Earlier this month, the collegium headed by Chief Justice of India D.Y. Chandrachud and comprising Justices Sanjay Kishan Kaul and K.M. Joseph said: “The Collegium resolves to recommend that Justices (i) Vikas Bahl, (ii) Vikas Suri, (iii) Sandeep Moudgil, (iv) Vinod Sharma (Bhardwaj), (v) Pankaj Jain, and (vi) Jasjit Singh Bedi, Additional Judges, be appointed as Permanent Judges of the High Court of Punjab and Haryana against the existing vacancies. The collegium took the decisions in its meeting on April 17.

It said that on December 19, 2022, the collegium of the High Court of Punjab and Haryana unanimously recommended the additional judges whose names are set out above for appointment as permanent judges of that high court. • Anti-corruption agencies staring at permanent interference: Ex-CBI joint director

Anti-corruption agencies staring at permanent interference: Ex-CBI joint director

    [ad_1]

Kolkata: The Central Bureau of Investigation and other anti-corruption agencies in the country are staring at the predicament of “permanent interference” if a 2018 anti-graft law remains unchallenged, according to former CBI joint director Shantonu Sen.

Sen also said the CBI should reinstate the practice of having its own cadre of investigators, as those inducted into the probe agency from states are bound to be “conditioned” to interference.

“Anti-corruption agencies are now dependent on another authority for their right to investigate, whereas in law, the police should not be dependent on anybody to take up an investigation of crime because a thana’ (police station) does not have to seek somebody’s permission to investigate a murder or rape case,” Sen told PTI in an interview.

    MS Education Academy

Sen, who is also an author and columnist, was referring to the insertion of Section 17(A) in the Prevention of Corruption Act (PCA) in July 2018, and later in 2021, the addition of Standard Operating Procedures (SOPs) for processing of cases under the section.

“This section states that henceforth, no act of corruption mentioned in the PCA, except if somebody is trapped, will be enquired/inquired or investigated by any police officer without the permission of the appointing authority.

“So now, a police officer, in CBI or an anti-corruption agency, who was supposed to enquire into allegations of corruption and investigate that, cannot do it. This is unequal application of law” he said.

The SOPs under Section 17(A) came into force in September 2021. A central government notification states that the SOPs were introduced to standardise and operationalise procedures with a view to achieving uniform and effective implementation for prior approval processes under this section.

Sen, who also served as the OSD to Lt Governor of Delhi from 2007 to 2013, however, is apprehensive about the SOPs.

“It says that verification will be done by certain rank of police officers, as per their annexure and that verification, for instance, in case of a judge or a cabinet minister, will be conducted by the DGP himself. He will verify and ask for permission. Similarly, the ranks are decided for other cases. This is not equal application of law. And yet, nobody has challenged it,” he said.

The former CBI joint director said anti-corruption agencies are becoming less useful, as no public servant can now be investigated without the orders of the government.

“There was a perception, right from the 1970s, that the CBI is being interfered with. So, this interference is nothing new. The question before us is if this new law remains, the CBI and all anti-corruption agencies will be permanently interfered with. Should this not be challenged?” Sen added.

Pakistan’s largest zoo faces permanent closure amid public outcry

    [ad_1]

Karachi: Pakistan’s largest zoo in the port city of Karachi is facing a permanent closure after 145 years in existence due to its “very poor” living conditions for the animals, who face ill-treatment and are not being fed properly.

The Federal and Sindh governments are mulling the closure of the Karachi Zoo, the second oldest zoo in the country, after reports of the ill-treatment of several animals, particularly a 17-year-old elephant named Nur Jehan.

Earlier, the elephant was found in poor health condition. Despite undergoing successful surgery, the mammal’s health condition has deteriorated due to months of inadequate care and treatment.

    MS Education Academy

“The living conditions are very poor and the animals are clearly not well taken care of. There have been complaints of animals not being fed properly. So, the option of shutting the zoo down is under consideration but not final as yet,” a top official in the provincial government said.

He said Federal Minister and Senator Sherry Rehman and Pakistan Peoples Party Chairperson Bilawal Bhutto had suggested closing the recreation park and the zoo.

“We are looking at moving the animals to safer places,” the official said.

The provincial government has already removed zoo Director Khalid Hashmi for his negligence and cruel behaviour towards animals, in particular Nur Jehan who is fighting for her life after falling into a concrete pond inside her small enclosure at the zoo last week.

The fall came after a team of veterinarians from a global animal welfare organisation visited the zoo and treated Nur Jehan and other animals who were sick.

Nur Jehan was one of four African elephants who were brought to Karachi in 2009. Nur Jehan and Madhubala were put in the Karachi Zoo while Malik and Sonu were taken to the Safari Park.

