H&ME Orders Inquiry Into Violation Of Norms By DHSK

SRINAGAR: The Health and Medical Education (H&ME) department on Tuesday ordered an inquiry into the alleged violation of government rules and regulations by the Director of Health Services Kashmir (DHSK).
The director has allegedly delegated financial powers to Chief Medical Officers (CMOs) in contradiction to the established protocols.
As per an order, issued by Secretary Health, Director Medical Supplies corporation limited Pankaj Gupta has been appointed as inquiry officer and has been directed to submit a report within 20 days.
As per the order, the inquiry officer has been asked to find reasons for delegating financial powers to Chief Medical Officers by the Director Health Services Kashmir in violation of rules and regulations and in spite of the fact that a Central Purchase Committee, duly constituted by the government, existed at the Directorate level.
He further has been directed to find reasons for further delegation of financial powers by Chief Medical Officer, Anantnag to Block Medical Officer, Saller against extant rules, establish whether Block Medical Officer, Saller exercised authority in violation of instructions issued by Director Health Services Kashmir, and even procured items available with JKMSCL against the mandate of purchase committee or not. In case of later, compelling reasons thereof.
Further, inquire how BMO Saller ascertained rates’ reasonability and establish whether the rates were reasonable or not and establish whether procured items bear the requisite technical specifications or not, the order reads.
“The Inquiry Officer shall fix responsibility for failure in observing financial propriety at various levels. The inquiry shall also extend to procurements made for the Baltal axis of Sh. Amarnath ji Yatra during 2022. The Inquiry Officer shall submit the report within a period of 20 days from the issuance of this order,” reads the order—(KNO)

Delhi HC orders Google to remove YouTube videos claiming Indian spices contain cow dung, urine

New Delhi: In view of some videos posted on YouTube channels claiming that all Indian spices contain cow dung and cow urine, the Delhi High Court has ordered Google to take them down.
These videos targeted several Indian brands, including ‘Catch Foods’.
Justice Sanjeev Narula of the Delhi High Court prohibited the Two YouTube channels from defaming and violating the copyright of the conglomerate Dharampal Satyapal Sons Pvt Ltd, which is the owner of goods sold under the ‘Catch’ brand.

The court observed that the videos contained defamatory words without any justification.
Stating that the defendants made such fraudulent statements and spread false information under the guise of disclosing truth or facts concerning Indian spices, the court noted that there was no authoritative material or underlying cause for this.
The court said: “The impugned videos contain defamatory remarks against the plaintiff’s products without any basis. The plaintiff has placed on record a list of ingredients contained in its products/spices advertised in the impugned videos. It has obtained certification from all the concerned regulatory bodies and has even presented reports of an independent food analysis by a certified laboratory, which do not indicate presence of cow dung, cow urine or any other contaminants, as alleged in the impugned videos.”
Google had already been directed to disable access to the videos and provide the basic subscriber data, which it did and later summons were issued to TVR and Views News. As they did not show up, the court decided to continue ex-parte.
Rule 4(4) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, which mandates additional due diligence to be observed by social media intermediaries in case such content is uploaded or streamed online, was also brought to the court’s attention by the plaintiff who urged for a summary judgement.

The court observed that the defendants’ failure to take action to remove the infringing content notwithstanding the plaintiff’s complaint, which was also confirmed by one of the defendants, demonstrated mala fide intentions.
As a result, the court decreed the suit against the defendants. It directed that in the event the videos appear again, the plaintiff might give Google the URLs, and Google will be required to take the appropriate steps to ensure that they are removed.
The court made it clear that if the content is different, Google could let the plaintiff know within a week and the plaintiff could then take appropriate legal action.

Consumer court orders Guwahati cinema hall to pay Rs 60,000 to woman who was bitten by rat

Guwahati: A cinema hall in Guwahati was asked by a consumer court to pay Rs 60,000 to a 50-year-old woman, who was bitten by a rat during a movie show.
The District Consumer Disputes Redressal Commission of Kamrup directed Galleria Cinema in Bhangagarh to pay the woman Rs 40,000 as compensation for mental agony, and Rs 20,000 for pain and suffering, besides reimbursement of medical bill of Rs 2,282 and another Rs 5,000 towards covering the cost of proceedings.
The woman had gone to the hall with her family for the 9 pm show of a movie on October 20, 2018. During the interval, she felt something had bitten her on the foot, and she immediately rushed out after starting to bleed, her lawyer Anita Verma told PTI on Friday.

