    Ramban, Apr 10: Jammu Kashmir Police Monday suspended two cops including an officer for allegedly demanding and accepting a bribe from a driver in Ramband district of Jammu and Kashmir.

    Two cops were suspended after a video went viral on social media showing policemen taking bribe from a driver.

    Police said that a video was doing rounds on various social media platforms wherein a traffic Police cop deployed at Ramban Bazar to Trishol Morh is allegedly seen indulging in unprofessional conduct by accepting money from a Driver at Naka Trishol Morh.

    Police as per the news agency Kashmir News Trust said that it is taken serious note of the incident and placed Selection Grade Constable
    Mohammed Latief and his Incharge ASI Bini Kumar under suspension with immediate effect.

    Police have also initiated a Departmental Enquiry against the accused cops. [KNT]

    SRINAGAR: The Jammu & Kashmir government has demoted a retired officer from the date he was placed as in-charge Deputy Superintendent of Police (DySP) after an inquiry established that there were building plan and master plan violations during his stint with the Lakes & Waterways Development Authority, which has been renamed as the Lake Conservation and Management Authority (LCMA).

    In an order, the J&K Home department has imposed a penalty of “reduction to a lower post” on Shah Sikander, the in-charge DySP (now retired).

    The Home department’s order states that Shah Sikander, the in-charge DySP, is demoted to the post of inspector with effect from 20.07.2012, the date he was placed as in-charge DySP.

    Sikander, the then enforcement officer of Lake and Waterways Development Authority (LAWDA), was arrested by the State Vigilance Organisation on March 14, 2017, in a case registered against him in 2015 for violations in peripheral areas of Dal Lake.

    According to the order, Sikander was served with a charge sheet on June 21, 2017, for not submitting a written statement of defence within a period of 21 days.

    He submitted his statement on September 25, 2017, and refuted all the charges.

    As per the order, the response submitted by the officer was found unsatisfactory, and accordingly, it was decided that the charges were required to be thoroughly investigated.

    On January 01, 2018, the government appointed an inquiry officer to probe the charges against him.

    In the report, the inquiry officer established that there was a violation of building permission norms and instances of illegal construction around the Dal Lake during his posting with LAWDA (now LCMA).

    “The competent authority decided to impose the penalty of ‘reduction in rank’ for violating J&K Government Employees (Conduct) Rules, 1971,” reads the order. (KNO)

    As the Chief Brand Officer, Ayaz will be responsible for developing and executing brand marketing campaigns for the Walt Disney Company. He will report directly to recently returned CEO Bob Iger and oversee the Disney100 campaign as the company celebrates its 100th year.

    Ayaz will also continue his duties as the President of Marketing for Walt Disney Studios. In this role, he will oversee all aspects of marketing and publicity for the Studios’ films and series as well as for Disney+ globally. Ayaz will report to Disney Entertainment co-chairman Alan Bergman.

    Srinagar: Central Bureau of Investigation conducted a search operation at the premises top official after it arrested Chief Horticulture Officer (CHO) for demanding and accepting huge sum of money as a bribe in Jammu and Kashmir.

    CBI said that it arrested a CHO while receiving a Rs 10 lakh bribe to resolve departmental issues, including a favourable posting and promotion of a junior colleague, officials said Saturday.

    The role of a senior officer in the Jammu and Kashmir government, is also under the scanner of the CBI, they said. The shocking demand of a bribe by a senior officer to be considered for posting and promotion prompted an official to approach the Central Bureau of Investigation with a complaint, they said.

    ”A case was registered on complaint against the accused and others on the allegations of demanding a bribe of Rs 10 lakh for the complainant’s posting and to resolve his departmental issues including promotion,” a CBI spokesperson said. After doing necessary verification and groundwork, the CBI laid an ambush and arrested the CHO Sarabjit Singh and middleman Gohar Ahmed Dar red-handed during an alleged bribe exchange, officials said.

    ”Searches were conducted at the premises of both the accused and the premises of the Special Secretary(Horticulture). During the searches, cash of Rs 3.5 lakh and other documents including movable/immovable property were recovered,” the spokesperson said.

