularities in the framing and implementation of the excise policy of the National Capital Territory of Delhi (GNCTD). Delhi’s Rouse Avenue Court sent him to Judicial Custody till March 20.

ED, last year filed its first chargesheet in the case. The agency said it has so far undertaken nearly 200 search operations in this case after filing FIR after taking cognisance of a CBI case which was registered on the recommendation of the Delhi lieutenant governor.

The CBI inquiry was recommended on the findings of the Delhi chief secretary’s report filed in July showing prima facie violations of the GNCTD Act 1991, Transaction of Business Rules (ToBR)-1993, Delhi Excise Act-2009, and Delhi Excise Rules-2010, officials had said.

In October, the ED had raided nearly three dozen locations in Delhi and Punjab following the arrest of Sameer Mahendru, Managing Director of Delhi’s Jor Bagh-based liquor distributor Indospirit Group, in the case and arrested him later.

The CBI too filed its first charge sheet in the case early this week.

ED makes 11th arrest in Delhi excise policy scam

    [ad_1]

Delhi: In the latest development in connection with the Delhi excise policy scam, the Enforcement Directorate (ED) on Tuesday arrested Arun Pillai. This is the 11th arrest made by the ED in the case.

Pillai was representing the South Group, which allegedly gave kickbacks of Rs 100 crore to the AAP leaders that were allegedly used in the Goa elections.

The South Group was represented by Abhishek Boinpally, Arun Pillai and Buchi Babu. Boinpalli facilitated the transfer of Rs 100 crore kickback in connivance and conspiracy with Vijay Nair (Aam Aadmi Party’s communication in-charge) and his associate, Dinesh Arora.

A land parcel worth Rs 2.25 crore in Vattinagulapalle, Hyderabad, owned by Pillai was recently attached by the ED.

Pillai will be produced before Rouse Avenue District Courts later in the day. The ED is likely to seek his two weeks custodial remand.

On March 2, liquor businessman Amandeep Dhal, the director of Brindco Sales Pvt Ltd was arrested by the ED. His questioning led to the arrest of Pillai, said sources.

Dhal allegedly played a major role in the formulation, conspiracy and kickbacks paid by the south group. He had got a draft copy of the liquor policy before it was released. Dhal allegedly shared the draft copy with Binoy Babu. The ED has also alleged that he made arrangements of meeting between South Grop persons and Vijay Nair.

The ED has claimed in the supplementary charge sheet that Vijay Nair, on behalf of leaders of the AAP received kickbacks to the tune of Rs 100 crore from the South Group, whose prominent faces are Magunta Srinivasulu Reddy, Raghav Magunta, Sarath Reddy and K. Kavitha, the daughter of Telangana Chief Minister K, Chandrasekhar Rao.

  • Centre for Policy Research’s FCRA licence suspension & Adani: Is there a connection?

Centre for Policy Research’s FCRA licence suspension & Adani: Is there a connection?

    [ad_1]

On February 27, the Ministry of Home Affairs suspended the Centre for Policy Research (CPR)’s FCRA licence for a period of 180 days for allegedly violating funding norms. It is believed that CPR’s funding of a few NGOs violated FCRA rules. An official, who spoke to the Indian Express said that an inquiry is going on and a decision will be taken within six months.

The suspension preceded Income Tax department surveys at various CPR offices in Maharashtra, Madhya Pradesh, Chhattisgarh, Uttarakhand, Uttar Pradesh, Haryana, Gujarat and Delhi.

The surveys were conducted in September last year, Indian Express reported. An official was quoted saying, “Some of these searches against political parties are linked to each other across states and some searches have no link to each other. The tax authorities are conducting searches across 100-plus locations and follow-up action and probe will continue in the coming days also.”

Followed by the surveys, the IT department on December 22, 2022, gave a show-cause notice to CPR alleging that it was in violation of being involved in activities which were “not in accordance with the objects and the conditions subject to which it was registered”.

A recent report by The Wire connected the dots that started from the September raids to the recent FCRA suspension.

