    The self-employed from January 2023 will be governed by a new contribution system that is based on the annual returns obtained in the exercise of all economic, business or professional activities. The Government approved this reform along with a set of changes regarding the benefit for cessation of activity that self-employed workers can access.

    As of January 1, 2023, anyone who is going to register as a self-employed person will have to choose a contribution base based on the forecast of the monthly average of your annual net income according to a general table of bases, set each year by the General State Budget Law. The bases chosen will be provisional until the time of the regularization that will be carried out in the following year, taking the annual yields obtained and communicated by the corresponding tax administration.

    In this reform that supposes new sections of the returns and new amounts of the quotas, it is also extended to new beneficiaries who will be able to collect the so-called unemployment of the self-employed. Thus, two new conditions are included to request the benefit for cessation of activity.

    – When there is a 60% reduction in the working day of all the company’s workers or the temporary suspension of the employment contracts of 60% of the workforce, as long as there has been a 75% reduction in income with respect to previous years

    – When the self-employed who do not have salaried workers maintain debts for two consecutive quarters with creditors and see their level of ordinary income or sales reduced by 60% compared to that registered in the same periods of the previous year.

    In which cases can unemployment and a salary be collected at the same time?

    These new conditions will allow the collection of the benefit for cessation of activity to be compatible with a job. In principle, the perception of the economic benefit for cessation of activity with a self-employed work is not allowed, even if its realization does not imply the mandatory inclusion in the Special Scheme of Social Security for Self-Employed or Self-Employed Workers or in the Special Scheme Social Security for Sea Workers. Nor is it with a job for someone else.

    However, the people who are in the two new cases included to access the benefit will be able to continue receiving the benefit if they find a job. They may also make the receipt of the aid compatible with self-employment or employment in the event of temporary partial cessation of the activity derived from force majeure, which will be compatible with the activity that causes the cessation, provided that the monthly net income obtained during the perception of the benefit are not greater than the amount of the minimum interprofessional salary or the amount of the base for which they were contributing, if this were lower.

    New Delhi: A group of ex-servicemen moved the Supreme Court seeking a direction to the Centre that arrears of the One Rank-One Pension scheme be paid to all eligible pensioners in one installment instead of four installments.

    A bench of Chief Justice DY Chandrachud and justices PS Narasimha and JB Pardiwala is scheduled to take up the application filed by Indian Ex-Servicemen Movement (IESM) through advocate Balaji Srinivasan for hearing on February 27.

    The military veterans association has also sought the setting aside of the Centre’s communication dated January 20, 2023 issued by the Ministry of Defence.

    The communication had said that “arrears on account of revision of pension from July 1, 2019 till date of its implementation shall be paid by the Pension Disbursing Agencies in four yearly installments. However, all the family pensioners including those in receipt of special/liberalized family pension and all gallantry award winners shall be paid arrears in one installment”.

    The ex-servicemen have alleged that the Centre has unilaterally modified and sought to subvert the directions passed by this court in the last year’s judgement dated March 16, 2022.

    “Shockingly, this has been done after taking indulgence of this court and seeking extension over the last ten months, during which time several assurances of compliance were given to this court (while seeking repeated extensions in time) to the lakhs of eligible pensioners depending on the payment of arrears”, the application has said.

    The association said that approximately four lakh pensioners have died during the pendency of the petition and “several more would perish without seeing the fruits of the judgement dated March 16, 2022 if the respondents/ Union of India is not directed to comply with the judgement dated March 16, 2022, in time in as much as a majority of the pensioners are aged citizens “.

    On January 9, the top court granted time till March 15 to the Centre for payment of arrears of OROP to all eligible pensioners of the armed forces.

    The top court had asked the Centre to ensure that all arrears are paid expeditiously to the pensioners of the armed forces and that there is no further delay.

    It had granted liberty to ex-servicemen association to file an application if they feel aggrieved by any action of the Centre on payment of arrears of the OROP.

    This was the second extension given by the top court to the Centre to pay the arrears after it had first moved the apex court in June last year and sought three months to compute and make payments in accordance with the March 16, 2022 verdict of the top court.

    The top court’s 2022 verdict had come on the plea filed by the IESM against the Centre’s formula of calculating OROP.

    The verdict had said in terms of the communication dated November 7, 2015, the benefit of OROP was to be effected from July 1, 2014 and the communication states that “in future, the pension would be re-fixed every five years”.

    “Such an exercise has remained to be carried out after the expiry of five years possibly because of the pendency of the present proceedings,” the bench had said, adding, “We accordingly order and direct that in terms of the communication dated November 7, 2015, a re-fixation exercise shall be carried out from July 1, 2019, upon the expiry of five years.

    “Arrears payable to all eligible pensioners of the armed forces shall be computed and paid over accordingly within a period of three months,” the top court had said in its verdict.

    Mumbai: A day after a real-time payments system linkage was established between India and Singapore using the UPI platform, State Bank of India on Wednesday announced a partnership with PayNow, the online payment system of the city state, for cross-border payments.

    The facility is offered through SBI’s Bhim SBIPay mobile application and the linkage will allow fund transfers from India to Singapore through registered mobile numbers, and from Singapore to India using the UPI ID, the bank said in a statement.

    The UPI-PayNow linkage is a significant milestone towards developing an infrastructure for cross-border payments between the two countries and the initiative closely aligns with the G20’s priorities of driving faster, cheaper, and more transparent cross-border payments.

    The inward bilateral remittance between the two countries was around USD 949 million in 2021 according to the World Bank bilateral remittances matrix, the bank said.

    RBI governor Shaktikanta Das and Ravi Menon, managing director of Monetary Authority of Singapore, which is the Reserve Bank of India’s counterpart in the city state, executed the first live cross-border transaction, using the Bhim SBIPay, the bank said.

    “The linkage of these two payment systems will enable residents of both the countries to initiate a faster and more cost-efficient transfer of cross-border remittances. It will also help the Indian diaspora in Singapore, professionals, students, and workers through an instantaneous and low-cost transfer of money both ways,” the statement quoting Prime Minister Narendra Modi, said.

    “Cross-border retail payments and remittances between the two countries amount to over USD 1 billion annually. As we progressively add more users and use cases, the UPI-PayNow linkage will grow in utility and contribute more to facilitating our trade and people-to-people links, Lee Hsien Loong, Prime Minister of Singapore, was quoted as saying.

On the other hand, KSRTC’s lawyer Deepu Thakan, while presenting the argument, said that the salary will be paid to the employees by February 15 of the last month. He also said that if the corporation is closed, it will affect 42000 pensioners including 26000 employees.

    Apart from this, more than 20,000 passengers will also be affected by this. Infact more than 20,000 commuters depend on KSRTC service for their travel. In such a situation, if the institution is closed, then the employees and pensioners along with the common citizens may also have to bear a big loss.

    High court order

    While hearing the matter, the High Court has clarified that the salary and pension should be paid by KSRTC to its employees on time. There is no need for such an institution which cannot pay its employees and pensioners. Also, if the passengers also have to go through its effect, then they can use other means of transport. At the same time, after the order of the court, it is believed that the amount can be seen in the account of the employees till February 15.

    Earlier, while submitting an affidavit, KSRTC had also said that it is making efforts to increase the daily revenue by 8 digits. It is expected that the corporation will soon achieve its target. In this way the salary will be paid to the employees in the first week of the month itself. However, it was also stated that till the Corporation does not achieve the daily revenue target, it is not in a position to make any commitment before the High Court with regard to the organization of salary for the first week of every month.
