    Judge orders partial release of Georgia grand jury report on possible 2020 election crimes

    Fulton County District Attorney Fani Willis indicated last month that decisions on whether to charge any subjects of her investigation are “imminent.” Her year-long probe into whether Trump violated Georgia election law — in part by urging Secretary of State Brad Raffensperger to “find” enough votes to reverse the outcome — featured extensive efforts to compel testimony form some of Trump’s top White House and campaign advisers, as well as his outside lawyers.

    Dispite Willis’ preferences on timing, McBurney said he had to prioritize the public’s right to know about at least the general findings of the probe into alleged efforts to tamper with the 2020 election results.

    “While publication may not be convenient for the pacing of the district attorney’s investigation, the compelling public interest in these proceedings and the unquestionable value and importance of transparency require their release,” McBurney wrote in his eight-page order.

    A spokesperson for Willis did not immediately respond to a request for comment on the judge’s order and whether she will seek to appeal it.

    McBurney ruled that aspects of the report that recommend whether to indict — or not indict — specific individuals should remain private for now in part because those individuals are not afforded the same due process rights during the grand jury process they would have in court if they’re charged.

    While witnesses were permitted to have their lawyers nearby during the grand-jury proceedings, those lawyers were not permitted to sit in on the interviews to help mount a defense or rebut questions from prosecutors and grand jurors.

    Willis’ office got court approval for the special grand jury investigation last January and impaneled the actual jury in May.

    The probe stems in large part from a phone call Trump held with Raffensperger on Jan. 3, 2021, asking him to locate more than additional 11,000 votes for Trump so that he could be deemed the victor over Joe Biden in the state. Raffensperger and other state officials repeatedly told Trump they’d looked into allegations he’d made of fraud and hidden stashes ballots, but found nothing to support them.

    While the Georgia officials stood firm, a recording of the call indicates Trump continued to press, largely ignoring their explanations.

    But the probe significantly broadened over time to focus on Trump’s larger effort to subvert the 2020 election, in part by pushing allies in several states to deliver false sets of presidential electors to Washington. Among the witnesses Willis compelled to appear in Fulton County: Rudy Giuliani, Mike Flynn, Sen. Lindsey Graham (R-S.C.) and Mark Meadows, all of whom lost court battles to resist her summons.

    Many legal analysts have said the call could amount to an illegal attempt to tamper with the election results, although Trump has described the call as “perfect.” The special grand jury also explored efforts other Trump supporters made to urge recounts or decertification of the election results in the days before Congress met to tally the electoral votes on Jan. 6, 2021.

    Trump’s lawyers did not seek to intervene in the litigation over releasing the special grand jury’s report. The former president’s attorneys issued a statement last month saying they assumed the investigative body recommended no charges since it never subpoenaed him or sought a voluntary interview.

    Trump’s attorneys did not immediately respond to a request Monday for comment on the judge’s new order.

    Under Georgia law, special grand juries cannot return indictments, but their results can be used by prosecutors to take a case before a regular grand jury to seek criminal charges.

    Maha orders SIT probe into scribe’s ‘killing’, Congress demands judicial probe

    Mumbai: Under flak from various quarters for the “killing” of a Ratnagiri journalist Shashikant Warishe, the Maharashtra government will on Saturday set up a Special Investigation Team (SIT) to probe the case.

    Deputy Chief Minister Devendra Fadnavis, who holds the home portfolio, ordered the police to form the SIT and investigate Warishe’s killing even as the Opposition Congress demanded a judicial probe panel.

    Fadnavis has directed the police department to set up the SIT headed by a senior officer and conduct the investigations into the case which has grabbed national attention.

    On the other hand, Congress Chief Spokesperson Atul Londhe has sought an inquiry commission headed by a sitting or retired Bombay High Court judge to carry out the case probe, plus the report must be handed over to the court and not the state government.

    “It must be noted that Fadnavis had in the past declared that the Barsu refinery complex (originally due to come up at Nanar) will come up no matter what and nothing can stop it…” Londhe pointed out, demanding the judicial probe to ascertain Warishe’s killing and a possible conspiracy behind it.

    On Monday, Warishe, 46, was knocked down and dragged on his bike by a SUV allegedly driven by a local realty agent, Pandharinath Amberkar, 42.

    While the scribe succumbed to his serious injuries on Tuesday, following a massive hue and cry, Ambedkar was arrested and charged with murder, as the incident reverberated nationally.

    Major media organisations, rights and social groups, NGOs, and almost all major political parties like Congress, Nationalist Congress Party, Shiv Sena (UBT), CPI, and others have rallied together to condemn Warishe’ killing, and unravel the plot behind it.

