Remarks against SC: Allahabad HC stays action against Owaisi

    [ad_1]

Prayagraj: The Allahabad High Court has directed the Uttar Pradesh government not to take any coercive action against All India Majlis-e-Ittehadul Muslimeen (AIMIM) chief Asaduddin Owaisi till April 24 in a case pertaining to his controversial remarks against the Supreme Court.

After the apex court verdict in the Ram Janmabhoomi-Babri Masjid title dispute in 2019, Owaisi had reportedly said that the Supreme Court is supreme “but not infallible”.

Justice Rajiv Gupta of the Allahabad High Court passed the order in a plea filed by Owaisi under Section 482 of the CrPC challenging the summoning order issued by the CJM court, Siddharth Nagar, Uttar Pradesh.

Owaisi’s counsel argued that he is being prosecuted for the offence under Section 153 (A) of the Indian Penal Code, but necessary sanction from the authority concerned, as contemplated under Section 196(1) CrPC, had not been taken and as such, the entire proceeding was ‘bad’ in the eyes of law.

The single-judge bench opined that the matter required consideration and issued notices to the complainant in the matter and fixed April 24 as the next date of hearing in the case.

The court observed, “Till then, no coercive action shall be taken against the applicant in the complaint case (MP/MLA) No. 566 of 2022 (Rakesh Pratap Singh Vs. Asaduddin Owaisi and Another), under Sections 153-A, 295-A, 298 IPC, Police Station Shohratgarh, district Siddharth Nagar, pending in the court of Chief Judicial Magistrate, Siddharth Nagar.”

A complaint had been filed against Owaisi following his remarks on the Supreme Court’s 2019 judgment in the Ram Janmabhoomi-Babri Masjid title dispute.

  • Owaisi slams BJP for scrapping 4% Muslim quota in Karnataka

Owaisi slams BJP for scrapping 4% Muslim quota in Karnataka

    [ad_1]

Hyderabad: AIMIM chief Asaduddin Owaisi on Saturday slammed the BJP-led Karnataka government for abolishing the 4 percent reservation for Muslims in the state.

He termed the decision as part of PM Narendra Modi’s ‘Muslim outreach’ program.

“Karnataka BJP govt removes reservation for poor Muslims in education & jobs This is @narendramodi’s “Muslim outreach” & love for Pasmanda Muslims. Whether it’s hijab or reservations, the target is Muslims’ progress in education & employment,” he tweeted.

The Karnataka government on Friday announced its decision to scrap the four percent quota for minorities and added it to the existing quota of two dominant communities of the poll-bound state.

The 4 per cent reservation given to Muslims under 2B classification of the OBC category will now be divided into two equal parts and added to the existing quota of Vokkaligas and Lingayats for whom two new reservation categories of 2C and 2D were created during the Belagavi Assembly Session last year.

The cabinet decided to bring the religious minorities under the EWS category.

The decision comes ahead of the Assembly elections.

Briefing reporters after the cabinet meeting on Friday, Chief Minister Basavaraj Bommai said the religious minorities quota would be done away with and brought under the 10 percent pool of the EWS category without any change of condition.

“The four percent (reservation for minorities) will be divided into two between 2C and 2D. The four percent reservation for the Vokkaligas and others will be enhanced to six percent and Veerashaiva Panchamasali and others (Lingayats), who are getting five percent reservation will now get seven percent,” the CM explained.

The Cabinet had abolished the 3A and 3B categories of reservation for Vokkaligas and Lingayats respectively and replaced them with two new categories of 2C and 2D last December.

Defending the decision to abolish the quota for Muslims, Bommai said there was no constitutional provision for religious minorities.

Citing a court verdict striking down the reservation provided for minorities in Andhra Pradesh, the CM said the architect of the Indian Constitution B R Ambedkar too had said that reservations were for caste.