Numerous reports have highlighted the cruelty shown by the zookeepers and the administration of the Karachi Zoo towards the animals.

The poor living conditions of animals have raised eyebrows of the wildlife experts who are demanding that the Karachi Zoo be shut down and the animals be shifted to safer sanctuaries.

Officials at the zoo say the animals are suffering because there are no adequate funds.

“What can we do without a proper budget? The money generated is not enough to feed all the animals properly and keep the zoo neat and clean,” one official said.

Established in 1878, the Karachi Zoo was formerly known as Mahatma Gandhi Garden. It is the largest zoo in Pakistan and the second oldest zoo in the country after the Lahore Zoo.

Defamation case: Maha court grants Rahul permanent exemption from appearance

    [ad_1]

Thane: A court in Maharashtra’s Thane district on Saturday granted a permanent exemption to Congress leader Rahul Gandhi from appearing before it in a defamation case filed against him by a Rashtriya Sawyamsevak Sangh (RSS) functionary.

Bhiwandi First Class Judicial Magistrate Laxmikant C Wadikar who heard Gandhi’s application filed through his counsel Narayan Iyer observed that the Congress leader deserves a permanent exemption.

The magistrate also set June 3 for recording evidence in the defamation suit filed by local RSS worker Rajesh Kunte.

    MS Education Academy

Kunte had in 2014 filed a private complaint before the Bhiwandi magistrate’s court after watching Gandhi’s speech where he allegedly accused the RSS of Mahatma Gandhi’s assassination. Kunte claimed this statement slandered the reputation of the RSS.

Gandhi had appeared before the court in June 2018 and pleaded not guilty.

“Accused Rahul Rajiv Gandhi is hereby exempted from appearance in the court till the further order passed by the court subject to following conditions,” reads the order, a copy of which was accessed by PTI.

“Accused to undertake that his duly designated advocate punctually and regularly appears before court on each and every scheduled date and conduct the trial in absence of accused,” says one of the conditions. “Accused to remain present in court as and when directed,” reads another.

Rahul Gandhi, who was recently disqualified as an MP after his conviction by a Surat court in a defamation case, had last year sought exemption from appearance in the Bhiwandi court on the grounds that he was a Delhi resident and a Lok Sabha member who had to visit his constituency (Wayanad), attend party work and travel a lot. Gandhi had requested that whenever required, he be allowed to be represented by his lawyer in the hearing.

Kunte recently argued that since Gandhi is no longer a parliamentarian, he should not be given an exemption in the matter.

The Surat court had on March 23 sentenced Gandhi to two years in jail in a 2019 criminal defamation case filed against him over his “why all thieves have Modi surname” remarks. The court also granted him bail and suspended the sentence for 30 days to allow him to appeal in a higher court. The next day, he was disqualified as a member of the Lok Sabha.

  • Naveen, Mamata resolve to make federal structure ‘strong, permanent’

Naveen, Mamata resolve to make federal structure ‘strong, permanent’

    [ad_1]

Bhubaneswar: Odisha Chief Minister Naveen Patnaik and his West Bengal counterpart Mamata Banerjee on Thursday said they had resolved to make the federal structure of the country “strong and permanent”.

The statement came after a much-awaited meeting of the two chief ministers held at the conclusion of Banerjee’s three-day visit to Odisha.

Addressing reporters at the end of the meeting at Naveen Niwas — Patnaik’s residence — with Banerjee beside him, the Odisha CM said, “We resolved to make the federal structure of the country permanent and strong. There was no other political discussion.”

Banerjee seconded Patnaik and said, “I strongly support what Naveen ji said and I appreciate this. We also discussed about democratic rights and the safety of the nation.”

She also sought iron ore for industries in her state and proposed an industrial corridor between the two states.

However, speculation remained rife that the meeting was part of Banerjee’s plan to form an opposition front with regional players minus the Congress.

Earlier, both Banerjee’s Trinamool Congress and Uttar Pradesh’s backwards’ leader Akhilesh Yadav-led Samajwadi party had last Friday said the two parties would stay away from both the Congress and BJP.

TMC had also announced it would hold talks with other regional parties in their bid to take on the BJP in the crucial 2024 elections though it officially continued to deny any plans for a ‘Third Front’, separate from the Congress-led broad coalition.

After Thursday’s meeting too, both the leaders skipped questions on the possibility of a third front or a regional alliance for the 2024 Lok Sabha polls.

“It was a courtesy meeting. There was no in-depth discussion about serious political matters. We share a very old friendship,” Patnaik said.

Banerjee thanked Patnaik for handing over two acres of land for the construction of a Bengal government guest house in Puri.

She also drew Patnaik’s attention to shortage of iron ore in Bengal and sought Odisha’s help which has the raw material for steel production in abundance.