    Warishe had run a series of articles opposing the Barsu refinery-cum-petrochemicals complex – billed as the world’s biggest – coming up at a cost of Rs 3.50 lakh-crore, with foreign collaboration in Ratnagiri.

    Earlier, following protests by locals, the erstwhile Maha Vikas Aghadi government had scrapped the Nanar location and the next regime has finalised Barsu as its new location, which is also facing huge opposition.

    Warishe had been running a campaign against the upcoming refinery and petrochemicals complex coming up in the region, while Amberkar was a supporter of the mega-project.

    Journalists and other organisations took out silent protest marches in Mumbai on Friday and in Rajapur on Saturday demanding justice for Warishe’s family and ensuring stringent punishment to the prime accused Amberkar.

    SRINAGAR: The administration has issued another order and asked tehsildars to make sure that agricultural land of missing people is not sold by their family members or that crop proceeds are not used by any third party.

    This comes as the crackdown on properties in Jammu and Kashmir that are allegedly encroaching government land continues.

    “It has been brought to my notice that in Tehsil Tangmarg that there are some land patches, belongs to those persons who are not traceable,” reads the order issued by the divisional commissioner Kashmir.

    It reads that they are neither traceable nor receive their share of crop yield and in such a situation there is difficulty in getting such land mutated.

    “In such situation the Standing Order No:23-A is clearly stipulates that for a period of more than 7 years, whenever any land holder is absent from the village and does not cultivate the land or do not take share of the produce, he shall be designated as “GAIR HAZIR/GAIR KABIZ” (not present / not in occupation) and the person who is in possession the land, is to be recorded as “KABIZ”.In such a situation, after making reasonable efforts/ enquiry; the concerned Tehsildar shall presume that he is dead and pass orders on the case accordingly. Before making formal entry into revenue record, he shall also get it confirmed/ approved from the District Collector concerned,” it added.

    “The share of such “GAIR HAZIR/GAIR KABIZ” persons may be allowed to be used by the family members/ other co-sharers (in blood relation). However, they shall not be entitled to sell, gift or in any manner alienate the share of such “GAIR HAZIR/GAIR KABIZ” persons or create 3rd party interest in the property in any manner. No FARD-INTIKHAB of such lands shall be issued,” it further added.

    “Necessary entry in this regard also shall be made by the concerned Tehsildar. Specific input from the office of Special DG, CID has been received, in which it is apprehended that such ‘GairHazir- GairKabiz’ properties are used for financiering militancy. There are specific instances of misuse. In such a situation, strict preventive action needs to be taken on priority,” reads the order.

    It reads that above provisions shall not be applicable to the immovable property of Migrants. As provisions of J & K Migrant Immovable Property (Prevention, Protection and Restraint on Distress Sale) Act, 1997 have superseding effect over all other laws.

    “In this backdrop, you are directed to take immediate necessary action in light of above directions/ instructions in the matter,” it added.

    According to Government Order No.207-JK(GAD) of 2023, issued by the General Administration Department (GAD, Dheeraj Gupta, IAS (AGMUT:1993), Principal Secretary to the Government, Housing and Urban Development Department, holding additional charge of smart Cities and proposed new Jammu/Srinagar Metropolitan Regional Development, is transferred and posted as Principal Secretary to the Government, Department of Forest, Ecology and Environment.

    Kolkata: A single judge bench of the Calcutta High Court on Thursday directed the West Bengal School Service Commission (WBSSC) to terminate the services of 2,819 illegally-appointed non-teaching staff of Group-D category in different state-run schools.

    Justice Abhijit Gangopadhyay of the Calcutta High Court directed the commission to upload the list of these 2,819 non-teaching staff on the commission’s website within 24 hours and accordingly start the process of terminating their services.

    The WBSSC counsel on Thursday admitted before the court that following the review of the recruitment details of these 2,819 non-teaching staff, it has been proved beyond doubts that there had been irregularities in the recruitment process, especially tampering of the optical mark recognition (OMR) sheets in the written examination.

    Thereafter, Justice Gangopadhyay said that when the commission is admitting that there had been irregularities, it should initiate the necessary proceedings in the matter at the earliest.

    “First publish the names of these candidates on the website and then cancel their appointments. Complete the entire process within the next 24 hours,” Justice Gangopadhyay directed the WBSSC’s counsel.

    It is learnt that on Friday, the commission will submit an affidavit to the court in the matter. Thereafter, first these names would be published on its website following which the commission will order for cancellation of their appointments.

    A state education department official, who refused to be named, said that several schools will face crisis after this order of the high court is implemented.

    “There are several schools which have just one Group-D staff responsible for jobs like locking and unlocking of classrooms and ringing the period bell, among others. Now the teachers employed in these schools will have to do that work till the time fresh appointments are made,” he said.
