    After being disqualified from the Lok Sabha, the Lok Sabha Housing Committee has reportedly sent a notice to Congress leader Rahul Gandhi to vacate the government-allotted bungalow on Tughlaq Lane.

    Gandhi was disqualified from the Lok Sabha on Friday, a day after a court in Gujarat’s Surat convicted him in a 2019 defamation case. Addressing a press conference in Delhi over his disqualification, Rahul Gandhi on Saturday said, “My name is not Savarkar, my name is Gandhi and Gandhi does not offer an apology to anyone”.

    New Delhi: The Supreme Court on Monday issued notice on a petition filed by 2002 Gujarat riots victim Bilkis Bano against the premature release of 11 persons convicted of her gang-rape and murder of her family members, calling the offence “horrendous”.

    A bench of Justices K.M. Joseph and B.V. Nagarathna observed that before hearing the plea, the court would like to know what is the gamut of issues, which would aid in knowing the framework within which the issues have to be considered.

    Advocate Shobha Gupta, representing Bilkis Bano, submitted that the state (Maharashtra), where the trial was held should decide on the remission of the convicts, and not the state where offence was committed.

    During the hearing in the matter, the bench orally observed that the offence was “horrendous”.

    Advocate Vrinda Grover, representing one of the petitioners, contended that the trial judge said no remission should be granted and also the CBI said that remission should not be given, yet they were released.

    As the judges queried how many years each accused had spent in jail, counsel, representing one of the convicts, said over 15 years and 14 years is the requirement for consideration under Gujarat government remission policy. However, it was contested by a counsel, representing one of the petitioners.

    Grover also informed the court, while on parole, another case of molestation of a woman was filed against one of the convicts and this was completely ignored while granting remission.

    A contention was made during the hearing in the matter that all the petitions against the release of 11 convicts were “emotional pleas”. However, the bench said it is only on the law and has nothing to do with emotions. Noting that the crime against Bilkis Bano and her family was horrendous one, the bench made it clear that the matter will be decided on the basis of law.

    After hearing detailed submissions, the top court scheduled the matter for further hearing on April 18.

    Justice Joseph observed that the court has many murder cases before it, where convicts are languishing in jails for remission without years and queried if is this a case where standards have been applied uniformly as in other cases?

    The bench directed the parties involved in the matter to complete the pleadings by the next date of hearing and also asked the state government to be ready with the relevant files connected with granting remission to the convicts on the next date of hearing.

    In the plea, Bilkis Bano said: “The premature release of all the convicts came as a shock not only to the petitioner, to her grown up daughters, to her family, but also to the society at large, nationally and internationally, and the society across segments had shown their anger, disappointment, distrust and protest to the clemency shown by the Government by releasing criminals like the 11 convicts of the case.”

    Terming the release order mechanical, the plea contended that the premature release of the convicts in much talked about case of Bilkis Bano, has shaken the conscience of the society and resulted in several agitations across the country.

    All 11 convicts were granted remission by the Gujarat government and released on August 15 last year.

    A batch of the petitions have been filed against the release of 11 convicts, including the one filed by Bilkis Bano. The other petitions were filed by CPI-M leader Subhashini Ali, Trinamool Congress MP Mahua Moitra, National Federation of Indian Women, Meeran Chadha Borwankar and others, Asma Shafique Shaikh and others. The top court has issued notice on all the pleas filed in the matter.

    New Delhi: Congress MP Manish Tewari on Monday moved an adjournment notice in the Lok Sabha against Rahul Gandhi’s disqualification.

    The notice states, “That this House do suspend Zero Hour and other businesses of the day to discuss the disqualification of Shri Rahul Gandhi.

    “The disqualification of Shri Rahul Gandhi from the membership of the House was a hasty and erroneous decision and not in consonance with the provisions of the Constitution of India.

    “Article 102 (1) (e) of the Constitution provides that a person shall be disqualified for being chosen as, and for being, a member of either House of Parliament if he is so disqualified by or under any law made by Parliament.”