The IT show-cause notice had accused CPR of funding an NGO called Jana Abhivyakti Samajik Vikas Sanstha (JASVS). The trustee of JASVS Alok Shukla was summoned by the IT department and recovered WhatsApp and Signal messages from his phone.

Shukla is also the convenor of Hasdeo Bachao Andolan and a known face of the Adivasi-led protests. “The JASVS has a consultancy agreement with CPR over non-compliance of environmental laws and related research. We published reports in pursuance of the agreement. Our consultancy work has nothing to do with the Hasdeo movement,” Alok Shukla told The Wire.

    Allegations on CPR

According to the CPR website, it is a non-profit, non-partisan, independent institution dedicated to conducting research that contributes to high-quality scholarship, better policies, and a more robust public discourse about the issues that impact life in India.

The Wire, in its report, found out the CPR and JASVS entered into an agreement in 2015 which was extended over time. The two organisations jointly produced six environmental reports, five of which focussed on Chhattisgarh.

Hasdeo Arand stretches across the Surguja, Korba and Raigarh districts of Chhattisgarh and is a fragile biodiversity zone and a natural habitat for elephants. It is also considered as India’s richest coalfield where the Adani group has nine coal blocks.

However, mining is yet to begin in some owing to the persistent protests by the Adivasi community and forest activists.

The IT department show-cause notice accuses CPR’s funding to JASVS “is not in pursuance of its approved objectives”.

Rejecting this, CPR shot back a public statement saying they have nothing to hide. “We are routinely scrutinised and audited by government authorities, including the Comptroller and Auditor General of India. There is no question of having undertaken any activity that is beyond our objects of association and compliance mandated with law,” the statement read.

    The beginning

During the UPA government, coal block contracts were given to both private and government-owned companies at undisclosed rates. These contracts are called Mine Developer and Operator (MDO) contracts.

This “arrangement of coal allocation” popularly known as “Coalgate” led the UPA government into hot waters. A public interest litigation was filed at the Supreme Court of India which reversed the allotment of 204 coal blocks in 2014.

It was also the year that the Narendra Modi-led Central Government was formed. He had promised to eradicate corruption from the coal mining industry.

A recent investigative report by the Reporters’ Collective published by Al Jazeera accuses the Modi government to help Adani become the richest coal mining private company by creating a bypass route.

SC’s order meant all coal block allocations to various state government companies as well as MDO contracts with private companies were cancelled.

Adani’s rise in coal mining industry

Once the Modi government came to power and all 204 coal block contracts were cancelled, the Centre promised a transparent method. In 2015, the then-home minister Rajnath Singh said, “We are focusing on bringing transparency in the allocation of natural resources including coal blocks. We have been able to rebuild confidence and trust that is extremely important to revive investments and drive higher growth.”

However, according to the investigative report, this was half the truth.

“The government had left open a window of discretion in the regulations. It could choose which ones to auction and which ones to allocate to states. What the Supreme Court had termed illegal, Modi’s government gave legislative backing and empowered itself to make discretionary allocations yet again to state government-owned companies,” the investigative report stated.

And thus, with this the Centre was able to grant all nine blocks to the Adani Group, making it the richest coal mining company in the country.

    Adani-Hasdeo conflict

Hasdeo Arand stretches across the Surguja, Korba and Raigarh districts of Chhattisgarh and is a fragile biodiversity zone and a natural habitat for elephants. It is also considered as India’s richest coal field.

As mentioned above, the Adani group has nine coal blocks in the zone. However, mining is yet to begin in some owing to the presistant protests by the Adivasi community and forest activists.

Interestingly, the nine blocks were initially allotted to various state governments.

While Rajasthan Vidyut Utpadan Nigam is the owner of Parsa East & Kete Basan, Parsa and Kete Extension coal blocks in Surguja district, Gare Pelma III block in Raigarh district and Gidhmuri Paturia block in Korba district is owned by the Chhattisgarh government.

The Gare Pelma Sector II is owned by the Maharashtra government and Gare Pelma I belongs to the Gujarat government.

However, over the years, the Adani Group won the tender of all blocks.

According to advocate Sudeep Srivastava, the Adani Group is currently the country’s largest coal mine developer and operator (MDO) that can produce 3,000 million tonnes of coal. The coal generated from these mines is sold to various government companies as well as to the Adani Group’s own power plants.