The cinema hall authorities failed to provide her with any first aid and none of its staff accompanied her to the hospital, she maintained.
“At the hospital, she was kept under observation for two hours as the doctors were initially not sure what had bitten her. She was later treated for rat bite,” Verma added.
She moved the court, seeking compensation of Rs 6 lakh for mental agony, pain and suffering, besides the amount incurred towards her medical treatment and other expenses.
Contesting the allegations, Galleria Cinema said that proper hygiene is maintained within its premise and that they had offered first aid to the woman, which she had refused.
Galleria Cinema urged the court to reject the complaint, and sought a compensatory cost of Rs 15,000.

After hearing the arguments, and taking into consideration the documents submitted by woman and that no evidence could be produced in support of the claims made by the cinema hall, the court ordered the payment of the compensation on April 25.
The cinema hall was negligent in maintaining hygiene for giving proper service to the viewers as required under the Cinematography Act and other obligations, the court said.
The amount is to be paid within 45 days, failing which an interest of 12 per cent per annum will be levied from the date of judgement, it said.

State Govt Issues Shoot At Sight’ Orders: The Manipur government has issued “shoot-at-sight orders” as a last resort to control the situation amid spiralling violence in the state between tribals and the majority Meitei community which has displaced over 9,000 people from their villages.
Clashes first broke out on Wednesday in Churachandpur town after tribal Kuki groups called for protests against a proposed tweak to the state’s reservation matrix, granting scheduled tribe (ST) status to the majority Meitei community. Violence quickly engulfed the state where ethnic fault lines run deep, displacing thousands of people who fled burning homes and neighbourhoods.
The violence didn’t abate till late on Thursday evening even as thousands of army and paramilitary personnel fanned across the state, marching through the deserted streets of the state’s violence-hit towns to restore peace, and evacuating at least 9,000 people.
The Indian army in statement late on Thursday said that the situation in the towns of Moreh and Kangpokpi was stable and had been brought under control.

The Manipur government on Thursday issued “shoot at sight” orders in “extreme cases” after violence in the state spilled over to Imphal. Rapid Action Force (RAF) was flown in and 55 army columns were deployed to contain the spiraling violence.
According to sources, Centre is rushing additional troops to the state. The Indian Air Force (IAF) will airlift forces from Guwahati and Tezpur in Assam. Former CRPF chief Kuldeep Singh has been appointed as the security advisor for Manipur while senior IPS officer Ashutosh Sinha made the overall commander overseeing the peace restoration operations in the state.
Union Home Minister Amit Shah will not be travelling to Manipur today. Mr Shah on Thursday spoke with the chief ministers of Manipur and its neighbouring states and held meetings with top central and state bodies through video conferencing to review the situation in the state.
Although the government is yet to confirm the number of lives lost, if any, or how many have been injured in the clashes, over 9,000 people from various districts have been evacuated and given shelter in special camps. Around 5,000 have been shifted to Churachandpur, another 2,000 people were shifted to Imphal Valley, and 2,000 people to the border town of Moreh.
“The government is taking all measures to maintain the law and order. We are committed to protecting the lives and property of all our people,” Manipur Chief Minister N Biren Singh said on Thursday.
In the wake of the violence, Meghalaya Chief Minister Conrad K Sangma on Thursday directed officials to evacuate students of his state studying in various schools and colleges in Manipur.
The violence began on Wednesday during protests by various tribal groups of Manipur over a court order on Scheduled Tribe status.
The All Tribal Student Union Manipur (ATSUM) called a ‘Tribal Solidarity March’ in Torbung area of Churachandpur district to protest against the non-tribal Meitei community’s demand for a Scheduled tribe status. According to the police, thousands took part in the rally during which violence broke out between some tribal groups and non-tribals.
The Meitei, who are the majority in the state, primarily inhabit the Manipur valley. The Meitei’s claim that they are facing difficulty in view of “large-scale illegal immigration by Myanmarese and Bangladeshis”. As per existing law, the Meiteies are not allowed to settle in the hill areas of the state.
Given the volatile atmosphere in the state, internet services have been suspended across the state till Monday, train operations have been stopped and curfew imposed in non-tribal dominated Imphal West, Kakching, Thoubal, Jiribam and Bishnupur districts and tribal-dominated Churachandpur, Kangpokpi and Tengnoupal districts.

