    SC order on EC appointments: Rijiju invokes ‘Lakshman Rekha’

    New Delhi: Law Minister Kiren Rijiju on Saturday invoked the constitutional “Lakshman Rekha” guiding different institutions, including the executive and the judiciary, and wondered if judges become part of administrative appointments, who would carry out judicial work.

    Rijiju was responding to a question on a Supreme Court bench directing the government to set up a panel comprising the prime minister, the chief justice of India and the leader of opposition in the Lok Sabha to select the chief election commissioner (CEC) and election commissioners till a law is in place for the same.

    “The appointment of election commissioners is prescribed in the Constitution. Parliament has to enact a law. Accordingly, the appointment has to be done. I agree that there is no enactment for that in Parliament, there is a vacuum,” the minister said at the India Today Conclave.

    Rijiju said he is not criticising the apex court judgment or talking about its “repercussions” or what the government is going to do on the issue.

    “…But what I am saying is that if the CJI or judges of India sit on every important appointment, who will carry forward the judiciary’s work? There are so many administrative matters in the country. So we have to see that judges are primarily there to deliver judicial work. They are there to deliver judicial orders by giving justice to people,” he said.

    The minister felt that if judges got involved in administrative work, they would have to face criticism. He said the principle of justice will be compromised if a judge ends up hearing a matter of which he or she was a part.

    “Suppose you are the chief justice or a judge. You are part of an administrative process that will come into question. The matter comes to your court. Can you deliver a judgment on a matter you were part of? The principle of justice itself will be compromised. That is why the Lakshman Rekha is very clear in the Constitution,” Rijiju said.

    In a landmark verdict aimed at insulating the appointment of the CEC and election commissioners from the executive’s interference, the Supreme Court ruled that their appointments will be effected by the president on the advice of a committee comprising the prime minister, the leader of opposition in the Lok Sabha and the CJI.

    A five-judge Constitution bench headed by Justice KM Joseph, in a unanimous verdict pronounced earlier this month, held that this norm will continue to hold good till a law on the issue is enacted by Parliament.

    A vacancy will arise in the Election Commission early next year when Election Commissioner Anup Chandra Pandey demits office on February 14 on attaining the age of 65 years.

    Responding to questions on the government’s relations with the judiciary, Rijiju said it will
    not be proper to use the word “confrontation” in describing their relationship.

    “In a democratic setup there are differences of opinions and positions. “Between different organs — the executive, the judiciary and the legislature — there will be issues which run against each other’s ideas. But to say that there is a confrontation is not correct,” he said.

    He asserted that the appointment of judges was not a judicial work but “purely administrative in nature”.

    He said it is the bounden duty of the government to carry out due diligence on the names recommended by the collegium. “Otherwise I’ll be sitting there as a post master. Secondly, as per Constitution, appointment of judges is the duty of the government,” he observed.

    On the issue of the Supreme Court Collegium making public intelligence reports with regard to some candidates recommended for high court judgeship, Rijiju wondered what is the sanctity of carrying out such a great effort in secrecy in the interest of the nation if reports of R&AW or IB are put in the public domain.

    “I am mindful of my responsibility. I’ll never ever put in public domain information which will not serve the purpose for which we are sitting there,” he said.

    On the issue of same-sex marriage, he reiterated that such issues have to be debated in Parliament which reflects the will of the people.

    If a law passed by Parliament does not reflect the spirit of Constitution, the Supreme Court has the option to alter it or pass an adverse judgment or refer it back to Parliament, he noted.

    Policy has to decided by people through their representatives in legislature, he observed.
    On the issue of accountability and “Lakshman Rekha”, he said the judges are not accountable, “you know it.”

    “Many people have suggested that along with the National Judicial Appointments Commission, there should be national judicial commission to regulate the conduct and the process of how courts are maintained, ruled…. So, there are suggestions.

    “I am not going to talk about any particular suggestion…but in general it is coming to me. We all are accountable. Parliament runs under rules, government functions under rules of business,” he said.