Banerjee also proposed a Bengal-Odisha industrial corridor which will develop the economies of the two states that are connected by national highways and railway tracks.

The West Bengal CM said a Jagannath temple is being constructed in Digha coastal town.

“I have invited Naveen ji to Bengal. Our states share good relationship,” she said.

Earlier, Banerjee reached Patnaik’s residence, where the Odisha chief minister welcomed her by presenting Sri Angavastra of Lord Jagannath. He also presented a replica of the three chariots to the Trinamool Congress supremo, besides filigree work and some sweets from Odisha.

Banerjee gave a return gift of a shawl to Patnaik, and placed a jamdani saree in front of photographs of Patnaik’s parents former Odisha CM Biju Patnaik and his wife Gyan Patnaik.

Earlier, when Banerjee had reached Bhubaneswar on March 21, she had sent some sweets from West Bengal to Patnaik.

  • Rahul has become permanent part of ‘toolkit’ working against India: Nadda

Rahul has become permanent part of ‘toolkit’ working against India: Nadda

    [ad_1]

New Delhi: BJP president JP Nadda led his party’s attack on Rahul Gandhi on Friday over the Congress leader’s recent comments made in the UK on the state of Indian democracy, charging him with becoming a “permanent part of the toolkit” working against India that seeks a weak government here so as to exploit it for its benefits.

In a statement, Nadda accused Gandhi of speaking the language of “anti-India” George Soros, a billionaire financier, and alleged that the Congress and the “so-called Left liberals” have become a part of the “deep state” conspiracy involving foreign forces against the country. “Anti-national” Congress leaders have been speaking the language of Pakistan, he added.

Gandhi will have to apologise to the people of India for his “sin” of seeking the “interference” of foreign powers in the country’s internal affairs, the Bharatiya Janata Party (BJP) president said.

He accused the former Congress chief of joining hands with foreign conspirators against India to encircle the country economically and strategically. Never before in independent India any leader has done what Gandhi has done on foreign soil, he said.

“This is a most serious matter,” Nadda said, adding that what the Congress leader has done has hurt every patriotic MP as well as the people of the country.

Those working against India want a weak government working under the compulsions of an alliance for their benefits, he said.

The BJP president said anti-India forces have always had problems with a strong India, its robust democracy and decisive government. By criticising the state of democracy in India and seeking the intervention of the United States and Europe on foreign soil, Gandhi has attacked the country’s sovereignty, he added.

“Rejected repeatedly by people, Rahul Gandhi has become a permanent part of the ‘toolkit’ working against India,” Nadda said.

He accused the former Congress chief of insulting India, its Parliament, its democratically-elected government and people in Britain, a country that ruled over India for long. What Gandhi has done amounts to strengthening those working against India, the BJP president said.

The Congress has dismissed the BJP’s accusations and asserted that Gandhi will not apologise. He has sought permission to speak in Parliament to respond to the criticism levelled against him by the ruling party members in both houses. Parliamentary proceedings have so far been a washout over the row.

Nadda said India has become the fifth-largest economy and is hosting the G20 summit under Prime Minister Narendra Modi’s leadership, while Gandhi has chosen to “insult” the country on foreign soil.

“There can be nothing more shameful than seeking the US’ and Europe’s interference in India and claiming that democracy no longer exists in the country,” he said.

Noting that Britain ruled over India before it gained independence, the BJP president said it was unfortunate that Gandhi sought foreign interference from that country.

  • It is the best time to be a woman in India: Permanent Representative to the UN Ruchira Kamboj

It is the best time to be a woman in India: Permanent Representative to the UN Ruchira Kamboj

    [ad_1]

United Nations: It is the best time to be a woman in India today, the country’s UN envoy Ruchira Kamboj has said, emphasising that the government was fully empowering women at all levels.

The Permanent Mission of India to the United Nations, in partnership with UN Women India, organised a high-level panel discussion this week on ‘Leveraging Public-Private Commitment for Women’s Greater Access to Technology and Education” at the United Nations Headquarters on the margins of the ongoing 67th session of the Commission on Status of Women.

“In India, there has been enormous, enormous growth in the past eight-nine years particularly and today, I think it is perhaps the best time to be a woman in India. I mean that very sincerely,” India’s Permanent Representative to the UN Ambassador Kamboj said.

In her remarks, Kamboj stressed that in India “we recognise the transformational capacity of technology to provide impetus to women’s empowerment and sustainable development.” “This is a fantastic time to be a woman and the government is fully empowering you at all levels. The Prime Minister has emphasised upon a model of women-led growth and development and it is very much a reality,” Kamboj said.

She highlighted that the Government of India has taken numerous citizen-centric digital initiatives with a greater focus to enable access for women to finance, credit, technology and employment.

These initiatives have focused on providing immediate assistance to women in distress, preventing violence against women, and promoting women’s full and equal participation in every sphere of society, she said.