    A case was registered on complaint against the accused & others on the allegations of demanding bribe of Rs.10 lakh for Complainant’s posting and to resolve his departmental issues including promotion.

    McCaughey’s restraint of D.C. Police Officer Daniel Hodges in a Capitol doorway is one of the most recognizable and horrifying images of the violence that day. McCaughey’s restraint of Hodges lasted more than two minutes while other rioters disarmed the officer, removed his gas mask and ignored his screams or help. Images of McCaughey face-to-face with Hodges became a symbol of the brutality of the Jan. 6 riot. It occurred in the Capitol’s lower west terrace tunnel, where many of the most violent confrontations that day took place.

    “The defendant’s actions on January 6 show an absolute disregard for the rule of law coupled with a willingness to incite and engage in violence,” Paschall wrote. “The nature and circumstances of this defendant’s crimes weigh heavily towards a significant term of incarceration.”

    U.S. District Court Judge Trevor McFadden convicted McCaughey of nine charges — including three counts of assaulting police and obstruction of Congress’ Jan. 6 proceedings — at a bench trial in September 2022. He has characterized McCaughey’s actions as particularly horrific, even compared to other rioters who participated in some of the same violent attacks. But McFadden has also repeatedly rejected prosecutors’ sentencing recommendations, often disagreeing with their calculations and proposed enhancements. Prosecutors indicated in their sentencing memo that they anticipate him disagreeing with them once again.

    Still, DOJ’s recommendation is the second-steepest it has made in any Jan. 6 case so far, trailing only the 17.5-year sentence it recommended for Thomas Webster, a former New York Police Department officer who brutally assaulted an officer on the front lines of the riot. Webster is currently serving a 10-year sentence, the longest of any handed down to a Jan. 6 defendant so far, issued by U.S. District Court Judge Amit Mehta. Mehta viewed Webster’s conduct as particularly egregious and also concluded that Webster lied on the stand when he testified about it.

    The recommendation for McCaughey surpasses the 15-year sentence the Justice Department recommended for Guy Reffitt, the first Jan. 6 rioter convicted by a jury. Reffitt, a militia member, planned for violence with associates ahead of Jan. 6, carried a firearm and engaged with police in a lengthy standoff that enabled the mob to start amassing at the base of the Capitol. Ultimately, the judge in his case, U.S. District Court Judge Dabney Friedrich, sentenced Reffitt to just over seven years in prison.

    Prosecutors say McCaughey, like Webster, was dishonest when he testified in his own trial last year. In addition to his lack of candor on the stand, prosecutors say McCaughey’s recommended sentence was influenced by the brutality of his attack against Hodges and a second officer, Henry Foulds — who McCaughey struck with a riot shield as the officer tried to close the doors to the tunnel.

    McCaughey, for his part, is arguing for a sentence of a year in prison, contending that his crimes on Jan. 6 were an “aberration” in an otherwise law-abiding life.

    “Although his conduct is indeed serious, it represents the only legal transgression this hard-working person has ever committed,” his attorney, Dennis Boyle wrote in a 25-page sentencing memo. “It is also significant to note that his actions were not motivated by any desire for personal financial gain or any other type of benefit. Rather, his actions, which he himself admits were reprehensible, were motivated by a misunderstanding as to the facts surrounding the 2020 election.”

    New Delhi: A Delhi court hearing a case of the 2020 northeast Delhi riots has deprecated the conduct of an investigating officer (IO), saying the police official was playing a game of hide and seek with the court and trying to mislead it.

    Additional Sessions Judge Pulastya Pramachala, while hearing arguments on charges in a case registered by Dayalpur police station against three accused, noted in addition to the first information report (FIR) the case pertained to four complaints.

    The judge said one of the complaints by Farooq Ahmad mentioned two separate alleged incidents on the intervening night of February 25 and 26, while the FIR was regarding a rioting incident around 9.50 am on February 25 in front of Victoria Public School on Main Wazirabad road.