Srivastava has been helping the Adivasi community who are up against arms with the Adani Group as they believe it is robbing them of their natural habitat.

“Awarding such a large number of coal blocks to a single entity monopolises the entire coal and power production market,” he told The Wire.

According to Srivastava, an aim of a coal policy is to provide cheap coal to PSU [Public Sector Unit] so that they can produce electricity at cheap rates, thus benefitting its customer. “But it gets defeated under the MDO model,” the advocate said.

Hasdeo Arand forest is home to many Adivasi communities. Nearly 90 percent of them survive on agriculture and forest produce.

The Adani Group has been clearing the forest areas for its mining opportunities. This displacement due to mining will lead to loss of livelihood, identity and culture, a 2021 biodiversity study conducted by ICFRE and the Wildlife Institute of India noted.

“I have been working in Chhattisgarh for marginalised communities for over two decades. I often coordinate among affected people and lawyers for Hasdeo and other movements. But I am also a researcher. The JASVS agreement with CPR is reflective of my research work. The output is in the public domain in the form of research publications. CPR has absolutely no role to play in the Hasdeo movement,” says Alok Shukla.

  • Excise Policy Case: Manish Sisodia moves bail plea in trial court

Excise Policy Case: Manish Sisodia moves bail plea in trial court

    [ad_1]

New Delhi: Former Delhi Minister and Aam Aadmi Party (AAP) leader Manish Sisodia, who is presently in CBI remand, moved a regular bail petition in a trial court on Friday.

Sisodia was recently arrested by the Central Bureau of Investigation (CBI) for alleged irregularities in the framing and implementation of the excise policy of GNCTD.

According to the lawyer concerned, hearing on the bail plea will be held on Saturday. Sisodia is also scheduled to be produced on Saturday at the end of his remand period granted on February 27, 2023.

Rouse Avenue Court on Monday while sending Sisodia to CBI remand directed that the interrogation of the accused during the remand period shall be conducted at some place having CCTV coverage in accordance with guidelines laid down by the Supreme Court and the said footage shall be preserved by the CBI.

Special Judge MK Nagpal on February 27, 2023, decided to send Manish Sisodia to CBI remand till March 4, 2023. Sisodia was arrested on Sunday in an ongoing investigation of a case related to alleged irregularities in the framing and implementation of the excise policy of GNCTD.

The court said, keeping in view the facts and circumstances, the accused is being remanded to CBI custody for a period of five days i.e. till March 4, 2023, for his further and extensive interrogation.

The court observed that the accused had joined the investigation of this case on two earlier occasions, but it has also been observed that he has failed to provide satisfactory answers to most of the questions put to him during his examination and interrogation conducted and has thus, failed to legitimately explain the incriminating evidence which has allegedly surfaced against him in the investigation conducted so far.

It is true that he cannot be expected to make self-incriminating statements, but the interests of justice and of a fair investigation require that he should come up with some legitimate answers to the questions which are being put to him by the Investigation officer.

Some of his subordinates are found to have disclosed certain facts which can be taken as incriminating against him and some documentary evidence against him has also already surfaced a proper and fair investigation requires that some genuine and legitimate answers to the questions being put to him about the same are to be found and hence, in considered opinion of this court, this can only be done during custodial interrogation of the accused, noted the court.

During arguments, CBI counsel told the court that the Delhi Deputy CM’s custodial interrogation is required for an effective investigation into the case. While seeking five days’ remand of Sisodia, CBI said, “Conspiracy was hatched in a very planned and secret manner.”
Meanwhile, senior Advocate Dayan Krishnan appeared for Sisodia and opposed the remand application of CBI.

“If someone is not willing to say something, that cannot be a ground for arrest,” argued Sisodia’s lawyer.

“What should I do with a phone that I changed? I am a minister, I cannot send it to a second-hand shop, it would have important data. CBI confronted me with the material but I did not confess. The remand application says I gave evasive replies. This cannot be a ground for remand. They search my residence on August 19, 2022. I hand over my phone.