    The notice says, “Article 103(1) provides that the decision as to the disqualification of members lies with the President of India. Further, Article 103(2) lays down that a decision on disqualification by the President must be preceded by mandatory consultation with the Election Commission of India.”

    The notice further states, “Section 8(3) of the Representation of People’s Act, 1951 which triggered the disqualification mandates conviction and sentencing as two conjunctive prerequisites for disqualification which were not fulfilled since Shri Rahul Gandhi’s sentence has been suspended for 30 days.”

    Tewari said the action is in violation of the basic principles of natural justice, contrary to the provisions of the Constitution, and beyond the legal competence of the Secretariat of Parliament.

    “Under these circumstances, the House must adjourn to discuss this matter concerning the disqualification of Rahul Gandhi,” the notice said.

    New Delhi: The Delhi Commission for Women (DCW) has issued a notice to National Medical Commission (NMC) seeking action against illegal trainings on conversion therapy for the LGBTQIA+ community being advertised under the banner of ‘World Congress of Psychologists’

    According to the DCW, it has taken suo moto cognizance of an advertisement circulating on social media claiming that an organisation called the ‘World Congress of Psychologists’ with its head office in Tirupati, Andhra Pradesh, is conducting a three-month training program on psychosomatic disorders which started on March 10.

    “The organisation appears to have offered training on tackling 47 different disorders, and has included homosexuality, lesbianism and transvestism in the advertisement,” said DCW in a statement issued on Saturday.

    DCW chief Swati Maliwal issued the notice to the NMC Chairman and has sought a copy of the enquiry report in the matter.

    The DCW has asked whether the program is being conducted or was conducted in the past and if so, details of action taken against the organisation, its office bearers and trainers as well as whether their licenses have been revoked.

    It has also asked for a copy of the guidelines/advisories issued by NMC banning conversion therapy of LGBTQIA+ persons.

    “It is an established fact that homosexuality, lesbianism and transvestism are not ‘psychosomatic disorders’. Over 50 years ago, the American Psychiatric Association (APA) issued a resolution stating that homosexuality is not a mental illness or sickness. Conversion therapies are a set of pseudo-scientific practices, targeting the LGBTIQA+ people into changing their sexual orientation, gender identity and gender expression.”

    “In a judgment passed by the Madras High Court in 2021, directed th e National Medical Commission, Indian Psychiatric Society and The Rehabilitation Council of India to take action against the concerned professional involving themselves in any form or method of conversion “therapy” including withdrawal of license to practice,” said a DCW official.

    “Pursuant to this order, the NMC declared conversion therapy as illegal and considers it in the category of ‘Professional Misconduct’ and has banned the pr actice under the Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002.”

    The official said that despite these judgements, it is unfortunate that conversion therapy is still prevalent and such programmes as mentioned seem to be organised and advertised.

    Maliwal said that it is unfortunate that even in this age, there appear to be organisations in the country who seem to claim that homosexuality, lesbianism and transvestism are apsychosomatic disorders’ and need to be “cured” through conversion therapy.

    “This is illegal and perpetuates myths, biases and discrimination in society against the LGBTQIA+ community. Every individual has a right to express their self identified gender and choose their sexual orientation. The Supreme Court has guaranteed these rights. Stringent action should be taken against organisations who indulge in such criminal acts,” she said.

    Chandigarh: Papalpreet Singh, the brain behind radical preacher and pro-Khalistan supporter Amritpal Singh, has been served a notice by the Income Tax department to explain the source of Rs 4.48 lakh credited into his account, officials said here on Friday.

    Papalpreet, who has been on the run along with Amritpal since the Punjab Police launched a crackdown on March 18, faced the I-T department action under section 147 of the Income Tax Act, under which an assessing officer has discretionary powers to reopen the proceedings when there are reasons to believe that some of the income has escaped assessment.

