    The Government of Jammu and Kashmir on Thursday ordered transfer and postings of 5 officers/officials in the interest of administration.

    According to a government order issued here to kashmir News, Ms. Renu Munshi, Private Secretary, is transferred from J&K Public Service Commission and posted in the Office of Commissioner for Persons with Disabilities, J&K.

    Ms. Syed Anjum Afroz, Section Officer under orders of transfer to J&K Grievance Cell is posted in the Office of Commissioner for Persons with Disabilities, J&K.

    Mr. Ajay Bharti, Senior Stenographer, is transferred from the Information Department and posted in the Information Technology Department.

    Ms.Manu Pandey, Junior Stenographer, is transferred from Information Technology Department and posted in the Information Department,

    Mr.Sarvesh, Junior Assistant, is transferred from Information Technology Department and posted in the Home Department. All the officers/officials shall be deemed to have been relieved. (Kashmir News)

    Sikkim happy as SC removes ‘people of foreign origin’ reference from order

    Gangtok: Citizens of Sikkim including Chief Minister Prem Singh Tamang and other political leaders on Wednesday expressed jubilation after the Supreme Court ordered the removal of reference to the Sikkimese-Nepalese as “people of foreign origin” from its January 13 verdict.

    The remark made by the apex court had sparked protests in the small northeastern state, with the formation of a Joint Action Council (JAC) by people from all sections of the society to carry out demonstrations seeking removal of the tag from the verdict on tax exemption in Sikkim.

    Tamang, who is also the chief of the ruling Sikkim Krantikari Morcha (SKM), state BJP president DR Thapa, opposition Sikkim Democratic Front (SDF) and the JAC said they are happy with the development and thanked the Supreme Court.

    A bench of justices MR Shah and BV Nagarathna earlier in the day modified the verdict while hearing the Centre’s plea along with petitions filed by Sikkim and private parties seeking modification of the remark.

    The chief minister in a social media post said that he wanted to express gratitude to the Supreme Court for its understanding of the sentiment of the people of Sikkim and for resolving the matter.

    “The government of Sikkim has taken up the matter with all due seriousness from day one. We believe in working silently without hullabaloo. Being a responsible government, we never joined the race for one-upmanship for scoring brownie points and earning political mileage on this sensitive issue,” he said.

    State BJP president DR Thapa said that the entire credit for the removal of the “foreigner” tag in the Supreme Court goes to the people of Sikkim as “they have dealt with the issue in a civilised and intellectual way even when it had hurt them very hard”.

    In a statement, the SDF said it is grateful to the Supreme Court for the justice provided to the people of Sikkim.

    “This positive result is a victory of the unity and strength of the Sikkimese people. The SDF party is also grateful to all those who have worked towards achieving this fruitful result,” it said.

    The JAC, which was spearheading protests against the issue for the past few days in the small Himalayan state, expressed happiness at the top court’s order of Wednesday.

    The JAC also called a 12-hour bandh in the state during the day.

    The SC bench said that the error has crept in because the original writ petitioners have made more than 25 amendments to the petition but this fact was not brought to the notice of the court.

    On January 13, the top court had ruled that the exclusion of a Sikkimese woman from exemption allowed under the Income Tax Act merely because she has married a non-Sikkimese man after April 1, 2008, is “discriminatory and unconstitutional”.

    Lucknow: The Lucknow bench of the Allahabad High Court has declined to issue directions to Lucknow Municipal Corporation (LMC) to kill birds and animals that have become nuisance in the state capital.

    Dismissing the plea, the bench held: “Such a direction cannot be issued by the Court as there is no provision which obliges the LMC to kill innocent animals.”

    The bench of Justices Ramesh Sinha and Subhash Vidyarthi passed the order on a PIL moved by a local lawyer Manoj Dubey.

    Arguing for the petitioner, senior advocate Sudeep Seth had sought issuance of a direction for LMC to discharge the duty of eliminating birds, animals, strays and ownerless dogs causing nuisance in Lucknow.

    The bench declined to issue any such direction.

    Welcoming the verdict, animal rights activist Kamna Pandey said: “It is a landmark verdict. It is significant and cuts through the current motivated campaign against dogs seeking to create an atmosphere of hate and hostility towards man’s best friend. It restores balance and returns good sense to the prevailing debate.”

    SC imposes interim stay on demolition order passed by Calcutta HC

    New Delhi: The Supreme Court on Saturday imposed an interim stay on a February 3 order of the Calcutta High Court order directing the demolition of a building.

    In a special hearing, a bench of justices V Ramasubramanian and Hrishikesh Roy issued a notice in the matter and sought a response from the parties.

    Senior advocate Siddhartha Dave, appearing for petitioners, contended that the impugned order directing demolition of the building has been passed in a contempt case which is pending, and the petitioners are yet to be found guilty.

    “It is also contended that in the event of the court carrying out the demolition now and eventually finding the petitioners not guilty of contempt, there must be one more restitution which is not permissible in law.