“However, we cannot drop that community entirely. With a view that there should not be any problem, the religious minorities…if someone challenges reservation to them, we decided to take a proactive decision. In fact they will go from 4 per cent to the 10 percent pool of the EWS group without any change of condition,” Bommai explained.

Muslims are divided into three reservation categories 1, 2A and 2B.

The extremely backward religious minorities, who form the sub-sects of Muslims such as Pinjara, Nadaf, Daroji, Chapparband and are enlisted in category 1, will remain undisturbed and in the same reservation list.

Similarly, the government did not touch the Muslim communities under 2A category.

“Some other Muslim sub-sects in the 2B category will not be disturbed. They will only be moved to the EWS quota on the same conditions,” Bommai said.

There are some more small backward communities, who find mention in the Backward Commission’s report.

“They never figured in any list including the backward list. They are not in any category. Regarding them, the Backward Commission has mentioned in its second list. I will study the report in detail. Our government will take further decision on it in the coming cabinet.

Already, a recommendation has been sent to the Centre to include two shepherd communities Kadu Kuruba’ and Gonda Kuruba’ spread over four districts in the ST category.

Further, the Union government has made some references to two to three communities including Kadu Gollaru and Koli communities seeking the opinion of the department.

Bommai also said that the government will notify the communities under the EWS category.

Also, a decision was taken with regard to the SC community that 6 percent reservation would be given to SC left sub-category, 5.5 per cent to SC right, 4.5 per cent to touchables and 1 per cent to others.

Hailing the announcement, Adichunchanagiri Math pontiff and Vokkaliga leader Nirmalanandanatha Swami said the demand was made for 12 per cent reservation keeping in view the condition of the community.

“Given the situation, the government has increased the reservation from four per cent to six per cent for which we thank the government. We welcome the move,” he said.

The Panchamasali community of the Lingayat sect and the Vokkaligas have been demanding a hike in reservation for quite a long time.

AIMIM chief Owaisi praises KCR in Bihar

    [ad_1]

Patna: AIMIM chief Asaduddin Owaisi showered praise on K Chandrasekhara Rao, the Chief Minister of his home state of Telangana, which is bracing for assembly elections later this year.

The Hyderabad MP was replying to queries from journalists in Bihar’s Kishanganj district, before winding up his tour of “Seemanchal”, a densely populated but poverty-ridden and flood-prone region of the state.

“I must say KCR has a vision. And he has done something worthwhile during his tenure, so far,” said Owaisi on Sunday in reply to a question about Prime Ministerial ambitions of regional satraps like Rao. Owaisi also praised KCR’s counterparts in Bihar and West Bengal, Nitish Kumar and Mamata Banerjee, respectively.

“Telangana is a landlocked state. Yet it has a very impressive gross state domestic product. It used to rank the highest in terms of use of pump sets. It is still the second highest producer of fisheries,” said the AIMIM Chief, whose party has seven MLAs in the 119-strong assembly.

Although KCR’s party, the Bharat Rashtra Samithi (BRS), enjoys a brute majority, it faces a challenge in the upcoming elections with the BJP making inroads and, according to many political experts, tipped to replace the Congress as the principal opposition in Telangana.

Owaisi also lambasted the Congress and its allies for “crying democracy is in danger over what happened in Maharashtra but looking the other way when our MLAs in Bihar were lured away”.

The AIMIM had won five seats in the Bihar assembly polls of 2020 and four of its MLAs joined the RJD last year, one of them even getting a cabinet berth.

Owaisi said, “We wanted an alliance with Mahagathbandhan in 2020, but they derided us… Our performance was there for all to see. We had contested only 10 seats. In 2025, we will field our candidates in 50 constituencies of the 243-strong Bihar assembly”.

  • On Bhiwani killings, Owaisi says Cong govt failed Muslims miserably in Raj

On Bhiwani killings, Owaisi says Cong govt failed Muslims miserably in Raj

    [ad_1]

Jodhpur: AIMIM chief Asaduddin Owaisi on Saturday urged Muslims to participate in politics to get justice and to evolve from being “vote givers” to “vote givers.”