    But in courts there are no rules, there are practices which are being changed from time to time and the chief justice as the master of the rooster conducts certain things as far as the holidays are concerned, he claimed.

    “So these are not exactly decided on the basis of rules framed by Parliament but these are on the basis of conventions and practices adopted by SC and different high courts,” he said.

    “…definitely while court is on vacation, cases will come to a halt. It is a fact. Definitely there can be regulation but I am of the opinion that judges require holidays because they deal with cases every day and need a break,” the minister said.

    In order to control pollution and promote circular economy, the Union Ministry of Road Transport has issued a notification of amendment in the Motor Vehicle Act, due to which the registration of these vehicles will be compulsorily cancelled.

    In order to control pollution and promote circular economy, the Union Ministry of Road Transport has issued a notification of amendment in the Motor Vehicle Act, according to which the registration of all government vehicles older than 15 years will be compulsorily cancelled.

    Vehicles whose registration has been renewed (beyond 15 years) will also automatically be considered cancelled. All such old vehicles will have to be disposed of at a registered scrap centre.

    Vehicles of Central Government, Vehicles of State Governments, Vehicles of Union Territories, Vehicles of Corporations, Vehicles of State Transport, Vehicles of PSUs (Public Sector Undertakings) and Government Autonomous Institutions all vehicles older than 15 years will have to be scrapped. However, army vehicles are not included in this. This new order will be applicable from April 1, 2023.

    Significantly, in November last year, the Ministry of Road Transport had issued a draft, in which it was said that all 15-year-old vehicles of the Central and State Governments would have to be scrapped. It was said to apply this rule to the buses and vehicles of the Corporations and the Transport Department as well. Then the government had sought suggestions and objections on the draft in 30 days. Now the government is going to implement this rule.

    In November last, Union Minister Nitin Gadkari had said that government vehicles that are more than 15 years old will be converted into junk. The policy related to this has been sent to the states. He had said, ‘Signed a file under the guidance of Prime Minister Narendra Modi, under which all vehicles of the Government of India that are more than 15 years old will be turned into junk. I have also sent this policy to all the states, they should also adopt it.

    San Francisco: Social discussion forum Reddit on Wednesday said that it has fixed the “internal systems” issue, and that the platform is now back online.

    The company tweeted from its ‘Reddit Status’ account: “Resolved: Alright, things are back in order. We’re peeling a lot better now! Thanks for your patience.”

    Taking to Twitter, several users had reported the issue.

    While one user posted: “Anyone else’s Reddit gone down?”, another said: “Is Reddit down or is this the universe trying to tell me to get a life?”

    According to Downdetector, over 53 per cent of people had reported problems while using the application, 23 per cent with the server connection, and 22 per cent while using the website.

    Meanwhile, the social discussion forum had faced an outage last month which prevented feeds from loading for users on desktop and mobile devices.

    Ludhiana: The BJP on Sunday targeted the AAP government over the law and order situation, saying it has “failed” to take action against self-styled Sikh preacher Amritpal Singh and his supporters in the recent Ajnala incident.

    “Till today, no action has been taken by the Punjab government against the violators,” said BJP leader Kewal Singh Dhillon here while referring to the Ajnala incident.

    Last month, radical preacher Amritpal and his supporters, some of them brandishing swords and guns, broke through barricades and barged into the Ajnala police station on the outskirts of the Amritsar city, clashed with police for the release of one of Amritpal’s aide.

    During the incident, six policemen, including a Superintendent of Police rank officer, suffered injuries.

    BJP leader Dhillon further said, “The law and order is a state subject and responsibility of its maintenance cannot be shifted upon anyone else.”

    He claimed that as a result of “deteriorating” law and order, industrialists of the state are feeling insecure and are contemplating to shift their businesses to other parts of the country.

    Punjab BJP general secretary Jeewan Gupta accused the Bhagwant Mann government of not taking any step to boost industry in the state.

    New Delhi: Delhi’s Rouse Avenue Court on Friday reserved an order on the Enforcement Directorate plea seeking 10-day custodial interrogation of former Deputy Chief Minister and Aam Aadmi Party leader Manish Sisodia in the excise policy scam case.