    “In view of the above, issue notice returnable on March 14, 2023. There will be an interim suspension of the impugned order till the next date of hearing,” the bench said.

    New Delhi: The Supreme Court on Friday declared that Centre’s March 2021 decision, stating Overseas Citizens of India (OCI) appearing for entrance tests to medical courses could not compete for seats reserved for Indian citizens would be applied with prospective effect only.

    A bench of Justices A.S. Bopanna and C.T. Ravikumar said: “The notification suffers from the vice of non-application of mind and despite being prospective, is in fact ‘retroactive’ taking away the rights which were conferred also as a matter of policy of the sovereign state.”

    It further added, “the notification being sustainable prospectively, we hereby declare that the impugned portion of the notification which provides for supersession of the notifications dated 11.04.2005, 05.01.2007, and 05.01.2009 and the clause 4(ii), its proviso and Explanation (1) thereto shall operate prospectively in respect of OCI cardholders who have secured the same subsequent to 04.03.2021”.

    The Central government had argued that OCI cardholders were not eligible for admission against any seat reserved exclusively for Indian citizens.

    Citing that notification is based on a policy, the bench said in the exercise of the statutory power of a sovereign state, it would apply prospectively only to persons who are born in a foreign country subsequent to March 4, 2021. “… the date of the notification and who seek for a registration as OCI cardholder from that date since at that juncture the parents would have a choice to either seek for citizenship by descent or to continue as a foreigner in the background of the subsisting policy of the sovereign state,” it added, in a 75-page judgment.

    The government had stressed that the OCI cardholder is a foreign national holding a passport from a foreign country and is not a citizen of India.

    The top court said: “It is held that the respondent No.1 (Centre) in furtherance of the policy of the sovereign state has the power to pass appropriate notifications as contemplated under Section 7B(1) of the Citizenship Act, 1955, to confer or alter the rights as provided for therein. However, when a conferred right is withdrawn, modified or altered, the process leading thereto should demonstrate application of mind, nexus to the object of such withdrawal or modification and any such decision should be free of arbitrariness.”

    It added that petitioners in all cases before it and all other similarly placed OCI cardholders will be entitled to the rights and privileges which had been conferred on them prior to the notification and could be availed by them. The top court’s judgment came on a batch of petitions by OCI candidates.

    A group of candidates led by Anushka Rengunthwar contended that the existing right of appearing for the entrance exams to compete with Indian citizens for the seat in NEET PG and Super Speciality courses was taken away.

    The candidates had emphasized that they were restricted for the admission only against the seats reserved for the NRIs or for supernumerary seats.

    Amaravati: Telugu Desam Party (TDP) national president N. Chandrababu Naidu has written to Prime Minister Narendra Modi to order an enquiry into the alleged tapping of phones of leaders of opposition parties, lawyers, journalists and activists by the YSRCP government in Andhra Pradesh.

    The former Andhra Pradesh chief minister appealed to the Prime Minister to order an enquiry by a competent body of the Central government to check phone tapping.

    He alleged that the YSR Congress Party (YSRCP) government was violating fundamental rights guaranteed under Articles 19 and 21 of the Constitution.

    “Ever since the YSRCP came to power, there has been a systematic and concerted attack on the democratic institutions in the state. Initially, the process of governance was completely derailed by attacking the investors and policies of previous regimes. This was followed by attacks on institutions like the State Election Commission and the Andhra Pradesh Public Service Commission (APPSC). Concomitantly, the ruling YSRCP has been attacking and threatening leaders of opposition parties, advocates, media persons, and social activists, among others, through various deceitful means. One such modus operandi that the ruling party has chosen is by illegally and unlawfully tapping the phones,” reads the letter.

    “It appears that the YSRCP-led government has been tapping phones illegally for its own political gains. Further, we are afraid it is being done through illegal software and unlawfully. This is all the more dangerous as in the long run it could pose a direct threat to national security. With such sophisticated technology in the hands of miscreants will not only violate the right to privacy of individuals, but also would lead to compromise of people in high places by bringing them under blackmail threats,” Naidu wrote.

    The TDP chief alleged that apparently the YSRCP has now even targeted the judiciary, the third pillar of democracy, as it is facing hurdles from the judiciary.

    “It appears that private persons are also illegally tapping phones using cutting edge technology and tools. We are afraid that if such illegal phone tapping goes unchecked, it would pose a serious threat to the integrity and security of the nation. Such illegal and unlawful practices by governments or private persons, if unrestrained, would lead to destruction of institutions that were built painstakingly over a period of time. In the long run, such nefarious activities would result in the breakdown of democratic values and freedom of speech, leading to jungle raj. In this backdrop, we appeal to you to initiate immediate and stern action in order to check any further unlawful activities (phone tapping) by the ruling party and private persons in Andhra Pradesh,” he added.

    Naidu had written to the Prime Minister on the backdrop of allegations by two MLAs of YSRCP that their phones were being tapped.

