    Delhi: Amazon and Flipkart Health plus are among the 20 online sellers that have been issued show-cause notices by the Drugs Controller General of India (DCGI) over the online sale of drugs in violation of norms.

    The show-cause notice dated February 8 by DCGI V G Somani cited a Delhi High Court order dated December 12, 2018, which prohibits online sales of medicines without a licence.

    The notice stated that the DCGI had forwarded the order to all state and Union Territories in May and November 2019 and again on February 3 for necessary action and compliance.

    “In spite of the same, you are found to be engaged in such activities without a licence,” the notice to the online medicine sellers said.

    “…You are hereby asked to show cause within 2 days from the date of issue of this notice, why action shall not be taken against you for sale, or stock, or exhibit or offer for sale or distribution of drugs in contravention of the provisions of the Drugs and Cosmetics Act 1940 and rules made thereunder,” the notice said.

    The notice states that the sale or stock or exhibit or offer for sale or distribution of any drug requires a licence from the concerned state licensing authority and conditions of a licence are required to be complied with by the licence holders.

    The DCGI has said that in case of no reply, it will be presumed that the company has nothing to say in the matter and necessary action will be initiated against them without any further notice.

    When contacted, Flipkart Health Plus said that it is a digital healthcare marketplace platform that enables easy and convenient access to genuine and affordable medicines and healthcare products, from independent sellers, for millions of customers across the country.

    “We have received the notice from CDSCO (Central Drugs Standard Control Organisation) and are responding to it appropriately. As an organisation, we remain committed to complying with the laws of the land and towards continuous improvements of our processes/checks and controls on our marketplace platform to build trust and enhance customer experience,” Flipkart Health plus said.

    Email queries seeking comments over the development sent to Amazon India and others did not elicit any reply.

    Traders body Confederation of All India Traders (CAIT) National President BC Bhartia and Secretary General Praveen Khandelwal in a joint statement demanded the government to strictly enforce the law and the judgment of the Delhi high court and ensure that no e-commerce company is selling medicine violating the Drug and Cosmetic Act.

    “Government must take strict action against the e-commerce, e-pharma intermediaries, marketplace platforms including Amazon and Flipkart who are selling the medicine without obtaining the requisite license-added the trade leaders,” the statement said.

    CAIT added that several online medicine sellers are foreign-controlled and therefore, are ineligible to seek these retail licences as this would be a violation of the extant Foreign Direct Investment policy in the multi-brand retail sector or inventory-based e-commerce.

    New Delhi: The Lok Sabha Secretariat has asked Congress MP Rahul Gandhi to respond by February 15 to notices given by BJP members regarding his remarks on Prime Minister Narendra Modi in the House.

    In a letter to Gandhi, dated February 10, the secretariat has asked him to furnish his reply on breach of privilege notices against him by BJP MPs Nishikant Dubey and Pralhad Joshi — also the parliamentary affairs minister — by February 15 for the Lok Sabha speaker’s consideration.

    Following Gandhi’s speech in Lok Sabha on the ‘Motion of Thanks on the President’s Address’ on Tuesday, in which he commented on the Hindenburg-Adani issue, Dubey and Joshi had moved the notices against him.

    Both the BJP leaders in their notices to Lok Sabha Speaker Om Birla have alleged that Gandhi’s comments were baseless and that he made “contemptuous, unparliamentary and dishonourable” allegations.

    Several remarks made by Gandhi were expunged by the speaker.

    New Delhi: Members of the Aam Aadmi Party, Shiv Sena Thackeray faction and Bharat Rashtra Samithi (BRS) on Wednesday staged a walkout from the Rajya Sabha after their adjournment notices were disallowed by the chair.

    Soon after laying of papers, Chairman Jagdeep Dhankhar said he has received four notices under Rule 267 from BRS member K Keshava Rao, AAP member Sanjay Singh and Shiv Sena members Sanjay Raut and Priyanka Chaturvedi and disallowed the same.

    Rao stood up and raised objection to the Rajya Sabha chairman’s remarks on Tuesday on their boycott of the House.

    Sanjay Singh also rose to seek a discussion on the Adani issue but was not allowed by the chair as their notices were disallowed.

    Soon, the BRS, Sena and AAP members staged a walkout from the House.

    The House started the discussion on the motion of thanks to the president’s address as there was no Zero Hour and Question Hour. The discussion on the motion of thanks would continue without lunch break.

    “I have received four notices under Rule 267 from Sanjay Raut, K Keshava Rao, Sanjay Singh, Priyanka Chaturvedi. I reiterate my stand. I have carefully gone through them. I do not find the notices in order. I am constrained not to allow them,” the chairman said.

    On BRS member Rao’s anguish over the chairman’s remarks made on Tuesday, he said, “The kind of aggressive body language you are reflecting is most unfortunate. You have perhaps not had the occasion to go through what I had said yesterday with full sense of sublimity, sobriety and seriousness.”

    Asking him to take his seat, he said, “This is not the way we conduct this House. What I said is on record, you can take recourse to rules. This is not the way to do it. I have conveyed my sentiments and these are the sentiments of millions of people.”

    Dhankhar said for the first time in this country, a history of the “wrong type” has been created by engaging in a proclaimed boycott of the President.