    This comes after Sisodia was presented before the court at 2 pm today after he was arrested by ED yesterday after hours of questioning in Tihar Jail where the AAP leader is lodged.

    During the hearing, senior Advocate Dayan Krishnan, appearing for Manish Sisodia, opposed ED plea seeking Sisodia’s 10-day custody.

    The agency said that it is seeking 10-day custody to interrogate Manish Sisodia to identify the modus operandi and to confront other persons who have been summoned.

    The ED told the court that Manish Sisodia had purchased SIM cards and mobile phones in other people’s names.

    There was a conspiracy behind framing the excise policy. The conspiracy was coordinated by Vijay Nair, along with others and the Excise policy was brought out for extraordinary profit margin for wholesalers, ED argued in the court.

    ED told the court that the margin of 12 per cent of wholesale profit margin to private entities was never discussed in the GoM meeting.

    The probe agency apprised the court about the meeting between Vijay Nair and K Kavitha (BRS MLC).

    ED stated that accused Butchibabu Gorantla disclosed a political understanding between then Dy CM Manish Sisodia and K Kavitha who also met Vijay Nair. Butchibabu is the former auditor of K Kavitha and is presently on bail.

    Countering Sisodia’s lawyer’s arguements, the ED lawyer told the court that if the policy is a matter of executive then there would not be a coal scam or a 2G scam.

    Earlier, Sisodia was arrested on Thursday by ED in money laundering in connection with the excise policy case.

    He was arrested during his Judicial custody in Tihar Jail, where he was lodged in.

    The Enforcement Directorate (ED) on March 9 arrested former Delhi deputy chief minister Manish Sisodia in the liquor policy case, after hours of questioning at Tihar Jail.

    Sisodia was arrested by the CBI in the liquor policy case on February 26 and was sent to 14-day judicial custody on March 6.

    The ED also made another arrest in the case earlier, as it took Hyderabad-based businessman Arun Ramchandra Pillai into its custody.

    The ED, on Thursday, summoned Bharatiya Rashtriya Samiti (BRS) MLC and Telangana Chief Minister K Chandrashekhar Rao’s daughter K Kavitha for questioning in the liquor policy case.

    Sisodia was arrested by the CBI earlier in its ongoing investigation of a case related to alleged irregularities in the framing and implementation of the excise policy of the National Capital Territory of Delhi (GNCTD). Delhi’s Rouse Avenue Court sent him to Judicial Custody till March 20.

    New Delhi: The Delhi High Court has stayed an order of the National Green Tribunal permitting pruning of trees in the city’s Vasant Vihar area.

    Justice Najmi Waziri issued notices to the city authorities, including the Delhi government and the tree officer concerned, on a petition challenging the NGT order and said that further pruning in the area shall be kept in abeyance.

    Senior counsel for the petitioners contended that pruning in the present case was illegal as it could be done only with strict permission of the tree officer and not on general guidelines and that extensive damage has been caused to trees in the area, which has set back the greenery by a decade.

    “A more detailed assessment of the activity done by the RWA (resident welfare association) needs to be carried out. Further pruning in the area concerned has to be stopped right away…further pruning in the area shall be kept in abeyance,” said Justice Waziri in a recent order.

    The court appointed lawyer Aditya N Prasad as amicus curiae and asked him to assess the situation at site and assist it in the matter.

    The court also called for a fresh affidavit by the tree officer and said he can issue further orders in the matter if necessary.

    The petitioners, Dr Sanjeev Bagai and others, said that under the Delhi Preservation of Trees Act, 1994, the essential part of the preservation is that a tree should not be damaged in a manner which would impede its growth or otherwise severely affect its re-growth and regeneration.

    It was stated that any woody plant which has a height of 30 cm and a trunk diameter of not less than 5 cm is considered a “tree” and is to be protected under the Act.

    In the present case, it was argued, quite a few trees have been lopped off and approximately 800 trees have been pruned in violation of the law.

    The matter would be heard next on March 10.