    The Income Tax notice was recovered from the house of Baljeet Kaur at Shahabad in Kurukshetra in Haryana where Papalpreet and Amritpal had taken shelter on March 19 and 20 before fleeing from there after changing their looks and leaving behind the sacred “Siri Sahib”, the officials said, adding a devout Sikh would not leave behind his kirpan.

    Papalpreet and Amritpal had told the woman that “someone would be collecting the bag” left behind by them, but the plan failed as the Haryana Police raided the house and recovered it.

    The Income Tax notice, issued on March 14 this year, had asked Papalpreet to submit his reply by March 20. He has not filed his response as he has been guiding the radical preacher since March 18, the officials said.

    The I-T department informed Papalpreet that his assessment had been flagged as “High Risk-CRIU (Case Related Information Upload” and asked him to explain the unaccounted income of Rs 4.48 lakh.

    An internal note of the I-T department stated that Papalpreet is a journalist based out of Amritsar who runs the website “Punjab Shield”, which is essentially a Khalistani propaganda site.

    Rejecting his reply of February 14 where Papalpreet had stated that he earned approximately Rs 8,000 to Rs 20,000 per month from Youtube and Rs 15,000 from dairy business,” the Income Tax department asked him to submit credit transactions along with documents supporting his claim.

    The Income Tax department made it clear that Papalpreet had not submitted his returns for the financial year of 2019-20 during which he had a credit entry of Rs 4,48,868 in his bank account and that needed to be explained.

    Papalpreet, who is alleged to be in close contact with Pakistan’s ISI and was taking instructions from it, has been one of Amritpal Singh’s mentors who had been advising him on various issues.

    The first images of Papalpreet were seen him driving a motorcycle with Amritpal riding pillion. The two-wheeler was found deserted at Phillaur in Jalandhar.

    The officials said Papalpreet Singh was taking instructions from the ISI to raise the bogey of Khalistan in Punjab and was working to plunge the state into the dark days of terrorism.

    They said it was on Papalpreet’s instructions that Amritpal changed his appearance from a radical Sikh preacher to an ordinary person and finally abandoned the motorcycle at a canal in Phillaur.

    Papalpreet faces four criminal cases, include one under the stringent Unlawful Activities (Prevention) Act and for the Ajnala police station incident.

    New Delhi: The Delhi Commission for Women (DCW) has issued a notice to the Municipal Corporation of Delhi (MCD) and Deputy Commissioner of Police (East) in connection with the gangrape of a 10-year-old girl by an MCD-run school peon and his associates in east Delhi.

    The DCW has sought the detailed action taken by MCD and Delhi Police.

    On Thursday, in a statement the MCD said that the incident of sexual assault with a class 5 student of Shahadara zone took place on March 14.

    “The student was absent on the next day of the annual examination. The class teacher contacted her mother who informed about the sexual assault with her by the school attendant. The school principal tried to convince the girl’s parents to come to the school to file a complaint against the accused, but they were reluctant,” the MCD added.

    “A committee of two school inspectors, including a female inspector, inquired into the matter and submitted its report. On the basis of Committee findings, Ajay Kumar, the school attendant, has been placed under suspension with immediate effect,” it said.

    The 54-year-old peon, identified as Ajay, a native of Jaunpur in Uttar Pradesh, has been arrested, the police said, adding the police are trying to nab the remaining accused.

    Ajay has been working in the MCD-run school as a peon for the last 10 years.

    According to police, on Wednesday, the principal of a school, along with fellow teachers, reported a sexual assault on one of her students.

    The incident allegedly took place on March 14.

    “As per the complaint, the accused took her from the school to an unknown place, sedated her with some substances and raped her along with his associates. The victim was sent to LBS hospital where her medical examination and counselling was done,” Deputy Commissioner of Police (DCP), Amrutha Guguloth said.

    A case under sections 363 (kidnapping), 328 (administering stupefying drug with intent to cause hurt, etc), 376D (gang rape), 506 (criminal
    intimidation) and Section 6 of Posco Act was registered in Ghazipur police station, and Ajay was arrested,” the DCP added.