    “I would urge the members, we are sending a very dangerous signal to people. Their anger is beyond tolerance. Every time in the morning they see this spectacle of the House being plunged into disorder as part of strategy,” the chairman said.

    AAP, BRS members created uproar by raising slogans of “PM sadan mein aao. jawaab do. JPC se jaanch karao (PM should come to the House and answer and JPC probe should be ordered)” and later staged a walkout.

    They later held a demonstration in front of the Gandhi statue in Parliament premises.

    Srinagar, Feb 06: Stating that the ongoing demolition drive going on across J&K has triggered a wave of frustration and chaos among people, National Conference vice-president Omar Abdullah Monday advocated that the government should make the bulldozer its last resort, give people a chance to prove their claim and issue proper notices to the people having illegal possession of State land. He was quick to add that the National Conference was not against those who have grabbed State land but “a proper procedure should be followed.”

    “In J&K, there is chaos everywhere. Bulldozers are being sent everywhere to demolish houses, complexes and buildings. But nobody knows what is the procedure and on what basis this demolition drive is being conducted,” said Omar while addressing a press conference in Srinagar, as per news agency—Kashmir News Observer (KNO). He said his sister approached the High Court with regard to the proposed demolition of the Gupkar house of Omar and was told by the government before the Court that the list making rounds in the media are “forged.” “Given the government response in the court, I urge the government to make the genuine list of people who have grabbed State land public,” he said.

    Omar suggested a slew of measures to the government with regard to the demolition drive. “No government is supposed to bring trouble for the people. Bulldozers should be the last resort. The Government must issue proper notices to those who, according to it, have grabbed State land and given them at least six weeks’ time to prove their claim on land under them and show the documents,” he said. “In our case, my sister produced the documents before the HC that states that the lease of Gupkar house is still active and has some years to expire. Likewise, people should be given time to present the documents and let the revenue team verify the same. If after proper verification land under anybody is found under illegitimate possession, then a bulldozer can be used for sure.”

    Omar said that the government should also make a public “genuine list of people who have occupied State land.” “It seems that the ongoing drive is aimed at creating a wedge between communities. This drive lacks proper procedure,” he said.

    He said in the case of demolition of NC leader Ali Muhammad Sagar, he found that no notice was served. “There is a procedure that if the person doesn’t receive the notice, the same is fixed on the front portion of the gate. Nowhere this is being done,” he said, adding, “Officials accompanying bulldozer at Nedous, told my relatives that they had pressure from the top and have to do something to show their bosses.”

    Omar said in many areas the ongoing demolition-cum-eviction drive is becoming a “hub of corruption.” “I got many calls from several areas with people saying that they are being told to pay Rs 1 or 1.5 lakh to get their names removed from the list,” he said.

    He said that NC MPs will try to raise the issue in the Parliament if they are given time to speak.

    To a query that whey NC would approach the court on the issue, Omar said that he has suggested some measures to the government and that if the J&K administration fails to give positive response, they would surely consult lawyers and discuss the future course—(KNO)

    Hyderabad: Suspended Goshamahal BJP MLA T Raja Singh denied making any provocative speeches and asked the Hyderabad police which issued him a show cause notice to drop the same.

    The Mangalhat police had issued a notice to Raja Singh for a provocative speech he made at a rally in Mumbai on Sunday. The police cited the conditions of the Telangana High Court while granting him bail in connection with a case booked for making derogatory comments against Prophet Muhammad last year. The court, while giving him bail, said that the MLA should not make provocative speeches or post on social media.

    In his reply to the notice served on him by the Mangalhat police, Raja SIngh said these actions are expected in the light of fact that elections are approaching and to create fear in the mind of political opponents. This, he said, is evident from the series of actions since the “malicious invoking of Preventive Detention Act” was made against him. “I reasonably believe, it is an act of political vendetta and your esteemed machinery is put into action under force,” he stated.

    He further stated that the contents of the notice express that the Hyderabad police took “suo –motu cognizance” of his speech at Mumbai. He said it was beyond the jurisdiction, and that it was taken without any complaint from anybody to the said effect.

    Singh denies all wrongdoing

    “I categorically deny having made any provocative statements or speech, deny having violated the Honourable High Court orders and well deny all adverses allegations levied against me under the show cause notice under reply. The notice is an act of creating unwarranted pressure on me and an attempt to meddle with my fundamental right of freedom of speech and expression and my right to public meetings and gatherings and my duty as a public representative. The rally was held under due permission and no complaint as such till the day the notice under reply is issued is known to have been lodged anywhere in context to alleged speech you refer to in your notice,” Raja Singh added.

    Singh asked to explain statements in notice

    The high court had quashed his detention under the PD Act and released him in November on bail after his arrest. The court however imposed certain conditions for his release, including that Raja Singh should not make any provocative speeches against any religion or post any derogatory or offensive posts on any social media platforms.

    “But on January 29 your speech during ‘Janakrosh Morcha’ at Dadar was circulating in social media. In the video your speech is very much provocative to a particular community regarding demands of laws on love jihad, cow slaughter, conversion and a few other words,” the notice issued to Raja Singh by the Mangalhat police stated.

    It further added, “Your speech with potential to provoke a particular religion is violation of conditions imposed by the HC.” The police has asked Raja Singh to explain why action should not be initiated against him for violating the conditions imposed by the High Court.