School Edu Deptt Kulgam orders closure of Pvt coaching institutes from 9:45 am to 4:15 pm

Srinagar, May 03: The School Education Department in south Kashmir’s Kulgam district Wednesday ordered private coaching institutes not to function during the schooling hours.
Officials of the School Education Department of the district said the orders were issued to keep the academic going smoothly.
According to the news agency—Kashmir News Observer (KNO), Chief Education Officer (CEO) Kulgam said, “In the backdrop of complaint pouring public at large and in the interest of smooth functioning of the regular all the registered coaching centre owners are put under strict instructions to keep their coaching centres closed from 9:45 am to 4:15 pm excluding in holidays so that the class work of the students is not affected.”
It also warned the government teachers of strict actions if found practising in the private coaching institutes.
“The government employees of the Education Department are strictly advised to refrain from engaging in private coaching which is sheer violation of government orders and invites action as warranted under rules,” the CEO also.
It also said that if any negligence in this behalf is found, the department will take serious and strict actions under rules without any further notice.
Pertinently, the government in the previous academic session had announced prohibition on any activity or assignment including the private tuitions by teaching faculty of School Education Department.
The government has said that it has observed that some members of teaching faculty of School Education Department are undertaking coaching assignments in private institutions and coaching centres even during school hours in violation of Rule 10 of the Jammu and Kashmir Government Employees (Conduct) Rules, 1971 as well as Chapter (IV) Section 28 of RTE Act, 2009.”

The department in a circular issued in 2022 has also said that the Rule-10 of the Jammu and Kashmir Government Employees (Conduct) Rules, 1971 states, “No Government employee, whether on leave or active service, shall except with the previous sanction of the government engage directly or indirectly in any trade or business or undertake any other employment.”—(KNO)

Dubai ruler orders humanitarian aid for displaced Sudanese

Abu Dhabi: Sheikh Mohammed bin Rashid Al Maktoum, Vice-President and Prime Minister of the UAE and Ruler of Dubai, has ordered urgent humanitarian support to Sudanese displaced by the conflict in their country, the Dubai Media Office (DMO) reported.
The assistance will consist of food parcels and rations, which will be delivered through the Mohammed bin Rashid Al Maktoum Global Initiatives (MBRGI).
Sheikh Mohammed stressed the depth of cultural and historical ties between the UAE and Sudan, stressing that the UAE is always keen to support brotherly countries.

J&K Govt Orders Recruitment of Workers And Helpers For Anganwadi Centers – Kashmir News

Srinagar, May 02 : The government of Jammu and Kashmir has Tuesday sanctioned the recruitment of Sanginis (Anganwadi Workers) and Sahayikas (Anganwadi Helpers) for Anganwadi centers across the union territory.
As per the order issued by the social welfare department a copy of which lies with the news agency (KNO), the recruitment will be done strictly as per the procedure laid out in the new Human Resource policy issued under the Government Order No. 222-JK(SWD) of 2022.
“The eligibility criteria for the selection of Sanginis require that women candidates in the age group of 18-37 years should be considered for the post. The candidates should be domiciles of the UT of J&K and residents of the Electoral Ward where the Anganwadi Centre is located,” the order said, adding that the minimum qualification for Anganwadi Workers should be 10+2 and a maximum of graduation. The selection will be done purely on merit basis based on the marks obtained in 10+2.
The eligibility criteria for the selection of Sahayikas require that women candidates in the age group of 18-37 years should be considered for the post. “The candidates should be domiciled of the UT of J&K and the minimum qualification required is matriculation. In case no matriculate candidate is available in the ward, candidates with qualification not less than VIII standard shall be considered,” it added.
The order further said that the Selection Committee comprising Child Development Project Officer (CDPO), Block Development Officer (BDO), and Zonal Education Officer (ZEO) concerned in each Project/Block shall have the mandate to make selections of the eligible candidates for the position of AWH.
“The Committee shall select the most destitute/needy married woman of the ward as a helper from amongst those who fulfill the qualification criteria. In case no married candidate is available, an unmarried candidate may be considered,” it added.
Similarly for Aanganwadi Worker (Sangini), the concerned CDPO, with prior approval from MD, Mission Poshan, shall invite applications from eligible candidates through advertisements in prominent newspapers, uploading on the district and department websites, and notifications in all government offices and Panchayat Ghars.
“A Selection Committee shall be constituted in each district to make selections of eligible candidates for the post of AWW. The committee shall comprise the officers including District Program Officer, ICDS concerned – Chairperson, District Social Welfare Officer concerned – Member, CDPO concerned – Member Secretary, Assistant Director Employment concerned – Member and General Manager, DIC concerned – Member,” it said.

The Selection Committee shall prepare the final merit list and select list, which shall be publicly displayed in local newspapers, offices of all committee members, Panchayat Ghars, and on the website of the department. A copy of the final merit list and select list shall also be provided to the concerned Sarpanch and Panch, with a receipt on the same day of issuance, for a period of 10 days for any appeals. After that, the Committee shall submit its recommendations to the concerned ADDC for approval. The CDPO concerned shall issue the engagement orders of AWW accordingly, after the ADDC’s approval.