Owaisi, who was in Jodhpur for a day, has been exploring possibilities for his party in Rajasthan, which is up for elections at the year end.

“Muslims only give votes and do not take votes like many other communities such as Jat, Rajputs, Gujars etc. These communities have not only given votes but taken votes too and have solved many of their problems unlike Muslims,” said Owaisi.

He said Muslims need to learn from these communities and build their leadership.

“Democracy is not just about casting your vote. You also need to participate in it. Only then you will be able to do something for yourself,” he said.

“We want to offer Rajasthan a political alternative, where BJP and Congress are engaged in a musical chair game,” he said.

Owaisi said Congress government in the state has disappointed Muslims miserably, and referred to the murder of Junaid and Naseer in Haryana by cow vigilantes.

“Why did Ashok Gehlot and other Muslim legislators of Rajasthan not visit the families of victims when they could have done it instantly. It took Gehlot a long time to visit them and that too after we criticised them,” he said.

Owaisi also criticised the BJP-led Haryana government over its handling of the Junaid and Naseer murder case and called one of the prime accused in the case, Monu Manesar, a “Darling of RSS.”

“Monu and all other accused are RSS-backed. Monu is the darling of RSS so there is no question of action against him. How can the BJP government of Haryana take action against him,” he said.

Owaisi alleged that Monu and his gang, with the patronage of RSS, are doing extortion, murders, terrorism, and firing in the name of gau-raksha.

“They are a militia. Criminals are being promoted. I would not be surprised if Monu is given a ticket by the BJP in the next election,” he said.

The Hyderabad-based leader also accused the BJP of trying to appease Muslims only to impress the Arab world.

“Had it not been so, it would have given the Pasmanda Muslims a status of Dalit. They have to just amend a 1950 presidential order,” he said.

Owaisi called Congress leaders arrogant, self-obsessed, and removed from reality.

“Congress is losing due to internal fights, ideological compromise. It has no strength and vision left. The party is altogether engaged in politics of opportunities and convenience,” he said.

  • BJP MPs called for Muslim boycott but Modi busy targetting KCR: Owaisi

BJP MPs called for Muslim boycott but Modi busy targetting KCR: Owaisi

    [ad_1]

Hyderabad: AIMIM chief Asaduddin Owaisi on Saturday remarked that while MPs of the Bharatiya Janata Party (BJP) have given calls for the economic boycott of Muslims, Prime Minister Narendra Modi is busy targetting Telangana chief minister K Chandrashekhar Rao and his family for his ‘leadership in Telangana’s inclusive development’.

Owaisi’s remarks towards the Prime Minister come on the same day as Kavitha’s probe by the Enforcement Directorate (ED) for her role in the Delhi Liquour policy scam case.

“BJP MPs have called for economic boycott of Muslims; they’ve asked people to keep weapons at home. But Modi govt is busy targeting @TelanganaCMO & his family for his leadership in Telangana’s inclusive development,” he tweeted.

He was referring to BJP MP’s Parvesh Sahib Singh Verma’s alleged remarks calling for a ‘total boycott’ of Muslims while speaking at a meeting organised by the Vishwa Hindu Parishad in north-east Delhi’s Dilshad Garden in October 2022.

Bharat Rashtra Samithi (BRS) leader K. Kavitha on Saturday joined the Enforcement Directorate’s (ED) probe in connection with the Delhi Excise Policy scam case.

She reached the ED office at around 11.05 a.m., and her statement will be recorded under section 50 of the Prevention of Money Laundering Act.

A woman deputy director level official will record her testimony.

Kavitha, the daughter of Telangana Chief Minister K. Chandrasekhar Rao, was summoned to join the probe on Thursday, but she wrote a letter seeking more time after which her questioning was postponed for Saturday.