    “Due to the clubbing of several incidents in one chargesheet, it had been a matter of deliberation by the court time and again, so as to have a clear-cut picture in order to decide within the parameters of law for what allegations the charges are to be decided,” the judge said in a recent order.

    The judge noted the IO’s earlier statement before the court, according to which the alleged incidents pertaining to Ahmad’s complaint would be separately investigated, and a separate report regarding the same would be filed.

    The judge said after the court directed him to file a status report in September last year, the IO did not submit the report, and when confronted again, the police official informed the court that no separate FIR was registered, and that “some investigation” was being conducted.

    “I fail to understand, under which particular law and following which particular procedure of law, such investigation is going on, without resorting to Section 154 of the code of criminal procedure (CrPC)…,” the judge said.

    Section 154 of the CrPC provides for registration of an FIR if the information discloses the commission of a cognizable offence.

    The judge further said, “Moreover, from the conduct of IO, it is well apparent that till date he had been trying to play a game of hide and seek from this court and to mislead the court in respect of proposed actions.”

    ASJ Pramachala said the complaint regarding the alleged rioting incident was still awaiting investigation by adopting the due process of law.

    “I do not wish to speculate any final reason behind such inaction over the aforesaid complaint, because it shall be a matter of internal inquiry and assessment of investigating agency ie, Delhi Police,” the judge said.

    “Hence, this matter requires serious attention from the higher officers, not only to take appropriate legal action on the pending complaint but also to make an assessment of the conduct of the IO so far,” the judge added.

    Seeking certain clarifications from the prosecution, including why the alleged incident which occurred prior in time was clubbed with this case, the court posted the matter for further proceedings on May 22.

    Directing a copy of the order be sent to the deputy commissioner of police (northeast) for “necessary action,” the court said a report was expected from the police officer regarding its observations.

    Mumbai: A former Army captain, a witness in the 2008 Malegaon blast case who had accused the Maharashtra Anti-Terrorism Squad (ATS) officials of threatening him to give a statement before a magistrate, on Wednesday turned hostile before a special NIA court here.

    He became the 34th prosecution witness to be declared hostile in the case in which Bharatiya Janata Party (BJP) MP from Bhopal, Pragya Singh Thakur, is one of the key accused.

    This witness had filed a complaint with the Maharashtra State Human Rights Commission alleging that the state ATS officials threatened him to give a statement before a magistrate.

    The witness had earlier given a statement to the National Investigation Agency (NIA) that when he first met Lieutenant Colonel Prasad Purohit in 2006, the latter who is one of the accused in the case, had asked the captain to work with him in the Abhinav Bharat organisation.

    Later that year, he was invited to a meeting at Purohit’s house in Pune. Purohit and an unidentified person had attended the meeting, where there was discussion on the work of the Rashtriya Swayamsevak Sangh (RSS) , the witness had told the NIA.

    The discussion in the meeting was that the RSS should do “aggressive and nationalistic work” as it was not doing so and Abhinav Bharat can do that, he had told the probe agency.

    The witness had also told the NIA that in 2008, he had attended a meeting on the participation of Abhinav Bharat in politics.

    He also took part in a training session arranged by Purohit at Pachmarhi in Madhya Pradesh in 2008. About 20 youths from Madhya Pradesh, Maharashtra and Karnataka attended the camp. Other accused Sameer Kulkarni and Sudhakar Chaturvedi were also present there, the witness had told the probe agency.

    He said the ATS (which probed the case earlier) at Nashik questioned him about his association with Purohit. They later took him to Mumbai and threatened him to give confession before the magistrate. After that, he had filed a complaint against the ATS officials at the Maharashtra State Human Rights Commission in 2009.

    However, during his deposition before the special NIA court judge A K Lahoti on Wednesday, the witness denied giving any statement. The court then declared him hostile.

    Six people were killed and more than 100 injured on September 29, 2008, when an explosive device strapped to a motorcycle went off near a mosque in Malegaon town in north Maharashtra, some 200 km from Mumbai.

    The ATS probed the case initially before the National Investigation Agency took over. A total of seven accused including Thakur and Colonel Prasad Purohit are facing trial in the case.