    Hyderabad: Openly defying his gag order, suspended Goshamahal BJP MLA T Raja Singh took a dig at the Telangana government and city police for issuing him a show cause notice over his provocative comments made at a rally in Mumbai last week. The Mangalhat police issued Raja Singh the notice after his speech since he is currently out on bail, and has restrictions placed on him by the Telangana high court.

    The suspended BJP MLA released a video after the police issued him a notice and asked why the Hyderabad or Telangana police is bothered when he made the comments at a meeting in Mumbai. He was arrested for a few months and was lodged in the Cherlapally jail under the Preventive Detention Act last year. Raja Singh had passed derogatory comments against Prophet Muhammad in a video, as a reaction to the state government allowing comedia Munawar Faruqui to hold a show in Hyderabad.

    “I demanded the central government and the state government (Maharashtra) bring in laws to stop love jihad, religious conversions and cow killings. The Telangana is ruled by Nizam government and VIII th Nizam and his slaves working in police are issuing notices,” said Raja Singh in the video.

    The MLA further said “I am not a political leader, I fight for ‘dharma’ and live for dharma.  When I am not afraid of going to jail, do you think I will get afraid of a notice?”. Raja Singh also challenged the ruling BRS government saying, “Now I will see if you would send to me to jail, or extern me from Telangana. I am ready for anything.”

    Singh asked to explain statements in notice

    The high court had quashed his detention under the PD Act and released him in November on bail after his arrest. The court however imposed certain conditions for his release, including that Raja Singh should not make any provocative speeches against any religion or post any derogatory or offensive posts on any social media platforms.

    “But on January 29 your speech during ‘Janakrosh Morcha’ at Dadar was circulating in social media. In the video your speech is very much provocative to a particular community regarding demands of laws on love jihad, cow slaughter, conversion and a few other words,” the notice issued to Raja Singh by the Mangalhat police stated.

    It further added, “Your speech with potential to provoke a particular religion is violation of conditions imposed by the HC.” The police has asked Raja Singh to explain why action should not be initiated against him for violating the conditions imposed by the High Court.

    Srinagar, Jan 31: Jammu and Kashmir administration led by Lieutenant Governor Manoj Sinha is likely to come up with a formal order in a week’s time ensuring protection for the poor and common masses during the ongoing anti-encroachment drive aimed at retrieving the land grabbed by the influential people in the past.

    Sources in the LG administration, told news agency—Kashmir News Observer (KNO), senior BJP leaders of J&K unit of the party, have made personal requests about protecting the poor and common masses during the ongoing anti-encroachment drive going on across J&K.

    “I met LG sahib in person and requested him to spare the people having grabbed or constructed homes on State land measuring 8 to 10 malras. I requested him to fix a nominal registration fee for them so that they are not rendered homeless,” BJP General Secretary and party’s Kashmir affairs incharge Sunil Sharma told news agency—Kashmir News Observer (KNO).

    He said that during his conversation with the LG it was decided that “influential won’t be spared and the land grabbed by them in the past will be retrieved at any cost.” “The LG told me that even though he has reiterated time and again that the poor won’t be touched and the influential won’t be spared, he would think on issuing a formal order in this regard,” he said.

    Sharma said that he was hopeful that the LG administration may issue a formal order in this regard within a week’s time. “The order may have a mention about the registration fee for the poor having possession of State land up to 10 malras,” he said.

    Another BJP leader, wishing not to be named, said that on behalf of the party, he too has urged the LG administration to spare the poor during the ongoing anti-encroachment drive. “Though it is up to the government to finalise whether they would keep 10 malras as the limit for having the State land for the poor lot who have constructed their homes or bring the number down to 5 malras or so. This is a matter of discussion and is being currently discussed by the Revenue officials and other officials of the LG led administration seriously,” the leader said, adding that “we expect a formal order shortly in this regard.”

    J&K BJP spokesman Altaf Thakur said several delegations of farmers and poor people from Srinagar and other parts of Kashmir came to BJP office in Srinagar with a request that they have constructed homes on just 5,8 and 10 malars of State land and if they would be evicted, where would they go.

    “We have requested the LG Sir not to touch the poor but go hard against the politicians especially all 34 former ministers whose names have surfaced in the list of land grabbers,” he said.

    Congress party’s J&K unit too had vociferously opposed the eviction drive of the LG led administration and sought a formal order mentioning protection for the poor and farmers. Congress leader and MP Rahul Gandhi also expressed his displeasure over the J&K administration’s anti-eviction drive. In his press conference at Srinagar during Bharat Jodo Yatra (BJY), Rahul said that “poor are being left homeless and farmer’s land is being snatched during the eviction drive of the J&K administration.” In the J&K’s anti-encroachment drive, action has been taken against former ministers and officers. “The list of land grabbers is so long that it will take years to retrieve the land. The drive is on as per the directions from the LG office,” an official said, wishing not to be named—(KNO)