On Friday, she staged a protest at Jantar Mantar and claimed that she had never met former Delhi Deputy Chief Minister Manish Sisodia, adding that her name was unnecessaryily being dragged into the matter.

According to the ED, Kavitha is also one of the representatives of South Group which allegedly paid a kickback of Rs 100 crore to AAP leaders.

The BRS leader might be confronted with the Hyderabad-based businessman Arun Pillai who was arrested on Friday as the latter is also from the South Group.

“The South Group was represented by Abhishek Boinpally, Arun Pillai and Buchi Babu. Boinpalli facilitated the transfer of Rs 100 crore kickback in connivance and conspiracy with Nair and his associate Dinesh Arora. Now we will have to confront Pillai with Kavitha,” an ED source had said.

Sisodia is currently on ED’s remand.

There are possibilities that Kavitha might be confronted with Sisodia in connection with the alleged kickback.

Hindutva crimes on the rise under Bihar’s ‘secular’ govt: Owaisi

    [ad_1]

Hyderabad: AIMIM chief Asaduddin Owaisi on Thursday remarked that Hindutva crimes are on the rise under the governance of a ‘secular’ government in Bihar.

Owaisi’s ‘secular’ jibe was directed at the JD(U)-RJD-Congress alliance which is currently in government in the state.

“Hindutva crimes are on the rise under the “secular” government of Bihar. In some places the police persecute 12-year-old Rizwan and at other places, instead of helping a citizen, abuse him and make him run away. Team brothers @yadavtejashwi @NitishKumar Will Naseeb get justice or Should work be done with Iftar party?” he tweeted.

Owaisi was referring to the case of 12-year-old Rizwan who was arrested along with his seventy-year-old grandfather after communal violence erupted in Siwan on September 12, 2022 and the latest case of the lynching of a Muslim man on suspicion of carrying beef.

The 47-year-old Muslim man was lynched to death by a Hindu mob who accused him and his nephew of carrying beef. The incident happened in Rasulpur of Chhapra district, Bihar on March 7.

In a press release, police said that three people have been arrested and the hunt is on for the remaining accused.

According to Maktoob Media, the deceased Naseeb Qureshi and his nephew Firoz Qureshi were returning home when they were attacked by a mob of 10-15 people.

  • Owaisi welcomes SC ruling on appointment of CEC, ECs

Owaisi welcomes SC ruling on appointment of CEC, ECs

    [ad_1]

Hyderabad: IMIM president Asaduddin Owaisi on Thursday welcomed the Supreme Court ruling that the appointment of Chief Election Commissioner and the Election Commissioners will be done by the President on the advice of a committee comprising Prime Minister, Leader of the Opposition in Lok Sabha and the Chief Justice of India.

Addressing a public meeting organised here on the occasion of AIMIM’s 65th Foundation Day, he hoped that transparency will come with the SC decision and that the Election Commissioner would be more independent.

“For democracy, it is necessary that transparency comes in the Election Commission and he (Election Commissioner) gets more independence,” he said.

During the debate on Article 324 in the Constituent Assembly, all favoured more powers to the Election Commissioner, he said.

In a landmark verdict aimed at insulating the appointment of the Chief Election Commissioner and Election Commissioners from the executive’s interference, the Supreme Court on Thursday ruled that their appointments will be done by the President on the advice of a committee comprising the Prime Minister, Leader of the Opposition in the Lok Sabha and the CJI.

Owaisi spoke about the comments of radical preacher Amritpal Singh in Punjab, and in an apparent reference to Union Home Minister Amit Shah, he asked as to why is the latter silent on the issue.

“We would like to ask India’s Prime Minister. In Punjab, one ‘saahab’ has come from Dubai. His name is Amrit. BJP says it is ‘Amritkaal’. Who is this Amrit in ‘Amritkaal’ and why is the Amit silent?,” he said.

“If any Muslim said the same thing, our TV anchors would have shown it 24 hours. (They would have said) ‘Owaisi said this today. He spoke about the country’. But, what is this? Nothing is said on this,” he said.

