    Kentucky Supreme Court leaves abortion ban in place

    That win on Election Day set up the abortion providers in the state who are challenging the laws to argue on Nov. 15 that both the state’s near-total ban on the procedure beginning at conception and a separate law banning abortion after six weeks of pregnancy violate provisions of the state constitution adopted in 1891 — namely, the “right of seeking and pursuing their safety and happiness” and freedom from “absolute and arbitrary power.” Both bans, which the state legislature passed in 2019, criminalize abortions with no exceptions for cases of rape or incest, with a narrow exception for life-endangering complications.

    During oral arguments in the case, the American Civil Liberties Union in Kentucky argued on behalf of clinics in the state that the abortion restrictions are causing “irreparable harm” to patients who are undergoing the “pain and trauma” of being forced to bear children they don’t want or having to search for ways to travel out of state for the procedure.

    Justice Lambert ruled Thursday that the clinics don’t have standing to challenge the laws on behalf of their patients, but do have standing to argue that the state’ s abortion bans violate protections in the state’s constitution.

    Several justices dissented in part from the decision, with some accusing the court’s majority of ignoring arguments made by the challengers that the bans are causing such “irreparable harm” in the state that an injunction is warranted.

    Justice Angela McCormick Bisig lamented that the court decided to “retreat from the duty of judicial review by failing to evaluate whether Plaintiffs present substantial allegations that the bans unconstitutionally prohibit the women of this Commonwealth from obtaining reproductive healthcare.” Citing recent reporting about Kentucky “women placed in untenable positions due to severe fetal anomalies” who had to travel out of state for an abortion, Bisig argued the court should have backed the Circuit Court’s decision to block the law temporarily.

    The ACLU and other groups that brought the case said they were “extremely disappointed” in the decision and vowed to keep fighting on the merits in the lower court. Pointing to the results of the November ballot referendum, they argued the state Supreme Court went against the will of the people in leaving the bans in place.

    Conservatives, meanwhile, cheered Thursday’s ruling.

    “We’re elated, but we know that it’s not the end. There will be more litigation in the courts and we have more work to do,” said Addia Wuchner, a former Republican representative in the Kentucky Statehouse who led the unsuccessful Yes for Life ballot measure campaign last year. “For now, however, this means the abortion facilities will remain closed.”

    New Delhi: Amid a raging controversy over a meltdown in Adani group stocks, regulator Sebi on Saturday said it is committed to ensuring the stock market’s integrity and all necessary surveillance measures are in place to address any excessive volatility in individual shares.

    Without naming the Adani group specifically, the capital markets watchdog said in a statement that unusual price movement in the stocks of a business conglomerate has been observed in the past week.

    Officials confirmed that the statement has been issued in the wake of the Adani matter only.

    “As part of its mandate, Sebi seeks to maintain orderly and efficient functioning of the market and has put in place a set of well-defined, publicly available surveillance measures (including the ASM framework) to address excessive volatility in specific stocks.

    “This mechanism gets automatically triggered under certain conditions of price volatility in any stock,” the Securities and Exchange Board of India (Sebi) said.

    Stock exchanges BSE and NSE have put three Adani group companies — Adani Enterprises, Adani Ports and Special Economic Zone, and Ambuja Cements — under their short-term additional surveillance measure (ASM), which basically means that intra-day trading would require a 100 percent upfront margin and is aimed at curbing speculation and short-selling in these stocks.

    Sebi further said that in all specific entity-related matters, if any information comes to its notice, then, as per extant policies, the same is examined and after due examination, appropriate action is taken.

    “Sebi has consistently followed this approach on entity-level issues and would continue to do so in future as well,” it added.

    New Delhi: The Congress on Monday said over 50 institutes of national importance including seven IITs and 22 NITs are without chairpersons and alleged that the government is looking at the “wrong place” to find the “right” person.

    Congress president Mallikarjun Kharge said the government has not filled up the vacancies even after many of the institutes have written to it.

    He also reminded Prime Minister Narendra Modi about claims made of providing world class futuristic education at these institutes even when basics were forgotten.

    “Narendra Modi ji, 50 institutes of national importance are without chairpersons.
    10 are vacant since the year your government came to power. Many institutes have written to government, but no avail. You speak about ‘world class futuristic education’ but forget the ‘basics’,” Kharge said.

    The Congress chief said this on Twitter while recalling that institutions without full-time chairpersons included seven Indian Institutes of Technology (IITs), 22 National Institutes of Technology (NITs) and 20 Indian Institutes of Information Technology (IIITs).

    Congress leader P Chidambaram also alleged that 10 such institutes are without chairpersons for the last eight to nine years.

    “The Modi government’s commitment to excellence in higher education has been exposed. IIT (7), NIT (22) and IIIT (20) are without a full-time chairperson of the Board. In 10 institutes, no chairperson has been appointed for the last eight-nine years,” he alleged.

    “In a country with a population of 140 crore, the government cannot find 50 persons who can serve as chairperson of such an institute. I suspect the government is looking at the wrong place to find the ‘right’ person,” Chidambaram said.

    Union Education Minister Dharmendra Pradhan had earlier told the Parliament in a written reply that 39 posts of chairman and directors are vacant at the IITs and the NITs.

    Admitting that several posts of chairman at IITs and NITs are lying vacant, Pradhan had told the Lok Sabha that “the nomination and selection of chairman and other posts is a continuous process”.

    Srinagar, Jan 25: Amid high alert, a multi-level security cover that entails special security measures is in place across Jammu and Kashmir the smooth conduct of Republic Day functions in the Union Territory tomorrow.

    Officials told news agency—Kashmir News Observer (KNO) that since high alert has already been sounded across J&K, some extra security measures have been taken to ensure peaceful conduct of Republic Day that will be followed by the Bharat Jodo Yatra, which is scheduled to enter Srinagar on Jan 30. “All security agencies are maintaining highest level of alert to foil all bids by the enemies aimed at possible disruption of Republic Day,” a senior police official said, wishing not to be named.

    He said apart from the aerial surveillance in the twin cities of Jammu and Srinagar, night patrolling, extra deployment of security forces personnel on highways and sensitive areas, strict Close Circuit Television (CCTV) vigil and Mobile Vehicle patrolling is taking place round the clock on certain roads.

    The main Republic Day function will take place in Jammu where Lieutenant Governor Manoj Sinha will unfurl the tri-colour and take salute of the parade. In Srinagar, LG’s advisor RR Bhatnagar will take the salute of the parade and also hoist the tri-colour. Sources said that both the venues have been sealed and handed over to the security forces. In Srinagar, Divisional Commissioner P K Pole inspected the preparations during full-dress rehearsal on Tuesday.

    At districts headquarters across the UT, elaborate security arrangements have been made for the smooth passage of the Republic Day function. A senior police officer told KNO that they are ready to deal with all the challenges and they are hopeful that the day will pass peacefully across Kashmir.

    In Jammu, security measures are more stringent this time around in the wake of killings in Rajouri district and two back to back mysterious blasts in Jammu’s Narwal recently that left nine people injured. Talking to reporters in Pulwama, Deputy Inspector General (DIG) of CRPF (Operations), South Kashmir, Alok Avasthi said that the force is fully alert to ensure peaceful R-Day and BJY.

    “We are always alert. If there are intelligence inputs of any element trying to disrupt peace, we will act swiftly against such elements”, he said. He said that the force is ready to facilitate BJY. “Whosoever travels on the highway will feel and secure. All measures are in place for facilitate BJY,” he said—(KNO)