Kamboj spoke on two major initiatives — the Digital India programme and the Jan Dhan-Aadhaar-Mobile (JAM) trinity — that have shown the capacity of technology to provide impetus to women’s empowerment and sustainable development.

She said that during the pandemic, these initiatives had facilitated direct benefit transfer to nearly 200 million women.

Assistant Secretary-General and Deputy Executive Director of UN Women Anita Bhatia said that since 2017, successive Commissions on the Status of Women have recognized the important and fundamental role that digitalization plays in closing the gender digital divide.

Highlighting that women have less access than men and boys to technology, Bhatia said “the non-negotiables have to be a recognition that digital rights are also human rights and that women have as much right to digital access as do men and boys.” She pointed to data, which she termed as “pretty shocking” and according to which, globally men are 20 per cent more likely to be online than women, with this percentage as high as 52 in low-income countries as a group.

“There also has to be a recognition of this from the point of view of opportunity, because not investing sufficiently in digitalization means that governments are actually leaving money on the table,” she said.

Bhatia added that in a post-pandemic world, where the fiscal space is constrained, “this is actually a fabulous opportunity to say how can we leapfrog our economies, how can we grow our economies quickly and how can we do so by leveraging both the power, creativity and innovation of women, but also the power of creativity and innovation that is inherent in digitalisation.” Bhatia also noted that the STEM (Science, Technology, Engineering and Mathematics) field is “uber-masculine” and “we need to make it look less masculine and have more girls and boys involved in this.” Apollo Hospitals Joint Managing Director Dr Sangita Reddy told the discussion that “in a single word, what we are all seeking today – we were striving for equity. We’re looking forward now to ‘Techquity’.” Reddy said it is techquity “which will help us take the position that we’re looking forward to in the years to come.” With technology driving every aspect and field of life now, Reddy said from computing and automation to artificial intelligence, “the world is transforming. As we seek equity in this world, it is important for every woman to be digitally connected, digitally savvy,” Reddy said.

The panel discussion was organised as a part of the ‘India Roundtables’ at the United Nations.

The roundtables, being organised to commemorate India@75, will showcase India’s achievements in various areas of development, including women empowerment, financial inclusion, social development, climate action and many more.

The panel, moderated by Country Representative, UN Women India Susan Ferguson, included Senior Vice President and Chief Marketing and Communications Officer, LinkedIn Melissa Selcher and Senior Vice President & Human Resources Development Head – India & Americas, Nina Nair.

“A point I would like to make to my Democratic colleagues on this committee, do you think Phil Washington could come anywhere close to Acting Administrator Nolen’s knowledge? I think the answer is no,” Cruz said, after asking Nolen to spell out his long career as a pilot. “I think it’s clear that Phil Washington is not going to have the votes. I think a nominee like Acting Administrator Nolen would receive widespread bipartisan support and could get confirmed quickly.”

At one point during the hearing Nolen made it clear that he isn’t angling for the job.

“I do believe that Phil Washington is fully qualified, I support the president and I support the nomination,” Nolen said.

Beyond Cruz, some Democrats on the Commerce Committee are not fully convinced. Sen. Jacky Rosen (D-Nev.) said she hasn’t yet decided on the nomination and Sen. Kyrsten Sinema (I-Ariz.) also raised concerns about Washington’s experience during his nomination hearing last week. While some Republicans vocally oppose Washington, not everyone agrees with Cruz. Aviation Subcommittee ranking member Jerry Moran (R-Kansas) said he’s also undecided.

Commerce Committee Chair Maria Cantwell (D-Wash.) argued on Wednesday that Washington’s lack of ties to the aviation industry will assist ongoing congressional efforts to ensure that the FAA is fully independent from the airlines and aircraft manufacturers it regulates, particularly after the Boeing 737 MAX crashes in 2018 and 2019.

“I think this notion of running a large organization with transportation background is really important because there’s some things here you’re trying to change culturally,” Cantwell said. “I definitely think he doesn’t represent the status quo and sometimes you get people with very long aviation careers and they’re the ones who basically go along with the system we’re trying to change.”

Cantwell hasn’t announced a committee vote on Washington’s nomination, a sign that Democrats may not be aligned.

Senate Democrats largely did not weigh in on Washington’s nomination last Congress, when he faced questions over lawsuits and search warrants related to his time leading the Los Angeles County Metropolitan Transportation Authority. But after the White House renominated Washington in January, Cantwell announced her support and Senate Majority Leader Chuck Schumer called Washington’s confirmation a priority after a FAA computer system meltdown led to the first nationwide grounding of flights since September 11, 2001.

“With recent events, including airline troubles and last week’s tech problem, this agency needs a leader confirmed by the Senate immediately,” Schumer said in January.