The AIMIM president asked his party leaders to start preparations for the Assembly elections to be held in Telangana later this year.

The preparations should be to see that hatred ends and peace wins and the progress of Telangana continues, he said.

He said the people have to decide whether they want “Constitution or bulldozer.”

The AIMIM president said his party would increase its strength in the Telangana Assembly polls. At present, the party has seven members in the Telangana Assembly.

Alleging that the BJP is moving forward in the State with a message of hatred, he hoped that the people of Telangana would reject it.

He indicated that the AIMIM would also contest in the upcoming Karnataka and Rajasthan Assembly polls.

Reiterating his allegation on “China’s intrusions into Indian territory,” he attacked External Affairs Minister S Jaishankar’s reported comments that ‘China is a bigger economy than India’s”.

He said AIMIM would like to ask the Prime Minister, ‘RSS people’ and the ‘BJP-bhakts’ whether India is small.

“The country does not become big or small with economy, Modi ji. The country becomes big by having a big heart,” he said.

If a country becomes big or small on the basis of its economy, why is Ukraine fighting against Russia and why did Vietnam fight with the US, he asked.

“BJP and the PM does not have faith on the country’s army and the people. You say India is small because of economy. What ‘Vishwa guru’ the PM is talking about,” he said.

Wondering what message would have gone to the world, including US, Britain and other countries, he said the message would be that India considers China to be big and sees itself as small.

Though China is big, India cannot lose its territory, he said. India is also a nuclear power, he added.

Referring to ‘Junaid and Naseer’ (two Rajasthan men whose charred bodies were found in Haryana), he alleged that Rajasthan Chief Minister Ashok Gehlot did not go to console their family members. However, there is information that Gehlot may go because AIMIM is speaking about it, he said.

AIMIM condemns the deaths of Junaid and Naseer in Rajasthan and also Khadeer Khan in Telangana allegedly following police interrogation recently, he said.

Owaisi claims Uddhav, Pawar didn’t support Muslims in their time of need

    [ad_1]

Thane: All India Majlis-e-Ittehadul Muslimeen (AIMIM) president Asaddudin Owaisi has asked the Muslim youth to become a strong force in the country to fight for their rights and targeted leaders like Uddhav Thackeray and Sharad Pawar, claiming they did not support the community members in their time of need.

Owaisi was addressing a rally in Mumbra area of Maharashtra’s Thane district on Saturday during his party’s national convention.

“If Ajit Pawar, Supriya Sule, Sharad Pawar, Uddhav Thackeray, Eknath Shinde and Devendra Fadnavis can become leaders, why can’t you?” he asked the Muslim community youth.

The AIMIM was formed 65 years back and just a handful of people used to attend its meetings, but the number has now gone up to thousands, he said.

“We also have the presence in Parliament, state Assemblies and local bodies and this growth should continue unabated and the youth should try to get into the administration as well through election,” he said.

He asked the youth to come forward, make the AIMIM strong and fight for the rights of Muslims and Dalits.

Owaisi targeted Shiv Sena (UBT) leader Uddhav Thackerary and sought to know why he kept silent when “our community members faced harassment”.

He further said Nationalist Congress Party (NCP) president Sharad Pawar wants to defeat Prime Minister Narendra Modi, and wants support from the AIMIM.

“But he forgets that when it comes to supporting Muslims at the time of their crisis, he never bothered to come forward and left us to our fate. What kind of secularism is this?” he asked.

He also hit out at the Congress, saying its leaders had time for the Bharat Jodo Yatra and other activities, but did not turn up to console the families of those killed in mob lynching and other incidents.

Owaisi said his party will put up “sher” (strong) candidates against those who claim to be holding on to their bastions.
“You cannot purchase everyone with money power, we still have some people who are loyal to us and with them we will defeat you,” he said without naming anyone.

The AIMIM leader said he cannot be bought with money power.
